Dafydd Elis-Thomas The Presiding Officer spoken in Welsh p. 2

Prynhawn da. Galwaf Gynulliad Cenedlaethol Cymru i drefn. Mae gennyf ddatganiadau i’w gwneud ar rai materion.

Good afternoon. I call the National Assembly for Wales to order. I have statements to make on a number of matters.

Methwyd â chael cytundeb rhwng trefnyddion busnes y pleidiau, felly yr wyf wedi cytuno ar y trefniadau eistedd yn y Siambr gyda’r swyddogion, ac yr wyf wedi rhoi rhybudd i’r Aelodau ynglŷn â hynny. Mae’n bwysig eich bod yn eistedd yn eich seddau priodol oherwydd bod lleoliadau’r seddau wedi eu cysylltu â switsfwrdd y meicroffonau, y system bleidleisio a’r system e-bost sydd yn gweithio yn y Siambr. Yr wyf wedi cytuno i wneud un newid pellach ar gais un grŵp. Byddaf yn sicrhau bod hyn yn cael ei wneud dros nos. O hyn ymlaen, byddai’n helpu’r system dechnoleg pe bai pawb yn eistedd yn yr un seddau. Bydd cyfle i newid y drefn eistedd yn ystod y gwyliau hanner tymor, os yw Aelodau yn anhapus.

In the absence of agreement between party business managers, I have agreed seating arrangements for the Chamber with the officials and have issued a notice to Members to that effect. It is important that you sit in the appropriate seats because the locations of seats are linked to the microphone switchboard, the voting system and the e-mail system that is in operation in the Chamber. I have agreed to make one further change at the request of one group. I will ensure that it is done overnight. From now on, if everyone could sit in the same seats, it would make the technology arrangements much easier. There will be an opportunity to change the seating arrangements during the half-term recess if Members are unhappy.

Carwn atgoffa Aelodau y byddai’n gymorth mawr pe byddech yn peidio â siarad nes bydd y meicroffonau wedi eu goleuo. Drwy oleuo’r meicroffon, yr ydych yn sicrhau eich bod ar gamera a bod eich geiriau wedi eu cofnodi am byth. Heb y system sain, nid oes modd cadw cofnod o bopeth a drafodir. Os bydd Aelodau yn dymuno cael unrhyw gymorth ynglŷn â defnyddio e-bost yn y Siambr, bydd swyddogion ar gael i wneud hynny ar ôl y sesiwn

I wish to remind Members that it would be most helpful if you would refrain from speaking until the microphone is lit. By lighting the microphone you ensure that you are on camera and that your words are recorded forever. Without the audio system it is impossible to record all the proceedings. If Members require assistance with e-mail use in the Chamber, officials will be available after the session.

Os yw Aelodau yn dymuno cael eu galw i siarad mewn dadl, byddai’n help mawr pe baech yn rhoi gwybod am hynny i’m Hysgrifennydd Preifat. Byddai hefyd yn help pe baech yn rhoi gwybod ar ba gynnig y dymunwch siarad. Mae modd gwneud hynny naill ai drwy e-bost neu drwy nodyn i’r Swyddfa Gyflwyno cyn 10 o’r gloch ar fore’r ddadl. Byddai hynny yn fy ngalluogi i benderfynu hyd dadleuon ac areithiau unigol. Mae’n bosibl y bydd yn fwy anodd i Aelodau nad ydynt yn cofnodi eu hawydd i siarad mewn dadl allu dal fy llygad.

If Members wish to be called to speak in a debate, it would be extremely helpful if you could inform my Private Secretary. It would also be helpful if you could indicate on which motion you wish to speak. This can be done either by e-mail or by sending a note to the Table Office before 10 o’clock on the morning of the debate. That will enable me to decide the length of debates and individual speeches. Members who do not register a desire to speak in a debate may find it difficult to catch my eye.

Mae Rheolau Sefydlog y Cynulliad yn rhoi cyfle imi ddyfarnu ar faterion gweithdrefnu. Mae Rheol Sefydlog Rhif 6.28 yn benodol yn caniatáu i mi ddyfarnu a yw cwestiynau llafar yn dderbyniol. Mae arweiniad drafft ar gael yn y Swyddfa Gyflwyno ynglŷn â gweithdrefnau cwestiynau llafar ac ysgrifenedig ac mae wedi ei anfon at arweinyddion y pleidiau. Mae paragraff 2.1 o’r arweiniad hwnnw yn datgan na fyddaf efallai yn derbyn cwestiynau penagored, er enghraifft cwestiynau sydd yn gofyn i’r Prif Ysgrifennydd ddatgan ei ymrwymiadau swyddogol ar gyfer y dydd.

The Standing Orders of the National Assembly give me the discretion to rule on matters of procedure. Standing Order No. 6.28 in particular allows me to rule on the acceptability of oral questions. Draft guidance on the procedure for both oral and written questions is available from the Table Office and has been sent to party leaders. Paragraph 2.1 of that guidance states that I may not accept open-ended questions, such as questions asking the First Secretary if he will list his official engagements for the day.

Yr wyf yn cydnabod mai mater i’r Cynulliad yw derbyn neu wrthod yr arweiniad drafft hwn, ond yr wyf hefyd yn gobeithio y bydd Aelodau yn gweithredu yn ysbryd yr arweiniad. Felly, yr wyf wedi dyfarnu eisoes na fydd cwestiynau penagored yn dderbyniol. Mae cwestiynau o’r math hwn yn tueddu i dynnu sylw oddi wrth y busnes a drafodir ac yn gallu dwyn yr amser cyfyngedig sydd gan Aelodau i ofyn cwestiynau priodol am bolisïau a phenderfyniadau aelodau’r Cabinet. Os yw Aelodau yn dymuno gofyn cwestiynau i Ysgrifenyddion y Cynulliad heb roi rhybudd ymlaen llaw, mae modd gwneud hynny drwy ofyn cwestiwn atodol sy’n berthnasol i’r cwestiwn gwreiddiol.

While I accept that it is a matter for the Assembly to adopt or reject this draft guidance, I hope that Members will be mindful of the spirit of the guidance. I have therefore made a first ruling that such open-ended questions will not be acceptable. Questions of this type tend to detract from the business in hand and can take up the limited time available for Members to question the policies and decisions of members of the Cabinet. Members who wish to ask questions of Assembly Secretaries without giving notice may do that by asking a supplementary question pertaining to the original question.

Diolch am eich amynedd.

Thank you for your patience.

Business Statement

Andrew Davies spoken in English p. 4

Andrew Davies siaradwyd yn Saesneg t. 4

I refer to future business for Tuesday 25 May to Wednesday 9 June. Arrangements have been made to place the next three weeks’ business on the Chamberweb and on the intranet. However, I want to draw your attention to the following. On Tuesday 25 May the Assembly will meet in Plenary session at 11 a.m. and not 2 p.m. Business will include the election of members to the Subject Committees followed by the First Secretary’s Question Time. This will be followed by the weekly Business Statement.

Cyfeiriaf at fusnes sydd i’w drafod o ddydd Mawrth 25 Mai hyd ddydd Mercher 9 Mehefin. Gwnaed trefniadau i osod y busnes ar gyfer y tair wythnos nesaf ar We’r Siambr ac ar y fewnrwyd. Fodd bynnag, yr wyf am dynnu’ch sylw at y canlynol. Ddydd Mawrth 25 Mai bydd y Cynulliad yn cyfarfod mewn Sesiwn Llawn am 11 a.m. ac nid am 2 p.m. Bydd y busnes yn cynnwys ethol aelodau i’r Pwyllgorau Pwnc ac ar ôl hynny Sesiwn Cwestiynau’r Prif Ysgrifennydd. Wedi hynny bydd y Datganiad Busnes wythnosol.

Questions for the First Secretary for next week should be tabled today in the Table Office. The Plenary session will end at 1.30 p.m. as television crews want to film in the Chamber in preparation for the opening ceremony by Her Majesty the Queen. On Wednesday 26 May, Her Majesty will formally open the Assembly. This will be followed by one week’s recess commencing on Monday 31 May.

Dylai cwestiynau i’r Prif Ysgrifennydd ar gyfer yr wythnos nesaf gael eu cyflwyno heddiw yn y Swyddfa Gyflwyno. Daw’r Sesiwn Llawn i ben am 1.30 p.m. gan fod criwiau teledu yn dymuno ffilmio yn y Siambr wrth baratoi ar gyfer y seremoni agoriadol gan Ei Mawrhydi y Frenhines. Ddydd Mercher 26 Mai, bydd Ei Mawrhydi yn agor y Cynulliad yn ffurfiol. Ar ôl hynny ceir wythnos o wyliau a fydd yn dechrau ddydd Llun 31 Mai.

On Tuesday 8 June the Assembly will meet in Plenary session at 2 p.m. and business will start with elections to the Audit and Legislation Committees followed by the First Secretary’s Question Time and then the weekly Business Statement. There will then follow a statement by the First Secretary on the Partnership Council and other partnership schemes and a debate on the Partnership Council. The Plenary session will end at 5.30 p.m. I propose that on Wednesday 9 June the Assembly will be in recess.

Ddydd Mawrth 8 Mehefin bydd y Cynulliad yn cyfarfod mewn Sesiwn Llawn am 2 p.m. a’r busnes cyntaf fydd ethol Aelodau i’r Pwyllgor Archwilio a’r Pwyllgor Deddfwriaeth. Wedi hynny bydd Sesiwn Cwestiynau’r Prif Ysgrifennydd ac yna’r Datganiad Busnes wythnosol. Ar ôl hynny ceir datganiad gan y Prif Ysgrifennydd ar y Cyngor Partneriaeth a chynlluniau partneriaeth eraill a dadl ar y Cyngor Partneriaeth. Daw’r Sesiwn Llawn i ben am 5.30 p.m. Yr wyf yn cynnig y bydd y Cynulliad ar wyliau ar ddydd Mercher 9 Mehefin.

Is the Business Statement agreed?

A gytunir â’r Datganiad Busnes?

Glyn Davies spoken in English p. 4

Glyn Davies siaradwyd yn Saesneg t. 4

I object to the Business Statement because it does not give the Assembly an early opportunity to discuss our motion on lifting the regulations banning the consumption and sale of beef on the bone. In the interests of openness, I propose that the Business Statement should be changed to include a debate on that motion.

Yr wyf yn gwrthwynebu’r Datganiad Busnes am nad yw’n rhoi cyfle buan i’r Cynulliad drafod ein cynnig ar godi’r rheoliadau sy’n gwahardd bwyta a gwerthu cig eidion ar yr asgwrn. Er mwyn bod yn agored, yr wyf yn cynnig y dylid newid y Datganiad Busnes i gynnwys dadl ar y cynnig hwnnw.

Dafydd Elis-Thomas The Presiding Officer spoken in English p. 5

Dafydd Elis-Thomas Y Llywydd siaradwyd yn Saesneg t. 5

Are there 10 objections to the Business Statement according to the Standing Order? I see that there are.

A oes 10 gwrthwynebiad i’r Datganiad Busnes yn unol â’r Rheol Sefydlog? Gwelaf fod 10.

I call on the Business Secretary to propose that it be adopted. I can allow one Member of each group to speak before the Business Secretary replies and I call a vote.

Galwaf ar y Trefnydd i gynnig ei fabwysiadu. Gallaf ganiatáu i un Aelod o bob grŵp siarad cyn y bydd y Trefnydd yn ymateb ac y byddaf finnau’n galw pleidlais.

Alun Michael The First Secretary spoken in English p. 5

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 5

It is important that the Assembly realises that we will be seen from outside by the way in which we exercise our powers and utilise the opportunity for debate. I have no difficulty with the idea of an early debate on the beef on the bone ban. As many people know, I am an enthusiast for Welsh beef and have promoted it at every opportunity. Nothing would give me greater pleasure than to see the ban lifted. However, there is a weight of evidence that has to be considered by this Assembly and with as great care as would be afforded by a Minister of the Crown working on behalf of the United Kingdom Government, or by the Secretary of State for Wales in exercising his responsibilities up until now. It is very important that the evidence should be considered with care and maturity. This issue is one that people have an instinctive wish to see resolved. We all would like to see it resolved. However, there is very serious evidence that would need to be considered by the Assembly in that debate.

Mae’n bwysig i’r Cynulliad sylweddoli y bydd yn cael ei weld o’r tu allan yn ôl y modd y byddwn yn arfer ein pwerau ac yn defnyddio’r cyfle i gael trafodaeth. Ni welaf yr un anhawster ynghylch y syniad o gael dadl fuan ar y gwaharddiad ar gig eidion ar yr asgwrn. Fel y gŵyr llawer, yr wyf yn frwd dros gig eidion Cymru ac wedi ei hybu ar bob cyfle. Nid oes dim a roddai fwy o bleser imi na gweld y gwaharddiad yn cael ei godi. Er hynny, fe geir tystiolaeth bwysig y bydd yn rhaid i’r Cynulliad hwn ei hystyried a hynny gyda chymaint o ofal ag a roddid gan un o Weinidogion y Goron wrth weithio ar ran Llywodraeth y Deyrnas Gyfunol, neu gan Ysgrifennydd Gwladol Cymru wrth arfer ei gyfrifoldebau hyd yn hyn. Mae’n bwysig iawn i’r dystiolaeth gael ei hystyried mewn modd gofalus ac aeddfed. Mae awydd greddfol mewn pobl i weld datrys y broblem hon. Byddai pawb ohonom am ei gweld yn cael ei datrys. Fodd bynnag, fe geir tystiolaeth ddifrifol y byddai angen i’r Cynulliad ei hystyried yn y ddadl honno.

How the debate should take place—whether it should be considered first by a committee with the ability to take evidence both from farming interests and from medical advisers—should be decided by the Business Committee. It is for the Business Committee to propose to the Assembly how the debate should take place. We are in our first week of real business. We need to use the powers and the opportunities open to us responsibly and sensibly in order to make sure that this body earns respect. I ask my colleagues to reflect on the request and to allow the Business Committee to reflect further on it, to make sure that the debate can be orderly and can encompass serious consideration of all the evidence before coming to a conclusion.

Mae’r modd y cynhelir y ddadl—pa un a ddylai gael ei hystyried yn gyntaf gan bwyllgor ac iddo’r gallu i dderbyn tystiolaeth oddi wrth fuddiannau amaethyddol ac oddi wrth ymgynghorwyr meddygol—yn fater a ddylai gael ei benderfynu gan y Pwyllgor Busnes. Lle’r Pwyllgor Busnes yw cynnig i’r Cynulliad sut y dylid cynnal y ddadl. Yr ydym yn yr wythnos gyntaf o fusnes gwirioneddol. Dylem arfer y pwerau a’r cyfleoedd sydd ar gael inni mewn modd cyfrifol a synhwyrol er mwyn sicrhau bod y corff hwn yn ennill parch. Gofynnaf i’m cyd-weithwyr fyfyrio ynghylch y cais a gadael i’r Pwyllgor Busnes fyfyrio ymhellach yn ei gylch, er mwyn sicrhau y gall y ddadl fod yn un drefnus gan gwmpasu ystyriaeth ddifrifol i’r holl dystiolaeth cyn cyrraedd casgliad.

Rod Richards spoken in English p. 6

Rod Richards siaradwyd yn Saesneg t. 6

We want this debate held next week. The First Secretary should realise that his is a minority administration and that three of the opposition parties are in this Assembly partly because of a pledge they gave to the electorate that at the earliest opportunity this issue would be debated in this Chamber. We have kept our pledge to raise this issue. We now look to the other two opposition parties to support us.

Yr ydym am i’r ddadl hon gael ei chynnal yr wythnos nesaf. Dylai’r Prif Ysgrifennydd sylweddoli mai gweinyddiaeth leiafrifol sydd ganddo a bod tair o bleidiau’r wrthblaid yn y Cynulliad hwn yn rhannol oherwydd addewid a roesant i’r etholwyr y byddai’r mater hwn yn cael ei drafod ar y cyfle cyntaf yn y Siambr hon. Yr ydym wedi cadw ein haddewid i godi’r mater hwn. Yn awr yr ydym yn disgwyl i ddwy blaid arall yr wrthblaid ein cefnogi.

As to the First Secretary’s comments on the need for full consideration of the medical and scientific evidence and data, of course we want full consideration given to the evidence and the data. However, there is no reason why that consideration cannot be given in principle this coming week. When Jack Cunningham decided to ban beef on the bone some months ago, the scientific evidence was rather tenuous. The First Secretary often quotes the Chief Medical Officer’s advice that the ban should be imposed, but he chooses to neglect the advice of the Chief Scientific Officer, who takes a different view. This matter should be aired next week. We have given the electorate a pledge and undertaken that we will debate this issue at the earliest opportunity. The other two opposition parties have also made this pledge and I look to them to do as the Conservatives have done and to fulfil their pledge to the electorate.

Ynglŷn â sylwadau’r Prif Ysgrifennydd ar yr angen i roi ystyriaeth lawn i’r dystiolaeth a’r data meddygol a gwyddonol, wrth reswm, yr ydym am weld y dystiolaeth a’r data yn cael eu hystyried yn llawn. Fodd bynnag, nid oes rheswm pam na ellir rhoi’r ystyriaeth honno mewn egwyddor yn yr wythnos sydd i ddod. Pan benderfynodd Jack Cunningham wahardd cig eidion ar yr asgwrn rai misoedd yn ôl, yr oedd y dystiolaeth wyddonol braidd yn denau. Bydd y Prif Ysgrifennydd yn aml yn dyfynnu cyngor y Prif Swyddog Meddygol y dylid gorfodi’r gwaharddiad, ond bydd yn dewis diystyru cyngor y Prif Swyddog Gwyddonol, sydd â barn wahanol. Dylid gwyntyllu’r mater hwn yr wythnos nesaf. Yr ydym wedi rhoi addewid i’r etholwyr ac wedi ymgymryd i drafod y mater hwn ar y cyfle cyntaf. Mae dwy blaid arall yr wrthblaid wedi addo hyn hefyd ac yr wyf yn disgwyl iddynt hwy wneud fel y gwnaeth y Ceidwadwyr a chadw eu haddewid i’r etholwyr.

Jenny Randerson spoken in English p. 6

Jenny Randerson siaradwyd yn Saesneg t. 6

Point of order. Perhaps Rod Richards is not aware that it was agreed in the Business Committee this morning by his Whip and other members of the Committee that we will discuss the tabling of this motion tomorrow morning. This has already been agreed between the four parties.

Mater o drefn. Efallai nad yw Rod Richards yn ymwybodol o’r cytuniad a gafwyd yn y Pwyllgor Busnes y bore hwn gan ei Chwip ef ac aelodau eraill y Pwyllgor y byddwn yn trafod cyflwyno’r cynnig hwn bore yfory. Cytunwyd ar hyn eisoes rhwng y pedair plaid.

John Marek spoken in English p. 7

John Marek siaradwyd yn Saesneg t. 7

I supported the plea for this motion to be debated because the Business Committee might meet, but I am not a member of the Business Committee and know nothing about what the Business Committee has decided, or is about to decide. I do not want to see Westminster-style politics where important subjects are kept off the agenda by Business Committees that meet and agree on matters among themselves. It should be up to the Assembly as a whole to make these decisions. Having said that, I take comfort in the First Secretary’s statement that the matter ought to go back to the Business Committee to be debated further. I hope that the Conservative Party will take the First Secretary’s advice and find a way forward, now that the principle of an early debate has been agreed.

Cefnogais yr alwad am drafod y cynnig hwn oherwydd y gallai’r Pwyllgor Busnes gyfarfod, ond nid wyf yn aelod o’r Pwyllgor Busnes ac nid wyf yn gwybod dim am yr hyn a benderfynwyd, neu sydd ar fin ei benderfynu, gan y Pwyllgor Busnes. Nid wyf am weld gwleidydda yn null San Steffan lle y bydd pynciau pwysig yn cael eu cadw oddi ar yr agenda gan Bwyllgorau Busnes sy’n cyfarfod ac yn cytuno ar faterion ymysg ei gilydd. Dylai fod yn fater i’r Cynulliad cyfan wneud y penderfyniadau hyn. Wedi dweud hynny, yr wyf wedi fy nghalonogi gan ddatganiad y Prif Ysgrifennydd y dylai’r mater fynd yn ôl i’r Pwyllgor Busnes i’w drafod ymhellach. Gobeithiaf y bydd y Blaid Geidwadol yn derbyn cyngor y Prif Ysgrifennydd ac yn canfod ffordd ymlaen, gan fod cytuno yn awr ar yr egwyddor o gynnal dadl fuan.

Ieuan Wyn Jones siaradwyd yn Gymraeg t. 7

Ieuan Wyn Jones spoken in Welsh p. 7

Hoffwn ategu sylwadau Jenny Randerson fod y mater yn cael ei drafod yn y Pwyllgor Busnes. Hefyd, hoffwn ategu sylwadau’r Prif Ysgrifennydd ei fod yn bwysig i ni edrych ar y dystiolaeth. Hoffem gael arweiniad. A fyddai modd i’r Pwyllgor Busnes ystyried trafodaeth yn nghyd-destun y sylwadau hynny? Mae angen i’r Cynulliad gael y dystiolaeth angenrheidiol wrth baratoi ar gyfer y ddadl honno. A fyddai’n briodol i’r Pwyllgor Busnes ystyried cynnwys y dystiolaeth honno fel cefndir i’r ddadl?

I endorse what has been said by Jenny Randerson, that this matter is to be discussed at the Business Committee. I also endorse the comments of the First Secretary that it is important that we look at all the evidence. We would like guidance. Would it be possible for the Business Committee to consider a discussion in the context of those comments? The Assembly needs all the necessary evidence in preparation for such a debate. Would it be appropriate for the Business Committee to consider the contents of that evidence as a background to the debate?

David Davies spoken in English p. 7

David Davies siaradwyd yn Saesneg t. 7

I have mentioned this subject at each of the meetings of the Whips and I have not been able to make progress in getting this matter debated. It is of the utmost importance and it is a pledge I have made to the rural area that I represent. I would welcome the support of the House when I bring this up tomorrow. The Conservative Party wishes to debate this matter at the earliest possible opportunity.

Yr wyf wedi crybwyll y pwnc hwn ym mhob un o gyfarfodydd y Chwipiaid ac nid wyf wedi sicrhau unrhyw symud ymlaen at gael dadl ar y mater hwn. Mae hyn yn rhywbeth sydd o’r pwys mwyaf ac yn addewid a roddwyd gennyf i’r ardal wledig yr wyf yn ei chynrychioli. Byddwn yn falch o gael cefnogaeth y Tŷ pan godaf hyn yfory. Mae’r Blaid Geidwadol yn dymuno cael dadl ar y mater hwn ar y cyfle cyntaf posibl.

I would like to refer to paragraphs 2.17 and 2.20 of this Code. I would also like Members to refer to the Declaration of Interests Paper and look at paragraphs 1.22 to 1.24, which are on the same issue. These reflect on all Members of this Assembly. Overseas visits are always a matter of some sensitivity and it is important to recognise that this is not Westminster. I read into most of what is written in this section the sort of delegation to the First Secretary that would be normal in a Westminster Cabinet but not so normal where the Executive and the Committees are working in balance. We have to recognise the political arithmetic of this Assembly. Undoubtedly, one of the effects is that it places more power in the hands of the Committees and balances the Committees and the Executive. It also allows the Committees to set the agenda and to be part of that balance.

Hoffwn gyfeirio at baragraffau 2.17 a 2.20 y Cod hwn. Byddwn hefyd yn dymuno i’r Aelodau gyfeirio at y Papur Datganiad o Fudd ac edrych ar baragraffau 1.22 i 1.24, sydd yn ymdrin â’r un mater. Mae’r rhain yn adlewyrchu ar holl Aelodau’r Cynulliad hwn. Mae ymweliadau tramor bob amser yn fater sydd braidd yn sensitif ac mae’n bwysig cydnabod nad San Steffan yw’r fan hyn. Yr ystyr a welaf yn y rhan fwyaf o’r hyn a ysgrifennwyd yn yr adran hon yw’r math o ddirprwyo i’r Prif Ysgrifennydd a fyddai’n arferol mewn Cabinet yn San Steffan ond na fyddai mor arferol lle mae’r Adran Weithredol a’r Pwyllgorau yn gweithio mewn cydbwysedd. Rhaid inni gydnabod rhifyddeg wleidyddol y Cynulliad hwn. Un o effeithiau hynny, yn ddi-os, yw ei fod yn rhoi mwy o bŵer yn nwylo’r Pwyllgorau ac yn cydbwyso’r Pwyllgorau a’r Adran Weithredol. Mae hefyd yn caniatáu i’r Pwyllgorau osod yr agenda a bod yn rhan o’r cydbwysedd hwnnw.

The proposal in paragraphs 2.17 and 2.20 gives the power to determine overseas visits to the First Secretary alone. If you compare that with paragraphs 1.22 to 1.24 of category 7 in the paper ‘Guidance for Assembly Members on the Registration and Declaration of Members’ Financial and Other Interests’ which deals with overseas visits for Members, you see that there are quite significant personal obligations placed upon Members of this Assembly. The paper before us does not provide quite the level of definition that the first paper provides, even though it is different and there are different circumstances. I propose that the Business Committee looks again at these two paragraphs to see if they can reflect the wishes, the spread of membership and the political arithmetic of this Assembly in the delegation. It is not a matter to complain about. It is vital that people use the Assembly to promote Wales in other countries. It is simply a matter of delegation and power that is given to the First Secretary. I would certainly want to ensure that we are informed of what is being done on our behalf. That is not included in these paragraphs and perhaps the Business Committee could consider it and bring it back to the Chamber at the very earliest opportunity.

Mae’r cynnig ym mharagraffau 2.17 a 2.20 yn rhoi’r pŵer i benderfynu ymweliadau tramor yn gyfan gwbl i’r Prif Ysgrifennydd. Os cymharwch hynny â pharagraffau 1.22 i 1.24 yng nghategori 7 yn y papur ‘Arweiniad i Aelodau’r Cynulliad ar Gofrestru a Datgan Buddiannau Ariannol ac Eraill yr Aelodau’ sy’n ymdrin ag ymweliadau tramor gan Aelodau, fe welwch fod rhwymedigaethau personol eithaf sylweddol yn cael eu rhoi ar Aelodau’r Cynulliad hwn. Nid yw’r papur sydd ger ein bron yn rhoi’r un graddau o eglurder ag a geir yn y papur cyntaf, er ei fod yn wahanol a’r amgylchiadau’n wahanol. Cynigiaf y dylai’r Pwyllgor Busnes ailedrych ar y ddau baragraff hyn i weld a oes modd iddynt adlewyrchu dymuniadau, rhychwant aelodaeth a rhifyddeg wleidyddol y Cynulliad wrth ddirprwyo. Nid yw’n fater i gwyno yn ei gylch. Mae’n holl bwysig bod pobl yn defnyddio’r Cynulliad i hyrwyddo Cymru mewn gwledydd eraill. Mater ydyw, yn syml, o ddirprwyo a’r pŵer a roddir i’r Prif Ysgrifennydd. Yn sicr, byddwn am sicrhau ein bod yn cael gwybod am yr hyn a wneir ar ein rhan. Nid yw hynny wedi ei gynnwys yn y paragraffau hyn a hwyrach y gallai’r Pwyllgor Busnes ystyried hyn a dod â’r mater yn ôl i’r Siambr ar y cyfle cyntaf.

John Marek spoken in English p. 10

John Marek siaradwyd yn Saesneg t. 10

I support that. I would like to make two points. First, how will the Assembly know that a particular Secretary has gone on an overseas visit? I believe that it is important that information like this should be known by the Assembly so that Assembly Members are at least given the chance to make representations before any such visit takes place. I believe that it is important and I would like to support that. On the theme of knowing, I would also like Members to refer to paragraph 2.12 where, rightly, it says in the middle of the paragraph:

Yr wyf yn cefnogi hynny. Hoffwn wneud dau bwynt. Yn gyntaf, sut y bydd y Cynulliad yn gwybod bod Ysgrifennydd penodol wedi mynd ar ymweliad tramor? Credaf ei bod yn bwysig i wybodaeth o’r fath fod ym meddiant y Cynulliad fel bod Aelodau’r Cynulliad o leiaf yn cael cyfle i gyflwyno sylwadau cyn i unrhyw ymweliad o’r fath ddigwydd. Credaf fod hynny’n bwysig a hoffwn ategu hynny. Gan ddilyn y thema o dderbyn gwybodaeth, byddwn hefyd yn dymuno i’r Aelodau gyfeirio at baragraff 2.12, lle y dywedir, yn briodol, yng nghanol y paragraff:

‘When the Assembly is in session the most important announcements of policy should be made, in the first instance, to the Assembly.’

‘Pan fydd y Cynulliad yn eistedd dylid rhoi’r cyhoeddiadau polisi pwysicaf, yn y lle cyntaf, i’r Cynulliad.’

I find that a little weasel worded because who is to decide what the most important announcements are going to be? We are all politicians in this Chamber. I do not have to pursue that political point. I feel it should be emphasised more firmly that the Assembly should know first and decisions should not be made through press releases or any other form. There is more to it than that. This document does not mention giving knowledge of draft policy statements to the Assembly so that the Assembly can be included in drawing up policies. I admit that it would be done through the Committee structure to a large extent and through debates in this Assembly. However, there can be no objection to having a paragraph that states that, where possible, draft policies should be made available to the Assembly before the Cabinet Secretary makes any final policy decisions. I realise that we have an Assembly where no party has overall control. That proposal provides that bit of control. In future, one party may well have control and then I think that my point would have extra weight.

Yr wyf yn gweld rhai geiriau sydd braidd yn gamarweiniol yn y fan hyn oherwydd pwy sydd i benderfynu beth fydd y cyhoeddiadau pwysicaf? Yr ydym oll yn wleidyddion yn y Siambr hon. Nid oes rhaid imi ddilyn y pwynt gwleidyddol hwnnw. Teimlaf y dylid pwysleisio’n gryfach y dylai’r Cynulliad gael gwybod gyntaf ac na ddylid gwneud penderfyniadau drwy ddatganiadau i’r wasg neu ar unrhyw ffurf arall. Mae mwy iddo na hynny. Nid yw’r ddogfen hon yn crybwyll rhoi gwybodaeth am ddatganiadau polisi drafft i’r Cynulliad fel y gellir cynnwys y Cynulliad wrth lunio polisïau. Yr wyf yn derbyn y byddai hyn yn cael ei wneud drwy fframwaith y Pwyllgorau i raddau helaeth a thrwy ddadleuon yn y Cynulliad hwn. Fodd bynnag, ni ellid gwrthwynebu cael paragraff sy’n datgan y dylai polisïau drafft fod ar gael, lle y bo modd, i’r Cynulliad cyn i Ysgrifennydd y Cabinet wneud unrhyw benderfyniadau polisi terfynol. Yr wyf yn sylweddoli bod gennym Gynulliad lle nad oes gan yr un blaid reolaeth lwyr. Y cynnig hwnnw sydd yn rhoi’r elfen honno o reolaeth. Yn y dyfodol, mae’n bosibl iawn y gallai un blaid fod â rheolaeth lwyr a chredaf y byddai’r pwynt hwn yn amlycach bryd hynny.

My final point is an administrative point on 2.16, which states:

Mae’r pwynt olaf sydd gennyf yn bwynt gweinyddol ar baragraff 2.16, sy’n dweud:

‘Assembly Secretaries who are planning official visits in Wales must inform the Assembly Members for the constituencies…which will be included in the visit.’

‘Mae’n rhaid i Ysgrifenyddion y Cynulliad sydd yn cynllunio ymweliadau swyddogol yng Nghymru roi gwybod i Aelodau’r Cynulliad dros yr etholaethau…a gynhwysir yn yr ymweliad.’

I believe that it is quite appropriate as a courtesy. As a Member of Parliament, there have been occasions when I have been told possibly only 24 hours before, or sometimes 24 hours after the visit has been made. I would like paragraph 2.16 to be rephrased to say that there ought to be as much time as possible in individual circumstances.

Credaf fod hyn yn briodol iawn fel mater o gwrteisi. Fel Aelod Seneddol, bu adegau pryd y rhoddwyd gwybod imi efallai ond 24 awr ymlaen llaw, neu weithiau 24 awr ar ôl cwblhau’r ymweliad. Hoffwn weld aileirio paragraff 2.16 i ddweud y dylai fod cymaint o amser ag y bo modd mewn amgylchiadau unigol.

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 11

I wish to respond positively to that point. The formal documents that we are considering in this sequence of weeks have come out of a great deal of thought. Consideration by the National Assembly Advisory Group, consultation with the political parties, and observations made by each of the four parties have been incorporated in these final drafts. Having said that, we cannot pretend that these documents are perfect or final, given that considerations on such difficult and sensitive issues can change over time. I am sure the Assembly will want to return to these issues to refine the sort of standards against which our behaviour and responsibilities would be judged.

Yr wyf am ymateb yn gadarnhaol i’r pwynt hwnnw. Mae’r dogfennau ffurfiol yr ydym yn eu hystyried yn y gyfres wythnosau hon yn ganlyniad i lawer iawn o feddwl. Ystyriaeth gan Grŵp Ymgynghorol y Cynulliad Cenedlaethol, ymgynhoriad â’r pleidiau gwleidyddol, a sylwadau gan bob un o’r pedair plaid —maent oll wedi eu hymgorffori yn y drafftiau terfynol hyn. Wedi dweud hynny, ni allwn honni bod y dogfennau hyn yn berffaith neu’n derfynol, o dderbyn bod ystyriaethau ynghylch materion mor anodd a sensitif yn gallu newid dros amser. Yr wyf yn sicr y bydd y Cynulliad am ddod yn ôl at y materion hyn er mwyn coethi’r math o safonau y bernir ein hymddygiad a’n cyfrifoldebau yn eu herbyn.

In relation to the question of the delegation of powers to the First Secretary, I agree that the power must be exercised with communication and information coming to the Assembly, and with the sort of accountability that Michael German considered necessary. The idea that the Assembly should be informed, and that Members should expect information so that everybody is clear about what is happening, is perfectly sensible and acceptable. There are occasions when decisions have to be taken at short notice. For example, an Assembly Secretary may have to be involved in discussion in Brussels regarding many issues, such as agriculture. It is necessary, therefore, to take decisions quickly. Giving information to the Assembly on the way in which powers have been exercised, and allowing questions to be asked if appropriate would be a way of ensuring that there was no misuse of those powers, and that the Assembly was kept fully informed on what was being done on its behalf.

Ynghylch y cwestiwn o ddirprwyo pwerau i’r Prif Ysgrifennydd, yr wyf yn cytuno bod rhaid arfer y pŵer gyda chyfathrebu a gwybodaeth yn dod i’r Cynulliad, a chyda’r math o atebolrwydd yr oedd Michael German yn ei ystyried yn angenrheidiol. Mae’r syniad y dylai’r Cynulliad gael gwybodaeth, ac y dylai’r Aelodau ddisgwyl cael gwybodaeth fel bod pawb yn glir ynghylch beth sy’n digwydd, yn gwbl synhwyrol a derbyniol. Fe geir adegau pan fydd rhaid gwneud penderfyniadau ar fyr rybudd. Efallai, er enghraifft, y bydd rhaid i un o Ysgrifenyddion y Cynulliad gymryd rhan mewn trafodaeth ym Mrwsel ynghylch llawer o faterion megis amaethyddiaeth. Felly, mae angen gwneud penderfyniadau’n gyflym. Drwy roi gwybodaeth i’r Cynulliad am y modd y defnyddiwyd pwerau, a chaniatáu gofyn cwestiynau os yw hynny’n briodol, byddai modd sicrhau na fyddai camddefnydd ar y pwerau hynny, ac y byddai’r Cynulliad yn cael gwybodaeth lawn am yr hyn a wneir ar ei ran.

The question of drawing up policy, which John Marek referred to, is not just a question of the Assembly Committees commenting on drafts. The Assembly Committees will have a range of roles, from taking evidence and listening to experts to making propositions that involve the development of policy in the Assembly at a much earlier stage. It is not merely a case of responding to propositions from the Executive or officials. In my judgement, the Assembly Members will want to be involved in that much more positive and creative role which will make the Assembly a different, more inclusive, type of body.

Mae’r mater o lunio polisi, y cyfeiriodd John Marek ato, yn fwy na mater o Bwyllgorau’r Cynulliad yn rhoi sylwadau ar ddrafftiau. Bydd amrediad o rolau gan Bwyllgorau’r Cynulliad, yn amrywio o dderbyn tystiolaeth a gwrando ar arbenigwyr hyd at wneud cynigion a fydd yn golygu datblygu polisi yn y Cynulliad mewn cyfnod cynharach o lawer. Mae’n golygu mwy o lawer nag ymateb i gynigion oddi wrth yr Adran Weithredol neu’r swyddogion. Yn fy marn i, bydd Aelodau’r Cynulliad am gymryd rhan yn y rôl hon, sy’n fwy cadarnhaol a chreadigol o lawer, a fydd yn gwneud y Cynulliad yn gorff gwahanol a mwy cynhwysol.

There are a variety of considerations regarding the formulation of important announcements. In general, we should follow the principle that announcements are made in the Assembly. We need to keep this aspect under scrutiny so that Assembly Members feel that this body is being treated with proper respect. Given the amount of consideration and consultation that has gone into the preparation of these documents, it is important that there are no inconsistencies in picking up the points that have been made during this short debate. The Business Committee is in place and it would be appropriate if these inconsistencies were picked up at this stage. In the longer term there will be a Standards Committee to regularly consider these issues in depth. I suggest that the points be picked up and dealt with either directly by the Business Committee or, in the long term, by the Standards Committee, as the Business Committee directs. The Code should be adopted so that there is a standard for our business from day one.

Mae amryw o ystyriaethau ynghylch llunio cyhoeddiadau pwysig. Yn gyffredinol, dylem ddilyn yr egwyddor bod cyhoeddiadau i’w rhoi yn y Cynulliad. Rhaid inni gadw golwg ar yr agwedd hon fel bod Aelodau’r Cynulliad yn teimlo bod y corff hwn yn derbyn y parch priodol. Gan gymaint yr ystyriaeth a’r drafodaeth a gafwyd wrth baratoi’r dogfennau hyn, mae’n bwysig na fydd unrhyw anghysonderau wrth godi’r pwyntiau a wnaed yn ystod y ddadl fer hon. Mae’r Pwyllgor Busnes wedi ei sefydlu a phriodol fyddai ymdrin â’r anghysonderau hyn ar yr adeg hon. Yn y tymor hwy fe fydd Pwyllgor Safonau a fydd yn ystyried y materion hyn yn fanwl ac yn rheolaidd. Yr wyf yn awgrymu y dylai’r pwyntiau gael eu codi a’u trafod un ai’n syth gan y Pwyllgor Busnes neu, yn y tymor hir, gan y Pwyllgor Safonau, yn ôl cyfarwyddyd y Pwyllgor Busnes. Dylid mabwysiadu’r Cod fel bod safon ar gyfer ein busnes o’r diwrnod cyntaf.

Michael German spoken in English p. 13

Michael German siaradwyd yn Saesneg t. 13

I would be happy with this on condition that the matters are picked up and we have a report from the Business Committee on the decisions taken about those paragraphs. I refer also to paragraph 3.4, and if the First Secretary wishes to give the same response I would be quite happy to accept it. I need to explain why I am focusing on paragraph 3.4, which is about the Regional Committees. In the original draft, which we were given to discuss as political parties, there were two extra paragraphs that have since been deleted? They refer to the matter of collective responsibility, which is an interesting subject.

Byddwn yn derbyn hynny ar yr amod y bydd y materion yn cael eu dilyn ac y byddwn yn cael adroddiad gan y Pwyllgor Busnes ar y penderfyniadau a wnaed am y paragraffau hynny. Yr wyf yn cyfeirio hefyd at baragraff 3.4, ac os yw’r Prif Ysgrifennydd yn dymuno rhoi’r un ateb byddwn yn fodlon iawn ei dderbyn. Mae’n rhaid imi egluro pam yr wyf yn canolbwyntio ar baragraff 3.4, sy’n ymdrin â’r Pwyllgorau Rhanbarthol. Yn y drafft gwreiddiol, a roddwyd inni i’w drafod fel pleidiau gwleidyddol, yr oedd dau baragraff ychwanegol sydd bellach wedi eu dileu. Maent yn cyfeirio ar fater cydgyfrifoldeb, sydd yn bwnc diddorol.

I will read the omitted paragraph so that people can get a flavour of what the issue was about:

Darllenaf y paragraff a hepgorwyd fel y gellir cael syniad o’r hyn a oedd dan sylw:

‘As a Member of the Committee that includes his or her constituency or electoral region, an Assembly Secretary is acting in his or her capacity as an Assembly Member rather than as a Member of the Assembly Cabinet’.

‘Fel Aelod o’r Pwyllgor sy’n cynnwys ei (h)etholaeth neu ranbarth etholiadol, bydd un sydd yn Ysgrifennydd yn y Cynulliad yn gweithredu yn rhinwedd ei swydd fel Aelod o’r Cynulliad yn hytrach nag fel Aelod o Gabinet y Cynulliad’.

This is a particularly important phrase—acting in his capacity as an Assembly Member, behaving in a constituency role. The paragraph then goes on:

Mae hwn yn ymadrodd arbennig o bwysig—gweithredu yn rhinwedd ei swydd fel Aelod o’r Cynulliad, gan ymddwyn mewn rôl etholaethol. Â’r paragraff ymlaen:

‘An Assembly Secretary will want to take as full a part as possible in the proceedings of the Regional Committee on this basis, and be as open as possible as a Member of the Committee.’

‘Bydd un sydd yn Ysgrifennydd yn y Cynulliad yn dymuno cymryd cymaint o ran ag y bo modd yn nhrafodion y Pwyllgor Rhanbarthol ar y sail hon, ac am fod mor agored ag y bo modd fel Aelod o’r Pwyllgor.’

This is perfectly reasonable. The original draft says, however, an Assembly Secretary is still bound by the principle of greater responsibility and the Codes on Access to Information. There is, of course, a difficult balance because we are trying to use the Regional Committees in a way that differs from the original idea. They will be bound not by political balance but by geographical interests and will therefore be a different group of people. It is very important that the Assembly Secretaries be allowed to behave and act in their capacity as a member of the Assembly Cabinet. Paragraph 3.4 does not clarify the role of collective responsibility, and where that boundary lies.

Mae hyn yn gwbl resymol. Fodd bynnag, fe ddywed y drafft gwreiddiol y bydd un sydd yn Ysgrifennydd yn y Cynulliad wedi ei rwymo o hyd gan egwyddor cyfrifoldeb mwy a’r Codau ar yr Hawl i Weld Gwybodaeth. Mae cydbwysedd anodd yma, wrth gwrs, am ein bod yn ceisio defnyddio’r Pwyllgorau Rhanbarthol mewn modd gwahanol i’r syniad gwreiddiol. Ni fyddant wedi eu rhwymo gan gydbwysedd gwleidyddol ond yn hytrach gan fuddiannau daearyddol a byddant felly yn grŵp gwahanol o bobl. Mae’n bwysig iawn caniatáu i Ysgrifenyddion y Cynulliad ymddwyn a gweithredu yn rhinwedd eu swyddi fel aelod o Gabinet y Cynulliad. Nid yw paragraff 3.4 yn rhoi gwedd gliriach ar rôl cydgyfrifoldeb, ac ymhle y mae’r llinell derfyn honno.

The Assembly Secretaries and the Members of the Regional Committees need clarity in order to assure themselves that they understand which hat they are wearing. Assembly Secretaries will need to declare which hat they are wearing when they speak or when they take part in the Regional Committees. However, that needs to be clearer and it was a mistake to have omitted the two paragraphs in the draft or to have assimilated them in paragraph 3.4. I ask the Business Committee to clarify this matter. That would help us all in our roles on the Regional Committees.

Mae angen eglurdeb ar Ysgrifenyddion y Cynulliad ac Aelodau’r Pwyllgorau Rhanbarthol fel y gallant deimlo sicrwydd eu bod yn deall pa het y maent yn eu gwisgo. Bydd rhaid i Ysgrifenyddion y Cynulliad ddatgan pa het y maent yn eu gwisgo pan fyddant yn siarad neu pan gymerant ran yn y Pwyllgorau Rhanbarthol. Fodd bynnag, rhaid i hyn fod yn eglurach a chamgymeriad oedd hepgor y ddau baragraff a oedd yn y drafft neu eu cymathu ym mharagraff 3.4. Yr wyf yn gofyn i’r Pwyllgor Busnes roi gwedd gliriach ar y mater hwn. Byddai hynny’n helpu pob un ohonom yn ein rolau ar y Pwyllgorau Rhanbarthol.

In the interest of progress on this matter today, I suggest that the Assembly adopt the Code of Conduct as it is. As a matter of urgency the Business Committee could pick up on any points that have been made in this debate and have a wide level of consensus. It could then report back to the Assembly after the short recess, in early June, with some concrete proposals. I am concerned that we, as a group, sympathise with some of the ideas from the floor but do not have time to consider them. It would be helpful to see these points in writing. I suggest that we adopt this Code of Conduct as a framework today, on the understanding that we will, at an early opportunity, adapt and improve it. If other Members have additional amendments, these could be made through the Business Committee. That would be preferable to trying to discuss them in detail today, when we have nothing concrete in front of us.

Er mwyn gallu symud ymlaen ar y mater hwn heddiw, yr wyf yn awgrymu y dylai’r Cynulliad fabwysiadu’r Cod ar Ymddygiad fel y mae. Fel mater brys, gallai’r Pwyllgor Busnes ddilyn unrhyw bwyntiau a wnaed yn y ddadl hon a sicrhau lefel consensws eang. Gallai wedyn adrodd yn ôl i’r Cynulliad ar ôl y gwyliau byr, ddechrau Mehefin, gyda rhai cynigion pendant. Mae’n destun pryder imi ein bod, fel grŵp, yn cydymdeimlo â rhai o’r syniadau o’r llawr ond nad oes gennym amser i’w hystyried. Byddai o gymorth gweld y pwyntiau hyn mewn ysgrifen. Awgrymaf ein bod yn mabwysiadu’r Cod Ymddygiad hwn fel fframwaith heddiw, ar yr amod y byddwn yn ei addasu a’i wella’n fuan pan geir cyfle. Os oes gan Aelodau eraill newidiadau ychwanegol i’w cynnig, gellid gwneud hynny drwy’r Pwyllgor Busnes. Byddai hynny’n well na cheisio eu trafod yn fanwl heddiw, pan nad oes gennym ddim byd pendant ger ein bron.

This is a helpful contribution and I suggest that it should be the way forward. In response to the point that Michael German made, we need to look at the role of the Regional Committees because it can be expanded in an imaginative way, if that is the wish of Assembly Members. The Committees could be a powerful instrument for making every part of Wales feel that it is a part of the Assembly, and not subject to the north-south divide, the east-west divide and so on. Getting the Regional Committees right is very important. That includes their overall role, and consideration of Assembly Secretaries’ roles in them. I think in that sense, the examination of the role of the Regional Committees in developing that could encompass the sort of points that Mike German has made.

Mae hyn yn gyfraniad sydd o gymorth ac yr wyf yn awgrymu mai hon yw’r ffordd y dylid ei dilyn. Er mwyn ymateb i’r pwynt a wnaed gan Michael German, mae angen inni edrych ar rôl y Pwyllgorau Rhanbarthol oherwydd gellir ei hymestyn mewn modd creadigol, os hynny yw dymuniad Aelodau’r Cynulliad. Gallai’r Pwyllgorau fod yn arf pwerus i wneud i bob rhan o Gymru deimlo ei bod yn rhan o’r Cynulliad, ac nid yn ddarostyngedig i’r rhaniad rhwng y de a’r gogledd a’r dwyrain a’r gorllewin, ac yn y blaen. Mae’n bwysig iawn cael y Pwyllgorau Rhanbarthol i weithio’n iawn. Mae hynny’n cynnwys eu rôl gyffredinol, ac ystyriaeth i rôl Ysgrifenyddion y Cynulliad ynddynt. Yn yr ystyr honno, yr wyf yn credu y gallai archwiliad o rôl y Pwyllgorau Rhanbarthol wrth ddatblygu hynny gwmpasu’r math o bwyntiau a wnaeth Mike German.

At the moment, these matters should be in the remit of the Business Committee. However, as I indicated earlier, there is to be a Standards Committee. This Committee should consider these issues—from the point of view of the standards observed by Members in a variety of different capacities—rather than actually ordering the business of the Chamber. I think it would be extremely helpful if these matters were flagged up, and, if appropriate, were dealt with in the short term by the Business Committee. However, the Standards Committee should certainly deal with them as early items, once it has been established. I believe that will be the sensible way forward.

Ar hyn o bryd, dylai’r materion hyn fod yn rhan o gylch gwaith y Pwyllgor Busnes. Fodd bynnag, fel y nodais yn gynharach, y mae Pwyllgor Safonau i’w sefydlu. Dylai’r Pwyllgor hwnnw roi ystyriaeth i’r materion hyn—o safbwynt y safonau a gedwir gan Aelodau mewn amryw o swyddogaethau gwahanol—yn hytrach na thrwy drefnu busnes y Siambr. Credaf y byddai o gymorth mawr iawn pe bai’r materion hyn yn cael eu dwyn i’r golwg, ac, os yw’n briodol, yn cael eu trafod yn y tymor byr gan y Pwyllgor Busnes. Fodd bynnag, mae’n sicr y dylai’r Pwyllgor Safonau eu trafod ymhlith yr eitemau cyntaf, wedi iddo gael ei sefydlu. Credaf mai dyna fydd y ffordd synhwyrol ymlaen.

‘except the Audit Committee and the Legislation Committee.’

‘ac eithrio’r Pwyllgor Archwilio a’r Pwyllgor Deddfwriaeth.’

I would not like this Plenary session to go ahead without correcting that mistake.

John Marek siaradwyd yn Saesneg t. 16

Under paragraph 9, a Member must give notice, and satisfy the Presiding Officer, that a matter does not relate to a case that is being heard, or is to be heard, before a jury. That places quite an onus on the Member. It will not be possible for Members to know what is likely to come before any court in the country. Therefore, I wonder whether that matter could be referred back to the Business Committee, and whether a slightly weaker argument—referring to something being not likely to be sub judice, or judice—could be inserted instead.

O dan baragraff 9, rhaid i Aelod roi rhybudd, a rhoi sicrwydd i’r Llywydd, nad yw mater yn gysylltiedig ag achos sy’n cael ei wrando, neu sydd i’w wrando, gerbron rheithgor. Mae hynny’n rhoi cryn gyfrifoldeb ar yr Aelod. Ni fydd modd i Aelodau wybod beth sy’n debygol o ddod gerbron unrhyw lys yn y wlad. Felly, tybed a ellid cyfeirio’r mater hwnnw yn ôl i’r Pwyllgor Busnes, ac a ellid cynnwys dadl ychydig yn wannach—gan gyfeirio at rywbeth nad yw’n debygol o fod yn sub judice, neu’n judice—yn ei le.

Obviously the phraseology was carefully arrived at. On one hand, it is an attempt to prevent Members of the Assembly being inhibited from raising issues that are appropriate matters of public interest. On the other hand, it is an effort to ensure that care is taken in preventing an inappropriate reference to sub judice matters. Of course, paragraph 10 says that the Presiding Officer will issue guidelines on this matter. Once again, those are obviously intended to be on the basis of legal advice. If there is a wish to consider this further—because of the need to be careful and sensitive on such matters—I suggest that it is the sort of matter that should be considered further by the Standards Committee—with the advice available to them.

Mae’r geiriau hyn wedi eu penderfynu’n ofalus, wrth reswm. Ar un llaw, mae’n ymgais i beidio â rhwystro Aelodau’r Cynulliad rhag codi materion sydd yn faterion priodol er budd y cyhoedd. Ar y llaw arall, mae’n ymgais i sicrhau y cymerir gofal rhag cyfeiriadau amhriodol at faterion sub judice. Wrth gwrs, mae paragraff 10 yn dweud y bydd y Llywydd yn cyhoeddi canllawiau ar y mater hwn. Unwaith eto, mae’n amlwg bod y rheini i’w seilio ar gyngor cyfreithiol. Os oes dymuniad i drafod hyn ymhellach—oherwydd yr angen i fod yn ofalus ac yn sensitif ynghylch materion o’r fath—yr wyf yn awgrymu bod hyn yn fater o’r math a ddylai gael ei ystyried ymhellach gan y Pwyllgor Safonau—gyda’r cyngor sydd ar gael iddynt.

At present, I suggest that we should adopt the document as it stands. I think it is certainly possible to explore the points that John Marek has made. However, I do not think we should hold up the agreement on the protocol in the meantime.

Ar hyn o bryd, awgrymaf y dylem fabwysiadu’r ddogfen fel y mae. Credaf yn sicr y bydd modd archwilio’r pwyntiau a wnaeth John Marek. Fodd bynnag, nid wyf yn credu y dylem rwystro’r cytundeb ar y protocol yn y cyfamser.

If Members turn to Standing Order No. 7.13, they will see that the jurisdiction of the Presiding Officer is limited to matters relating to matters of general public importance, or to a case that is to be heard, and matters raised by means of a motion, so this is indeed covered by Standing Orders.

Os bydd yr Aelodau’n troi at Reol Sefydlog Rhif 7.13, fe welant fod awdurdod y Llywydd yn gyfyngedig i faterion sy’n ymwneud â materion sydd o bwys cyffredinol i’r cyhoedd, neu i achos sydd i gael gwrandawiad, a materion a godir drwy gynnig, felly mae hyn yn sicr yn ddarostyngedig i’r Rheolau Sefydlog.

Michael German spoken in English p. 18

Michael German siaradwyd yn Saesneg t. 18

I would like to move that this motion be referred to the Business Committee. It was mentioned to all parties this morning, in the meeting of the Business Committee, that we would be doing that. I propose this because it is contrary to the spirit and nature of the Government of Wales Act. Paragraph 62 1(a) and (b) of the Government of Wales Act, says:

Hoffwn gynnig y dylai’r cynnig hwn gael ei gyfeirio i’r Pwyllgor Busnes. Dywedwyd wrth yr holl bleidiau fore heddiw, yng nghyfarfod y Pwyllgor Busnes, y byddem yn gwneud hynny. Yr wyf yn cynnig hyn am ei fod yn groes i ysbryd a natur Deddf Llywodraeth Cymru. Mae paragraff 62 1(a) a (b) Deddf Llywodraeth Cymru, yn dweud:

‘The Assembly may delegate functions of the Assembly,’

‘Gall y Cynulliad ddirprwyo swyddogaethau’r Cynulliad,’

—and the crucial words here are in brackets—

—ac mae’r geiriau holl bwysig yma rhwng cromfachau—

‘(to such extent as the Assembly may determine) to— (a) any committee of the Assembly, or (b) the Assembly First Secretary.’

‘(i’r graddau hynny y gall y Cynulliad eu penderfynu) i— (a) unrhyw bwyllgor o’r Cynulliad, neu (b) i Brif Ysgrifennydd y Cynulliad.’

The problem is that the motion before us does not reflect that spirit—which is that the Assembly will determine the functions that it will delegate to any Committee of the Assembly and the functions that it will delegate to the First Secretary. The motion may have been misdrafted—perhaps it is parliamentary formality—but it reads to me that the Assembly delegates its functions to the First Secretary. If that is the case, then it clearly does not reflect the spirit of the Government of Wales Act.

Y broblem yw nad yw’r cynnig sydd ger ein bron yn adlewyrchu’r ysbryd hwnnw—sef y bydd y Cynulliad yn penderfynu’r swyddogaethau a ddirprwyir ganddo i unrhyw Bwyllgor o’r Cynulliad a’r swyddogaethau a ddirprwyir ganddo i’r Prif Ysgrifennydd. Hwyrach fod y cynnig wedi ei gamddrafftio—efallai mai ffurfioldeb seneddol ydyw—ond yr hyn a welaf wrth ei ddarllen yw bod y Cynulliad yn dirprwyo ei swyddogaethau i’r Prif Ysgrifennydd. Os hynny sy’n wir, mae’n amlwg nad yw’n adlewyrchu ysbryd Deddf Llywodraeth Cymru.

It is difficult to amend a motion of this sort, because of difficulties with the intranet. As a result, a procedural motion is all that is available to us. Let us consider the matters that could be delegated as a result of this proposal. It might mean, for example, that the First Secretary could look at the allocation of funding available for the capital modernisation fund, and whether that money would go to hospitals or to schools. And in order to define the proposal fully, it needs to be considered more fully.

Anodd yw gwella cynnig o’r math hwn, oherwydd anawsterau gyda’r fewnrwyd. O ganlyniad i hynny, cynnig trefniadol yw’r unig ddewis sydd ar gael i ni. Gadewch inni ystyried y materion y gellid eu dirprwyo o ganlyniad i’r cynnig hwn. Gallai olygu, er enghraifft, y byddai’r Prif Ysgrifennydd yn gallu ystyried y dyraniad cyllid sydd ar gael i’r gronfa moderneiddio cyfalaf, ac a fyddai’r arian hwnnw yn mynd i ysbytai neu i ysgolion. Ac er mwyn diffinio’r cynnig yn llawn, bydd rhaid ei ystyried yn llawnach.

I think this Assembly has a duty to determine the functions that should go to the First Secretary, those that should go to the Committees and those that should go to the Assembly as a whole. The motion does not make that clear. I think that we have given ourselves an opportunity to remove from the Assembly the power of the Committees and the power of the floor.

Credaf fod dyletswydd ar y Cynulliad hwn i benderfynu ynghylch y swyddogaethau a ddylai fynd i’r Prif Ysgrifennydd, y rhai a ddylai fynd i’r Pwyllgorau a’r rhai a ddylai fynd i’r Cynulliad cyfan. Nid yw’r cynnig yn dweud hynny’n bendant. Credaf ein bod wedi rhoi cyfle i ni ein hunain i symud pŵer y Pwyllgorau a phŵer y llawr o’r Cynulliad.

It seems to me that this is a clear issue, particularly when you consider the political arithmetic of this Assembly. It is not in the power of any one group or party to be able to deliver any one thing. However, if you give that power away, you abrogate that responsibility. I worry that this Westminster-style motion, which gives all the power to the First Secretary, will emasculate this Assembly before it has begun. I ask that we do not debate this motion today but refer it to the Business Committee, which will take on board the spirit of delegation as proposed in the Government of Wales Act. This will allow us as an Assembly to determine what power we want ourselves and what powers we want to give to the First Secretary. We are on a slightly dangerous road if we give all that power to the First Secretary. The lack of clarity in the motion requires that we look at it again. There is no reason why this cannot be dealt with swiftly, but it does need to be dealt with. We would not be doing our duty to the people of Wales if we did not take the opportunity to discuss precisely what roles and powers we are going to give to each other.

Mae hyn yn ymddangos yn fater eglur i mi, yn enwedig pan ystyriwch rifyddeg wleidyddol y Cynulliad hwn. Nid yw yng ngallu unrhyw un grŵp neu blaid i gyflawni unrhyw beth penodol. Fodd bynnag, os rhoddwch y pŵer hwnnw i eraill, byddwch yn diddymu’r cyfrifoldeb hwnnw. Y mae’n ofid gennyf y bydd y cynnig hwn, sy ar ffurf rhai San Steffan, sydd yn rhoi’r holl bŵer i’r Prif Ysgrifennydd, yn gwanychu’r Cynulliad hwn cyn iddo ddechrau. Gofynnaf am beidio â thrafod y cynnig hwn heddiw a’i gyfeirio at y Pwyllgor Busnes, a fydd yn arddel ysbryd y dirprwyo fel y’i cynigiwyd yn Neddf Llywodraeth Cymru. Bydd hynny’n caniatáu i ni fel Cynulliad benderfynu pa bŵer yr ydym am ei arfer ein hunain a pha bwerau yr ydym am eu rhoi i’r Prif Ysgrifennydd. Byddwn yn dilyn llwybr braidd yn beryglus os rhown y cwbl o’r pŵer hwnnw i’r Prif Ysgrifennydd. Mae’r diffyg eglurdeb sydd yn y cynnig yn ei gwneud yn ofynnol inni ei ailystyried. Nid oes rheswm pam na ellir delio â hyn yn gyflym, ond y mae angen gwneud hynny. Ni fyddem yn cyflawni ein dyletswydd i bobl Cymru pe na chymerem y cyfle i drafod yn union pa rolau a phwerau yr ydym am eu rhoi i’n gilydd.

Yr wyf yn derbyn ysbryd cynnig Mike German. Trafodwyd y mater yn fyr iawn gan y Pwyllgor Busnes ac am mai hwn yw un o’r penderfyniadau pwysicaf y byddwn yn ei wneud heddiw, yr wyf yn derbyn bod angen cael mwy o drafodaeth arno. Gan hynny, byddwn yn cefnogi ei gynnig er mwyn i’r Pwyllgor Busnes gael cyfle i ystyried y goblygiadau yn fanylach.

I accept the spirit of Mike German’s proposal. The matter has been discussed very briefly by the Business Committee and as this is one of the most important decisions that we will make today, I accept that we need further discussion about it. Therefore, I support his motion so that the Business Committee has further time to discuss the implications in more detail.

Alun Michael The First Secretary spoken in English p. 20

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 20

It may be helpful if I explain the background to the resolution. As I indicated earlier there was much consultation on the way Assembly business would be conducted. That consultation included the recommendations of the National Assembly Advisory Group and extended consultation with all the political parties, both with the leaders of the parties in Westminster and in Wales, and with the parties in Wales directly. The purpose was to get into place the recommendation, which had all-party support, that the Assembly should be run by the Cabinet method, with the Cabinet accountable to the Assembly for the actions it takes. Involving the Assembly as a whole, as I have made clear, is an important element in the development and formation of policy. There needs to be a positive relationship between the Cabinet, the Assembly Secretaries who make up that Cabinet, and the individual Committees, not just in terms of accountability, although that is important, but also in terms of working together on the development and promotion of policy.

Fe allai fod o gymorth pe bawn yn egluro’r cefndir i’r penderfyniad. Fel y nodais yn gynharach cafwyd llawer o ymgynghori ynghylch y modd y byddid yn cynnal busnes y Cynulliad. Yr oedd yr ymgynghoriad hwnnw’n cynnwys argymhellion Grŵp Ymgynghorol y Cynulliad Cenedlaethol ac ymgynghori ehangach gyda’r holl bleidiau gwleidyddol, gydag arweinyddion y pleidiau yn San Steffan ac yng Nghymru, a gyda’r pleidiau yng Nghymru yn uniongyrchol. Yr amcan oedd sefydlu’r argymhelliad, a gefnogwyd gan bob plaid, y dylai’r Cynulliad gael ei redeg trwy’r dull Cabinet, a’r Cabinet yn atebol i’r Cynulliad am ei weithredoedd. Fel yr eglurais, mae cynnwys y Cynulliad cyfan yn elfen bwysig wrth ddatblygu a ffurfio polisïau. Rhaid wrth berthynas gadarnhaol rhwng y Cabinet, Ysgrifenyddion y Cynulliad sy’n ffurfio’r Cabinet hwnnw, a’r Pwyllgorau unigol, nid yn unig o ran atebolrwydd, er bod hynny’n bwysig, ond hefyd o ran cydweithio ar ddatblygu a hyrwyddo polisi.

The documents that are now before us, and the delegations that are recommended, were included with the Standing Orders that were circulated in large numbers. Indeed, some of the parties had more copies than they needed in order to ensure that there were plenty available for circulation and discussion well in advance. I am trying to explain the nature of the delegations, and the fact that they are to establish the Cabinet system and the system of responsibility and accountability, by delegating powers to the First Secretary. The First Secretary then delegates those powers to individual Cabinet members according to their portfolios, which I announced last week. The delegations recommended are important, therefore, in establishing the system of Cabinet leadership and accountability for which there was all-party support.

Yr oedd y dogfennau sydd ger ein bron yn awr, a’r dirprwyaethau a argymhellir, wedi eu cynnwys gyda’r niferoedd mawr o Reolau Sefydlog a gylchredwyd. Yn wir, rhoddwyd mwy o gopïau na’r angen i rai o’r pleidiau er mwyn sicrhau bod digon ar gael i’w cylchredeg a’u trafod ymhell o flaen llaw. Yr wyf yn ceisio egluro natur y dirprwyaethau, a’r ffaith mai eu bwriad yw sefydlu’r system Gabinet a’r system o gyfrifoldeb ac atebolrwydd, drwy ddirprwyo pwerau i’r Prif Ysgrifennydd. Wedyn bydd y Prif Ysgrifennydd yn dirprwyo’r pwerau hynny i aelodau unigol y Cabinet yn ôl eu portffolios, a chyhoeddais hynny yr wythnos diwethaf. Mae’r dirprwyaethau a argymhellir yn bwysig, felly, wrth sefydlu’r system o arweinyddiaeth ac atebolrwydd drwy Gabinet a gefnogwyd gan yr holl bleidiau.

Jenny Randerson spoken in English p. 21

Jenny Randerson siaradwyd yn Saesneg t. 21

Returning this matter to the Business Committee for discussion is a symbolic step to make sure that we do things with the agreement of all parties. When this motion was originally thought of some weeks ago, it was probably with the assumption that the Cabinet would come from a party with an overall majority in the Assembly. That is not the case, and it is essential that we do not allow a motion as open-ended as this one. It is even more open-ended than the Government of Wales Act and I believe that that Act was not tight enough. It is up to the Assembly to decide what it delegates and it is important that the Business Committee looks coolly, and with all-party agreement, at how we proceed and how the Cabinet structure is to be set up, bearing in mind the political make-up of the Assembly. Therefore, on the grounds that there is no harm in reconsidering this matter, I support the procedural motion.

Drwy gyfeirio’r mater hwn yn ôl at y Pwyllgor Busnes i’w drafod fe gymerir cam symbolaidd i sicrhau ein bod yn gwneud pethau gyda chytundeb yr holl bleidiau. Pan feddyliwyd gyntaf am y cynnig hwn rai wythnosau’n ôl, mae’n fwy na thebyg fod rhagdybiaeth y byddai’r Cabinet yn dod o blaid a oedd â mwyafrif dros bawb arall yn y Cynulliad. Nid hynny a fu, ac mae’n holl bwysig nad ydym yn caniatáu cynnig sydd mor benagored â hwn. Mae’n fwy penagored hyd yn oed na Deddf Llywodraeth Cymru a chredaf nad oedd y ddeddf honno’n ddigon tyn. Lle’r Cynulliad yw penderfynu’r hyn y bydd yn ei ddirprwyo ac mae’n bwysig fod y Pwyllgor Busnes yn edrych yn bwyllog, a gyda chytuniad yr holl bleidiau, ar y modd y byddwn yn symud ymlaen ac ar y modd y sefydlir strwythur y Cabinet, gan gofio cyfansoddiad gwleidyddol y Cynulliad. Felly, ar y sail nad oes dim o’i le mewn ailystyried y mater, yr wyf yn cefnogi’r cynnig trefniadol.
