Dafydd Elis-Thomas The Presiding Officer spoken in Welsh p. 2

Galwaf Gynulliad Cenedlaethol Cymru i drefn. Ar ddiwedd yr agenda heddiw —gobeithiaf y byddwn yn gorffen yn gynnar—byddaf yn galw ar y Prif Ysgrifennydd, yn ei rôl fel Ysgrifennydd Gwladol Cymru, i gyflwyno copi o’r Gorchymyn Trosglwyddo Swyddogaethau yn ffurfiol i’r Cynulliad.

I call the National Assembly of Wales to order. At the end of today’s agenda—I hope that we will finish early—I will call on the First Secretary, in his role as Secretary of State for Wales, to formally present a copy of the Transfer of Functions Order to the Assembly.

Yna, byddwn yn croesawu holl Aelodau’r Cynulliad i ymuno â ni y tu allan i’r Siambr fel y gallwn gael ffotograff i nodi’r achlysur hanesyddol hwn. Gobeithiaf mai dyna’r tro olaf y byddaf yn defnyddio’r gair ‘hanesyddol’.

Then, we will welcome all Assembly Members to join us outside the Chamber so that we can take a photograph to mark this historic occasion. Hopefully, that is the last time that I will use the word ‘historic’.

Cwestiynau i Ysgrifennydd yr Amgylchedd a Llywodraeth Leol

Questions to the Secretary for the Environment and Local Government

Llechres Lygredd Gynhwysfawr

Comprehensive Pollution Inventory

Q1 Peter Black spoken in English p. 2

C1 Peter Black siaradwyd yn Saesneg t. 2

What plans does Peter Law have to introduce a comprehensive pollution inventory for Wales so that air pollution and measures taken to tackle it can be effectively monitored? (OAQ252JS)

Pa gynlluniau sydd gan Peter Law i gyflwyno llechres lygredd gynhwysfawr ar gyfer Cymru er mwyn gallu monitro llygredd aer a mesurau i ddelio â hynny yn effeithiol? (OAQ252JS)

Peter Law The Secretary for the Environment and Local Government spoken in English p. 2

Peter Law Ysgrifennydd yr Amgylchedd a Llywodraeth Leol siaradwyd yn Saesneg t. 2

I appreciate your interest in this subject, bearing in mind that you raised it at the recent Environment Committee meeting. Environment Agency Wales recently published a pollution inventory, covering over 150 substances, from which information can be extracted for Wales, or a specific area of Wales. In addition, the Welsh Office is supporting a project to disaggregate existing greenhouse gas emission inventories for the United Kingdom so that figures for Wales will be available.

Gwerthfawrogaf eich diddordeb yn y pwnc hwn, gan gofio ichi ei godi yng nghyfarfod diweddar Pwyllgor yr Amgylchedd. Cyhoeddodd Asiantaeth yr Amgylchedd Cymru lechres lygredd yn ddiweddar a oedd yn ymwneud â rhagor na 150 o sylweddau. Gellir cael manylion am Gymru neu am ardal benodol yng Nghymru drwy dynnu gwybodaeth o’r llechres honno. Hefyd, mae’r Swyddfa Gymreig yn cefnogi prosiect i ddadelfennu’r llechresi sydd ar gael ar gyfer gollyngiadau nwy tŷ gwydr yng ngwledydd y Deyrnas Unedig er mwyn darparu ffigurau ar gyfer Cymru.

Peter Black spoken in English p. 2

Peter Black siaradwyd yn Saesneg t. 2

Thank you for that answer; it is very encouraging. What is the timetable for the publication of the Welsh Office’s information?

Diolch am yr ateb yna; mae’n galonogol iawn. Beth yw’r amserlen ar gyfer cyhoeddi gwybodaeth y Swyddfa Gymreig?

Peter Law spoken in English p. 3

Peter Law siaradwyd yn Saesneg t. 3

Environment Agency Wales’s pollution inventory is widely available to the public at the Agency’s offices and on the Internet. It gives information from over 2000 of the major industrial processes in England and Wales. The range of information covered will be expanded soon.

Mae llechres lygredd Asiantaeth yr Amgylchedd Cymru ar gael i’r cyhoedd yn swyddfeydd yr Asiantaeth ac ar y Rhyngrwyd. Mae’n rhoi gwybodaeth sydd yn deillio o dros 2000 o’r prif brosesau diwydiannol yng Nghymru a Lloegr. Ehangir ystod y wybodaeth a gynhwysir cyn bo hir.

Janet Ryder spoken in English p. 3

Janet Ryder siaradwyd yn Saesneg t. 3

Are you aware that the Pollution Prevention and Control Bill going through Parliament will give the Assembly new powers in this area? Do you intend to use these powers to press for realistic financial penalties on polluters that reflect the serious damage to public health that can be caused by pollution?

Ydych chi’n ymwybodol y bydd y Mesur Atal a Rheoli Llygredd sydd yn mynd drwy’r Senedd yn rhoi pwerau newydd i’r Cynulliad yn y maes hwn? Ydych chi’n bwriadu defnyddio’r pwerau hyn i bwyso am gosbau ariannol realistig i lygrwyr sydd yn adlewyrchu’r difrod difrifol i iechyd y cyhoedd y gall llygredd ei achosi?

Peter Law spoken in English p. 3

Peter Law siaradwyd yn Saesneg t. 3

Bearing in mind the well-being of the communities of all people in Wales, it is important that we are prepared to look seriously at using powers available to us if necessary. That is why we have them. If those powers were here, I would want to consider that. However, we have a useful local air-quality management scheme, which requires local authorities to review air quality every year. I will pursue that.

O ystyried lles cymunedau holl bobl Cymru, mae’n bwysig ein bod yn barod i edrych o ddifrif ar ddefnyddio’r pwerau sydd ar gael inni os oes angen. Dyna paham y mae’r pwerau hynny gennym. Pe bai’r pwerau hynny yma, byddwn am ystyried hynny. Fodd bynnag, mae gennym gynllun lleol defnyddiol ar gyfer rheoli ansawdd aer, cynllun sydd yn mynnu bod awdurdodau lleol yn adolygu ansawdd aer bob blwyddyn. Byddaf yn mynd ar drywydd hynny.

Adeiladu Cefnffyrdd

Road Construction

Q2 Phil Williams spoken in English p. 3

C2 Phil Williams siaradwyd yn Saesneg t. 3

What revisions are planned in the existing programme for road construction in Wales, and is Peter Law prepared to switch priorities in the programme to give greater emphasis to north-south communications within Wales, including the Valleys? (OAQ277JS)

Pa ddiwygiadau sydd wedi’u cynllunio yn y rhaglen gyfredol ar gyfer adeiladu cefnffyrdd yng Nghymru, ac a yw Peter Law yn barod i newid blaenoriaethau yn y rhaglen i roi mwy o bwyslais ar gysylltiadau gogledd-de yng Nghymru, gan gynnwys y Cymoedd? (OAQ277JS)

Peter Law spoken in English p. 3

Peter Law siaradwyd yn Saesneg t. 3

I am sure that we all wish to improve routes throughout Wales, particularly north-south routes. The Assembly will commence a full budget review shortly, which will consider the balance of existing plans and priorities for spending. I am keen to meet priorities such as north-south communications and the needs of the Valleys. However, other parts of Wales, such as Pembrokeshire, also need to be considered.

Yr wyf yn siŵr y byddem i gyd yn dymuno gwella ffyrdd ledled Cymru, yn enwedig ffyrdd rhwng y gogledd a’r de. Bydd y Cynulliad yn dechrau cynnal adolygiad llawn ar y gyllideb cyn bo hir a fydd yn ystyried y cydbwysedd rhwng y cynlluniau sydd gennym eisoes a blaenoriaethau ar gyfer gwario. Yr wyf yn awyddus i ymateb i flaenoriaethau megis cysylltiadau gogledd-de ac anghenion y Cymoedd. Fodd bynnag, mae angen hefyd ystyried rhannau eraill o Gymru, megis Sir Benfro.

Phil Williams spoken in English p. 4

Phil Williams siaradwyd yn Saesneg t. 4

If approved, what is the earliest date by which a bypass could be built at Cwm, Ebbw Vale?

Pe bai’n cael ei chymeradwyo, pa bryd fyddai’r cynharaf y gellid adeiladu ffordd osgoi yng Nghwm, Glynebwy?

Peter Law spoken in English p. 4

Peter Law siaradwyd yn Saesneg t. 4

I can hardly believe that that was a supplementary question. However, I appreciate the point. The Cwm bypass scheme is one of three in the Valleys that are receiving support for preparation costs in 1999-2000 under the transport grant arrangements, particularly through the local authorities. We shall look carefully at bids from local authorities throughout Wales, which were invited for transport grant support for 2000-2001. The Assembly will have to consider this matter through its Committee and we will take into account all the representations that are made, bearing in mind that the budget is limited. However, I appreciate the social exclusion problem in so many areas where bypasses are needed.

Prin y gallaf gredu mai cwestiwn atodol oedd hwnna. Fodd bynnag, yr wyf yn gwerthfawrogi’r pwynt. Mae cynllun ffordd osgoi Cwm yn un o dri yn y Cymoedd sydd yn cael cefnogaeth ar gyfer y costau paratoi yn 1999-2000 dan drefniadau’r grant trafnidiaeth, yn benodol drwy’r awdurdodau lleol. Byddwn yn edrych yn ofalus ar geisiadau gan awdurdodau lleol o bob rhan o Gymru a wahoddwyd i ymgeisio am gefnogaeth grant trafnidiaeth ar gyfer 2000-2001. Bydd rhaid i’r Cynulliad ystyried hyn drwy gyfrwng ei Bwyllgor a byddwn yn ystyried pob dadl a gyflwynir, gan gofio mai cyllideb gyfyngedig sydd gennym. Fodd bynnag, yr wyf yn ymwybodol o’r broblem allgáu cymdeithasol sydd yn bodoli mewn cymaint o ardaloedd lle mae angen ffordd osgoi.

Alun Pugh spoken in English p. 4

Alun Pugh siaradwyd yn Saesneg t. 4

Do you accept that there are grounds other than simple economics? I am thinking of the unity of our nation, which should determine road-building priorities.

A ydych chi’n derbyn bod dadleuon eraill ar wahân i ddadleuon economaidd pur? Undod ein cenedl sydd gennyf dan sylw, ac fe ddylai hynny bennu ein blaenoriaethau ar gyfer adeiladu ffyrdd.

Peter Law spoken in English p. 4

Peter Law siaradwyd yn Saesneg t. 4

Yes, I accept that. However, in the real world we are governed very much by economics. There are many points to consider whilst looking at the need for road development. At present we have a positive programme for developing our trunk roads and I hope that the Environment Committee will play a part in advising us on the best way forward as far as our north-south route and other important strategic routes in Wales are concerned.

Ydwyf. Yr wyf yn derbyn hynny. Fodd bynnag, yn y byd go iawn, economeg sydd yn ein rheoli i raddau helaeth iawn. Mae nifer o bwyntiau i’w hystyried wrth edrych ar yr angen am ddatblygu ffyrdd. Mae gennym raglen gadarnhaol ar gyfer datblygu cefnffyrdd ar hyn o bryd, a gobeithiaf y bydd Pwyllgor yr Amgylchedd yn cyfrannu drwy ein cynghori beth yw’r ffordd orau ymlaen wrth ystyried y ffordd rhwng y gogledd a’r de a ffyrdd strategol eraill yng Nghymru.

Michael German spoken in English p. 4

Michael German siaradwyd yn Saesneg t. 4

Given the Welsh Assembly’s limited powers in relation to railways and the fact that many people make shorter journeys than the long north-south Wales haul, what is your attitude towards reopening stations where there are existing freight or passenger lines? That would assist in getting more traffic off the roads and on to the railways.

Wrth ystyried pwerau cyfyngedig y Cynulliad Cenedlaethol dros y rheilffyrdd a’r ffaith fod llawer o bobl yn gwneud teithiau byrrach na’r daith hir o’r gogledd i’r de, beth yw eich agwedd tuag at ailagor gorsafoedd lle mae rheilffyrdd cludiant neu deithwyr yn bodoli eisoes? Byddai hynny’n gymorth i symud mwy o drafnidiaeth o’r ffyrdd i’r rheilffyrdd.

Peter Law spoken in English p. 5

Peter Law siaradwyd yn Saesneg t. 5

I support that wherever possible, bearing in mind that it is a matter for the Office of Passenger Rail Franchising. We can only be consulted on this matter, but we are an important consultee. The new Strategic Rail Authority will have to consult us by statute. There are great opportunities to reopen a number of stations and lines, such as the Vale of Glamorgan line on which money is being spent for strengthening for freight and, hopefully, passenger train use. Another example is the Newport to Ebbw Vale line, which could be used for a service between Cardiff and Abertillery. I discussed these developments recently with Sir Alastair Morton, the chairman of the Strategic Rail Authority. He looks forward to a positive relationship with the National Assembly and regards our views on rail matters as important.

Cefnogaf hynny lle bynnag y bo modd, gan gofio mai mater yw hyn i’r Swyddfa Trwyddedu Rheilffyrdd Teithwyr. Dim ond swyddogaeth ymgynghorol sydd gennym ni yn hyn o beth, ond mae’r swyddogaeth honno’n un bwysig. Bydd rhaid i’r Awdurdod Rheilffyrdd Strategol newydd ymgynghori â ni yn ôl y gyfraith. Mae cyfleoedd gwych i ailagor nifer o orsafoedd a rheilffyrdd, megis rheilffordd Bro Morgannwg lle mae arian yn cael ei wario i gryfhau’r defnydd o drenau cludiant a threnau teithwyr, gobeithio. Enghraifft arall yw’r rheilffordd o Gasnewydd i Lynebwy, y gellid ei defnyddio ar gyfer gwasanaeth rhwng Caerdydd ac Abertyleri. Trafodais y datblygiadau hyn yn ddiweddar gyda Syr Alastair Morton, cadeirydd yr Awdurdod Rheilffyrdd Strategol. Mae’n edrych ymlaen at greu perthynas adeiladol gyda’r Cynulliad Cenedlaethol ac yn rhoi pwys ar ein barn ni am faterion sydd yn ymwneud â’r rheilffyrdd.

Glyn Davies spoken in English p. 5

Glyn Davies siaradwyd yn Saesneg t. 5

Is Peter aware of a report by the Institute of Welsh Affairs last year, which identified a cost-effective programme of strategically located road-widening improvements, which would reduce the time travelling between north and south Wales by an hour, at a cost of about £63 million? That programme could be phased in over a number of years. Will he consider the recommendations in that report?

A yw Peter yn ymwybodol o adroddiad gan y Sefydliad Materion Cymreig y llynedd lle soniwyd am raglen gost-effeithiol o welliannau lledu-ffyrdd mewn mannau strategol, a fyddai’n lleihau awr oddi ar yr amser teithio rhwng y gogledd a’r de ac yn costio oddeutu £63 miliwn? Gellid cyflawni’r rhaglen fesul cam dros nifer o flynyddoedd. A fydd yn ystyried yr argymhellion yn yr adroddiad hwnnw?

Peter Law spoken in English p. 5

Peter Law siaradwyd yn Saesneg t. 5

We all want to do our best to improve the north-south communication and knock as much time off as possible. With that in mind, it is pleasing that two schemes on the A470 will hopefully start this year—one of those is the Dolwyddelan to Pont-yr-Afanc road. The A487 Llanwnda to Llanllyfni bypass is out for tenders and that will be a great relief to people between Porthmadog and Caernarfon.

Yr ydym i gyd am wneud ein gorau i wella’r cysylltiadau rhwng y gogledd a’r de a lleihau’r amser teithio gymaint ag y bo modd. Gyda hynny mewn golwg, mae’n braf gweld y bydd dau gynllun ar yr A470 yn dechrau eleni gobeithio—un o’r rheini yw’r ffordd o Ddolwyddelan i Bont-yr-Afanc. Mae ffordd osgoi’r A487 rhwng Llanwnda a Llanllyfni wedi’i gosod i dendr a bydd hynny’n rhyddhad mawr i bobl rhwng Porthmadog a Chaernarfon.

We have started a corridor study, which will take about six to nine months to complete, on the A470 between Brecon and Llandudno. It will also include the A483 and the A487. The Institute of Welsh Affairs report ‘Uniting the Nation’ will be considered in this study.

Dechreuwyd ar astudiaeth goridor y bydd angen oddeutu chwech i naw mis i’w chwblhau, ar yr A470 rhwng Aberhonddu a Llandudno. Bydd hefyd yn cynnwys yr A483 a’r A487. Rhoddir ystyriaeth i adroddiad y Sefydliad Materion Cymreig ‘Uno’r Genedl’ yn yr astudiaeth hon.

Sue Essex spoken in English p. 6

Sue Essex siaradwyd yn Saesneg t. 6

In view of the huge demands on the transport budget, which you have already mentioned, would you agree that it is vital that sensible criteria such as integration, environmental sustainability and safety are needed to judge all future proposals for transport infrastructure?

Gyda golwg ar y gofynion aruthrol ar y gyllideb drafnidiaeth yr ydych eisoes wedi sôn amdanynt, a fyddech yn cytuno ei bod hi’n holl bwysig sicrhau meini prawf synhwyrol, megis integreiddio, cynaliadwyedd amgylcheddol a diogelwch wrth farnu pob cynnig ar gyfer y seilwaith trafnidiaeth yn y dyfodol?

Peter Law spoken in English p. 6

Peter Law siaradwyd yn Saesneg t. 6

That is wise counsel, Sue. We must consider those important factors. It all comes back to sustainable development. We have talked a lot about it and I look forward to working with my friend, Christine, on it in the future. So, yes I would agree with that.

Dyna ddweud doeth, Sue. Rhaid inni ystyried y ffactorau pwysig hynny. Datblygu cynaliadwy sydd yn sail i’r cyfan. Buom yn sôn llawer amdano ac edrychaf ymlaen at weithio gyda fy nghyfaill, Christine, ar hyn yn y dyfodol. Felly, byddwn, fe fyddwn yn cytuno â hynny.

Cyfarwyddyd Cynllunio Mwynol

C3 Huw Lewis siaradwyd yn Saesneg t. 6

Can Peter Law give an update on the mineral planning guidance consultation document (MPG3)? (OAQ275VB)

A yw Peter Law yn gallu rhoi’r sefyllfa ddiweddaraf ar y ddogfen ymgynghorol ar gyfarwyddyd cynllunio mwynol (MPG3)? (OAQ275VB)

Peter Law spoken in English p. 6

Peter Law siaradwyd yn Saesneg t. 6

Following the consultation exercise in Wales, a draft version of the annual planning document is being prepared by officials. The Environment Committee will have an opportunity to see the draft before I issue it.

Yn dilyn yr ymgynghori yng Nghymru, mae’r swyddogion wrthi’n paratoi fersiwn ddrafft o’r ddogfen gynllunio flynyddol. Bydd cyfle i Bwyllgor yr Amgylchedd weld y drafft cyn imi ei gyhoeddi.

Huw Lewis spoken in English p. 6

Huw Lewis siaradwyd yn Saesneg t. 6

Can the Secretary give an indication of what emphasis he will place on any environmental impact assessments and public health reports made on opencast applications?

A all yr Ysgrifennydd roi syniad inni faint o bwyslais a roddir ganddo ar asesiadau effaith ar yr amgylchedd ac adroddiadau iechyd y cyhoedd a wneir ar geisiadau am weithfeydd glo brig?

Peter Law spoken in English p. 6

Peter Law siaradwyd yn Saesneg t. 6

I realise the importance of that question, particularly for you. I will pay great attention to any such reports relating to public health and the environment in all applications which come before me.

Sylweddolaf bwysigrwydd y cwestiwn yna, yn enwedig i chi. Byddaf yn rhoi sylw mawr i adroddiadau o’r fath sydd yn ymwneud ag iechyd y cyhoedd a’r amgylchedd ym mhob cais a ddaw ger fy mron.

Brian Hancock spoken in English p. 7

Brian Hancock siaradwyd yn Saesneg t. 7

When MPG3 is drawn up, will you include a strong presumption against the development of new opencast mining?

Pan baratoir MPG3, a fyddwch chi’n cynnwys rhagdybiaeth gref yn erbyn datblygu gweithfeydd glo brig newydd?

Peter Law spoken in English p. 7

Peter Law siaradwyd yn Saesneg t. 7

It would not be right for me to suggest any strong presumption before the Committee has been consulted and has looked at that document. That is the meaning of consultation. I will listen to what the Committee has to say before it is drawn up and also to many other people about the best way forward, so I cannot give you an assurance that I will include that strong presumption. However, it is important that we ensure that we put in place regulations that are in the interests of the communities we serve.

Ni fyddai’n iawn i mi awgrymu unrhyw ragdybiaeth gref cyn ymgynghori â’r Pwyllgor a chyn iddynt edrych ar y ddogfen honno. Dyna beth yw ystyr ymgynghori. Byddaf yn gwrando ar beth sydd gan y Pwyllgor i’w ddweud cyn ei lunio a hefyd ar lawer o bobl eraill ynghylch beth yw’r ffordd orau i fwrw ymlaen, felly ni allaf roi sicrwydd ichi y byddaf yn cynnwys y rhagdybiaeth gref honno. Fodd bynnag, mae’n bwysig ein bod ni’n sefydlu rheoliadau sydd er budd y cymunedau a wasanaethwn.

Rod Richards spoken in English p. 7

Rod Richards siaradwyd yn Saesneg t. 7

Does the Secretary for the Environment agree that MPG3 and any future plans depend upon local authorities’ future settlements and budgets being certain? Is he aware that in Denbighshire there is no such certainty because of the debt inherited from the former Rhuddlan Borough Council? Is he prepared to write off that debt so that council tax payers in Denbighshire, who have nothing to do with that debt, are relieved of that liability?

A yw Ysgrifennydd yr Amgylchedd yn cytuno bod MPG3 ac unrhyw gynlluniau yn y dyfodol yn dibynnu ar y ffaith fod gan awdurdodau lleol sicrwydd ynghylch setliadau a chyllidebau’r dyfodol. A yw’n sylweddoli nad oes sicrwydd o’r fath yn Sir Ddinbych oherwydd y ddyled a etifeddwyd gan hen Gyngor Bwrdeistref Rhuddlan? A yw’n barod i ddileu’r ddyled er mwyn rhyddhau, rhag y rhwymedigaeth honno, drethdalwyr cyngor Sir Ddinbych, nad oes a wnelont ddim â’r ddyled?

Peter Law spoken in English p. 7

Peter Law siaradwyd yn Saesneg t. 7

I cannot give such an assurance at this point. The First Secretary was questioned about, and has looked at this recently and we will discuss the matter with the local Members who raised it. I cannot give an assurance because the management of local government is a matter for local government. That is what management teams are for. We are here to ensure that local government gets a fair and just settlement. I will be pleased to discuss matters with Denbighshire County Council because that is why I am here.

Ni allaf roi sicrwydd o’r fath ar hyn o bryd. Holwyd y Prif Ysgrifennydd ynghylch hyn ac mae wedi edrych arno’n ddiweddar. Byddwn yn trafod y mater gyda’r Aelodau lleol a’i cododd. Ni allaf roi sicrwydd oherwydd mater i lywodraeth leol yw rheoli llywodraeth leol. Dyna beth yw diben timau rheoli. Ein gwaith ni yw sicrhau bod llywodraeth leol yn cael setliad teg a chyfiawn. Byddaf yn falch o drafod materion gyda Chyngor Sir Ddinbych oherwydd dyna yw fy ngwaith.

Ffordd Osgoi (Talgarth)

Bypass (Talgarth)

Q4 Kirsty Williams spoken in English p. 7

C4 Kirsty Williams siaradwyd yn Saesneg t. 7

What progress is being made towards the building of a bypass at Talgarth? (OAQ258VB)

Pa gynnydd a wneir tuag at adeiladu ffordd osgoi Talgarth?(OAQ258VB)

Peter Law spoken in English p. 8

Peter Law siaradwyd yn Saesneg t. 8

I am aware of your concern through our useful discussions outside the Chamber. The review of the trunk road programme, ‘Driving Wales Forward’, published last summer, confirmed that the A479 Talgarth bypass no longer formed part of the forward trunk road programme. We will consider and consult on other options to resolve the problems in Talgarth.

Yr wyf yn ymwybodol o’ch pryder yn dilyn ein trafodaethau buddiol y tu allan i’r Siambr. Yn yr arolwg a gynhaliwyd ar y rhaglen gefnffyrdd, ‘Gyrru Cymru Ymlaen’, a gyhoeddwyd yr haf diwethaf, cadarnhawyd nad oedd ffordd osgoi Talgarth, yr A479, bellach yn rhan o raglen gefnffyrdd y dyfodol. Byddwn yn ystyried dewisiadau eraill ac yn ymgynghori ynghylch y rhain er mwyn datrys y problemau yn Nhalgarth.

Kirsty Williams spoken in English p. 8

Kirsty Williams siaradwyd yn Saesneg t. 8

Is the Secretary aware that the people of Talgarth have waited more than 45 years for a relief road to ease the dangerous congestion in the town centre? The Highways Directorate cannot take forward the recommendations made by last year’s public inquiry and consider alternative options because there are no resources available.

A yw’r Ysgrifennydd yn ymwybodol bod pobl Talgarth wedi disgwyl dros 45 mlynedd am ffordd liniaru i leddfu’r dagfa beryglus yng nghanol y dref? Ni all y Gyfadran Priffyrdd fwrw ymlaen gyda’r argymhellion a wnaethpwyd gan ymchwiliad cyhoeddus y llynedd ac ystyried dewisiadau eraill oherwydd nad oes adnoddau ar gael.

Peter Law spoken in English p. 8

Peter Law siaradwyd yn Saesneg t. 8

I appreciate the concerns of the people of Talgarth and the concerns of those wherever bypasses are needed. I sometimes feel that I get more requests for bypasses than Jane Hutt.

Yr wyf yn gwerthfawrogi pryderon pobl Talgarth a phryderon pobl lle bynnag y mae angen ffyrdd osgoi. Weithiau, teimlaf fy mod yn cael mwy o geisiadau am ‘bypasses’ na Jane Hutt.

The Welsh Office, following receipt of the inspector’s report, accepted that it would not be appropriate to proceed with the proposals submitted to the public inquiry, held in February 1998, to consider a bypass for Talgarth. We shall consider and consult on other options to resolve the problems in Talgarth in due course. Among these could be a southern access road or detrunking. There are many issues to consider. I admit there is not an infinite amount of money available. There are also concerns further down the route that a bypass at Talgarth would increase traffic flow past or through other villages. There are many things to take into account. I assure you that I want to hear the views of the people of Talgarth. We shall listen and act as sensitively as we can.

Ar ôl cael adroddiad yr arolygydd, derbyniodd y Swyddfa Gymreig na fyddai’n briodol bwrw ymlaen gyda’r cynigion a gyflwynwyd gerbron yr ymchwiliad cyhoeddus a gynhaliwyd ym mis Chwefror 1998, i ystyried ffordd osgoi ar gyfer Talgarth. Byddwn yn ystyried dewisiadau eraill a allai ddatrys problemau Talgarth ac yn ymgynghori ynghylch y rheini maes o law. Ymhlith y rhain, gellid ystyried ffordd fynediad o’r de neu ddileu’r statws cefnffordd. Mae sawl mater i’w ystyried. Cyfaddefaf nad oes swm diderfyn o arian ar gael. Hefyd, ymhellach i lawr y ffordd, mae pryderon y byddai ffordd osgoi yn Nhalgarth yn cynyddu llif y traffig heibio i bentrefi eraill neu drwyddynt. Mae nifer o bethau i’w hystyried. Gallaf eich sicrhau fy mod am glywed barn pobl Talgarth. Byddwn yn gwrando ac yn gweithredu mewn modd mor sensitif ag y gallwn.

It is just as well that we do not have 45-year waits for heart bypass surgery. What message would you send to the people of Talgarth who live in daily fear for their safety when they go into town to shop and who suffer environmental damage when they do so? There are frequent accidents with articulated lorries going into shops and causing jams and mayhem in the town. This bypass, like many other road schemes, has been dropped from the road-building programme by the Labour Party. What message can you send to the people of Talgarth when there is all-party agreement locally that action needs to be taken urgently?

Yr ydym yn ffodus nad oes rhaid inni ddisgwyl 45 mlynedd am driniaeth dargyfeirio ar y galon. Pa neges y byddech chi’n ei hanfon at bobl Talgarth sydd yn wynebu peryglon beunyddiol wrth iddynt fynd i’r dref i siopa a dioddef yn sgîl y difrod a wneir i’r amgylchedd wrth wneud hynny? Mae damweiniau’n digwydd yn aml wrth i lorïau cymalog fynd drwy flaen siopau ac achosi tagfeydd ac anhrefn llwyr yn y dref. Mae’r ffordd osgoi hon, fel sawl cynllun ffordd arall, wedi’i hepgor o’r rhaglen adeiladu-ffyrdd gan y Blaid Lafur. Pa neges y gellwch ei hanfon at bobl Talgarth pan fo’r pleidiau i gyd yn cytuno’n lleol fod angen gweithredu’n ddi-oed?

You wrote to me recently about a constituent further down the route. If the bypass were built, it would mean more traffic for that person. Not everybody feels a bypass is appropriate. As I said earlier, there are other options to consider when there are limited resources available. However, we need to do something positive for Talgarth and those who use that road regularly. We will do what the inspector has suggested and consult on other options to resolve the problems in the town. I look forward to hearing from the people when we do that.

Yn ddiweddar, cefais lythyr gennych ynghylch un o’ch etholwyr ymhellach i lawr y ffordd. Pe bai’r ffordd osgoi’n cael ei hadeiladu, byddai’r person hwnnw’n gorfod dioddef rhagor o draffig. Nid yw pawb o’r farn bod ffordd osgoi’n briodol. Fel y dywedais eisoes, mae dewisiadau eraill i’w hystyried pan fo’r adnoddau sydd ar gael yn brin. Fodd bynnag, rhaid inni wneud rhywbeth cadarnhaol dros Dalgarth a’r bobl sydd yn defnyddio’r ffordd honno’n rheolaidd. Byddwn yn dilyn awgrym yr arolygydd ac yn ymgynghori ynghylch dewisiadau eraill i ddatrys problemau’r dref. Edrychaf ymlaen at glywed gan y bobl pan fyddwn yn gwneud hynny.

Datblygiad Parc Thema (Llanfarthin)

I am aware of some concerns. John Griffiths, the Member for that constituency, has made me aware of some of his constituents’ views. Letters have been received from local residents objecting to the proposal. Were the two local planning authorities prepared to grant permission for the development, they would notify the Assembly as this would represent a departure from the development plan. A decision would then need to be taken on whether to call in the application, or to leave it for the authorities to determine. I am aware of both points of view on the development.

Yr wyf yn ymwybodol o rai pryderon. Mae John Griffiths, yr Aelod dros yr etholaeth honno, wedi sôn wrthyf am farn rhai o’i etholwyr. Derbyniwyd llythyrau gan drigolion lleol yn gwrthwynebu’r cynnig. Pe bai’r ddau awdurdod cynllunio lleol yn barod i roi caniatâd ar gyfer y datblygiad, byddent yn rhoi gwybod i’r Cynulliad, gan y byddai hyn yn gwyro oddi wrth y cynllun datblygu. Yna, byddai angen penderfynu a ddylid galw’r cais i mewn, ynteu gadael i’r awdurdodau benderfynu arno. Yr wyf yn ymwybodol o’r ddwy farn sydd ynghylch y datblygiad.

Does the Secretary accept that these concerns, which relate to the impact on the environment and the decrease in quality of life for local people, must be fully answered before this project can be approved by the Assembly?

A yw’r Ysgrifennydd yn derbyn bod y pryderon hyn, sydd yn ymwneud â’r effaith ar yr amgylchedd a gwaethygu ansawdd bywyd pobl leol, yn rhai y mae’n rhaid eu hateb yn llwyr cyn y gall y Cynulliad gymeradwyo’r prosiect hwn?

Peter Law spoken in English p. 10

Peter Law siaradwyd yn Saesneg t. 10

I understand that environmental impact assessments have been called for by the two local authorities involved and that they have also carried out consultation. I cannot comment further on the merits of the scheme in case it is referred to the Assembly for determination. This is a quasi-judicial function and there is an onus on us to make sure the Assembly’s position is not prejudiced by premature comment on a specific application. I hope you will understand.

Deallaf fod y ddau awdurdod lleol wedi galw am asesu’r effaith ar yr amgylchedd a’u bod hefyd wedi ymgynghori. Ni allaf roi sylwadau pellach ar rinweddau’r cynllun gan y gellid ei gyfeirio i’r Cynulliad am benderfyniad. Mae’r swyddogaeth hon yn un lled-gyfreithiol ac mae’n ddyletswydd arnom i wneud yn siŵr nad ydym yn rhagfarnu sefyllfa’r Cynulliad drwy roi sylwadau’n rhy fuan ar y cais penodol hwn. Gobeithiaf y byddwch yn deall hyn.

It is kind of David Davies to raise my constituents’ concerns. I am grateful. I am interested in Peter’s response, which makes eminent sense at this point. However, I reiterate the need to listen to the concerns of local people. It is a classic equation of environmental impact versus economic benefit. That needs to be considered in due course. I hope the matter will be dealt with expeditiously because that is in the best interest of both local residents and those proposing the development.

Braf oedd clywed David Davies yn sôn am bryderon fy etholwyr. Yr wyf yn ddiolchgar iddo. Mae gennyf ddiddordeb yn ymateb Peter ac mae’n ymateb hollol gall ar hyn o bryd. Fodd bynnag, dywedaf eto fod angen gwrando ar bryderon pobl leol. Mae’n enghraifft glasurol o geisio tafoli’r effaith ar yr amgylchedd a budd economaidd. Bydd angen ystyried hynny maes o law. Gobeithiaf y rhoddir sylw i’r mater yn fuan gan mai dyna a fyddai orau i’r bob leol ac i’r sawl sydd yn cynnig y datblygiad.

Strategaeth Datblygu Cynaliadwy

Sustainable Development Strategy

C6 Cynog Dafis siaradwyd yn Gymraeg t. 10

Q6 Cynog Dafis spoken in Welsh p. 10

Pa drefniadau sydd gan Peter Law ar gyfer paratoi strategaeth datblygu cynaliadwy i’r Cynulliad? (OAQ255JS)

What arrangements has Peter Law in mind for the preparation of a sustainable development strategy for the Assembly? (OAQ255JS)

Peter Law spoken in English p. 10

Peter Law siaradwyd yn Saesneg t. 10

I appreciate Cynog’s question. His respected approach to sustainable development is well known throughout Wales and he played an important part in the Secretary of State’s conference on the subject earlier this year. Section 121 of the Government of Wales Act 1998 requires the Assembly to make a scheme to promote sustainable development. That will fulfil the need identified in the question. I am proud to point out that the Assembly is the first public body to be under such a legal requirement. I have an open mind on whether a separate strategy would help promote sustainable development in Wales.

Gwerthfawrogaf gwestiwn Cynog. Mae ei ymagwedd at ddatblygu cynaliadwy’n ennyn parch ac yn hysbys ledled Cymru. Gwnaeth gyfraniad pwysig i gynhadledd yr Ysgrifennydd Gwladol ar y pwnc yn gynharach eleni. Mae Adran 121 Deddf Llywodraeth Cymru 1998 yn mynnu bod y Cynulliad yn paratoi cynllun i hyrwyddo datblygu cynaliadwy. Bydd hynny’n diwallu’r angen a nodir yn y cwestiwn. Yr wyf yn falch o dynnu’ch sylw at y ffaith mai’r Cynulliad yw’r corff cyhoeddus cyntaf i fod yn destun gofyniad cyfreithiol o’r fath. Mae gennyf feddwl agored ynghylch a fyddai strategaeth ar wahân yn gymorth i hyrwyddo datblygu cynaliadwy yng Nghymru.

Cynog Dafis siaradwyd yn Gymraeg t. 11

Cynog Dafis spoken in Welsh p. 11

A yw’r Ysgrifennydd yn cytuno nad oes dim yn bwysicach y gall y Cynulliad a Chymru anelu ato na datblygu cynaliadwy sydd yn treiddio i bob agwedd o bolisi? Mae’n greiddiol i ddatblygu economaidd ac yn bwysig i allgáu cymdeithasol a pholisi cynllunio. A yw’n cytuno—mae’n debyg nad ydyw—ei bod yn amhriodol fod y mater hwn yn gysylltiedig â’r Pwyllgor Amaethyddiaeth a Datblygu Gwledig? Mae lawn cyn bwysiced i ganol Caerdydd ag ydyw i ardal wledig. A yw’n cytuno mai’r ffordd orau o lunio’r strategaeth angenrheidiol yw sefydlu pwyllgor llorweddol neu drawsbynciol a allai fynd i’r afael â’r mater hwn mewn ffordd strategol a systematig? A gawn ni sicrwydd bod y dewis o sefydlu’r Pwyllgor hwn yn dal i fod yn agored?

Does the Secretary agree that nothing is more important for the Assembly and Wales to aim for than sustainable development which permeates into every aspect of policy? It is crucial to economic development and important to social exclusion and planning policy. Does he agree—more likely he does not—that it is inappropriate that this matter is linked with the Agriculture and Rural Development Committee? It is just as important for the centre of Cardiff as for a rural area. Does he agree that the best way of drawing up the necessary strategy is to establish a horizontal or cross-cutting committee that can get to grips with this matter in a systematic and strategic manner? Can we have an assurance that the option of establishing this Committee is still open?

Peter Law spoken in English p. 11

Peter Law siaradwyd yn Saesneg t. 11

I thank Cynog for that supplementary question. I agree that sustainable development is one of the most important matters facing the National Assembly. The First Secretary announced yesterday that my friend Christine Gwyther is to champion sustainable development within the Cabinet. I am pleased to support her. He has also said that he expects all members of the Cabinet to promote sustainable development within their portfolios, both before and after the scheme is made. It is a cross-cutting issue.

Diolchaf i Cynog am y cwestiwn atodol yna. Yr wyf yn falch o estyn fy nghefnogaeth iddi. Dywedodd hefyd ei fod yn disgwyl i bob aelod o’r Cabinet hyrwyddo datblygu cynaliadwy o fewn eu portffolios, cyn llunio’r cynllun ac ar ôl hynny. Mae’n fater trawsbynciol.

After this question session, the First Secretary will make a statement on the progress made in the implementation of the statutory schemes, including sustainable development itself. The fact that Christine is to deal with sustainable development makes a pleasant change and I have no doubt about her commitment. She will do an excellent job for us.

Ar ôl y sesiwn gwestiynau hon, bydd y Prif Ysgrifennydd yn gwneud datganiad ynghylch y cynnydd a wnaethpwyd ar weithredu’r cynlluniau statudol, gan gynnwys datblygu cynaliadwy. Mae’r ffaith fod Christine yn mynd i ymdrin â datblygu cynaliadwy yn newid braf iawn ac nid oes gennyf amheuaeth ynghylch ei hymrwymiad. Bydd yn gwneud gwaith rhagorol.

We have set up a small sustainable development unit in the Welsh Office to take over the development of the scheme and we expect a consultation paper to be published in the autumn.

Sefydlwyd uned datblygu cynaliadwy fach yn y Swyddfa Gymreig i ysgwyddo’r gwaith o ddatblygu’r cynllun a disgwyliwn gyhoeddi papur ymgynghori yn yr hydref.

Mick Bates spoken in English p. 12

Mick Bates siaradwyd yn Saesneg t. 12

Those were interesting replies because sustainable development is a statutory duty. I hope to hear that it will be an evolutionary process and that we will be working towards this cross-cutting Committee and to establish sustainable development in every field. However, what attempt is being made to provide benchmarks so that we can assess our progress towards true sustainable development? It is about caring for the environment and the socio-economic development of Wales and providing targets for energy from renewable resources.

Yr oedd yr atebion hynny’n ddiddorol gan fod datblygu cynaliadwy’n ddyletswydd statudol. Gobeithiaf glywed y bydd yn broses esblygol ac y byddwn yn gweithio tuag at y Pwyllgor trawsbynciol hwn ac yn sefydlu datblygu cynaliadwy ym mhob maes. Fodd bynnag, pa ymdrech sydd yn cael ei gwneud i bennu meincnodau er mwyn mesur ein cynnydd tuag at ddatblygiad sydd yn wir gynaliadwy? Mae hyn yn gysylltiedig â gofalu am yr amgylchedd a datblygiad economaidd-gymdeithasol Cymru ac â gosod targedau ar gyfer adnoddau ynni adnewyddadwy.

Peter Law spoken in English p. 12

Peter Law siaradwyd yn Saesneg t. 12

Thank you Mick. It is for you to contribute when we draw up the scheme. Consultation will be taking place and the Committee will discuss it. I look forward to your input so that we can craft a sustainable development policy of excellence for the people of Wales.

Diolch Mick. Eich lle chi fydd cyfrannu pan fyddwn yn paratoi’r cynllun. Byddwn yn ymgynghori a bydd y Pwyllgor yn ei drafod. Edrychaf ymlaen at eich cyfraniad er mwyn inni lunio polisi datblygu cynaliadwy rhagorol ar gyfer pobl Cymru.

Datganiad ar Ombwdsmon Gweinyddiaeth Cymru

Statement on the Welsh Administration Ombudsman

Alun Michael The First Secretary spoken in English p. 12

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 12

As I have already indicated to the leaders of the other parties, we have received confirmation that Her Majesty the Queen has approved the appointment of Michael Buckley to the post of Welsh Administration Ombudsman from 1 July.

Fel yr awgrymais eisoes wrth arweinyddion y pleidiau eraill, cawsom gadarnhad bod Ei Mawrhydi’r Frenhines wedi cymeradwyo penodi Michael Buckley i swydd Ombwdsmon Gweinyddiaeth Cymru gan ddechrau 1 Gorffennaf.

Michael Buckley is the current Parliamentary Ombudsman for Administration and the Health Service Commissioner for Wales. He brings considerable experience to the new post of Welsh Administration Ombudsman. He will ensure the smooth transition of the arrangements that exist under the post of Parliamentary Ombudsman to the new arrangements under the post of Welsh Administration Ombudsman. I wish to take the opportunity to bring this decision to the attention of the Assembly.

Ar hyn o bryd, Michael Buckley yw Ombwdsmon Gweinyddiaeth Seneddol a Chomisiynydd y Gwasanaeth Iechyd yng Nghymru. Daw â phrofiad helaeth gydag ef i swydd newydd Ombwdsmon Gweinyddiaeth Cymru. Bydd yn sicrhau bod y trefniadau sydd yn bodoli dan swydd yr Ombwdsmon Seneddol yn cael eu trosglwyddo’n hwylus i’r trefniadau newydd sydd yn bodoli dan swydd Ombwdsmon Gweinyddiaeth Cymru. Dymunaf fanteisio ar y cyfle i ddwyn y penderfyniad hwn i sylw’r Cynulliad.

I propose to write to Assembly Members today to confirm the appointment and to explain the way in which the new office, in relation to Ombudsman issues, affects the Assembly. I am happy to respond to any queries but it might be helpful for us to return to the issue in the future. I am sure that Members will appreciate that I could not share the news of the announcement until the news was given to us.

Bwriadaf ysgrifennu at Aelodau’r Cynulliad heddiw i gadarnhau’r penodiad ac esbonio sut y bydd y swydd newydd yn effeithio ar y Cynulliad gyda golwg ar faterion sydd yn ymwneud â’r Ombwdsmon. Yr wyf yn barod i ymateb i unrhyw gwestiynau ond efallai y byddai’n fuddiol inni ddychwelyd at y mater hwn yn y dyfodol. Yr wyf yn siŵr y bydd yr Aelodau’n gwerthfawrogi na allwn rannu newyddion y cyhoeddiad nes inni gael y newyddion.

Rod Richards spoken in English p. 13

Rod Richards siaradwyd yn Saesneg t. 13

Will the First Secretary confirm that the arrangements that exist for Members of Parliament apply equally to Assembly Members so that, in cases of alleged maladministration, Assembly Members may refer directly to the Ombudsman?

A fyddai’r Prif Ysgrifennydd gystal â chadarnhau bod y trefniadau sydd yn bodoli ar gyfer Aelodau Seneddol hefyd yn berthnasol i Aelodau’r Cynulliad, fel bo modd i Aelodau’r Cynulliad gyfeirio’n uniongyrchol at yr Ombwdsmon os oes achos lle yr honnir bod camweinyddu?

Alun Michael The First Secretary spoken in English p. 13

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 13

There is a difference. Arrangements for scrutiny by Parliament have to be made through a Member of Parliament, whereas complaints to the Assembly Ombudsman do not have to be made through an Assembly Member. That is more consistent with the way that Ombudsman access for members of the public has developed. This was a matter that was discussed when the legislation was being passed. Rod makes an important point. It is crucial for Assembly Members to know, the arrangements which are being made, both for our own purposes when constituents approach us and so that we can provide information more widely. I am happy to set it out in my letter which I will try to finish today but certainly by tomorrow.

Mae gwahaniaeth. Rhaid gwneud trefniadau i’r Senedd archwilio drwy gyfrwng Aelod Seneddol, ond nid oes rhaid gwneud cwynion i Ombwdsmon y Cynulliad drwy gyfrwng Aelod o’r Cynulliad. Mae hynny’n fwy cydnaws â’r ffordd y mae hawl y cyhoedd i gysylltu â’r Ombwdsmon wedi datblygu. Trafodwyd y mater hwn wrth basio’r ddeddfwriaeth. Mae Rod yn gwneud pwynt pwysig. Mae’n holl bwysig bod Aelodau’r Cynulliad yn gwybod, pa drefniadau a wneir, at ein dibenion ni’n hunain pan fydd etholwyr yn dod atom ac er mwyn inni ddarparu gwybodaeth yn ehangach. Yr wyf yn fodlon esbonio hyn yn fy llythyr. Ceisiaf ei orffen heddiw ond byddaf yn sicr o’i gwblhau erbyn yfory.

Alun Michael The First Secretary spoken in English p. 13

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 13

It always sounds much more exciting in Welsh.

Mae bob amser yn swnio’n llawer mwy cyffrous yn y Gymraeg.

I underline the point that I made yesterday. An enormous amount of work has gone into preparing the ground for a number of decisions that are being taken and a number of systems that were put in place during the first few weeks of the Assembly’s life.

Pwysleisiaf y pwynt a wneuthum ddoe. Mae llawer iawn o waith wedi’i wneud i fraenaru’r tir ar gyfer nifer o benderfyniadau a wneir a nifer o systemau a sefydlwyd yn ystod wythnosau cyntaf y Cynulliad hwn.

Everybody will appreciate that when a new local authority is set up, there is a transfer of responsibilities from the old to the new local authority. In both 1973 and 1995, 11 months were allowed for the transfer. In contrast, the transfer of powers to the Assembly occurs tomorrow after less than 11 weeks. There has been a lot of work done and much of it for the first time. There are many issues that the Assembly will want to return to in the future. It is important that we set our sights towards the future and define a baseline at the beginning of our work rather than waiting until later.

Pan sefydlir awdurdod lleol newydd, bydd pawb yn deall bod cyfrifoldebau’n cael eu trosglwyddo o’r hen awdurdod lleol i’r awdurdod lleol newydd. Yn 1973 ac wedyn yn 1995, caniatawyd 11 mis ar gyfer y trosglwyddo. Fodd bynnag, bydd pwerau’n cael eu trosglwyddo i’r Cynulliad yfory, ar ôl llai nag 11 wythnos. Mae llawer o waith wedi’i wneud a chryn dipyn ohono am y tro cyntaf. Mae nifer o faterion y bydd y Cynulliad am ddychwelyd atynt yn y dyfodol. Mae’n bwysig ein bod yn edrych tua’r dyfodol ac yn diffinio’r llinell sylfaen ar ddechrau ein gwaith yn hytrach na disgwyl tan ymhellach ymlaen.

The Government of Wales Act sets out a series of requirements for the way that we are to conduct our business. We have to make arrangements to comply with those requirements on sustainable development, equality of opportunity, regulatory appraisal and partnership. Yesterday, I set out how some of those issues should be championed to ensure that they are put into effect and observed across the Cabinet and the functions of the Assembly. We should put in place the reality and the substance, rather than merely recognising the importance of issues such as sustainable development.

Mae Deddf Llywodraeth Cymru’n nodi cyfres o ofynion ynghylch sut y dylem ymdrin â’n busnes. Rhaid inni wneud trefniadau i gydymffurfio â’r gofynion hynny ym maes datblygu cynaliadwy, cyfle cyfartal, gwerthusiadau rheoleiddiol a phartneriaeth. Ddoe, nodais sut y dylid mynd i’r afael â rhai o’r materion hynny er mwyn sicrhau eu bod yn cael eu rhoi ar waith a bod sylw’n cael ei roi iddynt gan bawb yn y Cabinet ac ym mhob un o swyddogaethau’r Cynulliad. Dylem sicrhau ein bod yn gwireddu realiti a sylwedd materion megis datblygu cynaliadwy, yn hytrach na dim ond cydnabod eu pwysigrwydd.

On the eve of the transfer of functions, I remind the Assembly of the duties that are placed upon us under the Act. There are three particular obligations upon us that have immediate effect: conducting regulatory appraisal on Assembly legislation, promoting equality of opportunity and meeting obligations for human rights.

Ar noswyl trosglwyddo’r swyddogaethau, atgoffaf y Cynulliad o’r dyletswyddau sydd arnom o dan y Ddeddf. Daw tri o’r prif ddyletswyddau hynny i rym ar unwaith: cynnal gwerthusiad rheoleiddiol ar ddeddfwriaeth y Cynulliad, hyrwyddo cyfle cyfartal a chyflawni gofynion iawnderau dynol.

There is a requirement for the Assembly to consult interested bodies. These include a scheme promoting the interest of the voluntary sector, a scheme for local government, a scheme for promoting sustainable development and the processes of consultation with business. These are all important.

Mae gofyn i’r Cynulliad ymgynghori â chyrff perthnasol. Mae’r rhain yn cynnwys cynllun sydd yn hyrwyddo diddordebau’r sector gwirfoddol, cynllun i lywodraeth leol, cynllun i hyrwyddo datblygu cynaliadwy a’r prosesau i ymgynghori â byd busnes. Mae’r rhain i gyd yn bwysig.

I have laid out detailed guidance on the conduct of regulatory appraisal alongside today’s motion. Subject to today’s debate, these will be made available to staff in the next few days to ensure that we can meet the requirements of section 65 of the Act. Section 65 and regulatory appraisal are important, especially given the legitimate concerns of business about regulatory burdens. Under section 65, an assessment of the likely cost of benefits in complying with Assembly general subordinate legislation will be required. That is the regulatory appraisal. When it comes to new secondary legislation, the Assembly will have before it a proper assessment of the likely impact of the legislation. Where compliance costs are expected to be significant, prior consultation with those mainly affected will be required and the Assembly will take their views into account.

Yr wyf wedi paratoi canllawiau manwl ar y drefn arfarnu i gyd-fynd â’r cynnig heddiw. Os bydd y ddadl yn mynd rhagddi’n hwylus heddiw, bydd y rhain ar gael i staff yn ystod yr ychydig ddiwrnodau nesaf er mwyn sicrhau ein bod yn gallu cyflawni gofynion adran 65 y Ddeddf. Mae Adran 65 a’r gwerthusiadau rheoleiddiol yn bwysig, yn enwedig gan fod gan fyd busnes bryderon dilys ynghylch y baich gwerthuso. Dan adran 65, bydd angen asesu cost debygol y buddion a geir wrth gydymffurfio gydag is-ddeddfwriaeth gyffredinol y Cynulliad. Dyna’r gwerthusiad rheoleiddiol. Pan fydd angen creu deddfwriaeth eilaidd newydd, bydd asesiad iawn gerbron y Cynulliad o’r effaith debygol a gaiff y ddeddfwriaeth. Os rhagwelir y bydd costau cydymffurfio yn sylweddol, bydd angen ymgynghori ymlaen llaw gyda’r sawl yr effeithir arnynt fwyaf a bydd y Cynulliad yn ystyried eu barn hwy.

We need to move from consultation to create a partnership, particularly with business. I am pleased, as I am sure many Assembly Members are, with the way in which people in business have engaged themselves with the difference that having the Assembly will make.

Mae angen inni symud ymlaen ar ôl ymgynghori i greu partneriaeth, yn enwedig gyda byd busnes. Yr wyf yn falch, fel y mae llawer o Aelodau’r Cynulliad mae’n siŵr, o’r ffordd y mae pobl byd busnes wedi ymroi i fod yn rhan o’r newid a ddaw yn sgîl y Cynulliad.

Before the Assembly consults on detailed proposals and the formal adoption of schemes, I will issue details of the interim guidance to staff. This explains how they should reflect the statutory requirements in their advice. It is not, in any way, intended to pre-empt the detailed work required on the schemes in which Assembly Members will be involved. It will ensure that we keep in mind the key principles that the schemes have to reflect. Legislative requirements must be seen as a positive pole in better decision making, rather than a separate series of hurdles, to have maximum impact. I want to look at the overall picture. The interim guidance note on the scheme sets out in brief what we are discussing. The initial guidance will be developed as the Assembly progresses its detailed proposals for implementing schemes. It will be supported by training seminars on the schemes, raising staff awareness of the requirements, then looking at the detailed arrangements.

Cyn i’r Cynulliad ymgynghori ar gynigion manwl a mabwysiadu cynlluniau’n ffurfiol, byddaf yn rhoi manylion y canllawiau dros dro i’r staff. Mae hyn yn egluro sut y dylent adlewyrchu’r gofynion statudol wrth roi cyngor. Nid yw’n fwriad, mewn unrhyw fodd, i achub y blaen ar y gwaith manwl y bydd angen ei wneud ar y cynlluniau, gwaith y bydd gan Aelodau’r Cynulliad ran ynddo. Bydd yn sicrhau ein bod yn cadw mewn cof yr egwyddorion allweddol y mae’n rhaid i’r cynlluniau eu hadlewyrchu. Er mwyn iddynt gael eu heffaith lawn, rhaid ystyried gofynion y ddeddf yn rym cadarnhol sydd yn arwain at well trefn o wneud penderfyniadau, yn hytrach nag yn gyfres o rwystrau unigol. Dymunaf edrych ar y darlun cyfan. Mae’r nodyn canllaw dros dro ar y cynllun yn nodi’n gryno gynnwys ein trafodaeth. Datblygir y canllawiau cychwynnol wrth i’r Cynulliad fwrw ymlaen gyda’i gynigion manwl i weithredu cynlluniau. Yn gefn i hynny, cynhelir seminarau hyfforddi ar y cynlluniau; byddwn yn cynyddu ymwybyddiaeth staff ynghylch y gofynion, ac yna yn edrych ar y trefniadau manwl.

Everybody must understand that the Assembly is a new, different type of institution with different needs. We have a unique opportunity to create the modern Government that the Assembly represents. Much work has been done by the UK Government on setting an agenda for modernising Government and working on cross-cutting themes. To do that in Whitehall, they work to set boundaries and look at systems which have been in place for years. We can set up from scratch a modern democracy, an institution that can respond to the needs of today’s Wales. That is why we must work hard to ensure that tools like the statutory schemes are used as productively as possible to achieve modern Government. This guidance informs us as an Assembly. Our partners outside the Assembly will be able to see what we are striving for and comment if they feel we are not achieving the standards. This transparent way of working maintains our commitment to open and inclusive government. In this spirit, we are discussing the requirements with the relevant sectors and I shall briefly outline progress on each.

Rhaid i bawb ddeall bod y Cynulliad yn sefydliad newydd o fath gwahanol a chanddo wahanol anghenion. Mae gennym gyfle unigryw i greu’r Llywodraeth fodern y mae’r Cynulliad yn ei chynrychioli. Mae Llywodraeth y DU wedi gwneud cryn waith i sefydlu’r agenda ar gyfer moderneiddio Llywodraeth a gweithio ar themâu trawsbynciol. Er mwyn gwneud hynny yn Whitehall, byddant yn gweithio o fewn ffiniau penodol ac yn edrych ar systemau sydd wedi bod ar waith ers blynyddoedd. Gallwn sefydlu o’r newydd ddemocratiaeth fodern, sefydliad sydd yn gallu ymateb i anghenion Cymru heddiw. Dyna paham y mae’n rhaid inni weithio’n galed i sicrhau y defnyddir cyfryngau fel y cynlluniau statudol mewn ffordd mor gynhyrchiol ag y bo modd i greu Llywodraeth fodern. Mae’r canllawiau hyn yn goleuo’n gwaith ni fel Cynulliad. Bydd modd i’n partneriaid y tu allan i’r Cynulliad weld beth yr ydym yn anelu ato a chynnig eu sylwadau os teimlant nad ydym yn cyrraedd y nod. Bydd gweithio mewn ffordd dryloyw fel hyn yn cadarnhau ein hymrwymiad i lywodraeth agored a chynhwysol. Yn yr ysbryd hwn y trafodwn y gofynion gyda’r sectorau perthnasol, ac fe amlinellaf yn fras y cynnydd a wnaethpwyd ar bob un.

Arrangements for equality of opportunity will give us a chance to strengthen existing commitments. There was an excellent opportunity for many Members to meet the three main equality bodies a couple of weeks ago. It was a promising interchange. They wanted to be there and engage with all of us and make their concerns known to all Subject Committees. I intend to take stock of our inheritance of Welsh Office experience. We have the information to judge whether our policies are promoting equality of opportunity and to involve the different communities affected in their development. We also have the information to take action when people are being disadvantaged because they are not benefiting from the same opportunities as others. Arrangements have been made to set up an Equal Opportunities Committee, which will play an important role in implementing this and setting priorities. However, it must involve the Cabinet members and the Subject Committees. This will ensure that the Assembly, not only the Committee, takes part in advancing the agenda. Clear priorities for action must be identified so that the Assembly sets targets against which performance can be measured.

Bydd y trefniadau ar gyfer sicrhau cyfle cyfartal yn gyfle inni gryfhau’r ymrwymiadau a wnaethpwyd eisoes. Cafodd llawer o Aelodau gyfle gwych ychydig wythnosau’n ôl i gyfarfod â’r tri phrif gorff sydd yn gweithio ym maes cydraddoldeb. Yr oedd y cyfarfod hwnnw’n un addawol. Yr oeddent am fod yno i gyd-drafod â ni i gyd a sicrhau bod pob Pwyllgor Pwnc yn deall eu pryderon. Bwriadaf fanteisio ar brofiad y Swyddfa Gymreig a etifeddwyd gennym. Mae gennym y wybodaeth i farnu a yw ein polisïau’n hyrwyddo cyfle cyfartal ac i gynnwys y gwahanol gymunedau yr effeithir arnynt wrth eu datblygu. Mae gennym hefyd y wybodaeth i weithredu pan fydd pobl dan anfantais gan nad ydynt yn cael yr un cyfleoedd â phobl eraill. Trefnwyd sefydlu Pwyllgor Cyfle Cyfartal a fydd yn ysgwyddo’r gwaith pwysig o weithredu hyn a gosod blaenoriaethau. Fodd bynnag, rhaid iddo gynnwys aelodau’r Cabinet a’r Pwyllgorau Pwnc. Bydd hyn yn sicrhau bod y Cynulliad, nid dim ond y Pwyllgor, yn cyfrannu at fwrw ymlaen â’r agenda. Rhaid nodi blaenoriaethau clir ar gyfer gweithredu fel bod y Cynulliad yn gosod targedau a bod modd mesur perfformiad ar sail y rheini.

In February, I hosted a sustainable development conference. This gave us a great deal of input for progressing the sustainable development scheme. Some people, now Assembly Members, particularly Cynog Dafis, took an interest in establishing that conference and in its work. We have established a sustainable development unit, which will take this work forward. It will work within the structures which the Assembly inherits tomorrow and we expect to be able to present a formal consultation on such a scheme in the autumn. I shall want a full, participative consultation process, tapping into the enthusiasm of all sectors. We hope to bring forward the scheme for approval by the Assembly in the first half of next year.

Ym mis Chwefror, cynhaliais gynhadledd ar ddatblygu cynaliadwy. Drwyddi, cyfrannwyd yn helaeth at y broses o fwrw ymlaen gyda’r cynllun datblygu cynaliadwy. Yr oedd gan rai pobl sydd bellach yn Aelodau o’r Cynulliad, yn enwedig Cynog Dafis, ddiddordeb mewn sefydlu’r gynhadledd honno ac yn ei gwaith. Sefydlwyd uned ddatblygu cynaliadwy a fydd yn bwrw ymlaen â’r gwaith hwn. Bydd yn gweithio o fewn y strwythurau a etifeddir gan y Cynulliad yfory a disgwyliwn allu cyflwyno proses ymgynghori ffurfiol ar gynllun o’r fath yn yr hydref. Byddaf am i honno fod yn broses ymgynghori gyflawn a chyfranogol, proses a fydd yn tynnu ar frwdfrydedd pob sector. Gobeithiwn gyflwyno’r cynllun i’w gymeradwyo gan y Cynulliad yn ystod hanner cyntaf y flwyddyn nesaf.

Under section 107 of the Government of Wales Act 1998, we are bound by obligations regarding the European Convention on Human Rights. It is fitting that this Assembly should consider Convention rights from the outset and test our legislation and policies against that principle framework. There will be a seminar for Assembly Members on the implication of the legislation next month.

Dan adran 107 Deddf Llywodraeth Cymru 1998, mae’n ddyletswydd arnom gadw at ofynion Cytundeb Ewrop ar Iawnderau Dynol. Mae’n briodol bod y Cynulliad hwn yn ystyried hawliau’r Cytundeb o’r cychwyn a phrofi ein deddfwriaeth a’n polisïau ar sail fframwaith yr egwyddorion hynny. Cynhelir seminar i Aelodau’r Cynulliad ar oblygiadau’r ddeddfwriaeth fis nesaf.

We have discussed progress on the Partnership Council. Under legislation, we are required to go through consultation on the proposals agreed by the Assembly. An informal meeting with local government and representatives from all parties is planned for early July. We hope to discuss the draft local government scheme at the Partnership Council’s first meeting in the autumn. This will lead to a formal consultation before it is returned to the Assembly for formal adoption.

Trafodwyd y cynnydd ym maes y Cyngor Partneriaeth. Dan y ddeddfwriaeth, mae gofyn inni ymgynghori ynghylch y cynigion y cytuna’r Cynulliad arnynt. Bwriedir cynnal cyfarfod anffurfiol gyda llywodraeth leol a chynrychiolwyr o bob plaid ddechrau Gorffennaf. Gobeithiwn drafod y cynllun llywodraeth leol drafft yng nghyfarfod cyntaf y Cyngor Partneriaeth yn yr hydref. Bydd hyn yn arwain at ymgynghori ffurfiol cyn i’r cynllun ddychwelyd gerbron y Cynulliad i’w fabwysiadu’n ffurfiol.

Our work with the voluntary sector has a firm base in the voluntary sector compact, published last November. This was signed-up to, not just by the Welsh Office and the Wales Council for Voluntary Action, but also by the Welsh Local Government Association. We want to ensure that the voluntary sector in Wales is in a strong position to work with us in delivering our priorities and building strong communities. Further discussions will be held with the sector. I hope to submit proposals for a draft scheme in October with a view to an agreed document in February next year.

Mae sylfaen gadarn i’n gwaith gyda’r sector gwirfoddol, sef cytundeb y sector gwirfoddol a gyhoeddwyd fis Tachwedd diwethaf. Fe’i llofnodwyd, nid yn unig gan y Swyddfa Gymreig, a Chyngor Gweithredu Gwirfoddol Cymru, ond hefyd gan Gymdeithas Llywodraeth Leol Cymru. Yr ydym am sicrhau bod y sector gwirfoddol yng Nghymru mewn sefyllfa gref i gydweithio â ni er mwyn cyflawni’n blaenoriaethau ac adeiladu cymunedau cryf. Cynhelir rhagor o drafodaethau gyda’r sector. Gobeithiaf gyflwyno cynigion ar gyfer cynllun drafft ym mis Hydref gyda golwg ar ddogfen y gallwn gytuno arni fis Chwefror y flwyddyn nesaf.

We have consulted on a framework for the requirement to consult business. It is clear that business’s engagement with the Assembly has accelerated rapidly. This is a positive development which we should welcome. Following last month’s consultation, we should be able to present proposals to the Assembly after further debate with the sector. It is thinking through what it requires in response to the discussion and consultation. This should not be rushed.

Yr ydym wedi ymgynghori ar fframwaith ar gyfer ymgynghori â byd busnes, fel sydd yn ofynnol. Mae’n amlwg bod y berthynas rhwng byd busnes a’r Cynulliad wedi datblygu’n gyflym. Mae hyn yn ddatblygiad cadarnhaol ac yn un y dylem ei groesawu. Ar ôl yr ymgynghori y mis diwethaf, dylem allu cyflwyno cynigion gerbron y Cynulliad ar ôl trafod ymhellach gyda’r sector. Mae’n ystyried beth sydd ei angen arno er mwyn ymateb i’r drafodaeth a’r ymgynghori. Ni ddylid rhuthro hyn.

I seek the Assembly’s approval of the Guidance on Regulatory Appraisal. This will ensure that we carry out our duties under the Government of Wales Act from the first day that we enjoy our new powers over secondary legislation. I will also commend the interim guidance to staff on the other requirements and themes. It is a first and not a last word. However, it is important that staff are aware of the importance of the legal requirement attached to reflecting these issues in our decisions from the start. It is also crucial for the Assembly to indicate the importance of these issues.

Ceisiaf gymeradwyaeth y Cynulliad i’r Canllawiau ar werthusiad rheoleiddiol. Bydd hyn yn sicrhau ein bod yn cyflawni’n dyletswyddau dan Ddeddf Llywodraeth Cymru o’r diwrnod cyntaf y bydd gennym bwerau newydd dros ddeddfwriaeth eilaidd. Byddaf hefyd yn cymeradwyo’r canllawiau dros dro i’r staff ynghylch y gofynion a’r themâu eraill. Dyma’r gair cyntaf, nid yr olaf. Fodd bynnag, mae’n bwysig bod staff yn ymwybodol o bwysigrwydd y gofyniad cyfreithiol sydd ynghlwm wrth adlewyrchu’r materion hyn yn ein penderfyniadau o’r dechrau’n deg. Mae’n hanfodol hefyd fod y Cynulliad yn nodi pwysigrwydd y materion hyn.

We have considerable experience on local government, the voluntary sector, the environment, business and the promotion of equality of opportunity. I look forward to putting these proposals into final texts and drawing on the wealth of experience here. I also look forward to working closely with Assembly Members and our partners. I believe the effectiveness of this Assembly requires us to put these principles into practice. We cannot do it all perfectly on day one. However, I commend this approach to the Assembly and I hope it will have support from all quarters.

Mae gennym brofiad sylweddol ym maes llywodraeth leol, y sector gwirfoddol, yr amgylchedd, byd busnes a hyrwyddo cyfle cyfartal. Edrychaf ymlaen at droi’r cynigion hyn yn destunau terfynol ac at fanteisio ar y cyfoeth o brofiad sydd yma. Edrychaf ymlaen hefyd at gydweithio’n glòs gydag Aelodau’r Cynulliad a’n partneriaid. Credaf, er mwyn i’r Cynulliad hwn fod yn effeithiol, fod rhaid i ni roi’r egwyddorion hyn ar waith. Ni allwn wneud popeth yn berffaith ar y diwrnod cyntaf un. Fodd bynnag, cymeradwyaf yr ymagwedd hwn i’r Cynulliad gan obeithio y bydd cefnogaeth iddo o bob tu.

The First Secretary will now answer questions. He could answer them individually or in groups as preferred.

These are important documents. Despite their titles, they are radical in their implications. The regulatory appraisal schemes will give extra teeth to the equal opportunities and sustainable development schemes that we intend to establish. I hope that disability is integrated into the equal opportunities scheme. However, we must keep a careful watch on how these are implemented because any legislation we issue can be held up or challenged if it is not carried out properly.

Mae’r rhain yn ddogfennau pwysig. Er gwaethaf eu teitlau, maent yn radical yn eu goblygiadau. Bydd y cynlluniau gwerthuso rheoleiddiol yn rhoi dannedd ychwanegol i’r cynlluniau cyfle cyfartal a datblygu cynaliadwy yr ydym yn bwriadu eu sefydlu. Gobeithiaf fod anabledd i’w ymgorffori yn y cynllun cyfle cyfartal. Fodd bynnag, rhaid inni gadw llygad gofalus ar y modd y gweithredir rhain oherwydd gall unrhyw ddeddfwriaeth a gyhoeddir gennym gael ei hoedi neu ei herio os nad yw wedi ei chyflawni’n briodol.

You mentioned that we will have seminars on our human rights obligations. I welcome that, but could you tell me what training will be made available to Members to meet our other obligations? We welcome the reference to the voluntary sector scheme because it allows participation by the public through the various groups to which they may belong or by which they may be represented. All of us have been subjected to representations from many of them already. Some of the groups are very efficient and I am sure they will be powerful players. However, I would like some guarantees that the smaller voluntary groups will not be excluded.

Soniwch y bydd seminarau i ni ar ein dyletswyddau iawnderau dynol. Croesawaf hynny, ond a ellwch ddweud wrthyf pa hyfforddiant a gynigir i’r Aelodau er mwyn inni gyflawni ein dyletswyddau eraill? Croesawn y cyfeiriad at gynllun y sector gwirfoddol gan ei fod yn caniatáu i’r cyhoedd gyfrannu drwy’r grwpiau amrywiol y maent yn perthyn iddynt neu y cynrychiolir hwy ganddynt. Yr ydym i gyd wedi cael sylwadau eisoes oddi wrth nifer ohonynt. Mae rhai o’r grwpiau’n effeithiol iawn ac yr wyf yn sicr y bydd eu llais yn rymus. Fodd bynnag, hoffwn gael sicrwydd na fydd y grwpiau gwirfoddol llai yn cael eu cau allan.

In principle, the Conservative Party is pleased to support the guidance document on regulatory appraisal mentioned in the motion. Perhaps I could tie in my concerns about the motion with the statement that has already been made.

Mewn egwyddor, mae’r Blaid Geidwadol yn falch o gefnogi’r ddogfen ganllaw ar werthuso rheoleiddiol a grybwyllwyd yn y cynnig. Efallai y gallwn gydgysylltu fy mhryderon am y cynnig â’r datganiad a wnaed eisoes.

Order. That would not be in order. We are debating the motion separately. We are now discussing a specific statement from the First Secretary as I thought I had pointed out.

Trefn. Ni fyddai hynny mewn trefn. Yr ydym yn trafod y cynnig ar wahân. Ar hyn o bryd yr ydym yn trafod datganiad penodol gan y Prif Ysgrifennydd, a thybiwn fy mod wedi tynnu sylw at hynny.

My apologies, Mr Llywydd. Thank you First Secretary for the statement. I will raise my other concerns in the debate on the motion. Does the First Secretary envisage any problems in the incorporation of European Convention on Human Rights with reference to the Assembly in particular?

Ymddiheuraf, Mr Llywydd. Diolch i’r Prif Ysgrifennydd am y datganiad. Fe leisiaf fy mhryderon yn y ddadl ar y cynnig. A yw’r Prif Ysgrifennydd yn rhagweld unrhyw broblemau o ran ymgorffori Cytundeb Ewrop ar Iawnderau Dynol yng nghyd-destun y Cynulliad yn benodol?

Peter Black spoken in English p. 21

I would like to return to the question to the Environment Secretary on the sustainable development scheme. We welcome the fact that a member of the Cabinet has been given specific responsibility for that, and that it has been written into these regulatory appraisals and how we deal with them. However, I still feel that if we are to take a political lead on that scheme, we need a cross-cutting Committee on Sustainable Development. Will the First Secretary look at that again to see whether it is possible to establish one, draw up a scheme and monitor its implementation?

Hoffwn ddychwelyd at y cwestiwn i Ysgrifennydd yr Amgylchedd am y cynllun datblygu cynaliadwy. Croesawn y ffaith bod cyfrifoldeb penodol am hynny wedi ei roi i aelod o’r Cabinet, a’i fod wedi ei gynnwys yn y gwerthusiadau rheoleiddiol hyn a’r modd yr ydym yn ymdrin â hwy. Fodd bynnag, yr wyf yn dal i gredu, os ydym i roi arweiniad gwleidyddol ar y cynllun hwnnw, fod angen Pwyllgor trawsbynciol ar Ddatblygu Cynaliadwy arnom. A wna’r Prif Ysgrifennydd edrych ar hynny eto i weld a yw’n bosib sefydlu un, llunio cynllun a monitro’r modd o’i weithredu?

I am very happy to respond to those points. I am pleased that Jocelyn Davies described our approach as radical. Such a response encourages us all to be radical in the way we think through the practice and the opportunity we are given. I envisage equal rights in respect of disability being fully integrated in our approach. I am certain that would be the way that Jane Hutt, in taking a lead in the Cabinet and the Committee, will see the matter. It is certainly the way in which equalities organisations in Wales have developed—giving mutual support in the way they develop good practice. That is extremely promising.

Yr wyf yn gwbl fodlon ymateb i’r pwyntiau hyn. Fe’m plesiwyd gan ddisgrifiad Jocelyn Davies ein bod yn gweithredu mewn modd radical. Mae ymateb o’r fath yn annog pawb ohonom i fod yn radical yn ein ffordd o bwyso a mesur yr ymarfer a’r cyfle a roddwyd inni. Rhagwelaf y bydd hawliau cyfartal o ran anabledd yn cael eu hintegreiddio’n llwyr yn ein dulliau gweithredu. Yr wyf yn sicr mai dyna fydd barn Jane Hutt, wrth ddangos arweiniad yn y Cabinet a’r Pwyllgor. Yn sicr, dyna sut y mae mudiadau cydraddoldeb yng Nghymru wedi datblygu—maent yn rhoi cefnogaeth o’r naill du a’r llall wrth ddatblygu arfer da. Mae hynny’n addawol iawn.

On disability, the new Disability Rights Commission is being established. It will have an office in Wales and there will be a report to the Assembly each year. In addition to the organisations we already have in Wales, there will be a structure that will have a specific relationship with the Assembly to strengthen that work. In many ways, I am certain that the Members of this Assembly will not need encouragement to see that as a priority. However, the fact that the mechanism is there should be of some comfort to us and we should welcome it.

O ran anabledd, mae’r Comisiwn Hawliau Anabledd newydd yn cael ei sefydlu. Bydd ganddo swyddfa yng Nghymru a bydd yn rhoi adroddiad i’r Cynulliad bob blwyddyn. Yn ychwanegol at y mudiadau sydd gennym yng Nghymru eisoes, bydd yna strwythur fydd â pherthynas benodol â’r Cynulliad i atgyfnerthu’r gwaith hwnnw. Yr wyf yn sicr, mewn llawer ffordd, na fydd angen anogaeth ar Aelodau’r Cynulliad hwn i ystyried hynny’n flaenoriaeth. Fodd bynnag, dylai’r ffaith bod y peirianwaith yn bodoli fod yn beth cysur inni a dylem ei groesawu.

On training for Members, I am happy to consider what we could arrange in conjunction with outside organisations to make sure there is a pattern of opportunities available to Members. One of the things we have to examine, as time goes on, is our use of time. People will already know that the programme of work that Assembly Members have to undertake is not light. We must make sure that spaces are available for us to work in the regions of Wales, in our own constituencies and in contact with the different partners and for us to do our homework. In all of that, I believe there are proposals which can be made to strengthen the opportunities for people if we do it systematically.

Ynglŷn â hyfforddiant i’r Aelodau, byddwn yn falch o ystyried beth y gallem ei drefnu ar y cyd â mudiadau allanol i sicrhau bod patrwm o gyfleoedd ar gael i’r Aelodau. Un o’r pethau y bydd yn rhaid inni ei archwilio, wrth i amser fynd rhagddo, yw ein defnydd o amser. Bydd pobl eisoes yn ymwybodol nad yw’r rhaglen waith sydd yn wynebu Aelodau’r Cynulliad yn ysgafn. Rhaid inni wneud yn siŵr bod cyfleoedd ar gael inni i weithio yn rhanbarthau Cymru, yn ein hetholaethau ac mewn cysylltiad â phartneriaid gwahanol ac er mwyn inni wneud ein gwaith cartref. Yn hynny i gyd, credaf y gellir gwneud cynigion i atgyfnerthu’r cyfleoedd i bobl os gwnawn hynny’n systematig.

The point made in relation to disability could have been made about many other matters we need to pursue. I am happy to consider it in conjunction with the leaders of the other parties, the Trefnydd and the Business Committee, so that over time we will get all the bits to fit together. While being mindful of the role of the Presiding Officer in the management of business, I am certain with goodwill we can respond positively to the suggestion you make.

Gallai’r pwynt ynglŷn ag anabledd fod wedi ei wneud am lawer o faterion eraill y mae angen inni fynd ar eu trywydd. Yr wyf yn barod i’w ystyried ar y cyd ag arweinwyr y pleidiau eraill, y Trefnydd a’r Pwyllgor Busnes, fel y byddwn dros amser yn cael y darnau i gyd i gyd-fynd â’i gilydd. Er cydnabod rôl y Llywydd yn rheoli’r busnes, yr wyf yn sicr y gallwn, gydag ewyllys da, ymateb yn gadarnhaol i’ch awgrym chi.

I strongly endorse the point that smaller voluntary groups must not be left out. Smaller, local community groups must be a part of all of this. In that context, I welcome the establishment of the Wales Assembly centre by the Wales Council for Voluntary Action, with an officer dedicated to communication with the Assembly. In yesterday’s debate, we saw the first fruits of that. The WCVA, in conjunction with local councils of voluntary action or voluntary service in each county in Wales, will look at how the voluntary sector, including small organisations, relates to the Assembly, so that not only the large organisations with their own publicity and lobbying capacity have a voice in this Chamber. After many years as a professional youth and community worker, I concur with that strong point.

Ategaf yn gryf y pwynt na ddylai grwpiau gwirfoddol llai gael eu gadael allan. Rhaid i grwpiau cymunedol lleol, llai, fod yn rhan o hyn i gyd. Yn y cyd-destun hwnnw, croesawaf y ganolfan i’r Cynulliad Cenedlaethol a sefydlwyd gan Gyngor Gweithredu Gwirfoddol Cymru, gyda swyddog a benodwyd yn unswydd i gysylltu â’r Cynulliad. Yn y ddadl ddoe, gwelsom ffrwyth cyntaf hynny. Bydd y Cyngor Gweithredu, ar y cyd â chynghorau gweithredu gwirfoddol neu wasanaeth gwirfoddol lleol pob sir, yn edrych ar berthynas y sector gwirfoddol, gan gynnwys mudiadau bychan, â’r Cynulliad, fel mai nid dim ond y mudiadau mawr sydd â’u cyfundrefn gyhoeddusrwydd a lobïo eu hunain fydd â llais yn y Siambr hon. Wedi gweithio am flynyddoedd fel gweithiwr ieuenctid a chymuned proffesiynol, cytunaf â’r pwynt pwysig hwn.

Alun Cairns asked if I saw any particular problems in relation to the incorporation of the European Convention on Human Rights. Again in a previous incarnation, I was very much involved with the preparatory work on that. I do not see problems with it. It ensures that UK legislation builds in the principles which we signed up to as under the Convention so that we can deal with such matters here rather than on appeal in Europe. I think the principle is a good one. I am delighted that the Assembly is the first body to take responsibility from day one. I see many positives coming out of that obligation.

Gofynnodd Alun Cairns a oeddwn yn gweld unrhyw broblemau o ran ymgorffori Cytundeb Ewrop ar Iawnderau Dynol. Eto, yn y dyddiau a fu, bûm yn ymwneud llawer â’r gwaith paratoi ar hynny. Ni welaf fod unrhyw broblemau yn hynny. Mae’n sicrhau bod deddfwriaeth y DU yn ymgorffori’r egwyddorion yr ydym wedi rhoi ein henw wrthynt, megis dan y Cytundeb, fel y gallwn ddelio â materio n yma yn hytrach nag ar apêl yn Ewrop. Credaf fod yr egwyddor yn un dda. Yr wyf wrth fy modd mai’r Cynulliad yw’r corff cyntaf i ysgwyddo’r cyfrifoldeb o’r diwrnod cyntaf. Rhagwelaf y bydd llawer o bethau cadarnhaol yn dod o’r rhwymedigaeth honno.

Regarding Peter Black’s point, I think we all agree that the Assembly should deal properly with sustainable development. I have expressed one concern before. If we are not careful we will divide the cross-cutting issues and park them in a separate Committee which would mean that those issues get lost because they are not seen as part of the mainstream. Sustainable development is an issue for every Subject Committee and, as I explained yesterday, taking responsibility with the Cabinet makes sure that there will always be somebody to keep members of the Cabinet up to the mark. Reviewing progress from time to time does not take any responsibility away from the other Cabinet members or Committees. My view on establishing separate cross-cutting Committees is that, if we are not very careful, we will have wall-to-wall Committees all dealing with little bits of the agenda instead of making sure that we all take part in joined-up thinking. I suggest that as we all agree about the importance of sustainable development as a golden thread running through everything we do, we should examine it again when it has been operating for some time. If it turned out to be a gap that required a separate Committee to look at it, I would be open to persuasion. Given the amount of work that we have to do, I want to get sustainable development into the mainstream of the work of every Assembly Secretary, Committee, and Member to ensure that we keep on top of the need, which is in the legislation, for it to inform all that we do.

Ynglŷn â phwynt Peter Black, credaf fod pawb ohonom yn cytuno y dylai’r Cynulliad ddelio’n briodol â datblygu cynaliadwy. Mynegais un pryder o’r blaen. Os nad ydym yn ofalus byddwn yn rhannu’r materion trawsbynciol ac yn eu parcio mewn Pwyllgor ar wahân a fyddai’n golygu bod y materion hyn yn mynd ar goll gan na fyddent yn cael eu gweld fel rhan o’r brif ffrwd. Mae datblygu cynaliadwy yn rhywbeth i bob Pwyllgor Pwnc ac, fel yr eglurais ddoe, mae priodoli cyfrifoldeb â’r Cabinet yn sicrhau y bydd yna bob amser rywun i gadw aelodau’r Cabinet ar flaenau eu traed. Nid yw adolygu cynnydd o bryd i’w gilydd yn dwyn cyfrifoldeb oddi ar aelodau eraill y Cabinet neu Bwyllgorau eraill. O ran sefydlu Pwyllgorau trawsbynciol ar wahân, credaf, oni fyddwn yn ofalus iawn, y bydd gennym Bwyllgorau di-rif i gyd yn delio â phytiau bach o’r agenda yn hytrach na gwneud yn siŵr bod pawb ohonom yn meddwl am bethau mewn ffordd gydlynus. Gan fod pawb ohonom yn cytuno ar bwysigrwydd datblygu cynaliadwy, awgrymaf y dylem edrych ar hyn eto pan fydd wedi bod yn gweithredu am beth amser. Os gwelwn fod yma fwlch a bod angen Pwyllgor ar wahân i edrych arno, byddwn yn barod i gael fy mherswadio. Wrth ystyried faint o waith sydd gennym i’w wneud, yr wyf am sicrhau fod datblygu cynaliadwy yn rhan hanfodol o waith prif ffrwd pob Ysgrifennydd, Pwyllgor ac Aelod o’r Cynulliad i sicrhau ein bod yn llwyddo i ymdopi â’r angen, sydd yn y ddeddfwriaeth, ar i hyn oleuo popeth a wnawn.

Cynog Dafis siaradwyd yn Gymraeg t. 24

Cynog Dafis spoken in Welsh p. 24

I ryw raddau mae Alun wedi ymateb i rai o’r pwyntiau yr oeddwn am eu gwneud. Mae wedi ailadrodd ei amheuaeth ynglŷn â phriodoldeb sefydlu pwyllgor arbennig ar gyfer datblygu cynaliadwy. Ni allaf dderbyn ei resymeg oherwydd yr ydym wedi derbyn bod angen pwyllgor arbennig ar gyfer cyfle cyfartal. Nid yw hynny’n golygu y bydd y mater yn cael ei neilltuo a’i gadw ar wahân i brif ffrwd gweithgarwch y Cynulliad: i’r gwrthwyneb. Pwysaf arno, os bydd ystyriaeth bellach yn cael ei rhoi i sefydlu pwyllgor llorweddol neu draws-bynciol, i sicrhau nid yw hynny yn cael ei ohirio.

To some extent Alun has already responded to some of the points I wish to raise. He has repeated his doubts about the propriety of setting up a special committee for sustainable development. I cannot accept his reasoning because we have accepted that we need a special committee for equal opportunities. That does not mean that the matter will be set aside or kept separate from the mainstream of Assembly activities: to the contrary. I urge him, if the establishment of a horizontal or cross-cutting committee is to be considered further, to ensure that that is not delayed.

Yr wyf yn falch bod trefniadau ar waith i lunio’r cynllun a bod uned arbennig wedi’i sefydlu. Hoffwn glywed rhagor am capacity yr uned hon. Pan fydd y cynllun yn cael ei gyflwyno ddechrau’r flwyddyn, bydd cryn sylw yn cael ei roi i ba mor rymus a thrylwyr yw’r cynllun.

I am pleased that arrangements are in place to draw up the scheme and that a special unit has been established. I would like to hear more about the capacity of that unit. When the scheme is submitted at the beginning of the year, much attention will be paid to how forceful and thorough it is.

Mae hefyd yn bwysig iawn fod y Cynulliad yn datgan yn glir i gyrff eraill, ac i gyrff anadrannol megis Cyngor Cefn Gwlad, fod datblygu cynaliadwy yn golygu hyrwyddo datblygu sydd yn perthyn i’r categori cynaliadwy. Nid yw’n fater yn unig o godi rhwystrau i gynlluniau am fod amheuaeth ynglŷn â’u heffaith amgylcheddol.

It is also important that the Assembly states clearly to other bodies, and to non-departmental bodies such as the Countryside Council, that sustainable development means promoting development in relation to a sustainable category. It is not just a matter of raising obstacles to schemes because there is some doubt about their environmental effect.

Peth cadarnhaol iawn yw datblygu cynaliadwy. Mae’n eithriadol o bwysig, fel y mae mwy nag un person wedi dweud eisoes, ym maes ynni. Ymhen 10 i 15 mlynedd bydd yn allweddol bwysig fod gan Gymru a’i heconomi ffynhonellau ynni cystadleuol, dibynadwy a lleol. Mae gennym gyfle i roi pethau ar waith yn gynnar ar gyfer sefydlu hynny yn y dyfodol agos. Mae’n bwysig nad ydym yn colli’r cyfle oherwydd agweddau negyddol a nimby-aidd.

Sustainable development is very positive. It is particularly important, as more than one person has already said, to energy. In 10 to 15 years it will be imperative that Wales and its economy have competitive, dependable and local sources of energy. We have an opportunity to get to work early to establish that in the near future. It is important that we do not lose this opportunity because of negative and nimbyish attitudes.

Mick Bates spoken in English p. 25

Mick Bates siaradwyd yn Saesneg t. 25

Following on from Cynog’s statement, it is essential that we build a timescale with targets into this scheme, particularly for energy production. To follow the joined-up thinking process, taking submissions and consultation to their ultimate conclusion, you meet budgetary implications, particularly with voluntary organisations. As I mentioned before, continuity of funding to ensure that these organisations can perform their chosen duties within communities is essential.

Yn dilyn datganiad Cynog, mae’n hanfodol ein bod yn ymgorffori amserlen ynghyd â thargedau yn y cynllun hwn, yn enwedig ar gyfer cynhyrchu ynni. I ddilyn y broses o feddwl yn gydlynus, gan fynd â sylwadau ac ymgynghori i’w pen draw, rhaid wynebu’r goblygiadau cyllidebol, yn enwedig i fudiadau gwirfoddol. Fel y soniais yn gynharach, mae parhad yn y patrwm cyllido i sicrhau bod y mudiadau hyn yn gallu cyflawni’r dyletswyddau o’u dewis o fewn cymunedau yn holl bwysig.

I would like to see a further step taken as legislation is provided, a fund to enable the consultation process and allow the bodies involved to have some power over spending. That would complete the joined-up thinking. The scheme does not go far enough to empower people such as those in voluntary organisations.

Hoffwn weld cam pellach yn cael ei gymryd wrth ddarparu deddfwriaeth, sef cronfa i alluogi’r broses ymgynghori ac i ganiatáu i’r cyrff perthnasol fod â rhywfaint o reolaeth dros y gwario. Byddai hynny’n cwblhau’r meddwl cydlynus. Nid yw’r cynllun yn mynd yn ddigon pell i alluogi pobl fel y rheini mewn mudiadau gwirfoddol.

Cytunaf gyda llawer o’r hyn a ddywedodd Cynog. Yr wyf yn cydnabod pwysigrwydd gweithio yn gynaliadwy ym mhopeth yr ydym yn ei wneud yn y Cynulliad.

in Welsh I agree with a considerable amount of what Cynog said. I recognise the importance of working sustainably in everything we do in the Assembly.

Hefyd, mae yna bethau y gallwn eu gwneud gyda’n partneriaid y tu allan i’r Cynulliad. Nid cyfarfod mewn pwyllgor arbennig yw’r unig ffordd o fwrw ymlaen â’r gwaith. Cyfeiriais yn gynharach at y gynhadledd a gefnogodd Cynog ym mis Chwefror. Mae’n bwysig sicrhau ein bod yn gwneud y gwaith ac yn edrych ar ffyrdd newydd o’i wneud—nid dim ond ei roi i bwyllgor.

in Welsh In addition, there are things that we can do with our partners outside the Assembly. Meeting in a particular committee is not the only way to progress. I referred earlier to the conference that Cynog supported in February. It is important to ensure that we do the work and look at new ways of doing it and not just give it to a committee.

Mae Deddf Llywodraeth Cymru 1998 yn datgan bod yn rhaid inni gael rhai pwyllgorau megis y Pwyllgor Cyfle Cyfartal. Mae’n iawn bod y Pwyllgor hwnnw gennym a rhaid inni sicrhau ei fod yn gweithio’n iawn. Yr ydym yn defnyddio’r Pwyllgor. Ond, os awn ar ôl un pwyllgor ar ôl y llall, bydd hynny’n cynyddu nifer y lleoedd sydd yn gweithredu. Yr wyf yn barod i ddweud bod yn rhaid inni ailystyried yr holl beth yn y tymor byr yn hytrach na’r tymor hir.

in Welsh The Government of Wales Act 1998 states that we have to have certain committees such as the Committee on Equality of Opportunity. It is right that we have that Committee and we must ensure that it works properly. We are using the Committee. However, if we go after one committee after another, that would increase the number of places which take action. I am willing to say that we must reconsider the whole matter in the short term rather than the long term.

In all of this, and this applies to what Cynog and Mick said, the test will be whether our sustainable development scheme is practical. The test is whether our systems in the Assembly work and develop effective partnerships with the other organisations concerned, as well as whether we can get these golden threads to operate through everything we do. We need to get our systems right and not be trapped by one way of working. I am happy to review this matter and keep it under review.

yn Saesneg Yn hyn i gyd, ac mae hyn yn wir am yr hyn a ddywedodd Cynog a Mick, y prawf fydd a yw ein cynllun datblygu cynaliadwy yn ymarferol. Y prawf yw a yw ein systemau ni yn y Cynulliad yn gweithio ac yn datblygu partneriaethau effeithiol gyda’r mudiadau eraill perthnasol, yn ogystal os y gallwn ni gael y llinynnau euraid hyn i weithredu drwy bopeth a wnawn. Mae angen inni gael ein systemau’n iawn a pheidio â chael ein maglu gan un ffordd o weithio. Yr wyf yn barod i adolygu’r mater hwn a pharhau i wneud hynny.

I also accept Mick’s point about timescales and targets. I indicated that we should set targets. Targets need to be meaningful and worked out with those who deliver them so that all concerned are committed to reaching them and to continuing progress. That is how we should proceed.

yn Saesneg Derbyniaf hefyd bwynt Mick am amserlenni a thargedau. Dywedais y dylem osod targedau. Rhaid i dargedau olygu rhywbeth a’u bod wedi eu llunio ar y cyd â’r rhai sydd yn eu cyflawni fel bod pawb dan sylw yn ymroi i’w cyrraedd a pharhau i wella. Dyna sut y dylem symud ymlaen.

Consultation takes time and money for organisations. I appreciate that point particularly in relation to voluntary organisations. The Wales Council for Voluntary Action, supported in the past by the Welsh Office and in the future by the Assembly, is important in enabling much of that to happen.

yn Saesneg Mae ymgynghori yn golygu amser ac arian i fudiadau. Gwerthfawrogaf y pwynt hwn yn enwedig yng nghyswllt mudiadau gwirfoddol. Mae Cyngor Gweithredu Gwirfoddol Cymru, a gefnogwyd yn y gorffennol gan y Swyddfa Gymreig ac a gefnogir yn y dyfodol gan y Cynulliad, yn bwysig i alluogi llawer o hynny i ddigwydd.

There are aspects of funding voluntary organisations to which we need to return. There has been some good thinking in Government in the past two years on how we ensure that funding is dependable. There are also funds available that give opportunities for voluntary organisations and other partners to come in, and act as a glue to promote particular issues. Two examples are the social inclusion fund and the sustainable development fund, which encourage local community-based sustainable development projects. The more we can develop an understanding of those funds and encourage people to use them, the better for the voluntary sector and other partners in carrying out this important work.

yn Saesneg Mae yna agweddau ar gyllido mudiadau gwirfoddol y mae angen inni ddychwelyd atynt. Bu’r Llywodraeth yn meddwl yn effeithiol dros y ddwy flynedd ddiwethaf ynglŷn â sut y gallwn sicrhau cyllido dibynadwy. Mae yna gyllid ar gael hefyd sydd yn rhoi cyfleoedd i fudiadau gwirfoddol a phartneriaid eraill i ddod i mewn, a gweithredu fel glud i hyrwyddo materion penodol. Dwy enghraifft yw’r gronfa cynhwyso cymdeithasol a’r gronfa datblygu cynaliadwy, sydd yn annog prosiectau datblygu cynaliadwy wedi eu gwreiddio yn y gymuned leol. Po fwyaf y gallwn ddatblygu dealltwriaeth o’r cronfeydd hyn ac annog pobl i’w defnyddio, gorau oll fydd hynny i’r sector gwirfoddol a phartneriaid eraill wrth gyflawni’r gwaith pwysig hwn.

I welcome the fact that equality of opportunity is at the top of the policy priority list. I raise again the issue of the Committee on Equality of Opportunity and how it will consult, particularly with the black and ethnic minority communities not represented in the Assembly. I spoke earlier about standing advisers and my comments were misunderstood as being about paid appointments. I used the wrong term.

Croesawaf y ffaith bod cyfle cyfartal ar frig y rhestr blaenoriaethau polisi. Unwaith eto, hoffwn godi mater y Pwyllgor Cyfle Cyfartal a sut y bydd yn ymgynghori, yn enwedig â’r cymunedau du a ac ethnig lleiafrifol nad ydynt wedi eu cynrychioli yn y Cynulliad. Cyfeiriais yn gynharach at ymgynghorwyr sefydlog a chamddeallwyd fy sylwadau gan gymryd fy mod yn sôn am benodiadau gyda thâl. Defnyddiais y term anghywir.

We spoke in the National Assembly Advisory Group about the possibility of co-option onto cross-cutting committees. It was not appropriate to have voting co-optees, but I register again our concern that there should be regular advisers to the Committee on Equality of Opportunity from a range of disadvantaged groups. We are particularly concerned to see black and ethnic communities represented as, unfortunately, there is no direct representation of those communities among Assembly Members.

Soniasom yng Ngrŵp Ymgynghorol y Cynulliad Cenedlaethol am y posibilrwydd o gyfethol i’r pwyllgorau trawsbynciol. Nid oedd yn briodol cael aelodau cyfetholedig â phleidlais, ond nodaf eto ein pryder y dylai fod yna ymgynghorwyr rheolaidd ar y Pwyllgor Cyfle Cyfartal o amrediad o grwpiau â diffyg mantais. Yr ydym yn awyddus iawn i gymunedau du ac ethnig gael eu cynrychioli gan nad oes, ysywaeth, gynrychiolaeth uniongyrchol o blith y cymunedau hynny ymhlith Aelodau’r Cynulliad.

I responded to the spirit of this question when answering Val Feld a few weeks ago. Following those exchanges, I had further discussion with the equalities officer who, as I told the Assembly, was appointed last December. That discussion was also in preparation for a meeting with Operation Black Vote representatives who were visiting Cardiff.

Ymatebais i ysbryd y cwestiwn hwn wrth ateb Val Feld rai wythnosau’n ôl. Yn dilyn y drafodaeth honno cefais drafodaeth bellach gyda’r swyddog cydraddoldeb a benodwyd, fel y dywedais wrth y Cynulliad, fis Rhagfyr diwethaf. Yr oedd y drafodaeth honno hefyd yn baratoad ar gyfer cyfarfod gyda chynrychiolwyr Operation Black Vote a oedd yn ymweld â Chaerdydd.

I am pleased that there has been much discussion with organisations representative of ethnic minorities to prepare the ground for this work and for the Assembly scheme. There has been positive engagement from groups in different parts of Wales and I believe that we have laid a firm foundation for the work. I was pleased at the nature of the work because—and I know Members are also concerned about this—sometimes the process continues but does not achieve its aim. Both Welsh Office officials and representatives of minority organisations have engaged with this issue in a positive way and progress will be made.

Yr wyf yn falch y bu llawer o drafod gyda mudiadau sydd yn cynrychioli lleiafrifoedd ethnig i fraenaru’r tir ar gyfer y gwaith hwn a chynllun y Cynulliad. Cafwyd ymrwymiad cadarnhaol gan grwpiau mewn gwahanol rannau o Gymru a chredaf ein bod wedi gosod sylfaen gadarn i’r gwaith. Yr oeddwn yn fodlon iawn â natur y gwaith oherwydd—a gwn fod yr Aelodau’n poeni am hyn hefyd—weithiau mae’r broses yn parhau ond nid yw’n cyflawni ei nod. Mae swyddogion y Swyddfa Gymreig a chynrychiolwyr y mudiadau lleiafrifol wedi mynd i’r afael â’r mater hwn mewn modd cadarnhaol ac fe welwn gynnydd.

I do not want to pre-empt what Jane and the Committee will want to develop but I will make one further point on the equalities issue. Given that there was a requirement to have a Committee, I was keen that we should not make it a back alley so that promotion of equality of opportunity went lower down the priorities in the mainstream work of the Assembly. I think we have that balance right in our proposals. The Cabinet supports me in the view that equality of opportunity is a responsibility for each member and each of the committees. The Committee on Equality of Opportunity is an additional bonus.

Nid wyf am achub y blaen ar yr hyn y bydd Jane a’r Pwyllgor am ei ddatblygu ond hoffwn wneud un pwynt pellach ynglŷn â chydraddoldeb. O gofio bod yna ofyniad i gael Pwyllgor, yr oeddwn am sicrhau na châi hynny ei wthio i’r cefndir nes bod llai o sylw’n cael ei roi i hyrwyddo cyfle cyfartal ym mlaenoriaethau gwaith prif ffrwd y Cynulliad. Credaf inni gael y cydbwysedd yn iawn yn ein cynigion. Mae’r Cabinet yn fy nghefnogi yn y farn bod pob aelod a phob un o’r pwyllgorau â chyfrifoldeb am gyfle cyfartal. Mae’r Pwyllgor Cyfle Cyfartal yn fonws ychwanegol.

This is probably the last piece of the jig-saw, to go into place before we can pass what will go down as Welsh law, rather than the English and Welsh law we have suffered from in the past.

Mae’n debyg mai dyma ddarn olaf y jig-so, i’w roi yn ei le cyn y gallwn ni basio’r hyn a gofnodir fel cyfraith Cymru, yn hytrach na chyfraith Cymru a Lloegr a ddioddefwyd gennym yn y gorffennol.

There are two issues in the paper. One relates to the Assembly’s rights to challenge. The decision on whether to have a regulatory appraisal with the legislation is one taken by the Assembly executive and the Assembly Secretary concerned. However, there is no mechanism in the document for challenging that decision. Could the Business Secretary reply?

Mae dau fater i’w hystyried yn y papur. Mae un yn ymwneud â hawliau’r Cynulliad i herio. Penderfyniad i’w gymryd gan adran weithredol y Cynulliad a’r Ysgrifennydd dan sylw yw a ddylid cael gwerthusiad rheoleiddiol gyda’r ddeddfwriaeth. Fodd bynnag, nid oes unrhyw beirianwaith yn y ddogfen ar gyfer herio’r penderfyniad hwnnw. A wna’r Trefnydd ateb?

The second point is that there is a requirement in the Standing Orders. Everyone is familiar with Standing Order No. 22, which is our longest. Everyone knows Standing Order No. 22.61, which is the last one before we get to the miscellaneous procedure order. Standing Order No. 22.61 refers to the requirement for the Presiding Officer to publish subordinate legislation made or confirmed by the Assembly, which is not otherwise published for sale. You might say that it is the Presiding Officer’s job to make sure everything we do is published for sale. In that way all the lawyers in the land will buy the lot. However, there is an obligation, brought to our attention this morning by the Law Society, to give information to the people of Wales. In general, the first stop for that would be the legal profession.

Yr ail bwynt yw bod yna ofyniad yn y Rheolau Sefydlog. Mae pawb yn gyfarwydd â Rheol Sefydlog Rhif 22, sef yr un hwyaf. Gŵyr pawb am Reol Sefydlog Rhif 22.61, yr olaf cyn inni gyrraedd gorchymyn y gweithdrefnau amrywiol. Mae Rheol Sefydlog Rhif 22.61 yn cyfeirio at y gofyniad bod y Llywydd yn cyhoeddi unrhyw is-ddeddfwriaeth a wneir neu a gadarnheir gan y Cynulliad, nad yw fel arall wedi’i chyhoeddi i’w gwerthu. Gallech ddweud mai gwaith y Llywydd yw sicrhau bod popeth a wnawn yn cael ei gyhoeddi i’w werthu. Drwy hynny byddai’r holl gyfreithwyr drwy’r wlad yn prynu’r cwbl. Fodd bynnag, yr ydym dan rwymedigaeth, fel y cawsom ein hatgoffa fore heddiw gan Gymdeithas y Gyfraith, i roi gwybodaeth i bobl Cymru. Yn gyffredinol, y cam cyntaf tuag at hynny fyddai’r proffesiwn cyfreithiol.

This document talks about the importance of this consultation. One way to consult is to make things available to the public, and in this case, to lawyers, business groups, voluntary groups and so on. What will be the method of getting information to the public? The sensible approach would be to use the Internet. Some of us have expressed concerns to you, Dafydd, that this will not always work. Yesterday you were referred to as Dafydd dot, which is an interesting way of describing technological changes in the Chamber. We would like to speed up that process. The public need to know about the appraisals and subordinate legislation. What exact process will we use to get information into the public domain, both now, while the appraisals are being undertaken, and when the legislation is complete, under Standing Order No. 22.61?

Mae’r ddogfen hon yn sôn am bwysigrwydd yr ymgynghori. Un ffordd o ymgynghori yw sicrhau bod pethau ar gael i’r cyhoedd, ac yn yr achos hwn, i gyfreithwyr, grwpiau busnes, grwpiau gwirfoddol ac yn y blaen. Drwy ba ddull y rhoddir gwybodaeth i’r cyhoedd? Y peth synhwyrol fyddai defnyddio’r Rhyngrwyd. Mae rhai ohonom wedi mynegi gofid wrthych chi, Dafydd, na fydd hyn yn gweithio bob amser. Ddoe, cyfeiriwyd atoch fel Dafydd dot, sydd yn ffordd ddiddorol o ddisgrifio newidiadau technolegol yn y Siambr. Hoffem gyflymu’r broses. Mae angen i’r cyhoedd wybod am y gwerthusiadau a’r ddeddfwriaeth eilaidd. Pa broses yn union a ddefnyddiwn ni i ddarparu gwybodaeth i’r cyhoedd, yn awr, tra bo’r gwerthusiadau ar y gweill, a phan fydd y ddeddfwriaeth wedi ei chwblhau, dan Reol Sefydlog Rhif 22.61?

Alun Cairns spoken in English p. 30

Alun Cairns siaradwyd yn Saesneg t. 30

We support the guidance in the document on regulatory appraisals which are mentioned in the motion. Assessing costs and benefits of proposed legislation is a vital role for the Assembly. During the referendum, all sectors of society feared that the Assembly would introduce rules and regulations that would inhibit freedom of choice and add costs to people’s daily lives and business. That argument has ended. The Assembly has been established and all parties have a positive agenda and a positive role to play.

Yr ydym yn cefnogi’r arweiniad yn y ddogfen ar werthusiadau rheoleiddiol, y cyfeirir atynt yn y cynnig. Mae asesu costau a buddion deddfwriaeth arfaethedig yn rôl holl bwysig i’r Cynulliad. Yn ystod y refferendwm, ofnai pob carfan o gymdeithas y byddai’r Cynullid yn cyflwyno rheolau a rheoliadau a fyddai’n llyffetheirio rhyddid dewis ac yn ychwanegu costau at fywydau beunyddiol pobl a busnesau. Daeth y ddadl honno i ben. Mae’r Cynulliad wedi ei sefydlu ac mae gan bob plaid agenda gadarnhaol a rôl gadarnhaol i’w chwarae.

However, this is not to say that we can ignore the concerns and fears highlighted in the referendum. The role of regulatory appraisals is critical in alleviating the concerns of many people who expressed those fears at that time. All efforts must be made to ensure that every non-regulatory approach is pursued before we introduce subordinate legislation. In effect, a regulatory appraisal will be the end of wide-range analysis. It must be robust in its judgement, possibly as robust as the Economic Development Committee questioning by every Committee member was this morning. That makes for healthy debate and analysis.

Fodd bynnag, nid yw hynny’n gyfystur â dweud y gallwn anwybyddu’r pryderon a’r ofnau a amlygwyd yn y refferendwm. Mae rôl y gwerthusiadau rheoleiddiol yn dyngedfennol er lliniaru pryderon nifer o bobl a fynegodd yr ofnau hynny ar y pryd. Rhaid gwneud pob ymdrech i sicrhau ein bod yn mynd ar drywydd pob dull ar wahân i reoleiddio cyn cyflwyno is-ddeddfwriaeth. Yn wir, dim ond ar ddiwedd dadansoddiad eang ei gwmpas y ceir gwerthusiad rheoleiddiol. Rhaid iddo fod yn gadarn wrth farnu, yr un mor gadarn efallai ag yr oedd yr holi gan bob aelod o’r Pwyllgor Datblygu Economaidd yn y cyfarfod fore heddiw. Mae hynny’n ennyn trafod a dadansoddi iach.

The regulatory appraisals must not be complementary documents for any political agenda or proposed order before they come to the Assembly. The guidance states that the appraisal must identify the costs and implications. It is critical that all political interests are discarded and that the concerns raised in the preceding debate are explored. The consequences for small business and the interested groups which were considered in the discussions up until now are particularly important. At a time when every effort is being made to foster and promote indigenous enterprise, any subordinate legislation must have been analysed with focus on small business as well as other interested groups or organisations. We support the principles of the document but much responsibility is also placed on the Assembly Secretaries by regulatory appraisal. They must accept the spirit in which the documents are meant.

Rhaid i’r gwerthusiadau rheoleiddiol beidio â bod yn ddogfennau sydd yn ategu rhyw agenda wleidyddol neu drefn arfaethedig cyn iddynt ddod gerbron y Cynulliad. Dywed y canllawiau fod yn rhaid i’r gwerthusiadau nodi’r costau a’r goblygiadau. Mae’n holl bwysig bod unrhyw fuddiannau gwleidyddol yn cael eu bwrw heibio ac yr ymchwilir i’r pryderon a godwyd yn y ddadl flaenorol. Mae’r canlyniadau i fusnesau bach a’r grwpiau â diddordeb a gafodd eu hystyried yn y trafodaethau hyd yma yn neilltuol o bwysig. Ar adeg pan y gwneir pob ymdrech i feithrin a hybu mentrau cynhenid, rhaid dadansoddi unrhyw is-ddeddfwriaeth gan ganolbwyntio ar fusnesau bach yn ogystal â grwpiau a mudiadau eraill perthnasol. Cefnogwn egwyddorion y ddogfen ond mae’r gwerthusiadau rheoleiddiol yn rhoi llawer o gyfrifoldeb hefyd ar Ysgrifenyddion y Cynulliad. Rhaid iddynt dderbyn y dogfennau yn yr ysbryd y bwriadwyd hwy ynddo.

The definition of significant costs in the document must be determined by the Assembly Secretary. We must trust that vague statements are not used to avoid highlighting the impact—the possibly negative impact on every group on occasions—as well as the potential for political gain. Paragraph 3.1 states that a regulatory appraisal need not be undertaken if circumstances make it inappropriate. Clearly, health and public emergencies that have recently been in the news in Wales fall into that category. The same paragraph contains four such inappropriate circumstances. I assume that these are the only four cases when regulatory appraisals would not be conducted. That paragraph is not to be abused.

Rhaid i Ysgrifennydd y Cynulliad ddiffinio’r costau sylweddol yn y ddogfen. Rhaid inni fod yn ffyddiog na ddefnyddir datganiadau amwys i osgoi tynnu sylw at yr effaith—a’r effaith negyddol posibl ar bob grŵp ar adegau—yn ogystal â’r potensial i elwa’n wleidyddol. Dywed Paragraff 3.1 nad oes angen cynnal gwerthusiad rheoleiddiol os yw’r amgylchiadau’n golygu bod hynny’n amhriodol. Yn amlwg, mae’r argyfyngau iechyd a’r argyfyngau cyhoeddus a fu yn y newyddion yn ddiweddar yng Nghymru yn perthyn i’r categori hwnnw. Mae’r un paragraff yn cynnwys pedwar amgylchiad amhriodol o’r fath. Yr wyf yn cymryd mai’r rhain yw’r unig bedwar achos lle na châi gwerthusiadau rheoleiddiol eu cynnal. Nid yw hwn yn baragraff i’w gamddefnyddio.

It is essential that the spirit of the document is accepted by the Assembly and, in particular, by the relevant Assembly Secretary because it is on that basis that we can continue with a positive agenda.

Mae’n hanfodol bod ysbryd y ddogfen yn cael ei dderbyn gan y Cynulliad ac, yn arbennig, gan yr Ysgrifennydd perthnasol, oherwydd ar y sail honno y gallwn ni fwrw ymlaen gydag agenda gadarnhaol.

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 32

I thank Alun Cairns for his statement on behalf of the Conservative Party. I am sure it will be welcomed by everybody in the Assembly. He is right to talk about the importance of assessing costs and benefits properly. As Alun mentioned, regulatory appraisal is very important. While talking to business representatives over the last few months, it became clear that there was some tension. They want to be consulted and involved. They can now see the opportunity that the Assembly presents, and they want to be partners with it. However, they do not want to be tied into a bureaucratic system that adds to the amount of meetings and paperwork. There is a tension, as Alun rightly said, and it reflects Jocelyn’s point on the smaller voluntary organisations.

Diolch i Alun Cairns am ei ddatganiad ar ran y Blaid Geidwadol. Yr wyf yn siŵr y caiff groeso gan bawb yn y Cynulliad. Mae’n iawn i sôn am bwysigrwydd asesu costau a buddion yn fanwl. Fel y soniodd Alun, mae’r gwerthuso rheoleiddiol yn dra phwysig. Wrth siarad â chynrychiolwyr busnes dros y misoedd diwethaf, daeth yn amlwg bod yna rywfaint o densiwn. Maent am inni ymgynghori â hwy ac am gael llais. Gallant weld yn awr y cyfle a ddaw yn sgîl y Cynulliad, ac maent am fod yn bartneriaid gydag ef. Fodd bynnag, nid ydynt am gael eu clymu i mewn i system fiwrocrataidd sydd yn ychwanegu at swmp y cyfarfodydd a’r gwaith papur. Mae yna densiwn, fel y dywedodd Alun yn gywir, ac mae’n adlewyrchu pwynt Jocelyn am y mudiadau gwirfoddol llai.

The interests of smaller businesses should be represented. They should not have to spend all their time surfing the Internet to see what the Welsh Assembly proposes this week. We need a partnership approach between business and the Assembly to try to deliver that system. Work has been done to try to pull different business organisations together to form Business Wales, involving the Confederation of British Industry, the Institute of Directors, representatives of Small Business, the trade unions and the rest. We hope this will allow the possibility of a high-level interface between the Assembly and representatives similar to that in local government. Business wants the structure to be less bureaucratic, as it is in the voluntary sector.

Dylai buddiannau’r busnesau llai gael eu cynrychioli. Ni ddylent orfod treulio’u hamser i gyd yn syrffio’r Rhyngrwyd i weld beth y mae’r Cynulliad yn ei awgrymu’r wythnos hon. Mae angen inni weithio ar batrwm partneriaeth rhwng busnesau a’r Cynulliad i geisio gwireddu’r system honno. Aed ati i geisio dod â gwahanol fudiadau busnes at ei gilydd i ffurfio Busnes Cymru, gan gynnwys Cydffederasiwn Diwydiannau Prydain, Sefydliad y Cyfarwyddwyr, cynrychiolwyr Busnesau Bach, yr undebau llafur a’r gweddill. Gobeithiwn y bydd hyn yn caniatáu’r posibilrwydd o gyswllt ar lefel uchel rhwng y Cynulliad a chynrychiolwyr, yn debyg i’r hyn a geir mewn llywodraeth leol. Mae byd busnes yn awyddus i’r strwythur fod yn llai biwrocrataidd, fel y mae yn y sector gwirfoddol.

There is no simple answer. Previous discussions have not led to a perfect model so that everyone can say, ‘That’s great, that’s it, done.’ It must be taken forward in the spirit that I hope I demonstrated in my earlier statement, and in the way the Assembly approached these issues over the last weeks. With the positive engagement of every party in this Assembly, I am sure that we can produce something positive, allowing flexibility in consultation. As long as it is done appropriately, it does not always have to be done in the same way. In some circumstances, when, for example, something applies to the electrical industry but not to other industries, consultation is carried out by sectors. If we support the principle, tease it out and do not pretend it will be easy to work with our partners in business, we can make it work.

Nid oes ateb hawdd. Nid yw trafodaethau blaenorol wedi arwain at fodel perffaith a bod pawb yn dweud, ‘Mae hynny’n wych, dyna ni, mae wedi’i orffen.’ Rhaid symud pethau ymlaen yn yr ysbryd a ddangosais i, gobeithio, yn fy natganiad yn gynharach ac yn y ffordd y mae’r Cynulliad wedi ymdrin â’r materion hyn dros yr wythnosau diwethaf. Gyda phob plaid yn y Cynulliad hwn yn ymroi o ddifrif, yr wyf yn siŵr y gallwn gynhyrchu rhywbeth cadarnhaol, gan ganiatáu hyblygrwydd wrth ymgynghori. Cyhyd â’i fod yn cael ei wneud yn briodol, nid oes rhaid iddo gael ei wneud yn yr un ffordd bob amser. Dan rai amgylchiadau, er enghraifft, pan fo rhywbeth yn berthnasol i’r diwydiant trydan ond nid i ddiwydiannau eraill, cynhelir yr ymgynghori gan y sectorau. Os cefnogwn yr egwyddor, ei thrin a’i thrafod a pheidio â chymryd arnom y bydd gweithio gyda’n partneriaid mewn busnes yn hawdd, gallwn wneud i hyn weithio.

I commend the point that Alun Cairns made when he specified a number of areas where there might be exceptions, or where inappropriate circumstances might be involved. I make a commitment on behalf of myself and Cabinet Members that we will do all we can to ensure that that flexibility is never abused. Flexibility requires responsibility; that balance needs to be in place. Without it you are tied to a bureaucratic system and everybody rails at its inflexibility. On the other hand, if you have flexibility and you handicap organisations offering it, then confidence will go out of the window. It is our responsibility to ensure that we do not abuse that flexibility. To make it effective, we must use it for its intended purpose.

Cymeradwyaf y pwynt a wnaed gan Alun Cairns wrth iddo nodi nifer o feysydd lle y gallai fod yna eithriadau, neu lle y gallai fod yna amgylchiadau amhriodol. Addawaf ar fy rhan fy hun ac Aelodau’r Cabinet y gwnawn bopeth a allwn i sicrhau na chaiff yr hyblygrwydd hwn ei gamddefnyddio byth. Mae hyblygrwydd yn golygu cyfrifoldeb; rhaid sefydlu’r cydbwysedd hwn. Hebddo yr ydych wedi eich clymu wrth system fiwrocrataidd ac mae pawb yn cwyno am yr anhyblygrwydd. Ar y llaw arall, os oes gennych hyblygrwydd a’ch bod yn llyffetheirio’r mudiadau sydd yn ei gynnig, yna collir pob hyder. Ein cyfrifoldeb ni yw sicrhau nad ydym yn camddefnyddio’r hyblygrwydd. I fod yn effeithiol, rhaid inni ei ddefnyddio i’w ddiben bwriadedig.

I certainly take on board some of Mike German’s points. I am not completely aware of the Law Society’s concerns, but I shall consider what was said. I shall find the most appropriate way of responding to his points.

Yr wyf yn sicr yn derbyn rhai o bwyntiau Mike German. Nid wyf yn gwbl ymwybodol o bryderon Cymdeithas y Gyfraith, ond byddaf yn ystyried yr hyn a ddywedwyd. Byddaf yn dod i’r ffordd fwyaf priodol o ymateb i’w bwyntiau.

The method of getting information to the public is a matter of concern. In the past, there has been a tremendous amount of paper production that has not always reached the people who need it. The more flexible the system, the better. We must make the distinction, as we have in previous debates, between making information available through the intranet, which had some teething problems, and using the internet, which is increasingly the means of making information available quickly and flexibly. For example, we must ensure that development of access through the internet, in schools and libraries, at a local level throughout Wales, is seen as a way of being able to access information from the Assembly tomorrow, rather than in a few months’ time when the physical documents are published.

Mae’r dull o gael gwybodaeth i’r cyhoedd yn destun pryder. Yn y gorffennol, cynhyrchwyd tomenni o bapur ond nid ydynt bob amser wedi cyrraedd y bobl y bwriadwyd hwy ar eu cyfer. Po fwyaf hyblyg yw’r system, gorau oll. Rhaid inni wahaniaethu, fel y gwnaethom mewn trafodaethau cynt, rhwng darparu gwybodaeth drwy’r fewnrwyd, lle cafwyd rhai problemau cychwynnol, a defnyddio’r rhyngrwyd, sef y dull a ddefnyddir yn gynyddol i sicrhau bod gwybodaeth ar gael yn gyflym a hyblyg. Er enghraifft, rhaid inni sicrhau bod ehangu’r niferoedd sydd yn gallu manteisio ar y rhyngrwyd, mewn ysgolion a llyfrgelloedd, ar lefel leol ledled Cymru, yn cael ei dirnad fel ffordd i sicrhau mynediad at wybodaeth am y Cynulliad yfory, yn hytrach nag ymhen rhai misoedd pan gyhoeddir fersiynau papur y dogfennau.

I take on board the underlying thread of Mike’s argument, which, as I interpret it, requires us to ensure that we use technology, modern ways of communicating, so that things are accessible to the people who need them, as quickly as possible. If we tease out the best way of doing that with our partners, I believe that we can keep these processes under review and listen to people who need the information so that we address means of getting it to them in a timely way. Speed is of the essence. Ensuring that information is available in the most appropriate way is something that we must continue to tease out. I am happy to keep that under review and I welcome ideas from Assembly Members and our partners.

Derbyniaf y llinyn y seiliwyd dadl Mike arno, dadl sydd, fel y dehonglaf fi hi, yn golygu bod rhaid inni sicrhau ein bod yn defnyddio technoleg, ffyrdd modern o gyfathrebu, fel bod pethau o fewn cyrraedd y bobl hynny sydd eu hangen, cyn gyflymed â phosibl. Os gallwn ni ganfod y ffordd orau o wneud hynny gyda’n partneriaid, credaf y gallwn adolygu’r prosesau hyn yn barhaus a gwrando ar y bobl sydd angen y wybodaeth er mwyn inni roi sylw i ffyrdd o’i chael iddynt hwy yn gyflym. Mae cyflymdra yn holl bwysig. Mae sicrhau bod gwybodaeth ar gael yn y ffordd fwyaf priodol yn rhywbeth y mae’n rhaid inni barhau i ymchwilio iddo. Yr wyf yn gwbl fodlon parhau i adolygu hynny a chroesawaf syniadau gan Aelodau’r Cynulliad a’n partneriaid.

Trosglwyddo Swyddogaethau i’r Cynulliad

Transfer of Functions to the Assembly

Dyna ddiwedd y sesiwn ffurfiol. Fodd bynnag, yr wyf yn croesawu Aelodau i aros yma am ychydig funudau ar gyfer y seremoni hanesyddol y soniais amdani ar y dechrau. Galwaf ar y Prif Ysgrifennydd, yn ei rôl fel Ysgrifennydd Gwladol, i annerch y Cynulliad. Yna bydd cyfle i arweinyddion y pleidiau eraill ymateb, ac ar ddiwedd y seremoni fe ddywedaf innau ychydig eiriau i gloi. Fe’ch gwahoddaf wedyn i ymuno â mi y tu allan i’r Siambr lle y tynnir llun i nodi’r achlysur.

That is the end of our formal business. However, I invite Members to remain for the historic ceremony that I mentioned at the beginning. I call on the First Secretary, in his role as Secretary of State, to address the Assembly. Party leaders will then have the opportunity to respond, after which I shall say a few words in closing. I shall then invite Members to join me outside the Chamber where a commemorative photograph will be taken to mark the occasion.

A gaf fi ddiolch i chi, Mr Llywydd, am y cyfle i ddweud gair ynghylch yr hyn sydd yn digwydd heno ac yfory. Bydd y Cynulliad yn mabwysiadu’r cyfrifoldebau a’r pwerau a drosglwyddwyd iddo gan y Ddeddf.

in Welsh May I thank you, Mr Presiding Officer, for the opportunity to say something about what happens tonight and tomorrow. The Assembly will adopt the responsibilities and powers transferred to it by the Act.

Tomorrow the Secretary of State’s powers transfer, in great measure, to the new National Assembly for Wales. Many people will be looking to Scotland, where the transfer of powers to the new Scottish Parliament takes place tomorrow. We enjoyed our day, when there was a tremendous burgeoning of confidence and enthusiasm across Wales as we marked, in the presence of Her Majesty Queen Elizabeth, the transfer of powers, which effectively takes place at midnight.

yn Saesneg Yfory, mae pwerau’r Ysgrifennydd Gwladol yn trosglwyddo, i raddau helaeth, i Gynulliad Cenedlaethol newydd Cymru. Bydd nifer o bobl yn edrych tua’r Alban, lle bydd pwerau’n cael eu trosglwyddo yfory i Senedd newydd yr Alban. Mwynhasom ein diwrnod, gyda hyder a brwdfrydedd yn ffrwydro ar hyd a lled Cymru wrth inni ddynodi, ym mhresenoldeb Ei Mawrhydi, y Frenhines Elizabeth, fod y pwerau’n cael eu trosglwyddo. Am hanner nos heno, mewn gwirionedd, y daw hynny i rym.

There were many milestones along the road to devolution, but in many ways this is the most important, because it is the real one. From tomorrow, the powers held by myself and ministerial colleagues, pass to the National Assembly. I pay tribute to those who served in ministerial office: to Peter Hain and Jon Owen Jones, the current junior ministers at the Welsh Office, and all those who served before them from Jim Griffiths and John Morris onwards. It was a great delight to see John Morris take part in our formal ceremony given his responsibility for previous efforts at achieving devolution. I also thank Ron Davies, who steered the process through the House of Commons so successfully as well as up to and through the election period.

yn Saesneg Bu nifer o gerrig milltir ar hyd y ffordd at ddatganoli, ond mewn sawl ffordd hon yw’r garreg filltir bwysicaf, oherwydd hon yw’r un go iawn. O yfory ymlaen, trosglwyddir y pwerau a fu yn fy nwylo i a’m cyd-weinidogion i’r Cynulliad Cenedlaethol. Hoffwn dalu teyrnged i’r rheini a fu’n gwasanaethu fel gweinidogion: i Peter Hain a Jon Owen Jones, yr is-weinidogion yn y Swyddfa Gymreig ar hyn o bryd, a phawb sydd wedi gwasanaethu o’u blaen, o Jim Griffiths a John Morris ymlaen. Hyfryd iawn oedd gweld John Morris yn cymryd rhan yn ein seremoni ffurfiol, o gofio’i gyfrifoldeb ef dros yr ymdrechion blaenorol i sicrhau datganoli. Diolchaf hefyd i Ron Davies, a lywiodd y broses drwy Dŷ’r Cyffredin mor llwyddiannus yn ogystal ag yn y cyfnod yn arwain at yr etholiad ac wedi hynny.

It is also an important day for officials. From tomorrow, they serve the National Assembly for Wales. The Welsh Office effectively disappears; it comes to an end. The building remains and the officials are still there, but they are part of the Assembly and our responsibilities as elected Members. It is a very exciting and stimulating era, and I am sure you agree that officials already work differently in taking up responsibilities as servants of this Assembly. It has surprised and pleased us all to see the enthusiasm with which Jon Shortridge and his colleagues have taken up the challenge of working with us. It is bound to be a challenge but they are learning new tricks and new ways of doing things and entering into the spirit of why this Assembly was established. As Secretary of State for Wales, I present you with this copy of the transfer order as a symbol of the powers being transferred from Westminster to Wales. It is an important day and as Members of the first Assembly we should all be proud. I hope that we will succeed in making the people of Wales proud of the Assembly and of us as their Assembly Members.

yn Saesneg Mae hefyd yn ddiwrnod pwysig i’r swyddogion. O yfory ymlaen, maent yn gwasanaethu Cynulliad Cenedlaethol Cymru. Mae’r Swyddfa Gymreig, i bob diben, yn diflannu, yn dod i ben. Erys yr adeilad ac mae’r swyddogion yn dal yno, ond maent yn rhan o’r Cynulliad a’n cyfrifoldeb ni fel Aelodau etholedig ydynt. Mae’n gyfnod tra chyffrous ac ysgogol, ac yr wyf yn siŵr y byddech yn cytuno bod y swyddogion eisoes yn gweithio’n wahanol wrth ymgymryd â’u dyletswyddau fel gweision y Cynulliad hwn. Bu’n syndod ac yn bleser i bawb ohonom weld brwdfrydedd Jon Shortridge a’i gydweithwyr wrth ymgymryd â’r her o weithio gyda ni. Mae’n siŵr o fod yn her ond maent yn dysgu triciau newydd a ffyrdd newydd o wneud pethau ac yn mynd i mewn i’r ysbryd y sefydlwyd y Cynulliad hwn ynddo. Fel Ysgrifennydd Gwladol Cymru, cyflwynaf i chi gopi o’r gorchymyn trosglwyddo hwn fel symbol o’r pwerau a drosglwyddir o San Steffan i Gymru. Mae hwn yn ddiwrnod pwysig ac fel Aelodau’r Cynulliad cyntaf dylem oll fod yn falch. Gobeithiaf y byddwn yn llwyddo i wneud pobl Cymru yn falch o’r Cynulliad ac ohonom ninnau fel eu Haelodau yn y Cynulliad.

Dafydd Wigley siaradwyd yn Gymraeg t. 36

Dafydd Wigley spoken in Welsh p. 36

Fel y dywedodd yr Ysgrifennydd Gwladol a’r Prif Ysgrifennydd, y mae’r newid sydd yn digwydd dros nos heno yn gam sylweddol ymlaen, oherwydd o hyn ymlaen byddwn yn cymryd drosodd ein cyfrifoldebau llawn o fewn y Ddeddf. Ers ethol y Cynulliad Cenedlaethol hwn mae llawer o waith wedi ei wneud: gwaith paratoi, cael y rheolau i’w lle, sefydlu’r Pwyllgorau a chreu sefyllfa lle y gallwn symud ymlaen a chymryd y cyfrifoldeb ar ein hysgwyddau ein hunain fel Cynulliad. Mae hyn yn arbennig o wir am Ysgrifenyddion sydd â chyfrifoldeb adrannol o fewn y Cabinet.

As the Secretary of State and First Secretary said, the change taking place overnight is a substantial step forward, because from this point onward we will take over our full responsibilities within the Act. Since the election of this National Assembly a great deal of work has been done: preparatory work, getting the rules into place, establishing the Committees and creating a situation where we can move forward and take the responsibility upon our own shoulders as an Assembly. This is especially true for the Secretaries with departmental responsibilities within the Cabinet.

Mae pobl Cymru wedi bod yn dilyn ein trafodaethau â diddordeb mawr ac mae’r Prif Ysgrifennydd yn iawn i ddweud bod y seremoni agoriadol ar 26 Mai wedi taro tant. Fodd bynnag, mae pobl Cymru yn disgwyl gweld sut y gall y Cynulliad Cenedlaethol wneud gwahaniaeth i’w bywydau. Dylai hynny fod er eu lles. O yfory ymlaen bydd y pwerau gennym i ddechrau gwneud hynny. Yr ydym i gyd yn sylweddoli na fydd hyn yn digwydd dros nos. Bydd yn cymryd amser i unrhyw newidiadau sydd yn cael eu datblygu, eu trafod a’u penderfynu gan y Cynulliad ddod i rym. Mae’n bwysig i bobl wybod ein bod yn gweithio ar agenda benodol a bod gennym syniadau pendant sydd yn ennyn cefnogaeth. Gydag amser bydd y rheini’n dwyn ffrwyth a byddant yn gweld y newidiadau.

The people of Wales have followed our deliberations with great interest and I agree with the First Secretary that the opening ceremony on 26 May hit the right note. However, the people of Wales are waiting to see how the National Assembly makes a difference to their lives. That should be a change for the better. From tomorrow we shall have the powers to do that. We all realise that this will not happen overnight. It will take time before any changes developed, discussed and determined by the Assembly come into force. It is important for people to know that we are working on a specific agenda and that we have specific ideas, which are supported. They will bear fruit in time and people will see the changes.

Wrth baratoi ac adeiladu’r polisïau a fydd yn gwneud y gwahaniaeth, mae’n hynod bwysig ein bod yn egluro i bobl yr hyn sydd yn cael ei wneud, fel eu bod yn sylweddoli y bydd ymdrechion y Cynulliad hwn yn gwneud gwahaniaeth i’w bywydau. Felly, wrth groesawu’r newidiadau sydd yn digwydd a’r grym sydd yn dod i’r Cynulliad ac i’r Llywodraeth o fewn y Cynulliad, mae’n gryn her inni ddangos y bydd hyn yn gweithio. Yr wyf yn siŵr bod pob un ohonom yn benderfynol o wneud hynny, fel bod pobl yn teimlo bod y cam hwn o gael Cynulliad Cenedlaethol etholedig am y tro cyntaf o bwys iddynt, fel unigolion ac fel cymunedau. Yr wyf yn falch iawn o uniaethu fy hun â sylwadau’r Prif Ysgrifennydd wrth drosglwyddo i’r Llywydd y ddogfen ffurfiol sydd yn symbol o’r newid hwn.

While preparing and developing the policies which will make the difference, it is crucial that we explain to people what is being done, so that they will realise that the endeavours of this Assembly will make a difference to their lives. In welcoming the changes that are taking place and the power which will come to this Assembly and to the Government within this Assembly, it is a great challenge for us to show that this will work. I am sure that we are all determined to do that, so that the people of Wales will feel that the step of having an elected National Assembly for the first time is important to them as individuals and as communities. I am proud to associate myself with the First Secretary’s comments in transferring to the Presiding Officer the formal transfer order, symbolising this change

Rod Richards spoken in English p. 37

Rod Richards siaradwyd yn Saesneg t. 37

The moment has arrived. The day of reckoning is upon this Assembly and the clock is ticking. The Assembly should note that it is no longer a case of looking through the looking glass; it is the real world and it is time for governing. The Members of the Cabinet have had a place to hide thus far—apart from the First Secretary as he was the Secretary of State—but the honeymoon is now over. The Conservative Party has been gentle with the Cabinet until now, but no longer. They will be held to account. There is no longer a hiding place. Questions must be answered fully in writing, orally or during debate. That is incumbent upon the Cabinet, if they believe in being accountable and open. The Cabinet cannot ignore questions or put the ball into the long grass, because it is responsible. Government is about taking decisions and justifying those decisions to this Assembly. That is what the Members of this Assembly and the people of Wales expect from this Cabinet. If you fail, then the day of judgement, which may be less than four years away, will descend upon you even more violently than it did on 6 May, particularly on one of the Cardiff Members.

Mae’r foment wedi cyrraedd. Daeth dydd y prysur bwyso ar warthaf y Cynulliad hwn ac mae’r cloc yn tician. Dylai’r Cynulliad gofio nad edrych mewn drych a wna bellach, dyma’r byd go iawn ac mae’n bryd llywodraethu. Bu gan Aelodau’r Cabinet le i guddio ynddo hyd yma—ar wahân i’r Prif Ysgrifennydd gan mai ef oedd yr Ysgrifennydd Gwladol—ond mae’r mis mêl bellach ar ben. Bu’r Blaid Geidwadol yn garedig tuag at y Cabinet hyd yma, ond nid mwyach. Cânt eu dal i gyfrif. Nid oes lle i guddio mwyach. Rhaid ateb cwestiynau yn llawn, yn ysgrifenedig, yn llafar neu yn ystod dadleuon. Mae hynny’n rheidrwydd ar y Cabinet, os ydynt yn credu mewn bod yn atebol ac agored. Ni all y Cabinet anwybyddu cwestiynau neu roi’r bêl yn y borfa hir, oherwydd mae’n gyfrifol. Mae Llywodraethu yn golygu gwneud penderfyniadau a chyfiawnhau’r penderfyniadau hynny i’r Cynulliad hwn. Dyna beth y mae Aelodau’r Cynulliad hwn a phobl Cymru yn ei ddisgwyl gan y Cabinet. Os methwch chi, yna bydd dydd y farn, a allai fod lai na phedair blynedd i ffwrdd, yn disgyn arnoch hyd yn oed yn fwy didostur nag a wnaeth ar 6 Mai, yn enwedig ar un o Aelodau Caerdydd.

The day of history has indeed arrived but I am not so sure about the day of judgment. [assembly members: ‘What about the day of reckoning?’]

Yn sicr, mae’r dydd hanesyddol wedi cyrraedd ond nid wyf mor siŵr am ddydd y farn. [aelodau’r Cynulliad: ‘Beth am ddydd y prysur bwyso?’]

The day of judgement and the day of reckoning may have some similarities but today is part of a long march, which has taken many of us back over our political history. A 100-year march will end at midnight. That is important because it marks for us the end of the beginning. This is the start of something new. It is easy to think that this is a new process which has not got far to go, but it has. Tonight also marks the change for Scotland, but we also hope that it will be a new beginning for Northern Ireland. It is sad that we have devolution in the three parts of the United Kingdom and only two of us are able to share in that joy. I hope that the third element will be able to join us as soon as possible.

Efallai fod i ddydd y farn a dydd y prysur bwyso rai elfennau tebyg ond mae heddiw yn rhan o daith hir, a aeth â llawer ohonom yn ôl drwy ein hanes gwleidyddol. Daw taith 100 mlynedd i ben am hanner nos heno. Mae hynny’n bwysig am ei fod yn dynodi diwedd y dechrau i ni. Mae hyn yn ddechrau rhywbeth newydd. Hawdd yw meddwl bod hon yn broses newydd ac nad oes pellter maith ar ôl, ond nid dyna’r gwir. Mae heno hefyd yn dynodi’r newid i’r Alban, ond gobeithiwn hefyd y bydd yn ddechrau newydd i Ogledd Iwerddon. Mae’n drist fod gennym ddatganoli yn nhair rhan y Deyrnas Unedig ond mai dim ond dwy ohonom sydd yn gallu rhannu’r gorfoledd hwnnw. Gobeithiaf y bydd y drydedd elfen yn gallu ymuno â ni cyn gynted â phosibl.

We are responsible; it is not just a question for individual members of the Cabinet or the First Secretary. This is a corporate body and we are singularly and jointly responsible for what we do. This means that we share the responsibility and we must convince each other by weight of argument about the direction in which we wish to go. I hope that this Assembly will keep that thought in mind. It is also important because it is a new beginning in Welsh law. I took the opportunity to check with the lawyers who advise the Assembly that as from tomorrow we will be able to establish Welsh law. It may be secondary legislation but it will be law that we have made for ourselves. That is a responsibility which we share. I feel privileged to share in this day but also humbled, because unless we touch people’s lives in many ways, they will feel that we have made no difference. To make a real difference we must begin that challenge and work hard at it. We have worked together to begin the process, but the real challenge, argument, debate and the moving forward starts tomorrow.

Nyni sydd yn gyfrifol; nid dim ond mater i aelodau unigol y Cabinet neu’r Prif Ysgrifennydd mohono. Mae hwn yn gorff corfforaethol ac yr ydym ni oll, yn unigol a chyda’n gilydd, yn gyfrifol am yr hyn a wnawn. Mae hynny’n golygu ein bod yn rhannu’r cyfrifoldeb a rhaid inni argyhoeddi ein gilydd drwy rym ein dadl ynglŷn â’r cyfeiriad i symud iddo. Gobeithiaf y bydd y Cynulliad hwn yn cadw hynny mewn cof. Mae hefyd yn bwysig oherwyd ei fod yn ddechrau newydd yng nghyfraith Cymru. Achubais ar y cyfle i ofyn am gadarnhad gan y cyfreithwyr sydd yn cynghori’r Cynulliad y byddwn, o yfory ymlaen, yn gallu sefydlu cyfraith Gymreig. Deddfwriaeth eilaidd fydd hynny ond fe fydd yn gyfraith a luniwyd ar ein cyfer gennym ni. Mae’n gyfrifoldeb a rannwn. Fe’i teimlaf yn fraint bod yn rhan o’r diwrnod hwn ond eto’n wylaidd, oherwydd os na wnawn ni gyffwrdd â bywydau pobl mewn llawer ffordd, byddant yn teimlo nad ydym wedi gwneud unrhyw wahaniaeth. I wneud gwahaniaeth gwirioneddol rhaid inni ymgymryd â’r her a gweithio’n galed arni. Yr ydym wedi gweithio gyda’n gilydd i ddechrau’r broses, ond yfory y bydd yr her go iawn, y trafod, y dadlau a’r symud ymlaen yn dechrau.

Thank you First Secretary for taking this process forward today. It is an historic moment. The next such moment will be when the Presiding Officer signs the first piece of legislation that we pass. I look forward to that occasion because we will then show that we can start to make our plans move forward. We share a great responsibility and I am privileged to be part of it.

Diolch ichi, Brif Ysgrifennydd, am dywys y broses hon yn ei blaen heddiw. Y mae’n foment hanesyddol. Y foment nesaf o’i bath fydd pan fydd y Llywydd yn llofnodi’r darn cyntaf o ddeddfwriaeth i’w basio gennym. Edrychaf ymlaen at yr achlysur hwnnw oherwydd byddwn yn dangos wedyn y gallwn ddechrau gwneud i’n cynlluniau symud yn eu blaenau. Yr ydym yn rhannu cyfrifoldeb mawr ac mae’n fraint imi fod yn rhan ohono.

Un o bleserau’r swydd hon yw fy mod i bob amser yn cael y gair olaf. Diolchaf i Ysgrifennydd Gwladol Cymru a’r Prif Ysgrifennydd am y copi hwn o’r Gorchymyn Trosglwyddo Swyddogaethau. Mae’n symbol o’r pwerau a drosglwyddir am hanner nos heno. Bydd swyddogaethau a dyletswyddau Ysgrifennydd Gwladol Cymru yn cael eu trosglwyddo i’r Cynulliad, er mai drwy gyfrwng yr un person y bydd hynny’n digwydd.

One of the great pleasures of this office is that I always have the last word. I thank the Secretary of State for Wales and the First Secretary for this copy of the Transfer of Functions Order, which is a symbol of the powers transferred at midnight tonight. The functions and duties of the Secretary of State for Wales will be transferred to the Assembly, although this will happen through the same person.

Mae yna deimlad cryf y bydd ein llwyddiant ni yn cael ei fesur yn ôl ein gallu i ddod â lles i bobl Cymru. Mae gennym rywfaint o le i longyfarch ein hunain fel Cynulliad am y gwaith mawr a wnaed yn ystod y chwe wythnos diwethaf, wrth osod yr egwyddorion sylfaenol a sefydlu’r strwythur busnes, fel y’u rhagwelwyd yn Neddf Llywodraeth Cymru 1998 ac yn y Rheolau Sefydlog. Er ein bod i gyd wedi gwneud ambell gamgymeriad, mae gennym le i longyfarch ein hunain ar yr hyn a gyflawnwyd hyd yma.

There is a strong feeling that our achievement will be measured by our ability to benefit the people of Wales. We have some room to congratulate ourselves as an Assembly on the amount of work done over the last six weeks in establishing the fundamental principles and setting up the business structure as envisaged in the Government of Wales Act 1998 and in the Standing Orders. Although we have all made some mistakes, we can congratulate ourselves on what has been accomplished so far.

Mae’r Cynulliad wedi canolbwyntio ar y gwaith o sefydlu’r Pwyllgorau Pwnc, y Sesiwn Llawn a’r Pwyllgor Busnes. Datblygasom weithdrefnau unigryw sydd yn galluogi’r Cynulliad i weithio’n effeithiol. Mae’r sylfeini ar gyfer Cynulliad llwyddiannus wedi eu gosod. Mae diddordeb gwirioneddol ym mhob rhan o Gymru, a thu hwnt, yng ngweithgarwch y Cynulliad.

The Assembly has concentrated on the work of setting up the Subject Committees, the Plenary and the Business Committee. We have developed unique procedures, which enable the Assembly to work effectively. The foundations for a successful Assembly are laid. There is a real interest in all parts of Wales, and beyond, in the Assembly’s activities.

Talaf deyrnged i swyddogion y Swyddfa Gymreig: y rhai a lafuriodd ar hyd y blynyddoedd i greu cyfundrefn o lywodraeth ddatganoledig yng Nghymru a’r rhai a fu’n ymchwilio’n fanwl er mwyn cynhyrchu’r ddogfen hon. Dyma’r Gorchymyn Trosglwyddo mwyaf swmpus yn hanes y Deyrnas Unedig ac yn sicr y ddogfen gyfreithiol Gymreig fwyaf cymhleth ers cyfraith Hywel Dda. Diolch i’r swyddogion yn adeilad y Cynulliad ac yn Swyddfa’r Llywydd am eu gwaith caled er mwyn sicrhau llwyddiant y Cynulliad.

I pay tribute to the officials of the Welsh Office: those who have worked throughout the years to create a system of decentralised government in Wales and those who carried out the detailed research required to produce this document. It is the most substantial Transfer Order in the history of the United Kingdom and certainly the most complicated piece of Welsh legislation since the laws of Hywel Dda. I thank the officials of the Assembly building and the Office of the Presiding Officer for their hard work in ensuring the success of the Assembly.

Mater i’r Cynulliad fydd dangos i bobl Cymru a gweddill y Deyrnas Unedig ei fod yn gallu defnyddio’r pwerau yn y ddogfen hon mewn ffordd gyfrifol, gan roi blaenoriaeth i les a ffyniant pobl Cymru. Rhaid cofio ein cyfrifoldeb i etholwyr Cymru a’r ymdeimlad cryf sydd ym mhob plaid ein bod am wneud i’r gyfundrefn hon weithio a’n bod am weithio mewn ffyrdd ychydig yn wahanol i draddodiadau lleoedd eraill.

It is up to the Assembly to show the people of Wales and the rest of the United Kingdom that it can use the powers in this document responsibly, giving priority to the welfare and prosperity of the people of Wales. We must remember our responsibility to the electors of Wales, the strong desire in every party to make the Assembly work, and to work in ways that differ slightly from the traditions of other places.

Yn bwysicach na dim, heno fydd y noson pan fyddwn yn peidio ag edrych yn ôl fel Cynulliad. Mae hen hanes Cymru yn gorffen heno. Nid oes angen inni bellach ymhyfrydu yn y gorffennol nac yn ein traddodiadau gwych. Mae’n bryd inni edrych i’r dyfodol. Y Cynulliad hwn a’r gorchymyn hwn yw dyfodol Cymru. Yfory, bydd gwaith y Cynulliad yn dechrau o ddifrif.

Most importantly, tonight, we as an Assembly will stop looking back. The old history of Wales will end tonight. We no longer need to take delight in the past or our excellent traditions. It is time to look to the future. This Assembly and this order are the future of Wales. Tomorrow, the real business of the Assembly begins.
