Datganiadau gan y Llywydd

Statements by the Presiding Officer

Dafydd Elis-Thomas Llywydd heb ei enwi yn y Cofnod siaradwyd yn Gymraeg t. 2

Dafydd Elis-Thomas The Presiding Officer not named in the Record spoken in Welsh p. 2

Gofynnwyd i mi a oedd yn fwriad gennyf roi blaenoriaeth i rai aelodau wrth ofyn cwestiynau yn llafar. Yn achos cwestiynau sydd wedi eu cyflwyno, yr wyf yn bwriadu glynu’n dynn wrth y gweithdrefnau a nodir ym mharagraff 6.29 o Reol Sefydlog Rhif 6. Hynny yw, penderfynir ar drefn y cwestiynau drwy dynnu tocyn neu, yn achos ein trefniadau ni, drwy gymysgiad electronig. Mae hynny yn gosod y cwestiynau i’w hateb ar y diwrnod cyntaf y caniateir hynny. Wedyn, bydd cwestiynau sydd wedi eu cyflwyno ymlaen llaw yn cael eu hateb yn y drefn y cyflwynwyd hwy. Yn achos y cwestiynau atodol—ac yr wyf yn credu mai hwn oedd y pwynt dan sylw—gyda chytundeb y pleidiau gwleidyddol, ac yn ôl ysbryd cyfansoddiad y Cynulliad hwn, yr wyf yn dymuno bod pob aelod yn cael cyfle cyfartal i gael eu galw. Byddai o gymorth pe byddai Aelodau sydd yn dymuno gofyn cwestiynau atodol i gwestiynau sydd wedi eu cyflwyno eisoes yn rhoi rhybudd blaenorol i’m Swyddfa Breifat. Bydd hynny yn ei gwneud hi’n haws i’r Aelodau ddal fy sylw, ond nid yw hynny yn golygu o angenrheidrwydd y byddant yn cael eu galw. Er mwyn gwneud yn siŵr bod y nifer mwyaf posibl o Aelodau yn cael eu galw, byddwn yn falch pe byddai aelodau’n sicrhau bod y cwestiynau a’r atebion yn gryno.

I have been asked whether it was my intention to give preference to some Members in asking oral questions. In respect of questions which have been tabled, I intend to adhere strictly to the procedures set down in paragraph 6.29 of Standing Order No. 6. That is, the order of questions is to be decided by ballot or, in the case of our procedures, by an electronic mix. That sets the questions to be answered on the first permitted day. From then on, the questions that have been tabled beforehand will be answered in the order in which they have been tabled. In the case of supplementary questions—and this I believe was the point in question—with the agreement of the political parties, and in the spirit of the constitution of this Assembly, I want each Member to have an equal opportunity to be called. It would very helpful if Members who wish to ask supplementary questions to questions already tabled gave prior notice to my Private Office. That would make it easier for Members to catch my attention, though it does not necessarily mean that they will be called. In order to ensure that the greatest number of Members possible are called, I would be grateful if Members ensured that their questions and replies were concise.

Yn olaf, gyda chytundeb y pleidiau gwleidyddol, byddaf heddiw yn darparu ar gyfer Aelodau gyfarwyddyd drafft ynglŷn â chwestiynau yn y Cynulliad. Bydd y Pwyllgor Busnes yn adolygu’r cyfarwyddyd drafft ymhen tua chwe wythnos, yn ôl ein profiad, ac yn gwneud cynigion ar gyfer dogfen derfynol cyn gwyliau’r haf.

Lastly, with the agreement of the political parties, I will provide today the draft guidance for Members regarding questions in the Assembly. The Business Committee will review that guidance in about six weeks, according to our experiences, and will make proposals for a final document before the summer recess.

Mae fy ail ddatganiad yn ymwneud â chyfeirio materion at y Pwyllgor Busnes yn dilyn gweithgareddau ddoe. Yr wyf yn cyfeirio’n benodol at Reol Sefydlog Rhif 6, paragraff 6.16 a Rheol Sefydlog Rhif 13, paragraff 31.1. Cawsom ddau gynnig ddoe yn gofyn am gyfeirio materion at y Pwyllgor Busnes. Dim ond un ohonynt oedd yn gynnig trefniadol. Mae gennyf ddau bwynt i’w gwneud ar hyn.

My second statement deals with referring matters to the Business Committee following yesterday’s activities. I refer specifically to Standing Order No. 6, paragraph 6.16 and Standing Order No. 13, paragraph 31.1. We had two motions yesterday asking to refer matters to the Business Committee. Only one was a procedural motion. I have two points to make on this.

Yn gyntaf, dylai unrhyw gynnig i gyfeirio mater at Bwyllgor wrth drafod cynnig gael ei wneud fel cynnig trefniadol ffurfiol. Yn ail, mae cylch gorchwyl y Pwyllgor Busnes yn bendant a chyfyngedig. Pwrpas y Pwyllgor yw cynghori’r Trefnydd ar reoli busnes y Cynulliad, a chynghori’r Dirprwy Lywydd ar y modd y dylai hithau gyflawni ei swyddogaethau o ran penderfynu pa drywydd sydd fwyaf addas wrth ystyried is-ddeddfwriaeth. Bydd hefyd, yn achlysurol, yn cynghori’r Llywydd ar faterion gweithdrefnau cyffredinol. Mae’r Pwyllgor hefyd yn gallu gwneud argymhellion i’r Cynulliad ynghylch arferion a threfn gyffredinol wrth gyflawni ei fusnes. Nid corlan yw’r Pwyllgor ar gyfer cadw’r materion hynny y mae’r Cynulliad yn ei chael yn anodd penderfynu arnynt. Drwy drafodaeth agored y mae datrys materion o’r fath. Oherwydd natur ei gylch gorchwyl, mae’r Pwyllgor yn cwrdd yn breifat ac, o ganlyniad, mae gofyn i’r Aelodau fod yn ofalus wrth ddewis materion i’w cyfeirio ato. Un o’m dyletswyddau yw amddiffyn yr egwyddor o fod yn agored, ac yr wyf yn benderfynol o wneud hynny. Byddaf, felly, yn y dyfodol yn galw i drefn unrhyw Aelod a fydd yn cynnig cyfeirio mater at y Pwyllgor Busnes, os barnaf nad yw’r mater hwnnw yn fater cymwys i’r Pwyllgor ei drafod ac os na fyddaf wedi cael fy rhaghysbysu drwy y swyddfa yn y ffordd arferol.

First, any motion to refer a matter to Committee when discussing a motion should be made as a formal procedural motion. Secondly, the remit of the Business Committee is precise and limited. The purpose of the Committee is to advise the Business Manager on the management of Assembly business, and to advise the Deputy Presiding Officer on how she should undertake her functions when deciding the most suitable route for considering subordinate legislation. The Committee will also advise the Presiding Officer occasionally on general procedural matters. The Committee can also make recommendations to the Assembly on usage and general procedure when undertaking its business. The Committee should not be a means of shelving matters which the Assembly finds difficult to decide upon. It is through open discussion that such matters are resolved. Due to the nature of its remit, the Committee meets privately and, as a result, Members need to be careful when selecting matters for referral. One of my duties is to defend the principle of openness, and I am determined to do so. Therefore, in future, I will call to order any Member who makes a proposal to refer a matter to the Business Committee, if I decide that the matter is not appropriate for discussion by the Committee and if I have not been given prior notice in the usual manner through the office.

Mae gennyf un datganiad arall, ar gynigion trefniadol. Mae Rheol Sefydlog Rhif 6 yn berthnasol, a pharagraff 6.16. Mae rhai Aelodau eisoes wedi ymgynefino â’r Rheolau Sefydlog. Mae gan sefydliadau eraill, nad oes rhaid inni gyfeirio atynt wrth eu henwau, arferion y byddwn o bosibl am eu hefelychu. Nid wyf, serch hynny, yn argymell defnyddio’r Rheolau at ddibenion tactegau gwleidyddol ar draul eu defnyddio er mwyn sicrhau bod y Cynulliad yn gwneud ei waith yn drefnus. Os bydd Aelod am godi cynnig trefniadol yn ystod trafodaeth, dylai roi rhaghysbysiad o’i fwriad i’m Swyddfa Breifat neu i Ysgrifenyddiaeth y Siambr. Wrth wneud hynny, dylai’r Aelod nodi union eiriad y cynnig er mwyn hwylustod i ni ac i’r Cofnod. Heb wneud hynny, gallai fod yn anodd i’r Aelod hwnnw ddal fy sylw neu i mi ddod i benderfyniad yn ystod trafodaeth a ddylwn ganiatáu’r cynnig trefniadol hwnnw. Yn eithriadol yn unig y dylid cynnig cynigion trefniadol, ac eithriad a fydd i mi gytuno arnynt. Yn ogystal, yn y dyfodol, byddaf yn cadw’n gaeth at y Rheolau Sefydlog ynghylch nifer y bobl fydd yn cael siarad o blaid neu yn erbyn cynnig trefniadol.

I have one other statement, on procedural motions. Standing Order No. 6 and paragraph 6.16 are relevant. Some Members have already acquainted themselves with these Standing Orders. Other organisations, which we do not need to refer to by name, have practices that we might wish to emulate. I do not, however, recommend using Standing Orders for tactical politicial purposes at the expense of using them to ensure that the Assembly does its work in an orderly fashion. If Members want to raise a procedural motion during a discussion, they should give prior notice of that intention to my Private Office or to the Chamber Secretariat. When doing so, the Member should also note the exact wording of that motion for our convenience and for the Record. If that is not done, it could be difficult for that Member to catch my eye or for me to come to a decision during a discussion as to whether I should allow that procedural motion. Only in exceptional cases should procedural motions be proposed and it will be an exception for me to allow discussion upon them. In addition, in future, I will adhere strictly to the Standing Orders as regards the number of people who may speak for or against any procedural motion.

Nid wyf yn cyfeirio at neb yn arbennig yn ystod y datganiadau hyn, ond ys dywed yr hen ddywediad: gair i gall.

I am not referring to anyone specifically in these statements, but as the saying has it: a word to the wise.

We now move on to the Questions to the First Secretary.

Symudwn yn awr at y Cwestiynau i’r Prif Ysgrifennydd.

Brian Gibbons spoken in English p. 5

Brian Gibbons siaradwyd yn Saesneg t. 5

Point of order. Could you clarify for me the competence of the First Secretary to respond to these questions in view of the fact that we did not delegate any authority to him at yesterday’s meeting?

Mater o drefn. A ellwch chi egluro i mi pa awdurdod sydd gan y Prif Ysgrifennydd i ymateb i’r cwestiynau hyn yn wyneb y ffaith na ddirprwywyd unrhyw awdurdod iddo yn y cyfarfod ddoe?

Dafydd Elis-Thomas The Presiding Officer spoken in English p. 5

Dafydd Elis-Thomas Y Llywydd siaradwyd yn Saesneg t. 5

That is not a point of order. The First Secretary is, as I have known for many years, a competent person and the issue of delegation is not relevant to the First Secretary’s responsibility to answer questions. The First Secretary has been elected to that position by the Assembly, and therefore Members are able to table questions to him about matters relating to any of their responsibilities. It is in that capacity that the First Secretary answers questions today.

Nid mater o drefn yw hyn. Mae’r Prif Ysgrifennydd, fel y gwn ers blynyddoedd, yn berson cymwys ac nid yw’r cwestiwn ynglŷn â dirprwyo yn berthnasol o ran cyfrifoldeb y Prif Ysgrifennydd i ateb cwestiynau. Etholwyd y Prif Ysgrifennydd i’r swydd honno gan y Cynulliad, ac felly gall yr Aelodau gyflwyno cwestiynau iddo am faterion sy’n ymwneud â’u cyfrifoldebau. Yn rhinwedd y swydd honno y mae’r Prif Ysgrifennydd yn ateb cwestiynau heddiw.

Nick Bourne spoken in English p. 5

Nick Bourne siaradwyd yn Saesneg t. 5

Point of order. I am concerned that the composition of the Subject Committees will not reflect the membership of the Assembly. This is important in view of your comments about openness. There are rumours that the Conservatives are grossly underrepresented as opposed to the other three parties.

Mater o drefn. Yr wyf yn pryderu na fydd cyfansoddiad y Pwyllgorau Pwnc yn adlewyrchu aelodaeth y Cynulliad. Mae hynny’n bwysig yng ngoleuni eich sylwadau am fod yn agored. Y si sydd ar led yw nad yw’r Ceidwadwyr wedi eu cynrychioli’n deg o gwbl o’u cymharu â’r tair plaid arall.

Dafydd Elis-Thomas The Presiding Officer spoken in English p. 5

Dafydd Elis-Thomas Y Llywydd siaradwyd yn Saesneg t. 5

I am afraid that that is not a point of order, though I have allowed you to continue to make the point in the spirit of tolerance that grips me this week. It is a matter for the Business Committee. However, if you wish, either in the Business Committee or at a later stage, you can propose motions to raise this issue through the facilities available to you as a group.

Yr wyf yn ofni nad pwynt o drefn yw hwn, er i mi ganiatáu i chi barhau â’ch pwynt yn yr ysbryd goddefgar sy’n gafael ynof yr wythnos hon. Mater i’r Pwyllgor Busnes ydyw. Fodd bynnag, os dymunwch, un ai yn y Pwyllgor Busnes neu yn ddiweddarach, gellwch osod cynigion gerbron i godi’r mater hwn drwy’r drefn sy’n agored i chi fel grŵp.

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Gymraeg ac yn Saesneg t. 5

Presiding Officer, without taking time from the answering of questions, now that we are all here for the first time, I would like to thank you.

yn Saesneg Mr Llywydd, heb gwtogi ar yr amser ar gyfer ateb cwestiynau, gan ein bod ni i gyd yma am y tro cyntaf, hoffwn ddiolch i chi.

Diolchaf i’r Llywydd am y cymorth y mae ef wedi ei roi i ni heddiw drwy egluro llawer iawn o’r gweithdrefnau.

in Welsh I thank the Presiding Officer for the assistance he has given to us today by explaining many procedural matters.

In answering questions today, I also am going through a period of initiation. I hope that we can make question sessions interesting and constructive, and I will try to give clear answers that will help to take discussion forward. Polarised exchanges are often unhelpful and lead to serious issues being oversimplified, as is the case with some of the issues that have already been raised. We are in a new situation, and our conduct will determine the success of the Assembly.

yn Saesneg Wrth ateb cwestiynau heddiw, yr wyf finnau’n mynd drwy gyfnod o ymgyfarwyddo. Gobeithiaf y gallwn wneud y sesiynau cwestiynau yn ddiddorol ac adeiladol, a byddaf yn ceisio rhoi atebion clir a fydd yn help i symud y drafodaeth ymlaen. Ni ddaw dim budd yn aml wrth ddadlau o ddau begwn eithaf a gall olygu bod materion difrifol yn cael eu gorsymleiddio, fel sy’n digwydd gyda rhai o’r materion a godwyd eisoes. Yr ydym mewn sefyllfa newydd, a’n hymddygiad ni fydd yn pennu llwyddiant y Cynulliad.

Gobeithiaf y bydd hynny o gymorth i greu’r awyrgylch iawn wrth ateb cwestiynau.

in Welsh I hope that that will help create the right atmosphere when answering questions.

I ateb cwestiwn Cynog Dafis, adolygir gwelliannau yn strwythur tâl a rhagolygon cyflogau athrawon ar hyn o bryd gan y cynigion a geir yn y Papur Gwyrdd, ‘Y Gorau ar gyfer Addysgu a Dysgu’ a’r ddogfen dechnegol ar dâl a rheoli perfformiad. Cafwyd ymgynghori helaeth gyda phob sefydliad perthnasol a dadansoddir yr atebion ar hyn o bryd.

in Welsh To answer Cynog Dafis’ question about improvements in the pay structure for teachers and teachers’ pay, forecasts are being reviewed at present through the proposals in the Green Paper, ‘The BEST for Teaching and Learning’ and the technical document on salaries and performance management. Extensive consultation was carried out with every relevant party, and the replies are being analysed at present.

Cynog Dafis siaradwyd yn Gymraeg t. 6

Cynog Dafis spoken in Welsh p. 6

Diolchaf i’r Llywydd am ei waith, a llongyfarchaf ef ar ei benodiad. Gan nad oes cefnogaeth i’r argymhellion fel y maent yn y Papur Gwyrdd, a chan eu bod yn debyg o wneud mwy o niwed nag o les, a fyddai’r Prif Ysgrifennydd yn cytuno y dylai’r Pwyllgor Cynulliad perthnasol, fel mater o flaenoriaeth, gael cyfle i lunio argymhellion amgen ar gyfer patrwm Cymreig a allai ennill cefnogaeth eang? Byddai hyn yn esiampl dda iawn o allu’r Cynulliad i wneud pethau’n well yng Nghymru, a byddai’n bluen yn ein capiau ni i gyd.

I thank the Presiding Officer for his work, and congratulate him on his appointment. As there is no support for the recommendations as they stand in the Green Paper, and as they are likely to do more harm than good, does the First Secretary agree that the relevant Assembly Committee should, as a matter of priority, have the opportunity to draw up alternative recommendations for a Welsh model which would be able to attract broader support? This would be a good example of the Assembly’s ability to do things better in Wales, and it would be a feather in all our caps.

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Gymraeg t. 6

Alun Michael The First Secretary spoken in Welsh p. 6

Cymeradwyaf yr awgrym y dylai Pwyllgor archwilio cynnwys y ddogfen yn fuan. Mae’n iawn ein bod yn edrych ar y ffordd orau o wneud pethau yng Nghymru. Rhaid cydnabod bod strwythur tâl a rhagolygon cyflog athrawon yn berthnasol y tu allan i Gymru. Fodd bynnag, gallwn ystyried y mater, a dyna pam y mae yna Bapur Gwyrdd ar sut yr ydym yn dysgu yng Nghymru. Mae’n bwysig iawn inni ystyried sut i roi statws uwch a chyflog gwell i athrawon, yn arbennig y rhai gorau, er mwyn eu cadw yn yr ystafell ddosbarth, yn gweithio gyda phlant. Mae yna gefnogaeth i newid i sicrhau hynny, a dylai’r Pwyllgor ystyried y Papur Gwyrdd yn yr ysbryd hwn.

I commend the suggestion that a Committee should examine the document soon. It is only right that we consider how best we can do things in Wales. We must recognise that the pay structure and teachers’ pay forecasts are relevant outside Wales. However, we can consider the matter, and that is why there is a Green Paper on how we teach in Wales. It is important for us to consider how to give higher status and better salaries to teachers, particularly the best ones, so that we can keep them in the classroom, working with children. There is support for change to secure this, and the Committee should look at the Green Paper in that spirit.

Jenny Randerson spoken in English p. 7

Jenny Randerson siaradwyd yn Saesneg t. 7

I welcome your remarks so far. However, do you agree that the failure of the so-called ‘golden hellos’ to attract sufficient applications for next year’s training courses for shortage subjects such as science and mathematics is a sign of the need for a thorough review of the teachers’ salary structure? Do you also agree that we in Wales could set an excellent precedent for the rest of Britain?

Croesawaf eich sylwadau hyd yn hyn. Fodd bynnag, a fyddech chi’n cytuno bod methiant y ‘croeso euraid’ honedig i ddenu digon o geisiadau am gyrsiau hyfforddi’r flwyddyn nesaf yn y pynciau lle mae prinder, megis gwyddoniaeth a mathemateg, yn arwydd o’r angen am adolygiad trylwyr o strwythur cyflogau athrawon? A ydych chi hefyd yn cytuno y gallem ni yng Nghymru osod cynsail ragorol ar gyfer gweddill Prydain?

Alun Michael The First Secretary spoken in English p. 7

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 7

The idea of ‘golden hellos’ to attract people to shortage subjects was one step towards trying to address the problem that you mention. It is sensible for us to look at ways of both attracting and keeping teachers in shortage subjects to ensure that we can deliver a high quality of teaching across the board.

Un cam tuag at ddatrys y broblem y cyfeiriwch ati oedd y syniad o ‘groeso euraid’. Y peth synhwyrol yw i ni ystyried ffyrdd o ddenu a chadw athrawon yn y pynciau lle mae prinder er mwyn gallu sicrhau darpariaeth ddysgu o safon uchel ym mhob maes.

John Marek spoken in English p. 7

John Marek siaradwyd yn Saesneg t. 7

It would be helpful if the First Secretary could state that any advice that he as First Secretary gives to the Westminster Government regarding performance-related pay for teachers will be based upon an expression of opinion by the National Assembly for Wales only.

Byddai’n fuddiol pe gallai’r Prif Ysgrifennydd ddatgan y bydd unrhyw gyngor y bydd ef, fel Prif Ysgrifennydd, yn ei roi i Lywodraeth San Steffan ynghylch tâl ar sail perfformiad i athrawon wedi ei seilio ar y farn a fynegir gan Gynulliad Cenedlaethol Cymru yn unig.

Alun Michael The First Secretary spoken in English p. 7

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 7

John knows that the First Secretary is accountable to the National Assembly for Wales, and everything I do in that role will meet the responsibilities of this Chamber. He also knows that I have said from the beginning that I will stand down as Secretary of State for Wales, at the appropriate moment, in view of the need to smooth the transition of power to ensure that this Assembly is as effective as possible. It is in that spirit that I will tackle my responsibilities.

Gŵyr John fod y Prif Ysgrifennydd yn atebol i Gynulliad Cenedlaethol Cymru, a bydd popeth a wnaf yn y rôl honno yn unol â chyfrifoldebau’r Siambr hon. Gŵyr hefyd i mi ddweud o’r dechrau y byddaf yn ymddiswyddo fel Ysgrifennydd Gwladol Cymru, ar yr adeg briodol, yn wyneb yr angen i drosglwyddo grym yn ddidrafferth er mwyn sicrhau bod y Cynulliad hwn mor effeithiol â phosibl. Yn yr ysbryd hwnnw y byddaf yn ymdrin â’m cyfrifoldebau.

Ysbyty’r Tywysog Philip (Llanelli)

Prince Philip Hospital (Llanelli)

Q2 Helen Mary Jones spoken in English p. 8

C2 Helen Mary Jones siaradwyd yn Saesneg t. 8

I know that the First Secretary is well aware of the grave concern in my constituency of Llanelli about health care provision. These anxieties arise from the enormous debt of Dyfed Powys Health Authority. I ask him to give an assurance that, once the appropriate powers have been transferred to him, he will commit the Government to maintaining the accident and emergency unit at Prince Philip Hospital, Llanelli, at its current level, providing 24-hour cover, for the term of this National Assembly. (OAQ11JS)

Gwn fod y Prif Ysgrifennydd yn ymwybodol iawn o’r pryder mawr yn fy etholaeth i yn Llanelli am y ddarpariaeth gofal iechyd. Mae’r pryderon hyn yn deillio o ddyled enfawr Awdurdod Iechyd Dyfed Powys. Gofynnaf iddo gadarnhau heddiw y bydd, unwaith y bydd y pwerau priodol wedi’u trosglwyddo iddo, yn sicrhau ymrwymiad y llywodraeth i gynnal lefel bresennol y gwasanaethau yn yr adran ddamweiniau ac argyfwng yn Ysbyty Tywysog Philip, Llanelli, ac y darperir yno wasanaeth 24 awr dros dymor y Cynulliad Cenedlaethol hwn.(OAQ11JS)

Alun Michael The First Secretary spoken in English p. 8

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 8

I am sure that you appreciate that it is inappropriate to give specific undertakings about individual services. Otherwise we will have questions about every bed in every ward in every hospital in every area. Having said that, I am fully aware of the importance and considerable use made of the accident and emergency unit at Prince Philip Hospital, Llanelli. I have twice been to the hospital to counter what seem to be mischievous and unhelpful rumours about its possible closure. I have given the new Carmarthen and District NHS Trust a clear brief to balance the needs of Carmarthen and Llanelli to ensure that neither is neglected in providing an integrated and effective single health service for the whole of Carmarthenshire. I rejected the idea of trust-wide or authority-wide community health councils to make sure that Llanelli Dinefwr as well as Carmarthen has its own strong voice via its community health council.

Yr ydych, yr wyf yn siŵr, yn gwerthfawrogi mai amhriodol yw rhoi addewidion penodol am wasanaethau unigol. Fel arall, cawn gwestiynau am bob gwely ym mhob ward ym mhob ysbyty ym mhob ardal. Wedi dweud hynny, yr wyf yn gwbl ymwybodol o bwysigrwydd yr uned ddamweiniau ac argyfwng yn Ysbyty Tywysog Philip, Llanelli, a’r defnydd a wneir ohoni. Yr wyf wedi bod i’r ysbyty ddwywaith i danseilio’r straeon drygionus a di-fudd y gallai gael ei chau. Rhoddais gyfarwyddyd clir i Ymddiriedolaeth NHS newydd Caerfyrddin a’r Cylch i gadw cydbwysedd rhwng anghenion Caerfyrddin a Llanelli, fel nad yw’r naill na’r llall yn cael eu hesgeuluso wrth ddarparu un gwasanaeth iechyd cyfun ac effeithiol i Sir Gaerfyrddin gyfan. Gwrthodais y syniad o gynghorau iechyd cymuned wedi eu seilio ar yr ymddiriedolaeth gyfan neu’r awdurdod cyfan i wneud yn siŵr bod gan Lanelli Dinefwr yn ogystal â Chaerfyrddin ei llais cryf ei hun drwy’r cyngor iechyd cymuned.

You refer to the problems of Dyfed Powys Health Authority, and certainly that health authority’s finances need particular attention. We inherited an NHS in financial chaos, and the stock-take of NHS Wales, which will make an early report to the National Assembly, will deal with the provision of essential services across Wales, including emergency services in Dyfed Powys. I hope that we will have the full co-operation of all parties in consolidating and reconstructing the NHS in Wales, and that, through the visits I have already made, I have given all the reassurances that are necessary about the future of the accident and emergency unit at Prince Philip Hospital.

Cyfeiriwch at broblemau Awdurdod Iechyd Dyfed Powys ac yn sicr y mae angen sylw arbennig ar sefyllfa ariannol yr awdurdod. Etifeddasom Wasanaeth Iechyd mewn anhrefn ariannol, a bydd yr ymarferiad i gymryd stoc o NHS Cymru, y cyflwynir adroddiad buan arno i’r Cynulliad Cenedlaethol, yn delio â darparu gwasanaethau hanfodol ledled Cymru, gan gynnwys gwasanaethau argyfwng yn Nyfed Powys. Gobeithiaf y cawn gydweithrediad llwyr pob plaid i atgyfnerthu ac ail-lunio’r NHS yng Nghymru, a’m bod innau, drwy fy ymweliadau hyd yn hyn, wedi rhoi pob sicrwydd angenrheidiol am ddyfodol yr uned damweiniau ac argyfwng yn Ysbyty Tywysog Philip.

I appreciate the First Secretary’s point on not being able to discuss individual services. I felt free to raise this motion on this occasion in the light of the campaign commitments that you had made. Unfortunately your reassurances do not appear to have worked and I wonder if you would consider having an early meeting with me to discuss what we can do to put people’s minds at rest.

Gwerthfawrogaf bwynt y Prif Ysgrifennydd na all drafod gwasanaethau unigol. Teimlais y gallwn gyflwyno’r cynnig ar yr achlysur hwn o ystyried yr addewidion a wnaed yn ystod yr ymgyrch. Yn anffodus, nid yw’n ymddangos bod eich geiriau wedi lleddfu’r ofnau. Tybed felly a fyddech yn ystyried cael cyfarfod gyda mi yn fuan i drafod beth y gallwn ei wneud i dawelu meddyliau pobl.

I respect your wish to reinforce the reassurances that I have already given, and I would be happy to meet you to discuss this further.

Yr wyf yn falch o wneud hynny. Mae un neu ddwy ardal, er enghraifft Llanelli a Cheredigion—ynghylch Ysbyty Bronglais—lle mae straeon di-sail wedi achosi cryn loes i bobl. Yr wyf yn parchu eich awydd i ailbwysleisio’r sicrwydd a roddais eisoes, a byddwn yn falch o gwrdd â chi i drafod hyn ymhellach.

This year, £201 million of credit approval is available to local authorities to renovate public and private housing. Local Authority housing, in particular, has suffered from under-investment for many years. There is a backlog of essential repairs and modernisation work, estimated at £1 billion. I hope that Assembly Members will join me in considering any proposal that can draw in private finance alongside the public resources that the Assembly can provide.

Eleni, mae £201 miliwn o gymeradwyaeth credyd ar gael i awdurdodau lleol i adnewyddu tai cyhoeddus a phreifat. Mae tai Awdurdodau Lleol, yn arbennig, wedi dioddef o ddiffyg buddsoddi ers blynyddoedd lawer. I would not like to jump to that conclusion. A working party has been set up by the Welsh Local Government Association, the Welsh Tenants Federation, the Chartered Institute of Housing and the Council of Mortgage Lenders, to explore all avenues of levering private finance into council stock. This would mean being able to do more than we can with the resources available to the Welsh Office at present and to the Assembly in the future. That working party is concentrating on issues including stock transfer and private finance initiative solutions, and there is a report scheduled for July 1999. It would be of great interest to this Assembly to look at that report and at the options for a way forward.

Ni fynnwn neidio i’r casgliad hwnnw. Sefydlwyd gweithgor gan Gymdeithas Llywodraeth Leol Cymru, Ffederasiwn Tenantiaid Cymru, y Sefydliad Tai Siartredig a Chyngor y Benthycwyr Morgeisi, i ystyried pob dull o neilltuo cyllid preifat ar gyfer tai cyngor. Drwy hynny gellid gwneud mwy nag a allwn gyda’r adnoddau sydd ar gael i’r Swyddfa Gymreig ar hyn o bryd ac i’r Cynulliad yn y dyfodol. Mae’r gweithgor yn canolbwyntio ar faterion sy’n cynnwys trosglwyddo stoc ac atebion drwy’r cynllun cyllid preifat, a dylem gael adroddiad erbyn Gorffennaf 1999. In light of the answer he has given and the preliminary results of the Welsh House Conditions Survey that were published last week, will the First Secretary support an early investigation by the relevant committee of this Assembly into housing in Wales? This would be an effort to find solutions to very real problems that exist.

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 11

That is a sensible way forward. We need to look imaginatively at what are real problems. The results of the Welsh House Conditions Survey show that only 8.5% of Welsh housing was unfit in 1997 and 1998, compared with 13.4% in 1993. However, those percentages remain worrying and I believe that the relevant Assembly Committee and the responsible Assembly Secretary should pay attention to these matters and discuss them. One of the advantages of the Assembly is greater scrutiny, and we can use the resource that is here from members of all parties in trying to look for new ways of dealing with familiar problems.

Byddai hynny’n gam doeth ymlaen. Mae angen i ni edrych gyda dychymyg ar yr hyn sy’n broblemau gwirioneddol. Dengys canlyniadau’r Arolwg ar Gyflwr Tai Cymru mai dim ond 8.5% o dai Cymru oedd yn anaddas i fyw ynddynt yn 1997 ac 1998, o gymharu ag 13.4% yn 1993. Mae’r canrannau hyn, serch hynny, yn dal i beri gofid a chredaf y dylai Pwyllgor perthnasol y Cynulliad a’r Ysgrifennydd sydd â chyfrifoldeb roi sylw i’r holl faterion hyn a’u trafod. Un o fanteision y Cynulliad yw mwy o archwilio, a gallwn ddefnyddio’r adnodd sydd yma o du aelodau o bob plaid i geisio chwilio am ffyrdd newydd o ddelio â phroblemau cyfarwydd.

Rhaid edrych ar batrwm defnyddio arian Amcan 1 er mwyn sicrhau ei fod yn helpu’r strategaeth codi lefel GDP a chyflogau pobl y Cymoedd, fel rhan o’r ardal y mae arian Amcan 1 wedi’i neilltuo ar ei chyfer. Bydd Peter Hain, y Gweinidog presennol, yn cysylltu â Peter Law, Ysgrifennydd y Cynulliad, a fydd yn gyfrifol am y meini prawf y byddwn yn eu defnyddio ar gyfer y grant yn y dyfodol. Mae’n amlwg y bydd Pwyllgor y Cynulliad am edrych ar y ffordd yr ydym yn delio â’r arian sydd ar gael i’r Cynulliad. We have to look at the way in which Objective 1 funding is used, to ensure that it helps the strategy of raising the level of GDP and people’s salaries in the Valleys, as part of the area covered by Objective 1 funding. Peter Hain, the Minister at present, will contact Peter Law, the Assembly Secretary, who will be responsible for the criteria for the grant in the future. Obviously, the Assembly Committee will wish to look at the way in which we deal with the money available to the Assembly. If we wish to spend more money on roads, we will have to take that money from other places in order to raise the total.

This is a very good point. Our brief for the architect requires that, wherever possible, consideration must be given to the rich source materials of Wales and the use of indigenous materials. Of course, that must not compromise the proper public procurement standards for buildings and the search for value for money. However, materials such as slate, wood and steel—obvious materials in a Welsh context—are involved in the design, which is not entirely glass as the first look at the first model might have suggested. I believe that the point is stated correctly in the architect’s brief and it is one that we should keep in mind.

Mae hwn yn bwynt da iawn. Mae ein briff i’r pensaer yn mynnu, lle bynnag y mae hynny’n bosibl, fod ystyriaeth i’w rhoi i ddefnyddiau sydd i’w cael yn helaeth yng Nghymru ac i ddefnyddio deunydd cynhenid. Wrth gwrs, ni ddylai hynny danseilio’r safonau caffael cyhoeddus priodol ar gyfer adeiladau a’r ymdrech i sicrhau gwerth am arian. Fodd bynnag, mae defnyddiau fel llechi, coed a dur—sy’n amlwg iawn mewn cyd-destun Cymreig—yn rhan o’r cynllun. Nid gwydr yw’r cynllun i gyd, fel y gallai’r olwg gyntaf ar y cynllun cyntaf fod wedi awgrymu. I agree entirely with the spirit of your words. We must pay attention to domestic and European legislation that governs procurement by public bodies. Companies based in Wales that supply Welsh materials may not always win competitive contracts. However, ensuring that the design of the building takes account of the materials that are natural to Wales and that reflect our heritage is very much a part of the brief that was given to the architects. I believe that the Assembly would want to carry that forward within the requirements to which I have referred.

Cytunaf yn llwyr ag ysbryd eich geiriau. Rhaid inni gadw at y ddeddfwriaeth ddomestig ac Ewropeaidd sy’n rheoli caffael gan gyrff cyhoeddus. Nid cwmnïau o Gymru, yn cyflenwi defnyddiau Cymreig, sydd bob amser o reidrwydd yn ennill contractau cystadleuol. Fodd bynnag, y mae sicrhau bod cynllun yr adeilad yn adlewyrchu defnyddiau naturiol Cymru ynghyd â’n treftadaeth yn sicr yn rhan o’r briff a roddwyd i’r penseiri. How can the First Secretary justify spending £17 million of taxpayers’ money on a new building when the building that we currently occupy is perfectly adequate? Will you consider cancelling that project and diverting the £17 million to a far more worthy project for the new millennium—building a new children’s hospital for Wales? The First Secretary knows that we do not have a children’s hospital in Wales. I believe that Wales is the only country in Europe that does not have a children’s hospital.

Sut y gall y Prif Ysgrifennydd gyfiawnhau gwario £17 miliwn o arian trethdalwyr ar adeilad newydd pan fo’r adeilad yr ydym ynddo ar hyn o bryd yn gwbl ddigonol? A wnewch chi ystyried canslo’r prosiect a chyfeirio’r £17 miliwn at brosiect llawer mwy gwerth chweil ar gyfer y mileniwm newydd—adeiladu ysbyty plant newydd i Gymru? The question of a new Assembly building is a serious matter for the Assembly as a whole. We need a building that reflects our hopes and aspirations for the Assembly. It must be an inclusive building, where our proceedings will be looked at from outside and respected. It will be much easier for the public to look in and for Members to participate than is the case at the moment. I am grateful to Rod Richards for acknowledging the success of the work of shoehorning a chamber into an office block. Although the standard here is high, I suspect that Members will realise the drawbacks of this Chamber, which is essentially a meeting place, almost configured as a television studio. This ensures public information about what happens here but, nevertheless, has considerable constraints. The proposed new building enables the public to look in and be much more engaged with the processes of the Assembly. He is correct in saying that these are serious considerations and ones to which the Assembly will need to pay attention. An efficient new building that is designed for purpose can have a financial return as well as a process return. However, on the matter of our building, we should not proceed without thought or stop without good reason. It is a matter for very serious consideration by Members of this Assembly.

Mae cael adeilad newydd ar gyfer y Cynulliad yn fater difrifol i’r Cynulliad cyfan. Mae angen adeilad arnom sy’n adlewyrchu ein gobeithion a’n dyheadau ynghylch y Cynulliad. Rhaid iddo fod yn adeilad cynhwysol, lle bydd pobl o’r tu allan yn edrych ar ein trafodion ac yn eu parchu. Bydd yn llawer haws i’r cyhoedd edrych i mewn ac i’r Aelodau gymryd rhan nag yw ar hyn o bryd. Yr wyf yn ddiolchgar i Rod Richards am gydnabod llwyddiant y gwaith o wasgu siambr i mewn i adeilad swyddfeydd. Er bod y safon yma yn uchel, yr wyf yn amau y bydd yr Aelodau’n sylweddoli anfanteision y Siambr hon sydd, yn ei hanfod, yn fan cyfarfod, wedi ei llunio bron fel stiwdio deledu. Mae hynny’n sicrhau gwybodaeth gyhoeddus am yr hyn sy’n digwydd yma ond, serch hynny, mae yna gyfyngiadau sylweddol. Mae’r adeilad newydd arfaethedig yn galluogi’r cyhoedd i edrych i mewn a chysylltu mwy â phrosesau’r Cynulliad. Mae’n gywir wrth ddweud bod y rhain yn ystyriaethau difrifol ac y bydd gofyn i’r Cynulliad roi sylw manwl iddynt. Gall adeilad newydd effeithlon a gynlluniwyd i’r diben ddod ag elw ariannol yn ogystal â manteision i’n prosesau. Fodd bynnag, ar fater ein hadeilad, ni ddylem fwrw ymlaen yn ddifeddwl na rhoi’r gorau iddo heb reswm da. Y mae’n fater i’w ystyried yn ddifrifol iawn gan Aelodau’r Cynulliad hwn.

If we consider the way the money will be spent on Objective 1 schemes, and other strategic moneys, the sums will be low for this year and the next year, but will grow and increase quickly from 2001 to 2002. A ydych yn derbyn ei bod yn holl bwysig i fusnesau a phobl eraill sydd eisiau cyflwyno ceisiadau am arian o gronfeydd strwythurol Ewrop wybod yn union faint o arian cyfatebol fydd ar gael, ac o fewn pa fframwaith amser? Os ydym am gael mantais lawn a buan o’r cronfeydd hyn, mae’n gwbl angenrheidiol fod yr arian cyfatebol llawn ar gael o’r Trysorlys. Mae’n bwysig hefyd nad ydym fel Cynulliad yn gorfod wynebu’r cwestiwn o dorri ar wariant—o bosibl ar iechyd ac addysg—er mwyn sicrhau bod arian cyfatebol ar gael ar gyfer cynlluniau hanfodol bwysig.

Do you accept that it is essential for businesses and other people who wish to submit bids for money from European structure funds to know exactly what matched funding is available and within what time framework? If we are to take full and swift advantage of these funds, it is crucial that the full matched funding is available from the Treasury. It is also important that we do not have to face the question of cutting back on expenditure—possibly on education and health—in order to ensure that matched funding money is available for essential schemes.

Y mae hefyd wedi clywed geiriau’r Prif Weinidog wrth ateb y math yna o gwestiwn. Rhaid inni fynd drwy’r broses, ac i ddefnyddio geiriau y Prif Weinidog ei hun, ‘I will not let Wales down.’

He would have also heard the words of the Prime Minister when answering that type of question. There is a process we have to follow, and to use the words of the Prime Minister himself, ‘I will not let Wales down.’

Dyna’r ateb i’r cwestiwn. Mae’n bwysig, felly, ein bod yn sicrhau bod Amcan 1, a’r arian sydd yn dod ynghyd â hynny, yn creu llwyddiant yng Nghymru.

That is the answer to the question. It is important, therefore, that we ensure that Objective 1, and the money that accompanies it, creates success here in Wales.

Michael German spoken in English p. 15

Michael German siaradwyd yn Saesneg t. 15

In view of the answer you gave me in a television studio before the elections—that the matter of Objective 1 matched funding would be discussed by the UK Cabinet in the comprehensive spending review round—can you tell me when the UK Cabinet will meet to discuss the comprehensive spending review for next year? When will it reach a conclusion? When is it anticipated that it will present its decisions to Parliament? Could Alun also tell me what advice he would give as First Secretary to prospective project promoters who are preparing projects to commence on 1 January 2000? These promoters are anxious that they might be investing huge time, money and effort into helping project development when they have no guarantee that the necessary public matched funding will be available for the start of their projects.

O gofio’r ateb a roesoch imi mewn stiwdio deledu cyn yr etholiadau —y câi cyllid cyfatebol Amcan 1 ei drafod gan Gabinet y DU fel rhan o’r arolwg gwariant cynhwysfawr—a ellwch chi ddweud wrthyf pryd y bydd Cabinet y DU yn cwrdd i drafod yr arolwg gwariant cynhwysfawr ar gyfer y flwyddyn nesaf? Pa bryd y daw i benderfyniad? Pa bryd y tybir y bydd yn cyflwyno’i benderfyniadau i’r Senedd? A allai Alun ddweud wrthyf hefyd pa gyngor y byddai’n ei roi fel Prif Ysgrifennydd i hyrwyddwyr prosiectau posibl sy’n paratoi prosiectau i ddechrau ar 1 Ionawr 2000? Mae’r hyrwyddwyr hyn yn poeni eu bod efallai yn buddsoddi amser, arian ac ymdrech aruthrol yn helpu i ddatblygu prosiect er nad oes unrhyw warant ganddynt y bydd y nawdd cyfatebol cyhoeddus angenrheidiol ar gael ar ddechrau eu prosiect.

I understand your fascination with the process, and it does you great credit. I think the processes that the comprehensive spending review goes through are actually creative. I was involved with the processes of the Home Office during the last comprehensive spending review. The processes were very creative in looking at ways of making sure that the real objectives of public services were achieved, rather than just continuing to put funds in particular places, which was the traditional way of doing it.

Yr wyf yn deall eich diddordeb yn y broses, ac mae hynny’n glod mawr i chi. Credaf fod y prosesau sy’n rhan o’r arolwg gwariant cynhwysfawr yn rhai creadigol. Yr oeddwn â rhan ym mhrosesau’r Swyddfa Gartref yn ystod yr arolwg gwariant cynhwysfawr diwethaf. Yr oedd y prosesau’n greadigol iawn, yn ystyried ffyrdd o sicrhau bod gwir amcanion gwasanaethau cyhoeddus yn cael eu cyflawni, yn hytrach na pharhau i roi cyllid mewn mannau penodol, sef y ffordd draddodiadol o wneud y gwaith.

I am confident that we have learnt from that process, and that the next comprehensive spending review will be even more successful in making sure that public spending in Wales reaches its real target. The message I would give to those with interest in the public, private or voluntary sector is that, having achieved Objective 1 status, we are absolutely determined to make sure that the money that consequently comes to Wales changes the economy of Wales.

Yr wyf yn hyderus inni ddysgu o’r broses honno, ac y bydd yr arolwg gwariant cynhwysfawr nesaf hyd yn oed yn fwy llwyddiannus o ran gwneud yn siŵr bod gwariant cyhoeddus yng Nghymru yn cyrraedd ei wir darged. Y neges a roddwn i’r rheini sy’n ymddiddori yn y sector cyhoeddus, preifat neu wirfoddol yw ein bod ni, ar ôl sicrhau statws Amcan 1, yn gwbl benderfynol o wneud yn siŵr bod yr arian a ddaw i Gymru yn ei sgîl yn newid economi Cymru.

We are determined to ensure opportunity for people in all communities, including those in the Valleys and mid and west Wales. Indeed the phrase mid and west Wales does not always indicate the extent to which that includes parts of north Wales. All those areas will benefit from the way in which the money will be spent. I therefore tell people who are considering plans that it will be worthwhile for them to invest that money because, as the Prime Minister said, ‘We will not let Wales down.’

Yr ydym yn benderfynol o sicrhau cyfle i bobl ym mhob cymuned, gan gynnwys y rheini yn y Cymoedd ac yng nghanolbarth a gorllewin Cymru. Yn wir, nid yw’r ymadrodd canolbarth a gorllewin Cymru bob amser yn cyfleu cymaint o ogledd Cymru sydd wedi ei gynnwys. Bydd yr ardaloedd hyn i gyd yn elwa o’r ffordd y caiff yr arian ei wario. Dywedaf felly wrth bobl sy’n ystyried cynlluniau y bydd yn werth chweil iddynt fuddsoddi’r arian oherwydd, fel y dywedodd y Prif Weinidog, ‘We will not let Wales down.’

Val Feld spoken in English p. 16

Val Feld siaradwyd yn Saesneg t. 16

I am very grateful to you for agreeing to treat this as an emergency, as it is a matter of great importance across Wales. Is the First Secretary aware that HTV West and Granada Television will be broadcasting a party political broadcast for the British National Party this Friday night which will reach about a third of the population of Wales, despite the fact that the British National Party has not registered candidates for the European elections in Wales? In view of the evidence of increasing racist activity, will the First Secretary give an assurance that he will take steps to tackle racism and racial violence across Wales?

Yr wyf yn wir ddiolchgar i chi am gytuno i drin hwn fel argyfwng, gan ei fod yn fater o bwys mawr ledled Cymru. A yw’r Prif Ysgrifennydd yn ymwybodol y bydd cwmni teledu HTV West a Granada yn dangos darllediad gwleidyddol y Blaid Genedlaethol Brydeinig nos Wener nesaf? Bydd yn cyrraedd tua thraean poblogaeth Cymru, er nad yw’r Blaid Genedlaethol Brydeinig wedi cofrestru yr un ymgeisydd yn yr etholiad Ewropeaidd yng Nghymru. O gofio’r dystiolaeth bod gweithgareddau hiliol ar gynnydd, a wna’r Prif Ysgrifennydd roi sicrwydd y bydd ef yn cymryd camau i fynd i’r afael â hiliaeth a thrais hiliol ledled Cymru?

Alun Michael The First Secretary spoken in English p. 17

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 17

I am grateful to Val Feld for drawing this matter to my attention. The question of broadcasting is not a matter for me or the Assembly. The Representation of the People Act 1991 requires HTV and Granada to carry political broadcasts in accordance with the rules of the Independent Television Commission. Those rules have been agreed between broadcasting authorities, following consultation. Once agreed, no political party, Assembly or Government can intervene to prevent a broadcast that complies with those rules. That is an accurate statement of the context, and I am sure she will accept that. It is likely that some homes in east Wales will receive this broadcast.

Yr wyf yn ddiolchgar i Val Feld am ddwyn y mater i’m sylw. Nid yw darlledu yn fater i mi nac i’r Cynulliad. Yn ôl Deddf Cynrychiolaeth y Bobl 1991 mae’n ofynnol i HTV a Granada ddangos darllediadau gwleidyddol yn unol â rheolau’r Comisiwn Teledu Annibynnol. Cytunwyd ar y rheolau hynny rhwng yr awdurdodau darlledu, ar ôl ymgynghori. Unwaith y cytunir arnynt, ni all unrhyw blaid wleidyddol, Cynulliad na Llywodraeth ymyrryd i rwystro darllediad sy’n cydymffurfio â’r rheolau. Mae hwn yn ddatganiad cywir o’r cyd-destun, ac yr wyf yn siwr y bydd yn derbyn hynny. Mae’n debygol y bydd rhai cartrefi yn nwyrain Cymru yn derbyn y darllediad hwn.

In the Assembly, I hope that we will combat racism and vigorously promote an inclusive society in Wales. The Government is taking steps. I am proud of the part I played in the Crime and Disorder Act 1998 which introduced a new offence for racially aggravated assault, and provided for the anti-social behaviour order. The Protection from Harassment Act 1997 is another relevant measure.

Yn y Cynulliad, gobeithiaf y byddwn yn ymladd hiliaeth ac yn mynd ati’n egnïol i hybu cymdeithas gynhwysol yng Nghymru. Mae’r Llywodraeth yn cymryd camau. Ymfalchïaf yn fy rhan yn Neddf Troseddau ac Anhrefn 1998 a gyflwynodd drosedd newydd sef ymosod gyda chymhelliad hiliol, ynghyd â darparu’r gorchymyn am ymddygiad gwrthgymdeithasol. Mae Deddf Amddiffyn rhag Aflonyddu 1997 yn fesur arall perthnasol.

Those measures can be used to combat racial violence or the threat of it in any community. We need to set an example of respect, tolerance and celebration of being a multi-cultural society. That applies to some parts of Wales more than others. We can certainly be pleased that no member of the British National Party, or any other party that espouses racism, has succeeded in being elected in Wales. However, we need to be conscious that Wales is not free of racism. That was one of the big lessons of the Stephen Lawrence enquiry. We should focus on recognising and addressing this, in partnership with the police, public bodies, local authorities, and with black and ethnic communities, to achieve a fair and inclusive society.

Gellir defnyddio’r mesurau hyn i ymladd trais hiliol neu’r bygythiad ohono mewn unrhyw gymuned. Mae angen i ni osod esiampl o barch a goddefgarwch, ac o ddathlu perthyn i gymdeithas amlddiwylliannol. Mae hynny’n fwy perthnasol i rai rhannau o Gymru nag eraill. Yn sicr, gallwn fod yn falch nad oes unrhyw aelod o’r Blaid Genedlaethol Brydeinig, nac unrhyw blaid arall sy’n arddel hiliaeth, wedi llwyddo i gael ei ethol yng Nghymru. Fodd bynnag, rhaid inni fod yn ymwybodol nad yw Cymru yn rhydd rhag hiliaeth. Dyna un o wersi pennaf ymchwiliad Stephen Lawrence. Dylem ganolbwyntio ar gydnabod hyn a mynd i’r afael ag ef, mewn partneriaeth â’r heddlu, cyrff cyhoeddus, awdurdodau lleol, ac â chymunedau du ac ethnig, er mwyn gwireddu cymdeithas deg a chynhwysol.

Val Feld spoken in English p. 18

In view of the fact that there are no black or ethnic minority Members of this Assembly, and in the interest of true inclusiveness, will you ensure that the Equal Opportunities Committee, when set up, makes it a priority to establish ways of consulting and involving people from the black and ethnic minority communities of Wales in the work of the Assembly?

Yn wyneb y ffaith nad oes unrhyw Aelod du nac ethnig lleiafrifol yn y Cynulliad, ac er mwyn bod yn wirioneddol gynhwysol, a wnewch chi sicrhau bod y Pwyllgor Cyfle Cyfartal, pan sefydlir ef, yn gwneud pennu ffyrdd o ymgynghori â phobl o gymunedau du a lleiafrifol ethnig Cymru, a’u cynnwys yng ngwaith y Cynulliad, yn flaenoriaeth?

Alun Michael The First Secretary spoken in English p. 18

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 18

Yes, and I am sure that every Member of this Assembly would agree with that. The Equal Opportunities Committee will have the support of Members from every single party in the Chamber. The existence of the Equal Opportunities Committee gives the Assembly the opportunity to function in a more positive way, and we should welcome that. A race equality project officer, recently appointed to the Welsh Office, will be joining the Assembly’s team. The officer is actively engaged in promoting links with black and ethnic communities and those who will be developing policies for Wales to ensure that race equality is recognised and addressed.

Gwnaf, ac yr wyf yn siŵr y byddai pob Aelod o’r Cynulliad hwn yn cytuno. Bydd y Pwyllgor Cyfle Cyfartal yn cael cefnogaeth Aelodau o bob un blaid yn y Siambr. Mae bodolaeth y Pwyllgor Cyfle Cyfartal yn rhoi i’r Cynulliad y cyfle i weithredu mewn modd mwy cadarnhaol, a dylem groesawu hynny. Bydd swyddog prosiect cydraddoldeb hiliol, a benodwyd i’r Swyddfa Gymreig yn ddiweddar, yn ymuno â thîm y Cynulliad. Mae’r swyddog wrthi’n ddiwyd yn hybu cysylltiadau gyda chymunedau du ac ethnig a’r rheini a fydd yn datblygu polisïau i Gymru er mwyn sicrhau bod cydraddoldeb hiliol yn cael ei gydnabod ac y caiff sylw.

The Assembly cannot change things overnight. However, this is a positive step to ensure that foundations are set for the work of the Assembly and the Equal Opportunities Committee. I support the proposition that you have made and I am sure the Equal Opportunities Committee will approach its work in this spirit. However, these issues must not be dealt with solely by the Equal Opportunities Committee; they must also be approached by each one of the Committees and by the Administration of the Assembly as a whole. I hope that the proposition has widespread support from all parts of this Chamber.

Ni all y Cynulliad newid pethau dros nos. Fodd bynnag, mae hwn yn gam cadarnhaol i sicrhau bod sylfeini’n cael eu gosod ar gyfer gwaith y Cynulliad a’r Pwyllgor Cyfle Cyfartal. Cefnogaf y cynnig a gyflwynwyd gennych ac yr wyf yn siŵr y bydd y Pwyllgor Cyfle Cyfartal yn ymdrin â’i waith yn yr ysbryd hwn. Fodd bynnag, nid materion i’r Pwyllgor Cyfle Cyfartal yn unig i ddelio â hwy yw’r rhain; rhaid hefyd i bob un o’r Pwyllgorau a Gweinyddiaeth y Cynulliad drwyddo draw roi sylw iddynt. Gobeithiaf fod i’r cynnig gefnogaeth eang o bob rhan o’r Siambr hon.

On behalf of Plaid Cymru—the Party of Wales, I thank Val for drawing our attention to this matter. As the First Secretary stated, we must all be conscious of the evil of racism within our communities, and not be complacent. In addition to taking on board the needs of people from ethnic minority communities, I ask that he gives consideration to ensuring that the Equal Opportunities Committee appoints standing advisers from black and ethnic minority communities to address the issue that Val raised, as we do not have direct representation from those communities in this Chamber.

Ar ran Plaid Cymru—the Party of Wales, hoffwn ddiolch i Val am ddwyn ein sylw at y mater hwn. Fel y dywedodd y Prif Ysgrifennydd, rhaid i bawb ohonom fod yn ymwybodol o ddrygioni hiliaeth yn ein cymunedau, a pheidio â bod yn hunanfodlon. Yn ogystal â rhoi sylw i anghenion pobl o gymunedau ethnig lleiafrifol, gofynnaf iddo ystyried gwneud yn siŵr bod y Pwyllgor Cyfle Cyfartal yn penodi ymgynghorwyr sefydlog o gymunedau du ac ethnig lleiafrifol i roi sylw i’r mater a godwyd gan Val, gan nad oes cynrychiolaeth uniongyrchol o’r cymunedau hynny yn y Siambr.

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 19

We need to address the question of how staff are recruited. During my time as Secretary of State for Wales, I was aware of the need to increase the representation from ethnic minority communities among the employees of the Assembly. It clearly makes sense in terms of the support and advice available to the Equal Opportunities Committee. I certainly accept the spirit of the question and it is now a matter for the Committee.

Mae angen i ni ystyried sut y recriwtir staff. Yn ystod fy nghyfnod fel Ysgrifennydd Gwladol Cymru, yr oeddwn yn ymwybodol o’r angen i gynyddu’r gynrychiolaeth o gymunedau ethnig lleiafrifol ymysg gweithwyr cyflog y Cynulliad. Mae hynny’n amlwg yn gwneud synnwyr o ran y gefnogaeth a’r cyngor sydd ar gael i’r Pwyllgor Cyfle Cyfartal. Yr wyf fi yn sicr yn derbyn ysbryd y cwestiwn ac mae bellach yn fater i’r Pwyllgor.

Michael German spoken in English p. 19

I also agree with the sentiments expressed by Val. The issue of how you incorporate the equal opportunities measures into all Committees of the Assembly is one of great interest. Given the importance of this work in the Assembly and across Wales, would the First Secretary consider the use of benchmarking success whereby a Committee could set targets and measure its achievements?

Cytunaf innau gyda’r teimladau a fynegwyd gan Val. Mae sut y gellir ymgorffori’r mesurau cyfle cyfartal yn rhan o holl Bwyllgorau’r Cynulliad yn bwnc o ddiddordeb mawr. O gofio pwysigrwydd y gwaith hwn yn y Cynulliad ac ar draws Cymru, a fyddai’r Prif Ysgrifennydd yn ystyried defnyddio trefn i feincnodi llwyddiant, gyda’r Pwyllgorau yn gosod targedau ac yn mesur eu llwyddiant?

Alun Michael The First Secretary spoken in English p. 19

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 19

As you know, Mike, from our previous shared experience in local government, I am very committed to the idea of setting targets and measuring their effectiveness. However, these targets must be clear as well as measured correctly. We cannot simply set hoops for people to jump through with little resulting change. I accept your suggestion. However, I emphasise that the Equal Opportunities Committee will focus on a variety of issues relating to equal opportunity, such as those affecting women and disabled people, as well as issues raised by Val’s initial question. We cannot create mountains that are too steep to climb; objectives must, therefore, be realistic. They must be met progressively over time, so that we can change our society and the Assembly effectively.

Fel y gwyddoch, Mike, o brofiad blaenorol y ddau ohonom mewn llywodraeth leol, mae gennyf ymrwymiad cadarn i’r syniad o osod targedau a mesur eu heffeithiolrwydd. Fodd bynnag, rhaid i’r targedau fod yn glir yn ogystal â’u bod yn cael eu mesur yn gywir. Nid oes diben rhoi pobl drwy’r felin os nad yw hynny yn arwain at newidiadau. Derbyniaf eich awgrym. Fodd bynnag, carwn bwysleisio y bydd y Pwyllgor Cyfle Cyfartal yn canolbwyntio ar amrywiaeth o faterion yn ymwneud â chyfle cyfartal, megis materion sy’n effeithio ar fenywod a phobl anabl, yn ogystal â’r ystyriaethau a godwyd gan Val. Ni allwn greu mynyddoedd rhy serth i’w dringo; rhaid, felly, i’r amcanion fod yn realistig. Rhaid eu cyflawni fwyfwy dros amser, er mwyn inni newid ein cymdeithas a’r Cynulliad yn effeithiol.

The Conservative Party takes the work of the Equal Opportunity Committee very seriously. However, all the political parties present must work hard to get representatives from minority communities and to increase the participation and voting in those communities.

Mae’r Blaid Geidwadol yn cymryd gwaith y Pwyllgor Cyfle Cyfartal yn gwbl ddifrifol. Fodd bynnag, rhaid i bob plaid wleidyddol yma weithio’n galed i gael cynrychiolwyr o gymunedau lleiafrifol ac i ennyn mwy o gyfranogi a phleidleisio yn y cymunedau hynny.

Alun Michael The First Secretary spoken in English p. 20

I accept that point. We need to look at our own houses before looking at others. I was pleased with the number of Labour party candidates from ethnic minority groups in both local and national elections. However—I must be careful how I put this—I was particularly disappointed with the result in Monmouth. I mean that in the context of this discussion: I would not dream of making a political point. [Laughter.]

Derbyniaf eich pwynt. Rhaid inni edrych ar ein sefyllfa ein hunain cyn edrych ar neb arall. Yr oeddwn yn falch o’r nifer o ymgeiswyr o grwpiau ethnig lleiafrifol a oedd gan y blaid Lafur yn yr etholiadau lleol a chenedlaethol. Fodd bynnag—rhaid i mi eirio hyn yn ofalus—yr oeddwn yn neilltuol o siomedig â’r canlyniad yn Sir Fynwy. Yr wyf yn golygu hynny yng nghyd-destun y drafodaeth hon: ni fyddwn am funud am wneud pwynt gwleidyddol. [Chwerthin.]

The way people share representation in public life is a serious matter. The quality of appointments and fairness of opportunity offered in the public service and other bodies in Wales, as well as the Assembly, need to be examined. I look forward to the Assembly engaging with these important issues. There is now adequate time and opportunity for Members and officials to do that. That emphasises the importance of the Assembly.

Mae’r ffordd y mae pobl yn rhannu cynrychiolaeth mewn bywyd cyhoeddus yn fater difrifol. Rhaid edrych ar ansawdd y penodiadau a’r tegwch cyfle a gynigir yn y gwasanaeth cyhoeddus a chyrff eraill yng Nghymru, yn ogystal â’r Cynulliad. Edrychaf ymlaen at weld y Cynulliad yn mynd i’r afael â’r materion pwysig hyn. Mae gennym yn awr ddigon o amser a chyfle i’r Aelodau a’r swyddogion wneud hynny. Mae hynny’n pwysleisio pwysigrwydd y Cynulliad.

I have arranged for the Codes and Information to be placed on the Chamberweb.

Yr wyf wedi trefnu i’r Codau a’r Wybodaeth gael eu rhoi ar We’r Siambr.

Clearly, the Assembly is a new institution, designed to bring Government closer to the people it serves. Democracy and inclusiveness are fundamental principles dependent on openness, accessibility and transparency and allowing effective scrutiny of decisions. The Codes before you are the result of consultation. As an institution we need to establish codes. However, as was mentioned yesterday, these codes are not set in stone. They are the property of the Assembly and, as such, can be revised by the Assembly through the appropriate channels, either through the plenary sessions of the Assembly, the Business Committee or through the Standards Committee when it is established.

Yn amlwg, mae’r Cynulliad yn sefydliad newydd, a fwriadwyd i ddod â Llywodraeth yn nes at y bobl y mae’n eu gwasanaethu. Mae democratiaeth a chynwysoldeb yn egwyddorion sylfaenol sy’n ddibynnol ar fod yn agored, yn hygyrch a thryloyw, gan ganiatáu archwilio penderfyniadau’n effeithiol. Ffrwyth ymgynghori yw’r Codau ger eich bron. Fel sefydliad, mae angen inni sefydlu codau. Fodd bynnag, fel y soniwyd ddoe, nid codau haearnaidd na ellir eu newid yw’r rhain. Eiddo’r Cynulliad ydynt ac, felly, gall y Cynulliad eu haddasu drwy’r sianelau priodol, un ai drwy sesiynau llawn y Cynulliad, y Pwyllgor Busnes neu drwy’r Pwyllgor Safonau unwaith y bydd wedi ei sefydlu.

Part I of the Code of Practice on Public Access to Information sets out the general principles of openness on which we will operate. These include how we will be proactive in making information publicly available; how we ensure that we cater for the needs and preferences of different sectors of the community; how we respond to requests for information promptly—ideally within 15 working days—and how we publish our complaints procedure so that those who disagree with the decision to withhold information can appeal ultimately to an independent arbiter—the Welsh Administration Ombudsman.

Yn Rhan I y Cod Ymarfer ar Ganiatáu i’r Cyhoedd Weld Gwybodaeth, nodir yr egwyddorion cyffredinol y byddwn yn gweithredu arnynt o ran bod yn agored. Mae’r rhain yn cynnwys bod yn rhagweithiol o ran rhyddhau gwybodaeth i’r cyhoedd; sut y byddwn yn darparu ar gyfer anghenion a blaenoriaethau gwahanol sectorau’r gymuned; sut y byddwn yn ymateb i geisiadau am wybodaeth yn brydlon—o fewn 15 niwrnod gwaith yn ddelfrydol—a sut y byddwn yn cyhoeddi ein trefn gwyno fel bod y rheini sy’n anghytuno â’r penderfyniad i atal gwybodaeth yn gallu apelio yn y pen draw at ganolwr annibynnol—sef Ombwdsmon Gweinyddiaeth Cymru.

This Code is non-statutory. However, there is a clear presumption that information be made available on request, unless there are overriding reasons for withholding it. The question is why should information not be made available rather than why should it. The Code has been drafted against the background of a Freedom of Information Bill, which will introduce statutory rights of access to information, and the Code will need to be reviewed in the light of the consultation on this Bill as it progresses through the parliamentary process. Members should note that this Code introduces a more open regime than is currently operating across Government, and thus places this Assembly at the forefront of freedom of information. The rest of the United Kingdom will continue to be subject to the Code of Practice on Access to Government Information. However, it is vital to balance a need for openness and accountability against the requirement to protect certain types of information, such as personal data the disclosure of which might harm or be prejudicial to particular interests. For this reason, Part II of the Code describes the categories of information which may be withheld unless the public interest outweighs the harm or prejudice likely to arise from this disclosure. Judgement on disclosure will be delegated to officials and additional guidance on interpreting the Code will be drafted. Those decisions will be subject to review, and a formal complaint procedure will be established in the event of disagreement with these decisions.

Nid yw hwn yn God statudol. Fodd bynnag, ceir ynddo ragdybiaeth glir y darperir gwybodaeth pan wneir cais amdani, oni bai fod rhesymau holl bwysig dros ei hatal. Y cwestiwn yw pam na ddylai gwybodaeth fod ar gael, yn hytrach na pham y dylai. Drafftiwyd y Cod gan gadw mewn cof y Mesur Rhyddid Gwybodaeth, a fydd yn cyflwyno hawliau statudol i weld gwybodaeth, a bydd gofyn adolygu’r Cod yng ngoleuni’r ymgynghori ar y Mesur hwn ar ei hynt drwy’r broses seneddol. Dylai’r Aelodau nodi bod y Cod hwn yn cyflwyno cyfundrefn fwy agored na’r un sydd mewn grym ar hyn o bryd ar draws y Llywodraeth, ac mae felly yn golygu bod y Cynulliad hwn yn y lle blaen o ran rhyddhau gwybodaeth. Bydd gweddill y Deyrnas Unedig yn dal i fod yn ddarostyngedig i’r Cod Ymarfer ar Hawl i Weld Gwybodaeth y Llywodraeth. Fodd bynnag, mae’n holl bwysig bod yr angen i fod yn agored ac atebol yn cael ei gydbwyso yn erbyn y gofyniad i warchod rhai mathau o wybodaeth, megis data personol, lle gallai dadlennu’r wybodaeth niweidio neu ragfarnu buddiannau penodol. Oherwydd hyn, mae Rhan II y Cod yn disgrifio’r categorïau o wybodaeth y gellid eu celu oni bai fod lles y cyhoedd yn ystyriaeth bwysicach na’r niwed neu’r rhagfarn sy’n debygol o ddeillio o’r dadlennu. Bydd penderfynu pa wybodaeth sydd i’w dadlennu yn cael ei ddirprwyo i’r swyddogion, gyda chanllawiau ychwanegol ar ddehongli’r Cod yn cael eu drafftio. Bydd y penderfyniadau yn cael eu hadolygu, a sefydlir trefn gwyno ffurfiol lle’r anghytunir â’r penderfyniadau.

We need to be aware that this Code applies to information held by the Assembly only, including information given to it by others. The Code does not apply to the public bodies sponsored by the Assembly. There is no legislative basis on which we can do this at the moment. However, there is a suggestion that we look at the practicalities of extending this Code to Assembly-sponsored public bodies. This will bring us into line with proposals in the Freedom of Information Bill, which covers these bodies.

Rhaid inni fod yn ymwybodol mai i wybodaeth a gedwir gan y Cynulliad yn unig y mae’r Cod hwn yn berthnasol, a bod hynny’n cynnwys gwybodaeth a geir gan eraill. Nid yw’r Cod yn cynnwys cyrff cyhoeddus a noddir gan y Cynulliad. Nid oes sail ddeddfwriaethol i’n galluogi ni i wneud hynny ar hyn o bryd. Fodd bynnag, mae yna awgrym y dylem edrych ar y posibilrwydd o ymestyn y Cod i gynnwys cyrff cyhoeddus a noddir gan y Cynulliad. Bydd hynny’n gydnaws â’r cynigion yn y Mesur Rhyddid Gwybodaeth, sy’n cynnwys y cyrff hyn.

This Code represents a significant step forward in introducing a freedom of information regime, which gives the public genuine access to a wide range of information with which people can test the decisions that we, as an institution, make, and which affect their daily lives. I therefore urge the Assembly to adopt the Code as drafted, and also to agree that officials should consider the merits of asking Assembly-sponsored bodies to follow the Code.

Mae’r Cod yn gam sylweddol tuag at gyflwyno cyfundrefn rhyddid gwybodaeth. Bydd yn galluogi’r cyhoedd i weld ystod eang o wybodaeth y gellir ei defnyddio i roi prawf ar y penderfyniadau a wnawn ni, fel sefydliad—penderfyniadau sy’n effeithio ar eu bywydau beunyddiol. Anogaf y Cynulliad felly i fabwysiadu’r Cod fel y’i drafftiwyd, a hefyd i gytuno bod y swyddogion i ystyried ai da o beth fyddai gofyn i gyrff a noddir gan y Cynulliad ddilyn y Cod.

Point of order. Rhodri Morgan and I do not have on our screens the report to which Andrew referred, but Jane Hutt and Jenny Randerson have it on their screens. Apparently, we have been given different information from everybody else.

Mater o drefn. Nid yw’r adroddiad y cyfeiriai Andrew ato ar sgrîn Rhodri Morgan na’m sgrîn i, ond mae ar sgrîn Jane Hutt a Jenny Randerson. Mae’n ymddangos ein bod ni wedi cael gwybodaeth wahanol i bawb arall.

This is a technological point of order. We shall create a class of information technology points of order. There have been difficulties with documents being available on the Chamber touch screens. This has now been rectified. If Members can gently log off and then log on again, we should be all right.

Mater o drefn dechnolegol yw hyn. Byddwn yn creu dosbarth arbennig o faterion o drefn sy’n ymwneud â thechnoleg gwybodaeth. Bu anawsterau gyda’r dogfennau sydd ar gael ar sgriniau cyffwrdd y Siambr ond maent wedi eu datrys erbyn hyn. Os gwnaiff yr Aelodau allgofnodi’n ysgafn ac yna fewngofnodi eto, dylem fod yn iawn.

I have a question for Andrew Davies on the presentation he has just made. The Code of Practice relates to information that is publicly available. Yesterday, however, the press and media had considerable difficulty in getting access to working documents that are relevant to our discussions here. Can I assume, therefore, that a code of practice of this sort, would cover the needs and requirements of the press and media, which take an active interest in the work of this Chamber. As a matter of principle they should generally have access to any information that comes through to us on the IT system, unless there is a good reason for them not to have it.

Mae gennyf gwestiwn i Andrew Davies ar y cyflwyniad y mae newydd ei wneud. Mae’r Cod Ymarfer yn sôn am wybodaeth sydd ar gael i’r cyhoedd. Ddoe, fodd bynnag, cafodd y wasg a’r cyfryngau gryn anhawster i gael gweld dogfennau gwaith sy’n berthnasol i’n trafodaethau ni yma. A gaf i dybio, felly, y byddai cod ymarfer fel hwn yn cynnwys anghenion a gofynion y wasg a’r cyfryngau, sy’n cymryd diddordeb byw yng ngwaith y Siambr hon. Fel mater o egwyddor, dylent allu gweld unrhyw wybodaeth sy’n dod drwodd i ni ar y system TG, oni bai fod rheswm da dros atal hynny.

The point Dafydd makes is a good one. It has taken an enormous amount of hard work and preparation by officials and technical staff to prepare the systems and the Assembly to the high level that we found when we first arrived. A lot of new ground has been broken. I understand that the press has had some difficulty gaining access to documents and information, and that Members have also come across problems.

Mae pwynt Dafydd yn un da. Mae’r swyddogion a’r staff technegol wedi gweithio’n aruthrol o galed i baratoi’r systemau a’r Cynulliad i’r lefel uchel a oedd yn ein disgwyl pan gyraeddasom yma gyntaf. Torrwyd llawer o dir newydd. Yr wyf yn deall bod y wasg wedi cael anhawster i weld rhai dogfennau a chael gafael ar wybodaeth, a bod yr Aelodau hefyd wedi cael problemau.

Some of that has been to do with the technology and also the fact that the systems are new. I can certainly assure Dafydd that it is our intention to smooth out the wrinkles in the availability of information to the press, the public, and particularly to Members. I do not think that the document before us contradicts anything that he has said. Practical wrinkles are getting in the way. Should it turn out to be more than that, I will then be happy to discuss those matters.

Mae peth o hynny i’w briodoli i’r dechnoleg a hefyd i’r ffaith bod y systemau’n newydd. Gallaf roi sicrwydd pendant i Dafydd ein bod yn bwriadu datrys unrhyw anawsterau o ran darparu gwybodaeth i’r wasg, y cyhoedd, ac yn enwedig i’r Aelodau. Ni thybiaf fod y ddogfen gerbron yn gwrth-ddweud unrhyw beth a ddywedodd ef. Anawsterau ymarferol yw’r rhwystrau. Os gwelir bod rhywbeth mwy na hynny, byddaf yn barod wedyn i drafod y materion hynny.

We are in a new situation. Therefore, the more we talk about problems as they arise, with good will and the intention of trying to solve them, the more that will help the positive development of the Assembly. It is my intention to meet the party leaders on a regular basis to make sure that all of us are able to do our jobs properly.

Yr ydym mewn sefyllfa newydd. Felly, po fwyaf y sonnir am broblemau wrth iddynt godi, gydag ewyllys da a’r bwriad o geisio’u datrys, mwyaf oll y bydd hynny’n helpu datblygiad cadarnhaol y Cynulliad. Bwriadaf gwrdd ag arweinwyr y pleidiau’n rheolaidd i wneud yn siŵr bod pob un ohonom yn gallu gwneud ein gwaith yn iawn.

This will back up the work of the Business Committee. We will therefore find informal ways of making sure that those problems, when they arise, can be discussed as quickly as possible.

Bydd hyn yn gefn i waith y Pwyllgor Busnes. Byddwn, felly, yn canfod ffyrdd anffurfiol o sicrhau bod y problemau hynny, pan godant, yn cael eu trafod cyn gyflymed â phosibl.

I was interested to hear the Business Manager say that there was a public interest involved in this, and that in certain cases the public interest would demand that information be made available. Forgive me if I have missed that in the actual Code of Practice. However, if that principle is going to be included, will it be enshrined or put down in words? And will it be done by the time the Ombudsman or administrator—who after all will have the responsibility of deciding whether particular pieces of information should be made public or not—comes to consider his or her work. I would like some information on it.

Diddorol i mi oedd clywed y Trefnydd Busnes yn dweud bod lles y cyhoedd yn elfen yn hyn, ac y byddai lles y cyhoedd yn mynnu bod gwybodaeth yn cael ei dadlennu mewn rhai achosion. Maddeuwch imi os wyf wedi methu hynny yn y Cod Ymarfer ei hun. Fodd bynnag, os yw’r egwyddor hon i gael ei chynnwys, a fydd yn cael ei hymgorffori neu ei nodi mewn geiriau? Ac a wneir hynny mewn pryd erbyn i’r Ombwdsmon neu’r gweinyddwr—a fydd wedi’r cyfan yn gyfrifol am benderfynu a ddylid rhyddhau darnau penodol o wybodaeth i’r cyhoedd ai peidio—ystyried ei waith ef neu hi. Hoffwn gael gwybodaeth ar hyn.

I welcome the principle set out in paragraph 1.6 of this Code of Practice. There is, however, a notable omission. Hundreds of thousands of people in Wales today have access to the Internet at home or at work, and hundreds more are connected each day. Sometimes the technology even works.

Croesawaf yr egwyddor a nodwyd ym mharagraff 1.6 o’r Cod Ymarfer hwn. Fodd bynnag, mae un elfen amlwg wedi ei gadael allan. Mae cannoedd o filoedd o bobl yng Nghymru heddiw yn gallu cysylltu â’r Rhyngrwyd, gartref neu yn y gwaith, ac mae cannoedd yn fwy yn cysylltu bob dydd. Mae’r dechnoleg hyd yn oed yn gweithio weithiau.

I believe that an additional principle of electronic dissemination should have been added to this Code. Every document published by the Assembly should also appear on our website without exception. Simple publication is not enough. The register of interests for Members of the European Parliament is a published document. However, to inspect it, you have to travel to Strasbourg and locate the correct office, to discover it is available only in the language of the Member concerned.

Credaf y dylid bod wedi cynnwys egwyddor ychwanegol, sef lledaenu electronig, yn y Cod hwn. Dylai pob dogfen a gyhoeddir gan y Cynulliad ymddangos, yn ddiwahân, ar ein gwefan. Nid yw cyhoeddi’n unig yn ddigon. Mae cofrestr buddiannau Aelodau Senedd Ewrop yn ddogfen sy’n cael ei chyhoeddi. Fodd bynnag, er mwyn ei gweld, rhaid i chi deithio i Strasbourg a dod o hyd i’r swyddfa iawn, ac yna canfod mai dim ond yn iaith yr Aelod dan sylw y mae ar gael.

That is an example of how not to do it. We must use the power of the Internet to make our business instantly available on computers from Patagonia to Pen-sarn. In short, a digital democracy for a wired Wales.

Dyna i ni enghraifft o sut i beidio â gwneud pethau. Rhaid i ni ddefnyddio grym y Rhyngrwyd i sicrhau bod ein busnes ar gael ar amrantiad ar gyfrifiaduron o Batagonia i Ben-sarn. Yn fyr, democratiaeth ddigidol i Gymru wedi ei gwifro.

I am not entirely sure of the point that John Marek was making. Perhaps it would be easier if I invite him to discuss his concerns separately, and if they are of general interest then we can come back to them.

Nid wyf yn gwbl siŵr ynghylch y pwynt yr oedd John Marek yn ei wneud. Hwyrach y byddai’n haws pe bawn yn ei wahodd i drafod ei bryderon yn unigol, ac os ydynt o ddiddordeb cyffredinol gallwn ddod yn ôl atynt.

The Business Manager indicated the underlying principles of the document. This means that we need to balance the public interest of various sorts. Without looking at individual cases, there are sometimes pieces of information which immediately ought to be in the public domain. There are other pieces of information which need to be given context in being brought forward. The document itself seeks to underpin the general principle that information should be in the public domain to the greatest extent possible.

Cyfeiriodd y Trefnydd Busnes at yr egwyddorion sy’n sail i’r ddogfen. Mae hyn yn golygu bod gofyn i ni gydbwyso buddiannau cyhoeddus o amrywiol fathau. Heb edrych ar achosion unigol, mae yna weithiau ddarnau o wybodaeth a ddylai fod yn eiddo i’r cyhoedd ar unwaith. Mae yna ddarnau eraill o wybodaeth y dylid eu cyflwyno yn eu cyd-destun. Mae’r ddogfen ei hun yn ceisio atgyfnerthu’r egwyddor gyffredinol y dylai gwybodaeth fod yn eiddo i’r cyhoedd i’r graddau helaethaf posibl.

I agree with Alun Pugh about the electronic dissemination of information. Indeed, we have sought to do that. For instance, we have attempted to make documents published by the Welsh Office and Goverment in general available on the appropriate website. We have also attempted to link websites in order that access to government information is maximised.

Cytunaf gydag Alun Pugh am ledaenu gwybodaeth yn electronig. Yn wir, yr ydym wedi ceisio gwneud hynny. Er enghraifft, yr ydym wedi ceisio darparu dogfennau a gyhoeddir gan y Swyddfa Gymreig a’r Llywodraeth yn gyffredinol ar y wefan briodol. Yr ydym hefyd wedi ceisio cydgysylltu â gwefannau eraill fel bod pobl yn gallu gweld cymaint â phosibl o wybodaeth y llywodraeth.

Government has perhaps been slower than others in achieving this. That point is underlined when we look at the way new ground has, and is, being broken in the availability of electronic systems in this Chamber, and their availability to Members of this Assembly.

Efallai i’r Llywodraeth fod yn arafach nag eraill yn cyflawni hyn. Tanlinellir y pwynt hwnnw o edrych ar y ffordd y mae tir newydd wedi ei dorri, ac yn cael ei dorri, o safbwynt y systemau electronig sydd ar gael yn y Siambr hon, a’u bod ar gael i Aelodau’r Cynulliad.

What becomes immediately clear is that—whereas the systems are theoretically perfect—in practice there are problems. Systems do not always work quite as intended, and some of us manage to operate them in a way which produces results that are less than perfect. The general principle that he has enunciated is the right one. Indeed, the use of information technology and its availability is one of the crosscutting issues that the Assembly will need to address.

Yr hyn sy’n dod yn eglur ar unwaith yw—er bod y systemau’n berffaith yn ddamcaniaethol—fod yna broblemau ymarferol. Nid yw systemau bob amser yn gweithio fel y bwriadwyd iddynt, ac mae rhai ohonom yn llwyddo i’w defnyddio mewn ffordd sy’n cynhyrchu canlyniadau llai na pherffaith. Mae’r egwyddor gyffredinol a leisiwyd ganddo yn iawn. Yn wir, mae defnyddio technoleg gwybodaeth a sicrhau ei bod ar gael yn un o’r materion trawsbynciol y bydd gofyn i’r Cynulliad roi sylw iddo.

When we return to the question of crosscutting issues, I intend to place a responsibility within the Cabinet, and therefore within one of the Committees of the Assembly. We will then be able to decide how to deal with that type of issue.

Pan ddown eto i ystyried materion trawsbynciol, bwriadaf neilltuo cyfrifoldeb o fewn y Cabinet, ac felly gydag un o Bwyllgorau’r Cynulliad. Gallwn wedyn benderfynu sut i ddelio â’r math hwn o fater.

I have a reservation about category 6 of the Code and I am surprised that it has not been noticed hitherto. If colleagues look at category 6, they will see that there is a catch-all justifying the withholding of information on the basis that it is:

Yr wyf yn amheus ynglŷn â chategori 6 y Cod ac yr wyf yn synnu na sylwyd arno ynghynt. Pe bai fy nghyd-aelodau yn edrych ar gategori 6, fe welant fod yna gymal dal-popeth sy’n cyfiawnhau celu gwybodaeth ar y sail ei bod yn:

‘information whose disclosure is likely to compromise the effectiveness of the Assembly Cabinet’s deliberative process or that of Assembly Secretaries or Assembly Staff in carrying out functions delegated to them.’

‘wybodaeth a fyddai, o’i datgelu, yn debyg o gyfaddawdu effeithiolrwydd proses drafod Cabinet y Cynulliad neu effeithiolrwydd Ysgrifenyddion y Cynulliad neu Staff y Cynulliad wrth gyflawni’r swyddogaethau a ddirprwywyd iddynt.’

There is no attempt at actually describing or defining it, or saying under what circumstances it would apply. It does seem to be a considerable catch-all phrase to justify the withholding of information.

Ni wneir unrhyw ymgais i’w ddisgrifio na’i ddiffinio, nac i ddweud o dan ba amgylchiadau y byddai’n berthnasol. Mae’n ymddangos ei fod yn gymal dal-popeth sylweddol i gyfiawnhau celu gwybodaeth.

One issue that arises is the way in which protection of information is undertaken. I wholeheartedly underline the commitment of the Business Manager. We should make information available wherever possible and there would have to be good reason for withholding it. In addition to the opening statement of the category, there are sub-divisions that indicate the type of material we are discussing. If one is trying to make progress on issues that involve other assemblies, or matters that are being discussed with Ministers in the UK Government, one needs to make sure that those exchanges can be as frank and as open as possible and not feel that they will become stilted and unproductive because every piece and comment has to be made public immediately. I am sure the Assembly will accept that there is a good reason for having category 6. It must not be abused and it is not my intention or that of any other member of the Assembly Cabinet to misuse it.

Un mater sy’n codi yw’r ffordd yr eir ati i warchod gwybodaeth. Hoffwn ategu ymrwymiad y Trefnydd Busnes i’r eithaf. Dylem ryddhau gwybodaeth pa bryd bynnag y mae hynny’n bosibl a byddai’n rhaid cael rheswm da dros gelu gwybodaeth. Yn ychwanegol at ddatganiad agoriadol y categori, mae yna is-adrannau sy’n nodi’r math o ddeunydd yr ydym yn ei drafod. Os ydym yn ceisio symud ymlaen ar faterion sy’n cynnwys cynulliadau eraill, neu faterion sy’n cael eu trafod gyda Gweinidogion yn Llywodraeth y DU, mae gofyn bod yn siŵr y gall y trafodaethau hynny fod mor blaen ac agored â phosibl heb deimlo y byddant yn mynd yn herciog ac anghynhyrchiol am fod yn rhaid rhyddhau pob darn a sylw i’r cyhoedd ar unwaith. Yr wyf yn siŵr y bydd y Cynulliad yn derbyn bod yna reswm da dros gael categori 6. Rhaid peidio â’i gamddefnyddio ac nid wyf fi nac unrhyw aelod arall o Gabinet y Cynulliad yn bwriadu ei gamddefnyddio.

I accept the point that Alun has taken in respect of (a), (b) and (c). However, I do think that category 6 is very broadly drawn. Having brought it to the attention of the Assembly, I accept the assurance from the First Secretary that it will not be used without good reason. I hope the Assembly will record that I have voiced some reservations about this. It might also be necessary to return to this if the system is being abused.

Yr wyf yn derbyn pwyntiau Alun yng nghyswllt (a), (b) ac (c). Fodd bynnag, teimlaf fod categori 6 wedi ei lunio’n eang iawn. Gan fy mod wedi ei ddwyn i sylw’r Cynulliad, derbyniaf y sicrwydd gan y Prif Ysgrifennydd na chaiff ei ddefnyddio heb reswm da. Gobeithiaf y bydd y Cynulliad yn cofnodi i mi leisio rhai amheuon am hyn. Efallai y bydd yn rhaid dychwelyd at hyn os bydd y system yn cael ei chamddefnyddio.

This is a new institution and its principles are based upon honesty, integrity, openness and transparency, as well as accountability. We must have Members that are bound by those principles. In these post-Nolan times, it is important that our proceedings are open, honest and democratic. The way we carry out our functions and activities has to be according to these highest principles. It is, therefore, very important that we as Members, declare our interests and that those interests are registered.

Mae hwn yn sefydliad newydd gyda’i egwyddorion wedi eu seilio ar onestrwydd, unplygrwydd, bod yn agored a thryloyw, yn ogystal â bod yn atebol. Rhaid inni wrth Aelodau sy’n arddel yr egwyddorion hyn. Yn y cyfnod ôl-Nolan hwn, mae’n bwysig bod ein trafodion yn agored, gonest a democrataidd. Rhaid i ni gyflawni ein swyddogaethau a’n gweithgareddau yn unol â’r egwyddorion uchaf hyn. Felly, mae’n bwysig iawn ein bod ni fel Aelodau yn datgan ein buddiannau a bod y buddiannau hynny’n cael eu cofrestru.

William Graham spoken in English p. 28

William Graham siaradwyd yn Saesneg t. 28

I draw Members’ attention to category 11, paragraph 1.31 that decrees that membership of the freemasons must be registered. I am not a freemason, nor am I the son of a freemason. As far as I am aware, no member of the Conservative Group is a freemason. I understand that when these rules were drawn up, the commissioners omitted this reference and that it was included at the request of the First Secretary. In a free and inclusive society, surely all are permitted to join societies and clubs according to law, without risk of scrutiny or further questioning. In my personal experience as a lay magistrate, the Lord Chancellor made inquiry of us all. This was done in a slightly different way and we did not have to make a reply. Would the First Secretary undertake to give to this Assembly, or the appropriate Committee, information of an evidential nature as to why freemasonry should be so prescribed?

Tynnaf sylw’r Aelodau at gategori 11, paragraff 1.31, sy’n dyfarnu bod yn rhai cofrestru aelodaeth o’r seiri rhyddion. Nid wyf yn aelod, ac nid wyf ychwaith yn fab i aelod. Hyd y gwn i, nid oes yr un aelod o’r Grŵp Ceidwadol yn saer rhydd. Yn ôl a ddeallaf, pan luniwyd y rheolau hyn, nid oedd y cyfeiriad hwn wedi ei gynnwys gan y comisiynwyr ac fe’i cynhwyswyd ar gais y Prif Ysgrifennydd. Mewn cymdeithas rydd a chynhwysol, siawns nad oes hawl gan bawb i ymuno â chymdeithasau a chlybiau yn ôl y gyfraith, heb risg o archwiliad neu holi pellach. Yn fy mhrofiad personol i fel ynad lleyg, cafodd pob un ohonom ymholiad oddi wrth yr Arglwydd Ganghellor. Aed ati i wneud hynny mewn modd fymryn yn wahanol, ac nid oedd rhaid inni ateb. A wna’r Prif Ysgrifennydd addo rhoi i’r Cynulliad hwn, neu’r Pwyllgor priodol, wybodaeth o natur dystiolaethol i egluro pam y mae aelodaeth o’r seiri rhyddion wedi ei dyfarnu fel hyn?

I feel that a declaration of this kind is possibly a slippery slope. We know the lessons of history. For some curious reason, freemasonry has been prescribed not only by the Roman Church but also by the Nazis and in Communist countries. I would not like to think that we are embarking on a register that is to be so inclusive that it will be necessary to declare membership of other charitable bodies. Perhaps in the future we may need to declare whether we are members of Rotary, the Women’s Institute, the Honourable Society of Cymmrodorion, or even the Pony Club. I know that something to do with an oath is part of this problem and I believe that that is given by both Scouts and Guides. I would like the First Secretary to look again at this measure.

Teimlaf fod datganiad fel hwn o bosibl yn llethr lithrig. Gwyddom wersi hanes. Am ryw reswm rhyfedd, cafodd y seiri rhyddion eu dyfarnu nid yn unig gan Eglwys Rufain ond hefyd gan y Natsïaid ac mewn gwledydd Comiwnyddol. Ni fynnwn feddwl ein bod yn sefydlu cofrestr a fydd mor gynhwysol fel y bydd yn rhaid datgan aelodaeth o gyrff elusennol eraill. Yn y dyfodol, hwyrach y bydd yn rhaid datgan a ydym yn aelodau o’r Rotari, Sefydliad y Merched, Cymdeithas Anrhydeddus y Cymmrodorion, neu hyd yn oed y Clwb Merlod. Gwn fod rhywbeth i’w wneud â llw yn rhan o’r broblem hon a chredaf fod y Sgowtiaid a’r Geidiaid yn gwneud hynny. Hoffwn i’r Prif Ysgrifennydd edrych eto ar y mesur hwn.

In responding to this, the First Secretary may wish to bear in mind the experience of the National Assembly Advisory Group when we consulted on this matter. When consulting in Wales, we did not receive any objections from freemasons to freemasonry being declared an interest. We did, however, receive a letter from a senior figure in freemasonry in London. While these discussions were going on, I took part in a radio phone-in programme, where it was clear that the host of the programme hoped we were going to have numerous outraged freemasons phoning in, saying that their privacy was to be breached. On the contrary, we had numerous happy freemasons phoning in saying that they were more than happy to declare their membership of what they regarded as an honourable and charitable organisation.

Wrth ymateb, hwyrach y bydd y Prif Ysgrifennydd am gadw mewn cof brofiad Grŵp Ymgynghorol y Cynulliad Cenedlaethol wrth inni ymgynghori ynghylch y mater hwn. Wrth ymgynghori yng Nghymru, ni chawsom unrhyw wrthwynebiad oddi wrth seiri rhyddion i ddatgan eu haelodaeth fel buddiant. Fodd bynnag, derbyniwyd llythyr oddi wrth uwch aelod o’r seiri rhyddion yn Llundain. Tra oedd y trafodaethau ar y gweill, bûm ar raglen radio lle’r oedd y gwrandawyr yn ffonio i mewn. Yr oedd yn amlwg bod arweinydd y rhaglen yn gobeithio y byddai seiri rhyddion yn ffonio i mewn, yn flin bod eu preifatrwydd yn cael ei dorri. I’r gwrthwyneb, ffoniodd sawl saer rhydd gan ddweud eu bod yn fwy na pharod i ddatgan eu haelodaeth o’r hyn sydd yn eu barn hwy yn sefydliad anrhydeddus ac elusennol.

During the consultation we were concerned about what was perceived as a secret society having had excessive influence in the past upon certain sections of Welsh public life. We received wide support from members of the public in Wales. On behalf of Plaid Cymru—the Party of Wales, we believe that the First Secretary’s decision in his capacity as Secretary of State not to accept the guidance of the Standing Orders Commission on this matter, but to accept the original advice of the National Assembly Advisory Group, was both acceptable and appropriate.

Yn ystod yr ymgynghori, yr oeddem yn bryderus bod cymdeithas sydd, yn ôl pob golwg, yn gymdeithas gudd wedi cael dylanwad gormodol ar rai carfanau o fywyd cyhoeddus Cymru yn y gorffennol. Cawsom gefnogaeth eang o blith y cyhoedd yng Nghymru. Ar ran Plaid Cymru—the Party of Wales, credwn fod penderfyniad y Prif Ysgrifennydd i beidio â derbyn arweiniad y Comisiwn Rheolau Sefydlog ar y mater hwn, ond i dderbyn cyngor gwreiddiol Grŵp Ymgynghorol y Cynulliad Cenedlaethol, yn dderbyniol a phriodol.

I am grateful for those last comments. Helen Mary underlines the fact that the National Assembly Advisory Group did recommend that a declaration of membership of the freemasons should be part of the requirements. As the Member who raised the question said, it was not part of the recommendations that came from the Commissioners on Standing Orders. I therefore had to look at the two and I felt it was right that the requirement to register membership of the freemasons should be in the requirements put forward to this Assembly. That is why they are there. People are permitted to join but they are not permitted to be free of scrutiny. If you wish to consider evidence, I would refer anybody who is interested in this issue to the report of the Home Affairs Select Committee of the House of Commons. The acceptance of this by the Home Secretary led to the issues being looked at in relation to the Criminal Justice System as a whole, in the way that has been referred to. In deciding on the stance of the Assembly, we should strive for the highest standards in public service. At the moment the requirement to declare membership of the freemasons only applies to some public offices. Following the report from the Home Affairs Select Committee we are clearly moving forward and this Assembly should be at the forefront of the higher standards of public service. I therefore urge the Assembly to accept the requirements set out in this Paper, including Category 11.

Yr wyf yn ddiolchgar am y sylwadau olaf yna. Mae Helen Mary yn tanlinellu’r ffaith i Grŵp Ymgynghorol y Cynulliad Cenedlaethol argymell y dylai datgan aelodaeth o’r seiri rhyddion fod yn rhan o’r gofynion. Fel y dywedodd yr Aelod a gododd y cwestiwn, nid oedd yn rhan o’r argymhellion a ddaeth oddi wrth y Comisiynwyr ar Reolau Sefydlog. Yr oedd yn rhaid i mi felly edrych ar y naill a’r llall a theimlwn mai priodol oedd cynnwys y gofyniad i gofrestru aelodaeth o’r seiri rhyddion yn y gofynion a gyflwynir i’r Cynulliad hwn. Dyna pam y maent yma. Caniateir i bobl ymuno ond ni chaniateir hynny heb archwiliad. Os hoffech ystyried y dystiolaeth, byddwn yn cyfeirio sylw unrhyw un sydd â diddordeb yn y mater at adroddiad Pwyllgor Dethol Materion Cartref Tŷ’r Cyffredin. Am i’r Ysgrifennydd Cartref dderbyn yr adroddiad, aed ati i ystyried y materion hyn o safbwynt y System Cyfiawnder Troseddol yn ei chyfanrwydd, yn y ffordd y cyfeiriwyd ati. Wrth benderfynu ar safbwynt y Cynulliad, dylem ymgyrraedd at y safonau uchaf mewn gwasanaeth cyhoeddus. Ar hyn o bryd dim ond mewn rhai swyddi cyhoeddus y mae’n rhaid datgan aelodaeth o’r seiri rhyddion Yn dilyn adroddiad y Pwyllgor Dethol ar Faterion Cartref, yr ydym yn amlwg yn symud ymlaen a dylai’r Cynulliad hwn fod ar y blaen ynghylch arddel safonau uwch mewn gwasanaeth cyhoeddus o’r dechrau. Yr wyf felly yn annog y Cynulliad i dderbyn y gofynion a nodwyd yn y Papur hwn, gan gynnwys Categori 11.

This Assembly is a unique body as there is no separation between the Legislature and the Executive. The Civil Service, therefore, is in the unusual position of working for the Assembly as a body, unlike in the House of Commons where they work for the Executive. The Assembly must make a difference. However important the deliberations of Members in this Chamber and in Committees, they will not, in themselves, make that difference.

Mae’r Cynulliad hwn yn gorff unigryw gan nad oes rhaniad rhwng y Ddeddfwrfa a’r Adran Weithredol. Mae’r gwasanaeth sifil, felly, yn y sefyllfa anarferol o weithio gyda’r Cynulliad fel corff, yn wahanol i Dŷ’r Cyffredin lle maent yn gweithio i’r Adran Weithredol. Rhaid i’r Cynulliad wneud gwahaniaeth. Pa mor bwysig bynnag yw trafodaethau’r Aelodau yn y Siambr hon ac mewn Pwyllgorau, ni fyddant, ohonynt eu hunain, yn gwneud gwahaniaeth.

The Assembly has a small staff, less than half the staff of the Scottish Office. We must make the most effective use of staff if we are to meet our promises. The Assembly’s staff are all civil servants, which means that they are part of the British Civil Service and are bound by the Civil Service Code—copies of which are available on the Intranet. All staff work for the Assembly and some work specifically for the Members in providing guidance, briefing, translation and committee support—to name just some of the areas. The staff who carry out those functions will, therefore, take instructions from the Assembly Cabinet and the Secretaries responsible for their subjects in terms of the powers of the Cabinet and the First Secretary. This is the most effective way to execute our decisions, given the scarce resources at our disposal. As I mentioned, this is a new institution and the Civil Service will have to adapt to the way in which it works, and to the Assembly’s new inclusive style.

Nifer fechan o aelodau staff sydd gan y Cynulliad, llai na hanner staff Swyddfa’r Alban. Rhaid inni wneud y defnydd mwyaf effeithiol o’r staff os ydym i gyflawni ein haddewidion. Gweision sifil yw staff y Cynulliad i gyd, sy’n golygu eu bod yn rhan o Wasanaeth Sifil Prydain, wedi eu rhwymo gan God y gwasanaeth sifil—ceir copïau ohono ar y Fewnrwyd. Mae’r staff i gyd yn gweithio i’r Cynulliad ac mae rhai’n gweithio’n benodol i’r Aelodau, yn rhoi arweiniad, cyfarwyddyd, cyfieithiadau a chefnogaeth pwyllgora—i enwi dim ond rhai o’r meysydd. Bydd y staff sy’n cyflawni’r swyddogaethau hynny, felly, yn cael cyfarwyddiadau gan Gabinet y Cynulliad a’r Ysgrifenyddion sy’n gyfrifol am eu pynciau, yn unol â phwerau’r Cabinet a’r Prif Ysgrifennydd. Dyma’r ffordd fwyaf effeithiol inni roi ein penderfyniadau ar waith, o gofio’r adnoddau prin sydd gennym. Fel y soniais, mae hwn yn sefydliad newydd a bydd yn rhaid i’r Gwasanaeth Sifil addasu i’w ffordd o weithio, ac i arddull gynhwysol newydd y Cynulliad.

As officials in the Assembly, they will also be working with colleagues in Whitehall. If the Assembly is to keep up with and move ahead of policy developments in the rest of the UK, its staff must be given access to the huge information source in Whitehall. These documents set out the way in which the staff/Members relationship will work. The staff/Members protocol is a brief statement of principle. It explains the basis on which staff will serve the Assembly and the principles on which we all work as public servants. The Nolan principles of public life are central to this document; we must all work together to follow these principles.

Fel swyddogion yn y Cynulliad, byddant hefyd yn gweithio gyda chydswyddogion yn Whitehall. Os yw’r Cynulliad i gadw ar y blaen â datblygiadau polisi yng ngweddill y DU a symud yn gyflym, rhaid i’w staff allu manteisio ar ffynhonnell gwybodaeth enfawr Whitehall. Y dogfennau hyn sy’n pennu sut y bydd y berthynas rhwng staff ac Aelodau yn gweithio. Datganiad byr o egwyddor yw’r protocol staff/Aelodau. Mae’n egluro ar ba sail y bydd staff yn gwasanaethu’r Cynulliad a’r egwyddorion y mae pawb ohonom yn gweithio iddynt fel gweision cyhoeddus. Mae egwyddorion Nolan ar gyfer bywyd cyhoeddus yn ganolog yma; rhaid i bawb ohonom weithio gyda’n gilydd i ddilyn yr egwyddorion hyn.

Civil servants will also work to their own code, as will Assembly Members and Assembly Secretaries. We must recognise the fact that different staff in this Assembly will carry out different duties. Staff with executive duties, who carry out the functions delegated to the Cabinet and the First Secretary by this Assembly, will take instructions from members of that Cabinet. Civil servants can only give advice to those who have decision-making powers. They can advise the Assembly Secretaries but not individual Assembly Members. The Code on Provision of Information to Assembly Members explains clearly what information is available to Members.

Bydd y gweision sifil hefyd yn gweithio i’w cod eu hunain, fel y bydd Aelodau’r Cynulliad a’r Ysgrifenyddion. Rhaid i ni gydnabod y ffaith y bydd staff gwahanol yn y Cynulliad hwn yn cyflawni dyletswyddau gwahanol. Bydd staff sydd â dyletswyddau gweithredol, sy’n cyflawni’r swyddogaethau a ddirprwywyd i’r Cabinet a’r Prif Ysgrifennydd gan y Cynulliad hwn, yn cymryd cyfarwyddiadau gan aelodau’r Cabinet. Ni all gweision sifil ond rhoi cyngor i’r rheini sydd â’r grym i benderfynu. Gallant roi cyngor i Ysgrifenyddion y Cynulliad ond nid i Aelodau unigol. Mae’r Cod ar Ddarparu Gwybodaeth i Aelodau’r Cynulliad yn esbonio’n glir pa wybodaeth sydd ar gael i’r Aelodau.

There is a huge range of factual information available through the Library, which will provide a confidential and efficient briefing service to all Members. They will be able to access briefing on their constituencies, details of grant schemes, and the latest information on the Assembly’s activities. The Library will also provide a gateway to members of staff. Requests for information on specific topics will be answered by executive staff, and only the Library staff will know who requested that information. Similarly, as its databases fill up, the Intranet will be a key source of information. All supporting papers for plenary committee sessions can be found on the Net, and the issue that Dafydd Wigley raised will be discussed with members of the press later this week. However, if the Assembly is to make the best use of its resources, Members’ access to staff must be limited. The best way, therefore, to ensure a quick and accurate answer is to refer to the Library. Staff are busily carrying out the wishes of the Assembly and its Secretaries. Members requesting information directly from staff would simply delay this work. Given the complexities of many issues, this could lead to an incomplete answer from someone who does not have the full picture.

Mae amrediad enfawr o wybodaeth ffeithiol ar gael drwy’r Llyfrgell, a fydd yn cynnig gwasanaeth briffio cyfrinachol ac effeithlon i’r holl Aelodau. Gallant fanteisio ar gyfarwyddyd am eu hetholaethau, manylion cynlluniau grant, a’r wybodaeth ddiweddaraf am weithgareddau’r Cynulliad. Bydd y Llyfrgell hefyd yn fynedfa at aelodau staff. Y staff gweithredol fydd yn ateb ceisiadau am wybodaeth ar bynciau penodol, a dim ond staff y Llyfrgell fydd yn gwybod pwy a ofynnodd am y wybodaeth. Yn yr un modd, wrth i’w chronfeydd data lenwi, bydd y Fewnrwyd yn ffynhonnell wybodaeth allweddol. Bydd yr holl bapurau cefnogi ar gyfer sesiynau pwyllgorau llawn i’w gweld ar y Rhwyd, a chaiff y mater a godwyd gan Dafydd Wigley ei drafod gyda’r wasg yn ddiweddarach yr wythnos hon. Fodd bynnag, os yw’r Cynulliad i wneud y defnydd gorau o’i adnoddau, rhaid cyfyngu ar gyswllt yr Aelodau â’r staff. Y ffordd orau, felly, i sicrhau ateb cyflym a chywir yw troi at staff y Llyfrgell. Mae’r staff yn gweithio’n ddiwyd i gyflawni dymuniadau’r Cynulliad a’r Ysgrifenyddion. Pe bai Aelodau’n gofyn yn uniongyrchol i staff am wybodaeth, ceid oedi yn y gwaith hwn. O ystyried mor gymhleth yw llawer o faterion, gallai hyn arwain at ateb anghyflawn gan rywun nad yw’n meddu ar y darlun llawn.

This Code, therefore, proposes that Members contact Executive staff at Head of Division level or above, ensuring full and accurate replies to queries covering all the issues. However, this is not an attempt to keep Members away from the Civil Service. There will be regular contact with executive staff through briefings, committees and day-to-day contact. I wish to put on record the work of the staff in the Civil Service and the way in which they have been extremely helpful to Members. However, Members should realise that the job of the Assembly staff is to carry out the Assembly’s functions and that, ultimately, the decisions are taken by those to whom these functions have been delegated.

Mae’r Cod hwn, felly, yn awgrymu bod Aelodau’n cysylltu â staff Gweithredol ar lefel Pennaeth Adran neu’n uwch, gan sicrhau atebion llawn a chywir i ymholiadau sy’n ymdrin â’r holl ystyriaethau. Fodd bynnag, nid ymgais yw hyn i gadw’r Aelodau oddi wrth y gwasanaeth sifil. Ceir cyswllt rheolaidd gyda’r staff gweithredol drwy gyfarfodydd briffio, pwyllgorau a chyswllt beunyddiol. Carwn gofnodi gwaith staff y Gwasanaeth Sifil a’u cymorth parod i’r Aelodau. Fodd bynnag, dylai’r Aelodau sylweddoli mai tasg staff y Cynulliad yw cyflawni swyddogaethau’r Cynulliad a bod penderfyniadau, yn y pen draw, yn cael eu llunio gan y rheini y dirprwywyd y swyddogaethau iddynt.

We have said that we do not wish to replicate the practices of other institutions. This will not be a new Westminster, where Members of Parliament are referred to Ministers if they dare to contact the civil servants. Assembly Members will be able to speak to senior staff to acquire factual information. If there are difficulties, I wish Members to contact me directly. A new partnership is needed in this new body. We are planning a number of partnerships with bodies outside this building—the Partnership Council of Local Government and the Voluntary Sector. We also need a partnership within the Assembly—between the Cabinet and the rest of the Assembly, and between Members and the Assembly staff. These protocols and codes are a vital part of this new partnership and, in that spirit, I commend them to the Assembly.

Yr ydym wedi dweud nad ydym am gopïo arferion sefydliadau eraill. Nid San Steffan newydd a geir yma, lle mae’r Aelodau Seneddol yn gorfod mynd gerbron y Gweinidogion os meiddiant gysylltu â’r gweision sifil. Bydd Aelodau’r Cynulliad yn gallu siarad ag uwch aelodau staff i gael gwybodaeth ffeithiol. Os ceir anawsterau, hoffwn i’r Aelodau gysylltu’n uniongyrchol â mi. Mae angen partneriaeth newydd yn y corff newydd hwn. Mae nifer o bartneriaethau gyda chyrff o’r tu allan i’r adeilad hwn yn yr arfaeth—Cyngor Partneriaeth Llywodraeth Leol a’r Sector Gwirfoddol. Mae angen partneriaeth arnom hefyd o fewn y Cynulliad—rhwng y Cabinet a gweddill y Cynulliad, a rhwng Aelodau a staff y Cynulliad. Mae’r protocolau a’r codau hyn yn rhan holl bwysig o’r bartneriaeth newydd hon ac, yn yr ysbryd hwnnw, yr wyf yn eu hargymell i’r Cynulliad.

I agree with what Andrew has said. I see that there is an advance in this Paper in so far as Members will be able to talk to civil servants. There is, however, a potential point of conflict which is not evident at the present stage, given that there have been no divisive votes. However, this current situation could change. A civil servant’s loyalty is to the Crown. It is a philosophical point as to how that loyalty is exercised and through which channels it goes. I would like to put my reservations regarding this Paper on the record, because I think we will return to this point. A civil servant is, first and foremost, a servant of the Executive. However, there will be times when, as Members of the National Assembly, we will need advice from civil servants. It could, therefore, place them in very difficult positions. I am not trying to denigrate any civil servants; I have no doubt that they will do their jobs well. I emphasise that in most legislatures there are civil servants whose primary loyalties are to the legislature and not to the Executive. The last administration of the Westminster Parliament changed the situation so that people like the Controller and Auditor General were no longer paid from the Government vote but on a cash vote directly from the House of Commons. His loyalty therefore is directly to the House. Our Servants of the House—whose loyalty is to the House and not to the Executive—are paid directly from the votes by the House. We had this argument in the Westminster Parliament and I think it is a serious point to be addressed by the Assembly in the future.

Cytunaf â’r hyn a ddywedodd Andrew. Gwelaf fod y Papur hwn yn gam ymlaen yn yr ystyr y caiff yr Aelodau siarad â’r gweision sifil. Mae yna, fodd bynnag, wrthdaro posibl nad yw’n amlwg ar hyn o bryd, gan na fu unrhyw bleidlais gynhennus. Fodd bynnag, gallai’r sefyllfa bresennol newid. I’r Goron y mae teyrngarwch gwas sifil. Pwynt athronyddol yw sut y mae’r teyrngarwch hwnnw yn cael ei arddel a thrwy ba sianelau yr â. Hoffwn gael cofnodi fy amheuon ynglyn â’r Papur hwn, oherwydd tybiaf y byddwn yn dychwelyd at y pwynt hwn. Mae gwas sifil, yn anad dim, yn was i’r Adran Weithredol. Fodd bynnag, bydd yna adegau pan fydd arnom ni, fel Aelodau’r Cynulliad Cenedlaethol, angen cyngor gan y gweision sifil. Gallai, felly, eu rhoi hwy mewn sefyllfa anodd iawn. Nid wyf yn ceisio pardduo unrhyw weision sifil; yr wyf yn gwbl sicr y gwnânt eu gwaith yn dda. Yr wyf yn pwysleisio bod yna, yn y rhan fwyaf o ddeddfwrfeydd, weision sifil sydd â’u teyrngarwch pennaf i’r ddeddfwrfa yn hytrach nag i’r Adran Weithredol. Newidiodd gweinyddiaeth ddiwethaf Senedd San Steffan y sefyllfa fel nad oedd pobl fel y Rheolwr a’r Archwiliwr Cyffredinol bellach yn cael eu talu o ddyfarniad y Llywodraeth ond drwy ddyfarniad ariannol uniongyrchol o Dŷ’r Cyffredin. Mae Gweision ein Tŷ ni—sydd â’u teyrngarwch i’r Tŷ ac nid i’r Adran Weithredol—yn cael eu talu’n uniongyrchol o ddyfarniadau’r Tŷ. Cawsom y ddadl hon yn Senedd San Steffan a thybiaf ei fod yn bwynt difrifol i’r Cynulliad roi sylw iddo yn y dyfodol.

I wish to explain my reasons. Having read your e-mail this morning, my view is that you cannot refer back specific paragraphs or phrases from the document unless you refer back the whole document. Thank you for that clarification. The difficulty is that, normally, one would have proposed deletion of words, but you cannot do that until you have seen the document. The document has not been available on the Intranet until very recently; it did not appear within the timescale. That makes life slightly more difficult for Members, particularly at this difficult early stage of the Assembly when we set out the turf for the future. This is one of the most thorny issues facing the Assembly, and it stems from a decision not to have separate staff for the Executive and Members. That was an appropriate decision, but it places the Civil Service in a very difficult position. How can staff serve two masters at the same time?

Diolch ichi am yr eglurhad yna. Yr anhawster yw y byddwn, fel arfer, wedi awgrymu dileu geiriau, ond ni ellir gwneud hynny heb weld y ddogfen. Nid oedd y ddogfen hon ar gael ar y Fewnrwyd tan yn ddiweddar iawn; nid ymddangosodd yn unol â’r amserlen. Mae hynny’n gwneud bywyd ychydig yn anos i’r Aelodau, yn enwedig yn nyddiau cynnar y Cynulliad fel hyn wrth i ni osod ein stondin ar gyfer y dyfodol. Mae hwn yn un o’r materion mwyaf pigog sy’n wynebu’r Cynulliad, ac mae’n hanu o’r penderfyniad i beidio â chael staff ar wahân i’r Adran Weithredol a’r Aelodau. Roedd hwnnw’n benderfyniad priodol, ond mae’n rhoi’r Gwasanaeth Sifil mewn sefyllfa anodd iawn. Sut y gall staff wasanaethu dau feistr yr un pryd?

In paragraph 6.2, I find the following phrase objectionable:

Ym mharagraff 6.2, gwrthwynebaf y cymal a ganlyn:

‘executive officials will need to inform their Assembly Secretary of the inquiry, and the inquirer, in order to support the Assembly Cabinet effectively.’

‘bydd angen i swyddogion gweithredol hysbysu eu Hysgrifennydd yn y Cynulliad am yr ymholiad, a phwy sy’n ymholi, er mwyn cefnogi Cabinet y Cynulliad yn effeithiol.’

Paragraph 6.3 states that Assembly Members who wish to have a briefing from a member of the Civil Service can do so only with the agreement of the relevant Assembly Secretary. I also believe that the head of division is too high a level and it would be more appropriate for the paragraph to apply to staff with a salary of £30,000 and above, or head of branch. I believe that this will cause a problem, not only because of the political arithmetic, but in creating a balance between the advice and information service that Members and Assembly Secretaries can receive.

Dywed paragraff 6.3 na all Aelodau o’r Cynulliad sydd am gael cyfarwyddyd gan aelod o’r gwasanaeth sifil ond gwneud hynny gyda chytundeb yr Ysgrifennydd perthnasol. Credaf hefyd fod pennaeth adran yn lefel rhy uchel ac y byddai’n fwy priodol i’r paragraff gyfeirio at staff sydd â chyflog o £30,000 neu fwy, neu bennaeth cangen. Credaf y bydd hyn yn achosi problem, nid yn unig oherwydd y rhifyddeg wleidyddol, ond o ran cael cydbwysedd rhwng y gwasanaeth cyngor a gwybodaeth y gall Aelodau ac Ysgrifenyddion y Cynulliad ei gael.

For the vast majority of Members in this Assembly, the Code will virtually require Members to obtain their information through the Library. Therefore, Members will receive only written information. If you wanted information from a civil servant, face to face, that information and the nature of the inquiry would be passed to the Assembly Secretary. You would also have to obtain permission to speak to more than one Member at a time. Information is crucial in this Assembly to help us make up our minds, and written information often requires clarification or further explanation. A few words over the phone might make all the difference in understanding the complexity of issues, and the way in which they arise. Therefore, the problem lies with the original decision not to have independent staff. I mentioned this matter when we, the Liberal Democrats, were briefed by civil servants before the elections. At that time, the Civil Service struggled to understand how they could serve both masters at the same time. I believe that the paragraphs tie the hands of Assembly Members who are not members of the Assembly Cabinet. The outnumbering is quite obvious—20 staff in the Library to 2,000 staff in the Civil Service in the current Welsh Office. I believe that we must re-examine this matter in order to create the right balance of information flow.

I fwyafrif helaeth yr Aelodau yn y Cynulliad hwn, bydd y Cod i bob diben yn mynnu bod yr Aelodau’n cael eu gwybodaeth drwy’r Llyfrgell. Dim ond gwybodaeth ysgrifenedig y bydd yr Aelodau yn ei derbyn, felly. Pe baech am gael gwybodaeth gan was sifil, wyneb-yn-wyneb, câi’r wybodaeth honno a natur yr ymholiad eu trosglwyddo i Ysgrifennydd y Cynulliad. Byddai’n rhaid hefyd i chi gael caniatâd i siarad â mwy nag un Aelod ar y tro. Mae gwybodaeth yn hanfodol yn y Cynulliad hwn i’n helpu i benderfynu, ac mae gofyn cael eglurhad neu esboniad pellach ar wybodaeth ysgrifenedig yn aml. Gallai ychydig eiriau dros y ffôn wneud byd o wahaniaeth wrth ddeall cymhlethdodau materion, a’r ffordd y maent yn codi. Mae’r broblem yn deillio felly o’r penderfyniad gwreiddiol i beidio â chael staff annibynnol. Soniais am y mater hwn pan oeddem ni, y Democratiaid Rhyddfrydol, yn cael ein briffio gan weision sifil cyn yr etholiadau. Bryd hynny, roedd y Gwasanaeth Sifil yn ei chael hi’n anodd dirnad sut y gallent wasanaethu’r ddau feistr yr un pryd. Credaf fod y paragraffau yn clymu dwylo Aelodau’r Cynulliad nad ydynt yn aelodau o’r Cabinet. Mae’r anghydbwysedd yn gwbl amlwg—20 o staff yn y Llyfrgell o’i gymharu â 2,000 yn y Gwasanaeth Sifil yn y Swyddfa Gymreig ar hyn o bryd. Credaf fod yn rhaid i ni edrych eto ar y mater hwn i greu’r cydbwysedd priodol yn llif y wybodaeth.

If I ask my standard question about flood schemes on the River Taff, I need to find more information about the number of opportunities there have been to put that matter right and how the Environmental Agency has dealt with the problem. I do not wish to keep putting that in writing every time I want information. It is far easier to deal directly with someone, but the confidentiality of that information is prejudiced by these paragraphs. In my view, that matter should be of great concern to the majority of people in this Assembly. If we are intent on being inclusive—including everybody inside the circle of information—the paragraphs would prejudice that information. I hope that the First Secretary will re-examine this issue which is crucial to Assembly Members’ performance. I agree that there have to be safeguards but those are not apparent. This is a one-sided document. I hope that the First Secretary will reconsider the matter and respond with something slightly more substantial.

Os gofynnaf fy nghwestiwn safonol am gynlluniau llifogydd ar afon Taf, mae arnaf angen cael mwy o wybodaeth am nifer y cyfleoedd a fu i unioni’r mater a sut y mae Asiantaeth yr Amgylchedd wedi delio â’r broblem. Nid wyf am barhau i orfod nodi hyn ar bapur bob tro yr wyf am gael gwybodaeth. Mae’n llawer haws delio’n uniongyrchol â rhywun, ond mae cyfrinachedd y wybodaeth yn cael ei rhagfarnu gan y paragraffau hyn. Yn fy marn i, dylai hynny fod o bwys mawr i fwyafrif y bobl yn y Cynulliad hwn. Os ydym am fod yn gynhwysol—gan gynnwys pawb yn y cylch gwybodaeth—byddai’r paragraffau yn rhagfarnu’r wybodaeth honno. Gobeithiaf y bydd y Prif Ysgrifennydd yn edrych eto ar y mater hwn sydd mor hanfodol i berfformiad Aelodau’r Cynulliad. Cytunaf fod yn rhaid wrth fesurau diogelu ond nid yw’r rheini yn amlwg. Mae hon yn ddogfen unochrog. Gobeithiaf y bydd y Prif Ysgrifennydd yn ailystyried y mater ac yn ymateb gyda rhywbeth ychydig mwy sylweddol.

I support Mike German’s views on category 6. Listening to the presentation and reading the document, I got the impression that there was an attempt to put ordinary Members of the Assembly in their place. I do not believe that this should be the way forward for this Assembly. I am worried that we are setting procedures and processes in stone, and not allowing for the evolution of the role of ordinary Assembly Members. The role of the Assembly Member is still being defined, not only in terms of holding the Executive to account, but also in terms of service to individual constituents, as representatives and advocates for their areas. By defining access so tightly we may be in danger of hampering their role. I hope that the First Secretary and his team will consider the anxieties that we are expressing and reconsider the document in terms of giving ordinary Members greater access to the Civil Service on matters of concern both to themselves and their constituents.

Yr wyf yn cefnogi barn Mike German ynghylch categori 6. O wrando ar y cyflwyniad a darllen y ddogfen, cefais yr argraff bod yma ymgais i roi Aelodau cyffredin y Cynulliad yn eu lle. Ni chredaf mai dyma’r ffordd ymlaen i’r Cynulliad hwn. Ofnaf ein bod yn pennu gweithdrefnau a phrosesau rhy haearnaidd, heb ganiatáu ar gyfer esblygiad rôl Aelodau cyffredin y Cynulliad. Mae rôl Aelodau’r Cynulliad yn dal i gael ei diffinio, nid yn unig o safbwynt gwneud yr Adran Weithredol yn atebol, ond hefyd o ran gwasanaeth i etholwyr unigol, fel cynrychiolwyr ac eiriolwyr dros eu hardaloedd. Drwy ddiffinio cyswllt mor gaeth mae perygl i ni lesteirio eu rôl. Gobeithiaf y bydd y Prif Ysgrifennydd a’i dîm yn ystyried y pryderon sy’n cael eu lleisio gennym ac yn ailystyried y ddogfen o safbwynt caniatáu mwy o gyswllt i’r Aelodau cyffredin gyda’r Gwasanaeth Sifil ar faterion sy’n peri gofid iddynt hwy eu hunain a’u hetholwyr.

I did not know that two papers were going to be considered together, but I want to mention commercial confidentiality, which is included in paragraph 5.2 of the Provision of Information to Assembly Members. It states:

Ni wyddwn fod y ddau bapur i gael eu hystyried gyda’i gilydd, ond hoffwn gyfeirio at gyfrinachedd masnachol sydd wedi ei gynnwys ym mharagraff 5.2 o’r ddogfen Darparu Gwybodaeth i Aelodau’r Cynulliad. Dywed:

‘Members will not normally have access to information which is commercially confidential.’

‘Ni fydd yr Aelodau fel arfer yn gallu gweld gwybodaeth sy’n fasnachol gyfrinachol.’

I support the previous speakers. This is a catch-all phrase to ensure that any information that the Executive does not want us to have will not be given. Any commercial organisation will say that everything is commercially confidential. For the public, the test must be not whether harm, but substantial harm will be done by the release of that information. However, it must be a different test if the information is going to be supplied to us as Assembly Members. I am unhappy with the paper as it is drafted now, and I support those Members who have said that it simply is a catch-all phrase so that the Assembly is given only the information that anybody in the Executive allows it to be given.

Yr wyf yn cefnogi’r ddau siaradwr blaenorol. Mae hwn yn gymal dal-popeth i sicrhau na fydd unrhyw wybodaeth nad yw’r Adran Weithredol am i ni ei chael yn cael ei rhoi. Fe ddywed unrhyw gorff masnachol fod popeth yn fasnachol gyfrinachol. Y prawf i’r cyhoedd o reidrwydd fydd, nid a wneir niwed o ryddhau’r wybodaeth, ond a wneir niwed sylweddol. Fodd bynnag, rhaid wrth brawf gwahanol os yw’r wybodaeth i gael ei rhoi i ni fel Aelodau’r Cynulliad. Yr wyf yn anhapus â’r papur fel y mae wedi ei ddrafftio ar hyn o bryd, a chefnogaf yr Aelodau hynny sydd wedi dweud mai cymal dal-popeth ydyw fel nad yw’r Cynulliad ond yn cael y wybodaeth y mae rhywun yn yr Adran Weithredol yn fodlon iddo ei chael.

I wish to comment on category 6. I understand that there is no problem whatsoever with Members getting access to civil servants. They have to apply to a higher level because the civil servants would want an accurate answer to be given. Sometimes it is necessary to go to the top to get the best possible information. As Conservatives, we do not have a problem with this issue.

Hoffwn gyfeirio at gategori 6. Deallaf nad oes unrhyw broblem o gwbl i’r Aelodau gysylltu â’r gweision sifil. Mae’n rhaid iddynt gysylltu ar lefel uwch oherwydd byddai’r gweision sifil am i ateb cywir gael ei roi. Weithiau, mae’n rhaid mynd i’r brig i gael y wybodaeth orau posibl. Fel Ceidwadwyr, nid oes gennym broblem gyda’r mater hwn.

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 38

This has been an interesting debate and I hope that we can use it as an opportunity to look a little further into the distance. First, the purpose of establishing the codes and protocols is to enable us to enter a totally new type of relationship. The Assembly is a new type of body—it does not have the same relationship between the officials and the Assembly Cabinet as that between officials and Ministers at Westminster. Therefore, civil servants are being asked to enter into a completely different type of relationship. As I said earlier, it is particularly positive that civil servants in the Welsh Office have entered into what will be a very challenging situation with a great deal of enthusiasm. They are very positive about their ability to engage with Assembly Members, both through the committee structure and individually. However, there are also concerns on propriety, the different types of information that the Assembly needs to do its work and its relation with other Government bodies. We must also ensure that civil servants are protected from inappropriate approaches. It is reasonable to expect the most senior civil servant to be aware of what is right to give out and what is not. As processes build up over a period of time, it may be possible to relax current requirements because the pattern of working will become familiar to everybody, and everybody will know where the lines are set and what the ground rules are.

Bu hon yn ddadl ddiddorol a gobeithiaf y gallwn ei defnyddio fel cyfle i edrych ychydig ymhellach i’r dyfodol. Yn gyntaf, diben sefydlu’r codau a’r protocolau yw ein galluogi ni i ddechrau ar fath cwbl newydd o berthynas. Mae’r Cynulliad yn fath newydd o gorff—nid oes yr un berthynas rhwng y swyddogion a Chabinet y Cynulliad ag sydd rhwng swyddogion a Gweinidogion yn San Steffan. Felly, gofynnir i’r gweision sifil ymgymryd â math cwbl wahanol o berthynas. Fel y dywedais ynghynt, mae’n dra chalonogol bod gweision sifil yn y Swyddfa Gymreig wedi ymgymryd â’r hyn a fydd yn sefyllfa lawn her gyda chymaint o frwdfrydedd. Maent yn gadarnhaol iawn ynghylch eu gallu i weithio gydag Aelodau’r Cynulliad, drwy’r strwythur pwyllgorau ac yn unigol. Fodd bynnag, mae yna bryderon hefyd ynglyn â phriodoldeb, y gwahanol fathau o wybodaeth sydd eu hangen ar y Cynulliad er mwyn iddo wneud ei waith a’i berthynas gyda chyrff eraill y Llywodraeth. Rhaid inni sicrhau hefyd fod gweision sifil yn cael eu gwarchod rhag ceisiadau amhriodol. Rhesymol yw disgwyl y bydd y gwas sifil ar y brig yn sylweddoli beth y mae’n briodol ei ryddhau a beth na ddylid ei ryddhau. Wrth i’r prosesau aeddfedu dros gyfnod o amser, efallai y bydd posibl llacio’r gofynion cyfredol gan y bydd y patrwm gweithio yn dod yn gyfarwydd i bawb, a bydd pawb yn gwybod pa linellau sydd wedi eu pennu a beth yw’r rheolau sylfaenol.

A Standards Committee will look at the way in which issues of propriety are dealt with over a period of time. None of this is set in stone for the future. The codes provide a set of ground rules that allow us to start to build confidence within the Assembly, on the part of both Members and officials, so that appropriate exchanges can take place and information can be made available. I emphasise that although we are approaching this as a totally new institution, we accept the transfer of civil servants to the Assembly. They have great experience of working in a different type of environment, and, therefore, we need to allow time to settle down.

Bydd Pwyllgor Safonau yn edrych ar y ffordd yr ymdrinnir ag ystyriaethau priodoldeb dros gyfnod o amser. Nid oes dim yma na ellir ei newid i’r dyfodol. Mae’r codau’n rhoi inni gyfres o reolau sylfaenol er mwyn inni ddechrau magu hyder o fewn y Cynulliad, ar ran yr Aelodau a’r swyddogion, fel y gallwn drafod yn briodol a sicrhau bod gwybodaeth ar gael. Er ein bod yn ymdrin â’r Cynulliad fel sefydliad cwbl newydd, pwysleisiaf ein bod yn derbyn bod gweision sifil yn trosglwyddo iddo. Mae ganddynt lawer iawn o brofiad o weithio mewn math gwahanol o amgylchedd ac, felly, mae angen caniatáu amser i gael ein traed oddi tanom.

John Marek is right to say that the decision was taken not to separate the Assembly and the Executive. It would have been possible to have a separate group of officials whose accountability and loyalty was entirely to the Assembly, and another set of officials who were responsible to the Executive. That would have spread officials far too thinly instead of making sure that the resources and the capacities of all the officials who work for the Welsh Office—especially at a policy level—were available to the Assembly as a whole. That is why we have to create procedures that may seem somewhat mechanical. It is to make sure that we fulfil our aspirations. I am sure everybody agrees—that we should have the greatest openness and protection for staff by setting out certain rules.

Mae John Marek yn iawn i ddweud bod penderfyniad wedi ei gymryd i beidio â gwahanu’r Cynulliad a’r Adran Weithredol. Byddai wedi bod yn bosibl cael grŵp ar wahân o swyddogion yn gwbl atebol a theyrngar i’r Cynulliad, a set arall o swyddogion yn atebol i’r Adran Weithredol. Byddai hynny wedi lledaenu’r swyddogion yn llawer rhy denau yn lle gwneud yn siŵr bod adnoddau a doniau’r holl swyddogion sy’n gweithio i’r Swyddfa Gymreig—yn enwedig ar lefel polisi—ar gael i’r Cynulliad yn ei gyfanrwydd. Dyna pam y mae’n rhaid i ni lunio gweithdrefnau sydd efallai yn ymddangos braidd yn beiriannol. Yr ydym am wneud yn siŵr ein bod yn gwireddu ein dyheadau. Yr wyf yn siŵr bod pawb yn cytuno—y dylem sicrhau’r drefn fwyaf agored posibl a’r warchodaeth fwyaf posibl i’n staff drwy bennu rhai rheolau.

We should reassess most of the issues that have been raised. I believe that it would be helpful for party leaders to meet the Permanent Secretary in order to talk about the relationship between officials and Members. This would enable greater understanding, and could be followed by a discussion involving a wider range of Members. This would help to ensure that everybody over a relatively short period of time understood the relationship. It is vital that positive relationships are established between Assembly Members and Assembly officials.

Dylem ailasesu’r rhan fwyaf o’r materion a godwyd. Credaf mai buddiol fyddai i arweinwyr y pleidiau gwrdd â’r Ysgrifennydd Parhaol i drafod y berthynas rhwng swyddogion ac Aelodau. Bydd hyn yn hybu gwell dealltwriaeth, a gellid cynnal trafodaeth gyda mwy o’r Aelodau yn rhan ohoni wedyn. Byddai hyn yn help i sicrhau bod pawb wedi deall y berthynas dros gyfnod cymharol fyr o amser. Mae’n holl bwysig bod cysylltiadau cadarnhaol yn cael eu sefydlu rhwng Aelodau’r Cynulliad a swyddogion y Cynulliad.

I turn to the issue of the agreement of an Assembly Secretary. It is not intended to be a way of stopping the flow of information; it is to enable officials to give information with authority. It may be that we will find in time that it is possible to simplify structures and to extend the range of officials. It is possible that the Library system is the correct way of providing information. The Library, in this case, is part of the Civil Service and part of the Assembly. It is not like the House of Commons Library, which is a part of the services available to Members and separate from the Executive. We are all one Assembly. However, in the House of Commons Library, if you ask an expert researcher for information, they will return with information that is gathered very quickly from officials in the relevant department. This is because they have regular contact and they know where to ask the question. I suspect that Members of this Assembly will find that the Library service is one that acts as a short cut and enabler rather than an obstruction. If that proves not to be the case, then it would be right for us to reassess it.

Trof at y mater o gael cytundeb un o Ysgrifenyddion y Cynulliad. Ni fwriadwyd hynny fel ffordd o atal y llif gwybodaeth; y mae i alluogi swyddogion i roi gwybodaeth gydag awdurdod. Efallai y gwelwn ymhen amser ei bod yn bosibl symleiddio’r strwythurau ac ehangu ystod y swyddogion. Mae’n bosibl mai system y Llyfrgell yw’r ffordd iawn o ddarparu gwybodaeth. Mae’r Llyfrgell, yn yr achos hwn, yn rhan o’r Gwasanaeth Sifil ac yn rhan o’r Cynulliad. Nid yw, fel Llyfrgell Tŷ’r Cyffredin, yn rhan o’r gwasanaethau sydd ar gael i’r Aelodau ac ar wahân i’r Adran Weithredol. Un Cynulliad yw pawb ohonom. Fodd bynnag, yn Llyfrgell Tŷ’r Cyffredin, os gofynnwch i ymchwilydd arbenigol am wybodaeth, daw’n ôl gyda gwybodaeth sy’n cael ei chasglu’n gyflym iawn oddi wrth swyddogion yn yr adran berthnasol. Y rheswm yw bod ganddynt gyswllt rheolaidd a’u bod yn gwybod ymhle i holi. Yr wyf yn tybio y bydd Aelodau’r Cynulliad yn canfod bod y gwasanaeth Llyfrgell yn llwybr cwta ac yn eu galluogi, yn hytrach na bod yn rhwystr. Os na wireddir hynny, priodol fyddai inni ei ailasesu.

The Permanent Secretary, officials in the Office of the Presiding Officer, the Clerk, John Lloyd, and many others, have given much thought to trying to establish a system which will create the greatest confidence on the part of Members and officials alike. What I would urge the Assembly to do is to try and tease out the reasons why it has been placed in this way. I suggest that the leaders of the other three parties facilitate a discussion, and if there are things that are not working let us, as an Assembly, revise the issues in the future. However, if we find that it is working, it may be that the knowledge and expertise of those who proposed the systems to us was right.

Mae’r Ysgrifennydd Parhaol, swyddogion yn Swyddfa’r Llywydd, y Clerc, John Lloyd, a llu o bobl eraill, wedi rhoi llawer o feddwl i sefydlu system a fydd yn creu hyder o’r mwyaf ar ran yr Aelodau a’r swyddogion fel ei gilydd. Byddwn yn annog y Cynulliad i roi cynnig arni a cheisio gweld pam y mae wedi ei sefydlu fel hyn. Awgrymaf fod arweinwyr y tair plaid arall yn hybu trafodaeth, ac os oes elfennau nad ydynt yn gweithio gadewch inni, fel Cynulliad, adolygu’r materion hynny yn y dyfodol. Fodd bynnag, os gwelwn ei bod yn gweithio, efallai bod gwybodaeth ac arbenigedd y rheini a awgrymodd y systemau yn iawn.

In that spirit, I urge members not to dismiss the points that have been made by those who raised them, in particular the point that Mike German raised. Let us keep issues under review, but let us establish processes that will enable the Assembly to start its work.

Yn yr ysbryd hwn, anogaf yr aelodau i beidio â diystyru’r pwyntiau a wnaed gan y rhai a’u cododd, yn enwedig y pwynt a godwyd gan Mike German. Gadewch inni gadw llygad ar yr ystyriaethau hyn, ond gadewch inni sefydlu prosesau a fydd yn galluogi’r Cynulliad i ddechrau ar ei waith.

Point of order. There has been much discussion recently about the issue of beef on the bone. In the Business Committee this morning, a motion was discussed and I, in discussion with the other party representatives, wish to table this motion for discussion and implementation at the earliest possible opportunity. I give that assurance to the Assembly and I will take steps immediately to discuss this issue and to table it at an appropriate moment when we can fit it in with the forthcoming business of the Assembly.

Mater o drefn. Cafwyd llawer o drafod yn ddiweddar am gig eidion ar yr asgwrn. Yn y Pwyllgor Busnes fore heddiw, trafodwyd cynnig ac yr wyf fi, mewn trafodaeth gyda chynrychiolwyr y pleidiau eraill, am gyflwyno’r cynnig hwn i’w drafod a’i weithredu ar y cyfle cyntaf posibl. Rhoddaf fy ngair ar hynny i’r Cynulliad a byddaf yn mynd ati ar unwaith i drafod y mater hwn a’i gyflwyno ar adeg briodol pan allwn ei gynnwys yn rhan o’r busnes sydd i ddod gerbron y Cynulliad yn fuan.
