Statements by the Presiding Officer

Dafydd Elis-Thomas The Presiding Officer spoken in Welsh p. 2
Mae gennyf nifer o ddatganiadau i’w gwneud. Ar gyfer y sesiwn holi a fydd yn dilyn, mae’r drefn a fabwysiadwyd yn caniatáu rhoi cwestiwn yn llawn. Mae hyn yn ategu’r ysbryd o fod yn agored, gan gyfleu cynnwys y cwestiwn ar ddechrau’r drafodaeth i Aelodau eraill, ac i aelodau’r cyhoedd sy’n dilyn ein gweithgareddau. Daeth i’m sylw fod rhai Aelodau yn cymryd mantais o hyn, ac yn troi eu cwestiynau yn ddatganiadau. Byddaf o hyn ymlaen yn galw i drefn unrhyw Aelod sydd yn mynd yn bellach na’r cwestiwn a gyflwynwyd. Hoffwn hefyd atgoffa Aelodau—ac mae hyn yn cynnwys Ysgrifenyddion—y dylent gadw eu cwestiynau a’u hatebion yn gryno.
I have a number of statements to make. For the question session that will follow, we have adopted a procedure that permits the question to be put in full. This assists the spirit of openness, by conveying the contents of questions at the beginning of the discussion to other Members, and to members of the public who are following our proceedings. It has been brought to my attention that some Members take advantage of this, and turn their questions into statements. From now, I shall call to order any Member who goes beyond the term of the tabled question. I also remind Members—and this includes Secretaries—that they should keep their questions and answers brief.
Mae rhai Aelodau wedi cysylltu â mi ynglŷn â’r ychwanegiad hwyr at fusnes heddiw, sef trafodaeth ynghylch cig eidion ar yr asgwrn. Mae hyn yn dilyn cynnig a gyflwynwyd gan Ieuan Wyn Jones, a chynigir ef gan Ysgrifennydd Amaethyddiaeth a Datblygu Gwledig y Cynulliad, Christine Gwyther.
Some Members have contacted me about the late addition to today’s business, namely a debate on beef on the bone. This follows a motion that Ieuan Wyn Jones tabled and that the Assembly Secretary for Agriculture and Rural Development, Christine Gwyther, will propose.
Bydd busnes y Cynulliad yn mynd yn ei flaen yn unol â’r Datganiad Busnes y cytunodd y Cynulliad arno. Ni fydd y Swyddfa Gyflwyno yn derbyn cynigion ychwanegol i’w trafod oni bai fod y Trefnydd wedi hysbysu’r Cynulliad fod newid yn y busnes. Yn yr achos penodol hwn, hysbyswyd y Cynulliad gan y Trefnydd ddydd Mercher diwethaf ei fod am gyflwyno’r cynnig ar gyfer ei drafod a’i weithredu cyn gynted â phosibl. Rhoddodd sicrwydd i’r Cynulliad y byddai’n cymryd camau ar unwaith i drafod y mater hwn a chyflwyno cynnig ar adeg briodol. Mae hynny wedi digwydd. Nid yw trefniadau rhwng pleidiau gwleidyddol ynghylch materion busnes yn fater i’r Llywydd. Er hynny, yr wyf yn gyfrifol am weithredu yn ôl y drefn fusnes a dderbyniwyd gan y Cynulliad.
The business of the Assembly will proceed in accordance with the Business Statement that has been agreed by the Assembly. The Table Office will accept additional motions for debate only if the Business Secretary has given the Assembly notice of a change to the business. In this specific case, the Business Secretary gave notice to the Assembly last Wednesday that he wished to table this motion for discussion and implementation as soon as possible. He assured the Assembly that he would take immediate steps to discuss this issue and to table a motion at an appropriate time. That has happened. Arrangements between political parties on business issues are not a matter for the Presiding Officer. However, I am responsible for acting in accordance with the order of business accepted by the Assembly.
Ethol Aelodau’r Pwyllgorau Pwnc
Election of Members of Subject Committees
Andrew Davies The Business Secretary spoken in English p. 3
Andrew Davies Y Trefnydd siaradwyd yn Saesneg t. 3
Three of the political parties in the Business Committee have agreed that the Subject Committees should comprise nine Members. We needed to expedite business in order to set up the Subject Committees and make sure that they get on with the programme of work. We face many important issues, which the Subject Committees need to address. However, I assure the Assembly that the Business Committee will review the number of Members on the Subject Committees and the working of those Committees. It will report back, probably in the autumn, after the Committees have been in operation for some months.
Mae tair o’r pleidiau gwleidyddol yn y Pwyllgor Busnes wedi cytuno y dylai’r Pwyllgorau Pwnc gynnwys naw Aelod. Yr oedd angen inni hwyluso’r busnes er mwyn sefydlu’r Pwyllgorau Pwnc a sicrhau eu bod yn symud ymlaen â’r rhaglen waith. Yr ydym yn wynebu llawer o faterion pwysig y bydd rhaid i’r Pwyllgorau Pwnc ymdrin â hwy. Fodd bynnag, yr wyf yn sicrhau’r Cynulliad y bydd y Pwyllgor Busnes yn adolygu nifer yr Aelodau ar y Pwyllgorau Pwnc a gweithrediad y Pwyllgorau hynny. Bydd yn adrodd yn ôl, yn yr hydref yn ôl pob tebyg, wedi i’r Pwyllgorau fod ar waith am rai misoedd.

Dafydd Elis-Thomas Y Llywydd siaradwyd yn Saesneg t. 3
I will not take a point of order in the middle of a vote. I declare the motion carried.
Ni dderbyniaf fater o drefn ar ganol pleidlais. Yr wyf yn datgan bod y cynnig wedi ei dderbyn.
I challenge your announcement, and ask you under Standing Order No. 6.20 to call a confirmatory vote. I wish to explain my reasons. The composition of the Committees is nakedly partisan and discriminates against the Conservative group. It is not good enough for the Business Secretary to try to assuage us with a promise to review the matter in the autumn. It should be sorted out forthwith. If we are talking about a new era of inclusive politics, each political party should be fairly represented on the Subject Committees. I therefore ask for a confirmatory vote so that the views of all Members of this institution are noted. It is disgraceful that the Subject Committees are not inclusive. I ask you to rule that this vote should be recorded.
Yr wyf yn herio’ch cyhoeddiad, a gofynnaf ichi alw pleidlais gadarnhau o dan Reol Sefydlog Rhif 6.20. Dymunaf egluro fy rhesymau. Mae cyfansoddiad y Pwyllgorau yn amlwg yn bleidiol ac yn gwahaniaethu yn erbyn y grŵp Ceidwadol. Nid yw’n ddigon da i’r Trefnydd geisio ein tawelu ag addewid i adolygu’r mater yn yr hydref. Dylid ei ddatrys yn ddi-oed. Os ydym yn sôn am oes newydd o wleidyddiaeth gynhwysol, dylai pob plaid wleidyddol gael ei chynrychioli’n deg ar y Pwyllgorau Pwnc. Yr wyf yn gofyn felly am bleidlais gadarnhau fel y cofnodir barn holl Aelodau’r sefydliad hwn. Mae’n warthus nad yw’r Pwyllgorau Pwnc yn gynhwysol. Gofynnaf ichi ddyfarnu y dylid cofnodi’r bleidlais hon.
Dafydd Elis-Thomas The Presiding Officer spoken in English p. 4
Dafydd Elis-Thomas Y Llywydd siaradwyd yn Saesneg t. 4
A confirmatory vote has been requested. Members will be aware that there are six similar motions before the Assembly. We shall take a confirmatory vote after we have considered all six motions.
Gofynnwyd am bleidlais gadarnhau. Bydd yr Aelodau’n ymwybodol bod chwe chynnig tebyg gerbron y Cynulliad. Fe gymerwn bleidlais gadarnhau wedi inni ystyried pob un o’r chwe chynnig.
Point of order. I seek your guidance on procedure. I understand that several of my colleagues have notified your Office that they wish to speak on this motion and the linked motions. Will they be given an opportunity to speak or has that opportunity passed? It seemed to me that the vote was taken almost before the Trefnydd put a full stop at the end of his sentence.
Mater o drefn. Yr wyf yn gofyn am arweiniad gennych ynghylch y weithdrefn. Yr wyf yn deall bod nifer o’m cyd-aelodau wedi hysbysu’ch Swyddfa eu bod yn dymuno siarad ar y cynnig hwn a’r cynigion cysylltiedig. A roddir cyfle iddynt siarad ynteu a yw’r cyfle wedi mynd heibio? Yr oedd yn ymddangos i mi fod y bleidlais wedi ei chymryd bron cyn i’r Trefnydd roi atalnod ar ddiwedd ei frawddeg.
Dafydd Elis-Thomas The Presiding Officer spoken in English p. 4
Dafydd Elis-Thomas Y Llywydd siaradwyd yn Saesneg t. 4
I hope you are not challenging the conduct of proceedings in this Chamber. Each motion will be moved separately and therefore can be debated separately.
Yr wyf yn gobeithio nad ydych yn herio’r modd y cynhelir y trafodion yn y Siambr hon. Fe gyflwynir pob cynnig ar wahân ac felly gellir ei drafod ar wahân.

Cynigiaf fod
Point of order. The Business Secretary referred to section 57 of the Government of Wales Act 1998, the penultimate paragraph of which reads:
Mater o drefn. Cyfeiriodd y Trefnydd at adran 57 Deddf Llywodraeth Cymru 1998, y mae ei pharagraff olaf ond un yn darllen:
‘Those other members shall be elected by the Assembly from among the Assembly Members so as to secure that, as far as is practicable, the balance of the parties in the Assembly is reflected in the membership of the Committee (including the person who is a member by virtue of subsection (4) and the member who chairs it).’
‘Etholir yr aelodau eraill hynny gan y Cynulliad o blith Aelodau’r Cynulliad er mwyn sicrhau, cyn belled ag y bo’n ymarferol, fod cydbwysedd y pleidiau yn y Cynulliad yn cael ei adlewyrchu yn aelodaeth y Pwyllgor (gan gynnwys y sawl sydd yn aelod yn rhinwedd isadran (4) a’r aelod sydd yn ei gadeirio).’
I put it to the Presiding Officer that it would be impossible for this motion to go through and still be within the remit of section 57 of the Act.
Yr wyf yn awgrymu i’r Llywydd y byddai’n amhosibl i’r cynnig gael ei dderbyn ac iddo ddal i fod o fewn cwmpas adran 57 y Ddeddf.
Dafydd Elis-Thomas The Presiding Officer spoken in English p. 5
Dafydd Elis-Thomas Y Llywydd siaradwyd yn Saesneg t. 5
That is not a point of order, but it is a contribution to the debate.
Nid mater o drefn yw hynny, ond y mae’n gyfraniad i’r drafodaeth.
I am grateful for the opportunity to speak on this issue. I am deeply concerned about the proposal that has been put forward. First, I do not think that it is within the framework of the Act. Section 57(8) refers to ‘as far as is practicable’. There is nothing in the Act, the Standing Orders or the discussions of the National Assembly Advisory Group that requires each Committee to have the same number of members. A far better arithmetical balance could be achieved by having some Committees of nine members, some of 10, and some of 11. The Act requires us to achieve balance; the motion will not allow us to fulfil our legal duty.
Yr wyf yn ddiolchgar am y cyfle i siarad ar y mater hwn. Yr wyf yn bryderus iawn ynghylch y cynnig a roddwyd gerbron. Yn gyntaf, ni chredaf ei fod o fewn fframwaith y Ddeddf. Mae adran 57(8) yn cyfeirio at ‘cyn belled ag y bo’n ymarferol’. Nid oes dim yn y Ddeddf, y Rheolau Sefydlog nac yn nhrafodaethau Grŵp Ymgynghorol y Cynulliad Cenedlaethol sy’n mynnu y bydd gan bob Pwyllgor yr un nifer o aelodau. Gellid sicrhau cydbwysedd rhifyddol llawer gwell drwy gael rhai Pwyllgorau â naw aelod, rhai â 10, a rhai ag 11. Mae’r Ddeddf yn mynnu ein bod yn sicrhau cydbwysedd; ni fydd y cynnig yn caniatáu inni gyflawni ein dyletswydd o dan y gyfraith.
My second concern is more fundamental. Both the former Secretary of State for Wales, Ron Davies, and the present Secretary of State—now the First Secretary—Alun Michael, talk of inclusive politics. It seems to me that this inclusiveness stops short of the Conservatives. These proposals are deeply unfair to the Conservative group. A proportion of 4-3-1-1 would give the Labour Party four times as much representation as the Conservatives, although they achieved just over three times the number of seats. It would give Plaid Cymru three times the representation of the Conservatives although they have less than twice the number of seats, and it would give the Liberal Democrats the same representation as the Conservatives although they have 50 per cent fewer seats.
Mae’r ail bryder sydd gennyf yn un mwy sylfaenol. Mae cyn-Ysgrifennydd Gwladol Cymru, Ron Davies, a’r Ysgrifennydd Gwladol presennol—y Prif Ysgrifennydd bellach—Alun Michael, ill dau yn sôn am wleidyddiaeth gynhwysol. Mae’n ymddangos i mi nad yw’r cynwysoldeb hwn yn cyrraedd y Ceidwadwyr. Mae’r cynigion hyn yn annheg iawn â’r grŵp Ceidwadol. Byddai cyfrannedd o 4-3-1-1 yn rhoi pedair gwaith cymaint o gynrychiolaeth i’r Blaid Lafur ag i’r Ceidwadwyr, er iddynt ennill ond ychydig dros dair gwaith nifer y seddau. Byddai’n rhoi i Blaid Cymru dair gwaith cynrychiolaeth y Ceidwadwyr er bod ganddynt lai na dwywaith nifer y seddau, a byddai’n rhoi i’r Democratiaid Rhyddfrydol yr un gynrychiolaeth â’r Ceidwadwyr er bod ganddynt 50 y cant yn llai o seddau.
If rumours are true, not only will the Liberal Democrats have the same representation as the Conservatives, but they will also have the Chairmanship of the Legislation Committee. The moral of the story is that, while Westminster delivered a system of winner takes all, we are rapidly moving towards a system of loser takes all. If we had four seats—two thirds of the Liberal Democrat representation—could we expect an equal number of seats on Committees and more Chairmanships? I doubt it. The division of places on the Committees also creates an anomaly in that our spokesman for pre-16 education cannot sit on that Committee. That is nonsense.
Os yw’r sïon yn wir, nid yn unig y bydd y Democratiaid Rhyddfrydol yn cael yr un gynrychiolaeth â’r Ceidwadwyr, fe fyddant hefyd yn cael Cadeiryddiaeth y Pwyllgor Deddfau. Y foeswers yw bod San Steffan wedi esgor ar system lle bydd yr enillydd yn mynd â phob dim, a’n bod ni’n symud yn gyflym at system lle y bydd y collwr yn cael pob dim. Pe bai gennym bedair sedd—dwy ran o dair o gynrychiolaeth y Democratiaid Rhyddfrydol—a allem ddisgwyl yr un nifer o seddau ar Bwyllgorau a mwy o Gadeiryddiaethau? Go brin. Mae rhaniad y lleoedd ar y Pwyllgorau yn creu anghysonder hefyd i’r graddau nad yw ein llefarydd ar addysg cyn-16 yn gallu eistedd ar y Pwyllgor hwnnw. Nid oes synnwyr yn hynny.
My chief concern is that these proposals let down the people of Wales. They do a disservice to the people of Wales because much of the Assembly’s important work will be done through the Committees. Much has been made of the fairness of the electoral system, but that will be distorted if these motions are accepted. They are unacceptable. We are setting the groundwork for the next four years. If we are to consider the deep-seated problems that face Wales in a way that reflects how people voted, these proposals are unacceptable. The Business Secretary has offered to reconsider them in the autumn, but, given these objections—which people will recognise as reasonable—why cannot he look at the matter again, and come up with a variation in the numbers of people on each of these Committees?
Y prif bryder sydd gennyf yw bod y cynigion hyn yn siomi pobl Cymru. Maent yn gwneud anghymwynas â phobl Cymru am y bydd llawer o waith pwysig y Cynulliad yn cael ei gyflawni drwy’r Pwyllgorau. Fe wnaed yn fawr o degwch y system etholiadol, ond fe gaiff hynny ei wyrdroi os derbynnir y cynigion hyn. Maent yn annerbyniol. Yr ydym yn gosod y sylfeini ar gyfer y pedair blynedd nesaf. Os ydym i ystyried y problemau dyfnion sy’n wynebu Cymru mewn modd sy’n adlewyrchu sut y pleidleisiodd y bobl, y mae’r cynigion hyn yn annerbyniol. Mae’r Trefnydd wedi cynnig eu hailystyried yn yr hydref, ond, yn wyneb y gwrthwynebiadau hyn—y bydd pobl yn eu gweld yn rhai rhesymol—pam nad yw’n gallu edrych ar y mater eto, a chynnig amrywiad yn niferoedd y bobl ar bob un o’r Pwyllgorau hyn?
I support the Business Secretary’s proposals. Let us reconsider the matter in the autumn. I find myself on the Under-16 Education Committee. I did not know that until the Agenda was given to me over the telephone yesterday afternoon. I do not complain about that.
Yr wyf yn cefnogi cynigion y Trefnydd. Gadewch inni ailystyried y mater yn yr hydref. Yr wyf yn gweld fy mod ar y Pwyllgor Addysg Cyn-16. Ni wyddwn hynny hyd nes imi gael yr Agenda dros y ffôn brynhawn ddoe. Nid oes gennyf gŵyn am hynny.
I hesitate to make this point, because we want to get away from House of Commons procedures, but the system there is—as I hope it is in the Assembly—that representation on Committees reflects the membership of the House as a whole. You clearly cannot achieve that on any one Committee. I believe—and Dafydd or other Members of Parliament can correct me if I am wrong—that if we consider the whole of the Select Committee membership in the House of Commons, one Committee might have seven Labour Members and six Opposition Members, while another Committee might have eight Labour Members and only five Opposition Members. However, when everything is added together, the total sum reflects the membership of the House. This could be a guiding principle when we come to review the system in the autumn.
Yr wyf yn petruso cyn gwneud y pwynt hwn, oherwydd yr ydym am symud oddi wrth weithdrefnau Tŷ’r Cyffredin, ond y system yno—fel y mae yn y Cynulliad, gobeithio—yw y bydd y gynrychiolaeth ar Bwyllgorau’n adlewyrchu aelodaeth y Tŷ yn ei gyfanrwydd. Mae’n amlwg na ellir cyflawni hynny ar yr un Pwyllgor unigol. Yr wyf yn credu—a chaiff Dafydd neu Aelodau Seneddol eraill fy nghywiro os wyf yn camgymryd—os ystyriwn y cwbl o aelodaeth y Pwyllgorau Dethol yn Nhŷ’r Cyffredin, fe allai un Pwyllgor fod â saith Aelod Llafur a chwe Aelod o’r Wrthblaid, tra bydd Pwyllgor arall ag wyth Aelod Llafur ac ond pum Aelod o’r Wrthblaid. Fodd bynnag, o ddwyn popeth ynghyd, mae’r cyfanswm yn adlewyrchu aelodaeth y Tŷ. Gallai hyn fod yn egwyddor arweiniol pan ddeuwn i adolygu’r system yn yr hydref.
In case Members are confused, I will give some background to this development. The Business Committee considered the number of members on each Subject Committee last week and Labour found itself in a minority. Three of the parties wanted nine members and we wanted another number. We took the proposal away, came back and agreed to nine members, only to find that the Conservatives wanted a different number again. In the spirit of inclusivity, we said that we would consider this in future. However, the guidance—[Interruption.]
Rhag ofn bod yr Aelodau mewn penbleth, rhoddaf rywfaint o gefndir y datblygiad hwn. Ystyriwyd nifer yr aelodau ar bob Pwyllgor Pwnc gan y Pwyllgor Busnes yr wythnos diwethaf ac fe ganfu Llafur ei bod mewn lleiafrif. Yr oedd tair o’r pleidiau am gael naw aelod ac yr oeddem ni am gael nifer arall. Aethom â’r cynnig oddi yno, daethom yn ôl a chytuno ar naw aelod, ond i ganfod bod y Ceidwadwyr am gael nifer gwahanol eto. O ran cynwysoldeb, dywedasom y byddem yn ystyried hynny yn y dyfodol. Fodd bynnag, yr arweiniad—[Torri ar draws.]

If I can just finish, the advice that we have received from officials is that a variation in the numbers on each Committee would have to be legally defensible. We would need to make a case for why the numbers on, for example, an education committee, would vary from those on the Economic Development Committee. We did not feel, given the time available, that we could make that case and—[Interruption.]

On the advice given, the three political parties present at the Business Committee meeting decided that we would move this motion today. We will take into account the views of the Conservatives and, indeed, any other political party and individual Member of the Assembly.

The Business Secretary has now resumed his seat. You have tried to intervene a number of times and he has graciously given way to you once. This cannot be allowed to continue. It is not in order for the Business Secretary to answer questions unless he is called to do so. David Davies has already spoken in this debate and, therefore, may not be called again.
Mae’r Trefnydd wedi mynd yn ôl i’w sedd. Yr ydych wedi ceisio ymyrryd sawl gwaith ac mae ef wedi ildio’n garedig ichi unwaith. Ni ellir caniatáu hyn rhagor. Nid yw’n dderbyniol i’r Trefnydd ateb cwestiynau oni elwir arno i wneud hynny. Mae David Davies eisoes wedi siarad yn y ddadl hon ac, felly, ni ellir galw arno eto.
I wish to confirm that we received written legal advice at the Business Committee meeting this morning. We also had a full discussion about the legal position, and I took a particular view because, two weeks ago, I asked for legal advice, which was not entirely in line with the advice we received this morning. Two weeks ago, I wanted to consider the size of Committees. At first, the Conservatives accepted their size. This morning, we felt that it was far too late to start examining the matter in an ad hoc way—it needs comprehensive consideration. The purpose of the meeting this morning—despite the fact that the Conservative representative did not attend—was to look at the matter. We shall review it once the Committees are underway. We can then examine the burden of work that individual Committees will have to undertake.
Dymunaf gadarnhau ein bod wedi derbyn cyngor cyfreithiol ysgrifenedig yng nghyfarfod y Pwyllgor Busnes fore heddiw. Hefyd cawsom drafodaeth lawn ar y sefyllfa gyfreithiol, a chymerais safbwynt arbennig oherwydd, bythefnos yn ôl, gofynnais innau am gyngor cyfreithiol, nad oedd yn hollol gyson â’r cyngor a gawsom fore heddiw. Bythefnos yn ôl, yr oeddwn am ystyried maint y Pwyllgorau. I ddechrau, yr oedd y Ceidwadwyr yn derbyn eu maint. Fore heddiw, yr oeddem yn teimlo ei bod yn rhy hwyr o lawer i ddechrau edrych ar y mater mewn modd ad hoc—mae angen rhoi ystyriaeth gynhwysfawr iddo. Pwrpas y cyfarfod fore heddiw—er gwaethaf y ffaith nad oedd cynrychiolydd y Ceidwadwyr yn bresennol—oedd edrych ar y mater. Byddwn yn ei adolygu wedi i’r Pwyllgorau ddechrau ar eu gwaith. Wedyn gallwn edrych ar y llwyth gwaith y bydd rhaid i bwyllgorau unigol ymgymryd ag ef.

Pwyllgor Pwnc Addysg a Hyfforddiant Ôl-16
Post-16 Education and Training Subject Committee
I propose that
Cynigiaf fod
The composition of Subject Committees discriminates against the Conservative Party, and we have heard no justification of that from the Business Secretary. The other parties have tried to put up various barriers against us, the most pathetic of which is so-called legal advice. The Labour Party has had 18 months to sort these matters out. It is a disgrace that the Business Secretary is now trying to pull the wool over Members’ eyes. If there is any contravention of the law, it is likely to be that the Committees do not reasonably reflect the membership of political parties in the Assembly. I assume that this would take precedence over the fact that each Committee should be the same size.
Mae cyfansoddiad y Pwyllgorau Pwnc yn gwahaniaethu yn erbyn y Blaid Geidwadol, ac ni chlywsom unrhyw gyfiawnhad dros hynny gan y Trefnydd. Mae’r pleidiau eraill wedi ceisio codi gwahanol rwystrau yn ein herbyn, a’r mwyaf truenus o’r rheini yw cyngor cyfreithiol bondigrybwyll. Mae’r Blaid Lafur wedi cael 18 mis i ddatrys y materion hyn. Mae’n warth bod y Trefnydd yn awr yn ceisio taflu llwch i lygaid yr Aelodau. Os ydyw’r gyfraith wedi ei thorri, mae’n debygol bod hynny oherwydd nad yw’r Pwyllgorau yn adlewyrchu’n rhesymol aelodaeth y pleidiau gwleidyddol yn y Cynulliad. Cymeraf y byddai hyn yn cael blaenoriaeth dros y ffaith y dylai pob Pwyllgor fod o’r un maint.
Some of us do not believe that everything that comes from the civil service should remain unchallenged. Presumably it is better for the Assembly to function in a proper, inclusive, dynamic and variable way. That means that Committee sizes will differ. This is not unreasonable and does not break the law. Although I am not a lawyer, I find it offensive that our views are being stymied by the Business Secretary quoting the law in a rather loose fashion.
Mae rhai ohonom yn credu na ddylid derbyn popeth a ddaw o’r gwasanaeth sifil yn ddiwrthwynebiad. Byddai’n well, yn ôl pob tebyg, i’r Cynulliad weithredu mewn modd priodol, cynhwysol, egnïol ac amrywiadwy. Mae hynny’n golygu y bydd meintiau Pwyllgorau yn wahanol. Nid yw hyn yn afresymol ac nid yw’n torri’r gyfraith. Er nad wyf yn gyfreithiwr, mae’n peri tramgwydd imi ein bod yn cael ein rhwystro rhag mynegi’n barn gan y Trefnydd sy’n dyfynnu o’r gyfraith mewn modd braidd yn llac.
Our Chief Whip, David Davies, had to speak to us this morning in an emergency meeting, when we learned of the disgraceful decision to discriminate against the Conservative Party. That is why he could not attend the Business Committee meeting. It is important to discuss this matter because of its effect on devolved government. The Assembly sets precedents. Its actions in the first three months are more important than a loose review that is not transparent, but is carried out in smoke-filled rooms in three to six months’ time. That is simply not fair. We are being judged in these early days by the way in which we conduct our business. The Business Secretary is not giving the Assembly good advice. The membership of Committees needs to be sorted out. To tell us that the Assembly cannot hack a system that reflects party size is risible.
Bu’n rhaid i’n Prif Chwip, David Davies, siarad â ni fore heddiw mewn cyfarfod brys, pryd y cawsom wybod am y penderfyniad gwarthus i wahaniaethu yn erbyn y Blaid Geidwadol. Dyna pam nad oedd modd iddo fod yn bresennol yng nghyfarfod y Pwyllgor Busnes. Mae’n bwysig trafod y mater hwn oherwydd ei effaith ar lywodraeth ddatganoledig. Mae’r Cynulliad yn gosod cynseiliau. Mae ei weithredoedd yn y tri mis cyntaf yn bwysicach nag adolygiad llac ac un nad yw’n eglur, ond a gyflawnir mewn ystafelloedd llawn mwg ymhen tri i chwe mis. Mae hynny’n gwbl annheg. Yr ydym yn cael ein barnu yn y dyddiau cynnar hyn yn ôl y modd y byddwn yn cynnal ein busnes. Nid yw’r Trefnydd yn rhoi cyngor da i’r Cynulliad. Mae angen rhoi trefn ar aelodaeth y Pwyllgorau. Chwerthinllyd yw dweud wrthym nad yw’r Cynulliad yn gallu ymdopi â system sy’n adlewyrchu maint y pleidiau.
Mae’n bwysig ymateb i honiadau’r Aelodau Torïaidd. Mae’r mater wedi cael sylw yn y Pwyllgor Busnes droeon. Nid y bore yma y cafodd y Blaid Geidwadol wybod gyntaf am y drefn. Yng nghyfarfod blaenorol y Pwyllgor, cytunodd y Blaid Geidwadol benodi naw Aelod i bob Pwyllgor. Heddiw, maent yn gwrthwynebu. Mae cynnig y Trefnydd yn deg. Rhaid sefydlu Pwyllgorau’r Cynulliad. Byddwn yn gofyn am gynnig i godi’r gwaharddiad ar gig eidion ar yr asgwrn. Ni allwn wneud hynny oni bai fod gennym Bwyllgor. Gofynnaf i’r Blaid Dorïaidd ystyried y mater o ddifrif a derbyn ysbryd y cynnig, er mwyn inni allu mynd ati i sefydlu’r Pwyllgorau ac adolygu’r trefniadau o fewn chwe mis.
It is important that we respond to the allegations of Tory Members. The matter has been given attention a number of times in the Business Committee. The Conservative Party did not hear about the procedure for the first time this morning. In the previous meeting of the Committee, the Conservatives agreed to appoint nine Members per Committee. Today, they are objecting. The Business Secretary’s proposal is fair. We must establish the Assembly Committees. We will be asking for a proposal to lift the ban on beef on the bone. We cannot do that unless we have a Committee. I ask the Conservative Party to consider this matter seriously and accept the spirit of the proposal, so that we can move on to establish the Committees and review the arrangements within six months.
At the original business meeting, we were presented with a paper and asked to go away and think about it. When I looked at the paper, I saw a complicated mathematical table and I agreed that nine Members might be a possibility. The Deputy Presiding Officer and the civil servants present also told us that all the Subject Committees had to be the same size. Since then, I have checked that information and have discovered that we were given misleading advice. Subject Committees can be different sizes. I returned to another business meeting and stated all my objections. They appear in the minutes of the meeting. We did not accept nine Members then and we do not accept that number now. We want a fair deal for the Conservative Party.
Yn y cyfarfod busnes gwreiddiol, rhoddwyd papur inni a gofynnwyd inni fynd oddi yno a’i ystyried. Pan edrychais ar y papur, gwelais dabl mathemategol cymhleth a chytunais y gallai naw Aelod fod yn bosibiliad. Dywedodd y Dirprwy Lywydd a’r gweision sifil a oedd yn bresennol hefyd fod rhaid i’r holl Bwyllgorau Pwnc fod o’r un maint. Ers hynny, yr wyf wedi gwirio’r wybodaeth honno ac wedi darganfod ein bod wedi derbyn cyngor camarweiniol. Fe all Pwyllgorau Pwnc fod o wahanol feintiau. Dychwelais i gyfarfod busnes arall a nodais yr holl wrthwynebiadau oedd gennyf. Fe’u gwelir yng nghofnodion y cyfarfod. Nid oeddem yn derbyn naw Aelod bryd hynny ac nid ydym yn derbyn y nifer hwnnw yn awr. Yr ydym am gael bargen deg i’r Blaid Geidwadol.

I object to this particular motion. As many Members know, I am the education spokesman for the Conservative group, and I look forward to working with Tom Middlehurst and Rosemary Butler. However, that work can only be assisted by membership of the relevant Committees. Our rigid structure does not allow flexibility and fair representation of the political parties in this Assembly. That is wrong and disgraceful and sends the wrong message to the people of Wales, who are looking for a new type of politics.
Yr wyf yn gwrthwynebu’r cynnig arbennig hwn. Fel y gŵyr llawer o’r Aelodau, llefarydd y grŵp Ceidwadol ar addysg ydwyf fi, ac edrychaf ymlaen at weithio gyda Tom Middlehurst a Rosemary Butler. Fodd bynnag, ni ellir cymryd rhan yn y gwaith hwnnw ond drwy gael aelodaeth o’r Pwyllgorau perthnasol. Nid yw’r strwythur haearnaidd sydd gennym yn caniatáu hyblygrwydd a chynrychiolaeth deg i’r pleidiau gwleidyddol yn y Cynulliad hwn. Mae hynny’n anghywir ac yn warthus ac mae’n gyrru’r neges anghywir i bobl Cymru, sydd yn chwilio am fath newydd o wleidyddiaeth.
What message do we send to parts of Wales still sceptical about this Assembly? What message do we send to people in education about the way we are going to conduct business in this Chamber and in the Committees? I object to this proposal and I ask Members to do the same. I cannot support it, and I think that delaying the review until the autumn is wrong. The decision should have been made earlier, with flexibility and imagination.
Pa neges yr ydym yn ei hanfon at y rhannau o Gymru sydd yn amheus o hyd ynghylch y Cynulliad hwn? Pa neges yr ydym yn ei hanfon at bobl mewn addysg ynghylch y modd y byddwn yn cynnal busnes yn y Siambr hon ac yn y Pwyllgorau? Yr wyf yn gwrthwynebu’r cynnig hwn a gofynnaf i’r Aelodau wneud yn yr un modd. Ni allaf ei gefnogi, a chredaf mai anghywir yw gohirio’r adolygiad tan yr hydref. Dylai’r penderfyniad fod wedi ei wneud yn gynt, gyda hyblygrwydd a dychymyg.
Last week, we were presented with guidance about Chairs and the great duty that is placed upon them. We now face difficulties about the size of Committees. If I was the Chairman of this particular Committee—and it could equally apply to Miss Williams with regard to the previous Committee—it would be difficult to make party points. Those should surely come from the floor, not from the Chair. Therefore, if you are the party’s sole representative, it is difficult to make the points on which you have campaigned for years. I ask the Business Secretary to reconsider the matter.
Yr wythnos diwethaf, rhoddwyd arweiniad inni ynghylch Cadeiryddion a’r ddyletswydd fawr a roddir iddynt. Yn awr yr ydym yn wynebu anawsterau ynghylch maint Pwyllgorau. Pe bawn i’n Gadeirydd ar y Pwyllgor arbennig hwn—a gallai hynny fod yr un mor gymwys i Miss Williams mewn perthynas â’r Pwyllgor blaenorol—fe fyddai’n anodd gwneud pwyntiau pleidiol. Dylai’r rheini ddod o’r llawr, nid o’r Gadair. Felly, os mai chi yw unig gynrychiolydd eich plaid, mae’n anodd gwneud y pwyntiau yr ydych wedi ymgyrchu drostynt ers blynyddoedd. Yr wyf yn gofyn i’r Trefnydd ailystyried y mater.
I am in a similar position. I am Chair of the Health and Social Services Committee and the only Liberal Democrat member of it. I have no problem in fulfilling my role as Chair and as a Liberal Democrat. Standing Orders clearly point out that there is a perfect opportunity for individual party members—whether they are Chairs or not—to make their party points. There are clear guidelines in them on the conduct of Committee Chairs. I suggest that William Graham reads the Standing Orders and acquaints himself with both roles.
Yr wyf innau mewn sefyllfa debyg. Yr wyf yn Gadeirydd ar y Pwyllgor Iechyd a Gwasanaethau Cymdeithasol a’r unig aelod arno sy’n Ddemocrat Rhyddfrydol. Nid oes gennyf unrhyw broblem wrth gyflawni fy rôl fel Cadeirydd ac fel Democrat Rhyddfrydol. Mae’r Rheolau Sefydlog yn nodi’n eglur fod cyfle perffaith i aelodau unigol y pleidiau—boed yn Gadeiryddion neu beidio—wneud eu pwyntiau pleidiol. Mae canllawiau eglur ynddynt ar ymddygiad Cadeiryddion Pwyllgorau. Awgrymaf y dylai William Graham ddarllen y Rheolau Sefydlog ac ymgyfarwyddo â’r ddwy rôl.
Will the Business Secretary tell us who gave this legal advice—which particular office and authority—and will he place that advice in the Library?
A yw’r Trefnydd yn fodlon dweud wrthym pwy a roddodd y cyngor cyfreithiol hwn—pa swyddfa ac awdurdod penodol—ac a fydd yn gosod y cyngor hwnnw yn y Llyfrgell?
We have already had this discussion on size, and I have given an assurance that it will be reviewed. Three of the parties are happy with that assurance, and it has been agreed in the Business Committee. I will take advice on the question about sources of information and I will report back in due course.
Yr ydym eisoes wedi cael y drafodaeth hon ynghylch maint, ac yr wyf wedi rhoi sicrwydd y caiff y mater ei adolygu. Mae tair o’r pleidiau yn fodlon â’r sicrwydd hwnnw, ac fe’i cytunwyd yn y Pwyllgor Busnes. Byddaf yn derbyn cyngor ynghylch y cwestiwn am ffynonellau gwybodaeth ac adroddaf yn ôl maes o law.

As I said earlier, I have recognised that there was an objection and a request for a confirmatory vote. This is the first confirmatory vote of the Assembly. Therefore, I shall remind you of what will happen.
Fel y dywedais yn gynharach, yr wyf wedi cydnabod bod gwrthwynebiad a chais am bleidlais gadarnhau. Hon yw’r bleidlais gadarnhau gyntaf yn y Cynulliad. Felly, fe’ch atgoffaf am yr hyn fydd yn digwydd.
In accordance with the Standing Orders, the bell will ring and the vote will be taken after five minutes. In a few moments, I shall ask the Clerk to ring the division bell. The bell will ring for one minute and then there will be a three-and-a-half-minute silence. After that, the bell will ring for the final thirty seconds of the five-minute period. I shall then ask the operator to turn on the voting system. The system will be open for 15 seconds to give you the chance to register your vote. If you hit the wrong button, you can rectify your error as long as the voting system is open.
Yn unol â’r Rheolau Sefydlog, bydd y gloch yn canu ac fe gymerir y bleidlais ar ôl pum munud. Ymhen ychydig eiliadau, fe ofynnaf i’r Clerc ganu cloch y bleidlais. Bydd y gloch yn canu am un munud ac wedyn bydd distawrwydd o dri munud a hanner. Wedi hynny, bydd y gloch yn canu am ddeg eiliad ar hugain olaf y cyfnod o bum munud. Byddaf wedyn yn gofyn i’r gweithredydd droi ymlaen y system bleidleisio. Bydd y system yn agored am 15 eiliad i roi cyfle ichi gofnodi’ch pleidlais. Os byddwch wedi pwyso’r botwm anghywir, gallwch gywiro’ch camgymeriad gyhyd ag y bydd y system bleidleisio yn agored.
I remind you that the plus sign registers for the motion, the minus sign registers against the motion, and the nought in the middle registers an abstention. After the voting has closed, and I have been passed the result to read, the result will be shown on the screens at the front of the Chamber. Are you happy with those procedures?
I’ch atgoffa, mae’r arwydd plws yn cofnodi o blaid y cynnig, yr arwydd minws yn cofnodi yn erbyn y cynnig, a’r sero yn y canol yn cofnodi atal pleidlais. Ar ôl cau’r pleidleisio, ac wedi i’r canlyniad gael ei estyn imi ei ddarllen, fe ddangosir y canlyniad ar y sgriniau ym mlaen y Siambr. A ydych yn fodlon â’r gweithdrefnau hynny?

Alun Michael The First Secretary spoken in English p. 16
Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 16
The construction of any large project is a lengthy process. Party leaders, inside and outside Parliament, have been given opportunities to comment. Assembly Members will also have the opportunity to be involved in the process as it develops. The site of the new National Assembly building was acquired for a peppercorn fee of £1. Approximately £160,000 has been spent to date on the development of the new Assembly building, and we are committed to paying professional fees of approximately £300,000 to the Richard Rogers Partnership for the design work that has already been undertaken.
Mae adeiladu unrhyw brosiect mawr yn broses faith. Rhoddwyd cyfleoedd i arweinyddion y pleidiau, y tu mewn a’r tu allan i’r Senedd, roi sylwadau. Bydd cyfle hefyd i Aelodau’r Cynulliad fod yn gysylltiedig â’r broses wrth iddi ddatblygu. Prynwyd safle adeilad newydd y Cynulliad Cenedlaethol am ffi rad o £1. Gwariwyd tua £160,000 hyd yn hyn ar ddatblygu adeilad newydd y Cynulliad, ac yr ydym wedi ymrwymo i dalu ffïoedd proffesiynol o oddeutu £300,000 i Bartneriaeth Richard Rogers am y gwaith dylunio yr ymgymerwyd ag ef eisoes.
Many of us, particularly those on the National Assembly Advisory Group, who were united on only one issue—the unsuitability of this building for an Assembly—are surprised at how suitable this building has become. In the light of that, would the First Secretary consider setting up an Assembly committee to consider whether this building is suitable for an Assembly, and placing a moratorium on all future financial commitments during that committee’s deliberations? Another project, such as a millennium children’s hospital for Wales, would be a more lasting testament to the first four years of this Assembly.
Mae llawer ohonom, yn enwedig y rhai ar Grŵp Ymgynghorol y Cynulliad Cenedlaethol, oedd yn gytûn ar un mater yn unig—sef anaddasrwydd yr adeilad hwn ar gyfer Cynulliad—wedi synnu bod yr adeilad hwn mor addas erbyn hyn. Yng ngolwg hynny, a fydd y Prif Ysgrifennydd yn ystyried sefydlu pwyllgor o’r Cynulliad i ystyried a yw’r adeilad hwn yn addas i Gynulliad, a rhoi moratoriwm ar y cwbl o’r arian a ymrwymwyd ar gyfer y dyfodol yn ystod trafodaethau’r pwyllgor hwnnw? Byddai prosiect arall, fel ysbyty plant y mileniwm i Gymru, yn gofadail mwy parhaol i bedair blwyddyn gyntaf y Cynulliad hwn.
Alun Michael The First Secretary spoken in English p. 16
Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 16
The question of this building’s suitability is something we need to consider as time goes on, and Assembly Members will have an opportunity to contribute to that discussion. This Chamber is small and limited and not easily accessible. Therefore, it is not suitable for the National Assembly for Wales. I agree with Nick Bourne’s statement about the wonders that officials and architects have achieved in developing this building and giving us a temporary Chamber that is practical and workable. However, we should not jump to conclusions. I wish to take this project forward by agreement and consensus and not by rushing ahead. That is why I have made the commitment to involve the Assembly Members. It is my wish to maintain our initial spirit by involving the leaders of all four parties in this process.
Mae’r cwestiwn ynghylch addasrwydd yr adeilad hwn yn rhywbeth y bydd rhaid inni ei ystyried wrth i amser fynd ymlaen, a bydd cyfle gan Aelodau’r Cynulliad i gyfrannu at y drafodaeth honno. Mae’r Siambr hon yn fach ac yn gyfyng ac ni ellir ei chyrraedd yn rhwydd. Felly, nid yw’n addas i Gynulliad Cenedlaethol Cymru. Cytunaf â datganiad Nick Bourne am y rhyfeddodau a gyflawnodd swyddogion a phenseiri wrth ddatblygu’r adeilad hwn a rhoi inni Siambr dros dro sydd yn ymarferol ac yn hawdd ei defnyddio. Fodd bynnag, ni ddylem neidio i gasgliadau. Yr wyf am fynd â’r prosiect hwn ymlaen drwy gytundeb a chonsensws ac nid drwy ruthro ymlaen. Dyna pam yr wyf wedi ymrwymo i gynnwys Aelodau’r Cynulliad. Fy nymuniad yw cynnal ein hysbryd gwreiddiol drwy gynnwys aelodau pob un o’r pedair plaid yn y broses hon.
Given that there are only 60 seats in the public gallery of this Chamber and that people are standing, as they have done at every plenary meeting, does not the First Secretary think that, in the spirit of openness, we should have a Chamber that houses as many members of the public as possible, so that they can see the Assembly in action?
O wybod nad oes ond 60 o seddau yn oriel gyhoeddus y Siambr hon a bod pobl yn sefyll, fel y gwnaethant ym mhob cyfarfod llawn, onid yw’r Prif Ysgrifennydd yn credu, o ran bod yn agored, y dylai fod gennym Siambr sy’n cynnwys cymaint ag y gellir o aelodau’r cyhoedd, fel y gallant weld y Cynulliad ar waith?
Alun Michael The First Secretary spoken in English p. 17
Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 17
I agree with that point. It is important that people can be seated and that the building is easily accessible. I hope we can arrange an early opportunity for people to look at the design work and the underlying concepts developed by Richard Rogers. I think they would be very excited by what they see. There has been considerable support for the project—for example, the business community sees it as a positive flagship project. We should consider all the arguments. The party leaders have had opportunities to be up to date with the preparatory work. However, the majority of Members are new to the arguments and there should be time for everybody to consider the pros and cons and the options available to the Assembly.
Yr wyf yn cytuno â’r pwynt hwnnw. Mae’n bwysig bod seddau ar gael i bobl a bod yr adeilad yn hygyrch. Gobeithio y gallwn drefnu cyfle yn fuan i bobl weld y gwaith dylunio a’r syniadau sylfaenol a ddatblygwyd gan Richard Rogers. Credaf y byddent yn llawn cynnwrf o’r hyn a welent. Bu cryn gefnogaeth i’r prosiect—er enghraifft, mae’r gymuned fusnes yn ei weld yn brosiect cadarnhaol a blaengar. Dylem ystyried yr holl ddadleuon. Mae arweinyddion y pleidiau wedi cael cyfleoedd i gael gwybod am y gwaith paratoi wrth iddo fynd ymlaen. Fodd bynnag, mae’r rhan fwyaf o’r Aelodau newydd ddod at y dadleuon a dylid cael amser i bawb ystyried y dadleuon dros ac yn erbyn a’r dewisiadau sydd ar gael i’r Cynulliad.
Will the First Secretary outline the value-for-money justification for the proposed new Assembly building, and will he publish his department’s value-for-money assessment of the new building and place it in the Assembly Library?
A yw’r Prif Ysgrifennydd yn fodlon amlinellu’r cyfiawnhad o ran gwerth am arian dros adeilad arfaethedig newydd y Cynulliad, ac a yw’n fodlon cyhoeddi asesiad gwerth-am-arian ei adran ef ar yr adeilad newydd a’i osod yn Llyfrgell y Cynulliad?

The way in which arguments have been developed means that value for money is considered at different stages of the project, and I think that that information should be available to Assembly Members. We must focus on the benefits of this building and on future options. The Committees have not yet started to meet, Members are setting up offices and considering what it means to be an Assembly Member here and in their constituencies.
Mae’r modd y datblygwyd y dadleuon yn golygu bod gwerth am arian yn cael ei ystyried yng ngwahanol gamau’r prosiect, a chredaf y dylai’r wybodaeth honno fod ar gael i Aelodau’r Cynulliad. Rhaid inni ganolbwyntio ar fanteision yr adeilad hwn ac ar y dewisiadau ar gyfer y dyfodol. Nid yw’r Pwyllgorau wedi dechrau cyfarfod eto, mae’r Aelodau’n sefydlu eu swyddfeydd ac yn ystyried yr hyn y mae’n ei olygu i fod yn Aelod o’r Cynulliad yma ac yn eu hetholaethau.
We need to consider the necessary facilities for the Assembly together so that we are able to do a good job for the people of Wales.
Rhaid inni ystyried y cyfleusterau sy’n angenrheidiol i’r Cynulliad gyda’i gilydd fel y gallwn wneud gwaith da i bobl Cymru.

When does the First Secretary expect to make an announcement of match funds for European funding purposes? (OAQV23)
Pryd mae’r Prif Ysgrifennydd yn disgwyl cyhoeddi arian cyfatebol ar gyfer cyllid Ewropeaidd? (OAQV23)
Will the First Secretary take steps immediately to press for match funding on European structural funds in view of his revelation that match funding for Wales will not be addressed until the next standard spending assessment round? Will he make a statement on this? (OAQ51JS)
A wnaiff y Prif Ysgrifennydd gymryd camau i bwyso ar unwaith am gyllid cyfatebol ar gyfer cronfeydd strwythurol Ewropeaidd o ystyried ei ddatguddiad na eir i’r afael â’r mater o gyllid cyfatebol ar gyfer Cymru tan gylch nesaf yr asesiad gwariant safonol? A fydd yn gwneud datganiad? (OAQ51JS)

I will answer question 2 with question 26. I refer to the answer I gave to a similar question last week. As I indicated then and on every occasion since, there is a process for considering the implications of Objective 1—the outline figures of which are known—and other structural fund programmes to ensure that Wales makes the most of those opportunities.
Atebaf gwestiwn 2 gyda chwestiwn 26. Cyfeiriaf at yr ateb a roddais i gwestiwn tebyg yr wythnos diwethaf. Fel y nodais bryd hynny a phob tro wedyn, ceir proses ar gyfer ystyried goblygiadau Amcan 1—y gwyddys y ffigurau amlinellol ar ei gyfer—a rhaglenni cronfeydd strwythurol eraill er mwyn sicrhau y bydd Cymru’n manteisio i’r eithaf ar y cyfleoedd hynny.
That response is like saying the cheque is in the post. If a cheque is going to be written, we need to know when it will be written and its amount. The people of Wales need to know that. Help is needed urgently, particularly in west Wales and the Valleys. Those concerned in developing bids for European funding need to know where they stand. Given the desperate need for these funds, we must move forward and I urge the First Secretary to give guidance about when he will make an announcement.
Mae’r ateb hwnnw yr un fath â dweud bod y siec yn y post. Os bydd siec yn cael ei hysgrifennu, rhaid inni gael gwybod pa bryd y caiff ei hysgrifennu a beth fydd y swm arni. Mae ar bobl Cymru angen gwybod hynny. Mae angen cymorth ar unwaith, yn enwedig yng ngorllewin Cymru ac yn y Cymoedd. Mae ar y rhai sy’n ymwneud â datblygu ceisiadau am gyllid Ewropeaidd angen gwybod lle maent yn sefyll. O wybod yr angen dybryd am y cyllid hwn, rhaid inni symud ymlaen a phwysaf ar y Prif Ysgrifennydd i roi arweiniad ynghylch pa bryd y bydd yn gwneud cyhoeddiad.

I say to Nick Bourne that, when Dafydd Wigley made a similar point during the St David’s Day debate this year, Liam Fox—speaker on Welsh Affairs for the Conservative Party in the House of Commons—agreed with me on the point I have just made. Making decisions on future financial arrangements is a lengthy process. Liam Fox referred to the fear and smear tactics from nationalists who are trying to drive a wedge between the Welsh Assembly and the Treasury at Westminster—his words not mine, no offence to Dafydd Wigley. I suggest, therefore, that Nick Bourne speaks to his parliamentary representative to get this straight. I am sure Dafydd Wigley understands that there is a process to go through and he is slightly mischievous in tabling the question again. We have to go through the same process in financing the Assembly as for securing funds for the Welsh Office. The requirements of structural funds will be considered during that process.
Yr hyn a ddywedaf wrth Nick Bourne yw bod Liam Fox—llefarydd y Blaid Geidwadol ar Faterion Cymreig yn Nhŷ’r Cyffredin—wedi cytuno â mi ar y pwynt yr wyf newydd ei wneud pryd y gwnaeth Dafydd Wigley bwynt tebyg yn ystod y ddadl Gŵyl Dewi eleni. Mae gwneud penderfyniadau ar drefniadau ariannol ar gyfer y dyfodol yn broses hirfaith. Cyfeiriodd Liam Fox at y tactegau o godi ofn a phardduo gan y cenedlaetholwyr sy’n ceisio gyrru hollt rhwng y Cynulliad Cymreig a’r Trysorlys yn San Steffan—ei eiriau ef yw’r rheini, nid fy rhai i, ac nid oeddwn yn bwriadu tramgwyddo Dafydd Wigley. Awgrymaf, felly, y dylai Nick Bourne siarad â’i gynrychiolydd seneddol er mwyn cael hyn yn iawn. Yr wyf yn sicr bod Dafydd Wigley yn deall bod proses y mae’n rhaid ei dilyn ac y mae ychydig bach yn ddrygionus wrth gyflwyno’r cwestiwn eto. Rhaid inni fynd drwy’r un broses wrth ariannu’r Cynulliad ag wrth sicrhau cyllid i’r Swyddfa Gymreig. Rhoddir ystyriaeth i ofynion y cronfeydd strwythurol yn ystod y broses honno.
When do you propose to place the draft national strategy for the use of European Structural Funds before the National Assembly? I understand that this document exists and that it is not as far-reaching and imaginative as it might be. While we wait to know about the match funding, we could discuss ways of spending this money, if and when we get it.
Pa bryd yr ydych yn bwriadu gosod y drafft o’r strategaeth genedlaethol er defnyddio Cronfeydd Strwythurol Ewrop gerbron y Cynulliad Cenedlaethol? Deallaf fod y ddogfen hon yn bod ac nad yw mor drylwyr a llawn dychymyg ag y gallai fod. Tra byddwn yn disgwyl i gael gwybod am yr arian cyfatebol, gallem drafod dulliau i wario’r arian hwn, os neu pryd y byddwn yn ei gael.

Work is being done to prepare a document for consultation that will go from the task force to wide public consultation during the course of the next month. It will be available for debate by Members in this Chamber and I agree with Helen Mary’s point, that we should look at this document and consider the Assembly’s contribution. In essence, the document is produced and it will be open to public consultation including businesses, local authorities and the voluntary sector. We will then receive the relevant documents and comments. I am certain that Members of this Assembly and Committees will want to look at some of the details as soon as the document is available.
Mae gwaith yn mynd rhagddo i baratoi dogfen ar gyfer ymgynghori fydd yn cael ei throsglwyddo o’r tasglu ar gyfer ymgynghori eang ymhlith y cyhoedd yn ystod y mis nesaf. Bydd ar gael i’w thrafod gan yr Aelodau yn y Siambr hon a chytunaf â phwynt Helen Mary, y dylem edrych ar y ddogfen hon ac ystyried cyfraniad y Cynulliad. Yn fyr, mae’r ddogfen wedi ei chynhyrchu a bydd yn agored ar gyfer ymgynghori â’r cyhoedd gan gynnwys busnesau, awdurdodau lleol a’r sector gwirfoddol. Byddwn wedyn yn derbyn y dogfennau a’r sylwadau perthnasol. Yr wyf yn sicr y bydd Aelodau’r Cynulliad hwn a’r Pwyllgorau am edrych ar rai o’r manylion cyn gynted ag y bydd y ddogfen ar gael.
With reference to your earlier statement on match funding, when will next year’s comprehensive spending review be discussed by the Cabinet? When will it be completed and when will it be presented before Parliament and communicated to this Assembly?
Gan gyfeirio at eich datganiad cynharach ar arian cyfatebol, pa bryd y bydd y Cabinet yn trafod yr arolwg cynhwysfawr o wariant ar gyfer y flwyddyn nesaf? Pa bryd y caiff ei gwblhau a pha bryd y caiff ei gyflwyno gerbron y Senedd a’i draddodi i’r Cynulliad hwn?

There is no timescale for this process yet. I will keep Members informed of developments. The process requires Cabinet discussion and involves all Government departments. The words ‘comprehensive spending review’ mean that we must consider the requirements of each aspect of Government finances. I hope the Assembly will give careful consideration to the best way of utilising our finances across the range of our departments. People who have been involved in structural fund processes know that there is a tapering upwards. The plan that was mentioned must be produced and there must be agreement between the UK Government and Europe on the profile of expenditure in dealing with different requirements, including additionality.
Nid oes amserlen ar gyfer y broses hon eto. Byddaf yn sicrhau bod yr Aelodau yn cael gwybod am y datblygiadau. Mae angen trafodaeth yn y Cabinet ar gyfer y broses hon a bydd yn cynnwys holl adrannau’r Llywodraeth. Mae’r geiriau ‘arolwg cynhwysfawr o wariant’ yn golygu bod rhaid inni ystyried gofynion pob agwedd ar gyllid y Llywodraeth. Gobeithiaf y bydd y Cynulliad yn rhoi ystyriaeth ofalus i’r dull gorau i ddefnyddio ein cyllid ar draws amrediad ein hadrannau. Mae rhai a fu’n gysylltiedig â phrosesau cronfeydd strwythurol yn gwybod bod meinhau tuag at i fyny. Bydd rhaid cynhyrchu’r cynllun a grybwyllwyd a bydd rhaid cael cytundeb rhwng Llywodraeth y DU ac Ewrop ar broffil y gwariant wrth ymdrin â gwahanol ofynion, gan gynnwys ychwanegoldeb.

The decisions on allocation of Sportlot grants to individual projects are the responsibility of the Sports Council for Wales and are taken independently of Government. Having said that, the decision is good news for Swansea. I am sure it was not received with the same enthusiasm in Cardiff or Newport, which provided the competing bids. However, the quality of the Swansea bid was such that it should have been supported and the decision was unanimous.
Cyfrifoldeb Cyngor Chwaraeon Cymru yw’r penderfyniadau ar ddyfarnu grantiau Sportlot i brosiectau unigol ac fe’u gwneir yn annibynnol ar y Llywodraeth. Wedi dweud hynny, mae’r penderfyniad yn newyddion da i Abertawe. Yr wyf yn sicr na chafodd dderbyniad mor frwdfrydig yng Nghaerdydd a Chasnewydd, oedd yn cystadlu â’u ceisiadau hwy. Fodd bynnag, gystal oedd ansawdd cais Abertawe fel y dylesid bod wedi ei gefnogi ac yr oedd y penderfyniad yn unfrydol.
Given that £9 million of the Sportlot grant was originally earmarked for the Cardiff project, are you concerned that this is not related to a positive policy of spreading facilities around Wales but is the result of a failure of agreement between two leading bodies in Cardiff? Following the precipitate demolition of the Empire pool, the swimmers of Cardiff and the surrounding area have worse facilities.
O dderbyn bod £9 miliwn o grant Sportlot wedi ei glustnodi’n wreiddiol ar gyfer prosiect Caerdydd, a ydych yn bryderus nad yw hyn yn gysylltiedig â pholisi cadarnhaol o ledaenu cyfleusterau o gwmpas Cymru ond yn ganlyniad i fethiant dau gorff arweiniol yng Nghaerdydd i gytuno? Ar ôl y dymchwel brysiog ar bwll nofio’r Empire, mae cyfleusterau nofwyr Caerdydd a’r cylch wedi gwaethygu.

Jenny Randerson should speak to the leader of the Liberal Democrat group on Cardiff City Council, as these issues should be discussed there. We all want to see resources spread across Wales. We must, therefore, take pleasure in the fact that facilities are made available for the whole of Wales and not revert to antagonism and fear when these facilities are given to somebody else. The Leader of Cardiff City Council has stated optimistically that Cardiff will be provided with a pool. However, as I said, it is a matter for debate in the City Council chamber.
Dylai Jenny Randerson siarad ag arweinydd grŵp y Democratiaid Rhyddfrydol ar Gyngor Dinas Caerdydd, gan y dylai’r materion hyn gael eu trafod yn y fan honno. Mae pawb ohonom am weld lledaenu adnoddau ar draws Cymru. Felly, rhaid inni deimlo’n falch bod cyfleusterau ar gael i Gymru gyfan a pheidio â throi’n ôl at ofn a gelyniaeth pan roddir y cyfleusterau hyn i rywun arall. Mae Arweinydd Cyngor Dinas Caerdydd wedi datgan yn obeithiol y bydd pwll yn cael ei ddarparu ar gyfer Caerdydd. Fodd bynnag, fel y dywedais, mae’n fater i’w drafod yn siambr Cyngor y Ddinas.

That will not happen. A few weeks ago in Cardiff, the Prime Minister reinforced my point that there was a process to go through. Doubts cast at the Berlin Summit were undermined by his announcement that Objective 1 status had been won. This week in Cardiff, the Chancellor referred to his pleasure at having been part of the negotiating team that succeeded in winning Objective 1 status. We can, therefore, continue with great enthusiasm. I regret that the question has been posed in a way that seems to cast doubt on the ability to draw Objective 1 funding. I do not have that doubt. Those who are interested in making the project work should engage in developing the strategy to which Helen Mary referred. People in business, the voluntary sector and local government should put all their energies into driving the project forward as it will benefit people throughout Wales.
Ni fydd hynny’n digwydd. Ychydig wythnosau’n ôl yng Nghaerdydd, cadarnhaodd y Prif Weinidog y pwynt a wneuthum bod proses y byddai’n rhaid ei dilyn. Mae’r amheuon a fynegwyd yn Uwchgynhadledd Berlin wedi eu tanseilio gan ei gyhoeddiad bod statws Amcan 1 wedi ei ennill. Yr wythnos hon yng Nghaerdydd, cyfeiriodd y Canghellor at y mwynhad a gafodd o fod yn rhan o’r tîm negodi a lwyddodd i ennill statws Amcan 1. Felly, gallwn fynd ymlaen gyda brwdfrydedd mawr. Mae’n ofid imi fod y cwestiwn wedi ei eirio mewn modd sydd fel petai’n bwrw amheuaeth ar y gallu i dderbyn arian Amcan 1. Nid yw’r amheuaeth honno gennyf fi. Dylai’r rhai sydd am wneud i’r prosiect weithio gymryd rhan wrth ddatblygu’r strategaeth y cyfeiriodd Helen Mary ati. Dylai pobl mewn busnes, y sector gwirfoddol a llywodraeth leol ymroi’n llwyr i yrru’r prosiect ymlaen gan y bydd pobl ym mhob rhan o Gymru yn elwa arno.

The imports of waste into the UK are managed in the framework of the UK management plan for exports and imports of waste which came into effect on 1 June 1996. That plan is legally binding and takes account of the UK’s international obligations. The UK Government has announced a review of that plan and we aim to consult on any proposed changes this autumn. The National Assembly will have an opportunity to participate in that review and we should look at the sort of issues to which Mike German refers.
Rheolir mewnforion gwastraff i’r DU o fewn fframwaith cynllun rheoli’r DU ar gyfer allforion a mewnforion gwastraff a ddaeth i rym ar 1 Mehefin 1996. Mae’r cynllun hwnnw’n rhwymo mewn cyfraith ac yn cymryd i ystyriaeth rwymedigaethau rhyngwladol y DU. Mae Llywodraeth y DU wedi cyhoeddi adolygiad o’r cynllun hwnnw a bwriadwn ymgynghori ynghylch unrhyw newidiadau arfaethedig yr hydref hwn. Bydd cyfle i’r Cynulliad Cenedlaethol gymryd rhan yn yr adolygiad hwnnw a dylem edrych ar y math o faterion y mae Mike German yn cyfeirio atynt.
I wish to comment on waste and, in particular, the difficulties we face in identifying the country of origin of the waste. What influence will the Assembly have, through the reviewed waste management plan, on the approval of waste imports and on judging whether there are genuinely safe levels of contaminants in Pontypool at the end of this process?
Dymunaf wneud sylw ar wastraff ac, yn arbennig, ar yr anawsterau a wynebwn wrth ganfod gwlad tarddiad y gwastraff. Pa ddylanwad a gaiff y Cynulliad, drwy’r cynllun rheoli gwastraff a adolygir, ar gymeradwyo mewnforion gwastraff ac ar ddyfarnu a oes lefelau gwir ddiogel o ddifwynyddion ym Mhont-y-pŵl ar ddiwedd y broses hon?

Mike is aware that I have been interested in these types of environmental issues for a long time. I agree that there is a need to ensure that all the necessary information is available to identify any public risk. That is the purpose of the current scheme, but the review will ensure that the systems are improved. The Assembly will have an opportunity to contribute to that review and to give the advice necessary to strengthen public protection.
Fe ŵyr Mike fy mod yn ymddiddori yn y mathau hyn o faterion amgylcheddol ers amser maith. Yr wyf yn cytuno bod angen sicrhau bod yr holl wybodaeth angenrheidiol ar gael i ganfod unrhyw berygl i’r cyhoedd. Dyna bwrpas y cynllun cyfredol, ond bydd yr adolygiad yn sicrhau bod y systemau’n cael eu gwella. Bydd cyfle i’r Cynulliad gyfrannu at yr adolygiad hwnnw a rhoi’r cyngor angenrheidiol i gryfhau’r amddiffyniad i’r cyhoedd.
Is the First Secretary aware of the recent decision by the Environment Agency to allow the import of toxic polychlorinated biphenyls (PCBs) from Italy to Rechem after 31 May 1999, the date on which toxic waste from Europe should not be imported legally? Can the First Secretary assure the people of Pontypool that, when the Assembly reviews the waste management plan in the autumn, this and other loopholes will be closed?
A yw’r Prif Ysgrifennydd yn ymwybodol o’r penderfyniad diweddar gan Asiantaeth yr Amgylchedd i ganiatáu mewnforio biffenylau polyclorinedig (PCB) gwenwynig o’r Eidal i Rechem ar ôl 31 Mai 1999, y dyddiad pryd na ddylid mewnforio gwastraff gwenwynig o Ewrop yn gyfreithlon? A all y Prif Ysgrifennydd sicrhau pobl Pont-y-pŵl y caeir y bwlch hwn ac eraill pan fydd y Cynulliad yn adolygu’r cynllun rheoli gwastraff yn yr hydref?

Any loopholes can be discussed during the review and any evidence or concerns that Lynne Neagle has about her constituency can be fed into that process. I understand that the decontamination of transformers is classified as a materials recovery operation under the European directive. Therefore, PCBs will be drained from the transformers before they leave Italy. The Environment Agency must then determine whether a particular process is a disposal or a recovery, in line with the relevant UK and EU legislation. We can seek information about the decision and consider any concerns as part of the review.
Gellir trafod unrhyw fylchau yn ystod yr adolygiad a gellir porthi unrhyw dystiolaeth neu bryderon sydd gan Lynne Neagle ynghylch ei hetholaeth i’r broses honno. Deallaf fod dadlygru newidyddion yn nosbarth y gweithrediadau adfer deunyddiau o dan y gyfarwyddeb Ewropeaidd. Felly, fe gaiff y PCB eu draenio o’r newidyddion cyn iddynt adael yr Eidal. Rhaid i Asiantaeth yr Amgylchedd benderfynu wedyn a yw proses benodol yn waredu ynteu’n adfer, yn unol â deddfwriaeth berthnasol y DU a’r UE. Gallwn ofyn am wybodaeth am y penderfyniad ac ystyried unrhyw bryderon fel rhan o’r adolygiad.

Business Statement
The business for the next three weeks is on the intranet. However, I wish to draw your attention to the following items of business. In the plenary session on Tuesday 8 June, the election of members to the Audit Committee and the Legislation Committee will be held. It was decided last week that the Assembly will be in recess on Wednesday 9 June. In the plenary session on Tuesday 15 June, the election of members for the following three committees will be held: the Committee on European Affairs, the Committee on Standards of Conduct and the Committee on Equality of Opportunity. In the plenary session on Wednesday 16 June, there will be an opportunity for oral questions to be put to Jane Hutt, the Secretary for Health and Social Services, and to Tom Middlehurst, the Secretary for Post-16 Education and Training. Fifteen minutes has been allocated for each of these question sessions. The oral questions to Assembly Secretaries in plenary on Wednesday 23 June will be taken by Peter Law, the Secretary for the Environment and Local Government, and by Christine Gwyther, the Secretary for Agriculture and Rural Development. Again, 15 minutes has been allocated for each of these question sessions.
Mae’r busnes ar gyfer y tair wythnos nesaf ar y fewnrwyd. Fodd bynnag, dymunaf dynnu’ch sylw at yr eitemau busnes canlynol. Yn y sesiwn llawn dydd Mawrth 8 Mehefin, cynhelir etholiad aelodau’r Pwyllgor Archwilio a’r Pwyllgor Deddfau. Penderfynwyd yr wythnos diwethaf y bydd y Cynulliad ar wyliau dydd Mercher 9 Mehefin. Yn y sesiwn llawn dydd Mawrth 15 Mehefin, cynhelir etholiad aelodau’r tri phwyllgor canlynol: y Pwyllgor Materion Ewropeaidd, y Pwyllgor Safonau Ymddygiad a’r Pwyllgor Cyfle Cyfartal. Yn y sesiwn llawn dydd Mercher 16 Mehefin, bydd cyfle i ofyn cwestiynau llafar i Jane Hutt, yr Ysgrifennydd Iechyd a Gwasanaethau Cymdeithasol, ac i Tom Middlehurst, yr Ysgrifennydd Addysg a Hyfforddiant Ôl-16. Dyrannwyd pymtheg munud ar gyfer pob un o’r ddau sesiwn holi hyn. Derbynnir y cwestiynau llafar i Ysgrifenyddion y Cynulliad yn sesiwn llawn dydd Mercher 23 Mehefin gan Peter Law, Ysgrifennydd yr Amgylchedd a Llywodraeth Leol, a chan Christine Gwyther, yr Ysgrifennydd Amaethyddiaeth a Datblygu Gwledig. Unwaith eto, dyrannwyd 15 munud ar gyfer pob un o’r sesiynau holi hyn.
Finally, I promised the Assembly and the Assembly Business Committee last week that I would seek to make time available at the earliest opportunity to table a motion to debate the beef on the bone ban. I have done so as quickly as possible and I have tabled a motion to debate the issue in plenary today.
Yn olaf, rhoddais addewid i’r Cynulliad ac i Bwyllgor Busnes y Cynulliad yr wythnos diwethaf y byddwn yn ceisio sicrhau bod amser ar gael ar y cyfle cyntaf i gyflwyno cynnig i drafod y gwaharddiad ar gig eidion ar yr asgwrn. Gwneuthum hynny mor fuan ag yr oedd modd ac yr wyf wedi cyflwyno cynnig i drafod y mater yn y sesiwn llawn heddiw.

Carwn ofyn cwestiwn i Andrew ynglŷn â’r amserlen fusnes. Credaf ei bod yn bwysig ein bod yn cael dadl agored yn fuan lle bydd y Llywodraeth yn cael cyfle i nodi yn fanwl ei rhaglen ar gyfer y flwyddyn sydd o’n blaenau. Byddwn yn ddiolchgar pe gallai Andrew ddweud a fydd cyfle i wneud hynny yn fuan ar ôl y toriad ac y bydd y Llywodraeth yn nodi’n glir ei blaenoriaethau ar gyfer y dyfodol er mwyn i Aelodau’r Cynulliad eu trafod.
I wish to ask Andrew a question about the business timetable. It is important that we have an open debate soon where the Government has an opportunity to set out in detail its programme for the coming year. I would be grateful if Andrew could tell us whether there will be an opportunity for that to be done soon after the recess and that the Government will state clearly its priorities for the future so that Members of the Assembly can discuss them.
I am happy to give that assurance. Does the First Secretary have anything to add?
Mae’n dda gennyf roi’r sicrwydd hwnnw. A oes gan y Prif Ysgrifennydd rywbeth i’w ychwanegu?

That opportunity would be welcome. It would allow the other parties in the Assembly, starting with the second largest, to have an opportunity to debate issues of their choice. That would enable us to begin to deal with individual issues and start to develop a trend of positive debates in the Chamber. I welcome the spirit in which Dafydd has made the suggestion.
Byddai’n dda cael y cyfle hwnnw. Byddai’n caniatáu i bleidiau eraill yn y Cynulliad, gan ddechrau â’r ail fwyaf, gael cyfle i drafod materion o’u dewis. Byddai hynny’n ein galluogi i ddechrau ymdrin â materion unigol a dechrau datblygu tueddiad at drafodaethau cadarnhaol yn y Siambr. Yr wyf yn croesawu ysbryd awgrym Dafydd.

Amserlen
Timetable
I have arranged to place the outline timetable for the next three months on the intranet. This includes details of plenary meetings, times available for Committee meetings, political party meetings and recesses. I would like to draw your attention to particular dates. The first Legislation Committee briefing session will take place on the morning of 15 June. The first three Subject Committee meetings will take place on the morning of 16 June, starting with the Under-16 Education Committee, the Economic Development Committee and the Agriculture and Rural Development Committee. The Post-16 Education and Training Committee, the Environment and Local Government Committee and the Health and Social Services Committee will meet on the morning of the following Tuesday, 23 June. It is proposed that Subject Committees will usually meet every two weeks. The first meeting of the Audit Committee will be held on the morning of 17 June and the first meeting of the Committee on Standards of Conduct will take place on the morning of 24 June. The first meeting of the Committee on European Affairs is scheduled to take place on the morning of 1 July, and the first meeting of the Committee on Equality of Opportunity is scheduled to be held on the morning of 22 July. Questions to the First Secretary will be taken in plenary every Tuesday and will last for 15 minutes. Each Assembly Secretary, apart from myself, will take oral questions once a month. They will be taken on Wednesdays and last for 15 minutes. Two hours have also been allocated every Tuesday between noon and 2 p.m. for meetings of the political parties, and the first minority party debate will be held in plenary on 16 June. That matter was discussed in the Business Committee today, and has been agreed by the party business managers. The schedule for the minority party debates will be posted in due course.
Yr wyf wedi trefnu i osod yr amserlen amlinellol ar gyfer y tri mis nesaf ar y fewnrwyd. Mae hon yn cynnwys manylion y cyfarfodydd llawn, yr amseroedd sydd ar gael ar gyfer cyfarfodydd Pwyllgorau, cyfarfodydd pleidiau gwleidyddol a gwyliau. Carwn dynnu’ch sylw at ddyddiadau penodol. Cynhelir sesiwn briffio cyntaf y Pwyllgor Deddfau ar fore 15 Mehefin. Cynhelir tri chyfarfod cyntaf y Pwyllgorau Pwnc ar fore 16 Mehefin, gan ddechrau â’r Pwyllgor Addysg Cyn-16, y Pwyllgor Datblygu Economaidd a’r Pwyllgor Amaethyddiaeth a Datblygu Gwledig. Bydd y Pwyllgor Addysg a Hyfforddiant Ôl-16, Pwyllgor yr Amgylchedd a Llywodraeth Leol a’r Pwyllgor Iechyd a Gwasanaethau Cymdeithasol yn cyfarfod ar fore’r dydd Mawrth canlynol, 23 Mehefin. Cynigir y bydd y Pwyllgorau Pwnc yn cyfarfod bob pythefnos fel arfer. Cynhelir cyfarfod cyntaf y Pwyllgor Archwilio ar fore 17 Mehefin a chyfarfod cyntaf y Pwyllgor Safonau Ymddygiad ar fore 24 Mehefin. Trefnwyd i gynnal cyfarfod cyntaf y Pwyllgor Materion Ewropeaidd ar fore 1 Gorffennaf, a threfnwyd i gynnal cyfarfod cyntaf y Pwyllgor Cyfle Cyfartal ar fore 22 Gorffennaf. Cynhelir sesiwn holi’r Prif Ysgrifennydd yn y sesiwn llawn bob dydd Mawrth a bydd yn para am 15 munud. Bydd holl Ysgrifenyddion y Cynulliad, heblaw amdanaf fi, yn derbyn cwestiynau llafar unwaith y mis. Fe’u derbynnir ar ddydd Mercher a byddant yn para am 15 munud. Hefyd dyrannwyd dwy awr bob dydd Mawrth rhwng hanner dydd a 2 p.m. ar gyfer cyfarfodydd y pleidiau gwleidyddol, a chynhelir dadl gyntaf plaid leiafrifol yn y sesiwn llawn ar 16 Mehefin. Trafodwyd y mater hwnnw yn y Pwyllgor Busnes heddiw, ac mae trefnyddion busnes y pleidiau wedi cytuno arno. Cyhoeddir amserlen dadleuon y pleidiau lleiafrifol maes o law.
I wish to speak against the proposed timetable. The low turnout at the Assembly elections will be of concern to all Members, irrespective of their political party. It is of deep concern to me. Actions speak louder than words and, after 19 weeks of its existence, the Assembly will have been in recess for eight weeks and two days—more than 42 per cent of the time. That will not give the electorate much confidence in us and I oppose the motion on those grounds. We must do more. We have powers from 1 July and we must act to improve the situation in Wales.
Dymunaf siarad yn erbyn yr amserlen arfaethedig. Bydd y nifer isel a bleidleisiodd yn etholiadau’r Cynulliad yn peri pryder i’r holl Aelodau, beth bynnag fo’u plaid wleidyddol. Mae’n peri pryder mawr i mi. Mae gwneud yn bwysicach na dweud ac, ar ôl 19 wythnos o fodolaeth, bydd y Cynulliad wedi bod ar gau am wyth wythnos a dau ddiwrnod—mwy na 42 y cant o’r amser. Ni fydd hynny’n ennyn llawer o hyder ynom ymhlith yr etholwyr a gwrthwynebaf y cynnig ar y sail honno. Rhaid inni wneud mwy. Bydd gennym bwerau oddi ar 1 Gorffennaf a rhaid inni weithredu i wella’r sefyllfa yng Nghymru.
The motions to go into recess have been adopted by the Assembly. It is a decision for the Assembly, not me. I propose that the Assembly agrees on the recess period.
Mae’r cynigion i gau am wyliau wedi eu derbyn gan y Cynulliad. Penderfyniad i’r Cynulliad ydyw, nid i mi. Cynigiaf y bydd y Cynulliad yn cytuno ar y cyfnod o wyliau.
We were told earlier that there would be no time to look at the make-up of Subject Committees until September or October. Could the Business Committee meet to discuss this urgent matter while the rest of the Assembly is in recess, and ensure that the Conservative Party is given fair representation?
Dywedwyd wrthym yn gynharach na fyddai amser i ystyried cyfansoddiad y Pwyllgorau Pwnc tan Fedi neu Hydref. A allai’r Pwyllgor Busnes gyfarfod i drafod y mater brys hwn tra bydd gweddill y Cynulliad ar wyliau, a sicrhau y rhoddir cynrychiolaeth deg i’r Blaid Geidwadol?
The point I made on the review of the workings of the Subject Committees is that we need time for those Committees to meet. The Business Committee feels that one or two months is insufficient time for the Committees to establish themselves and that is why it was agreed that the review would take place in the autumn.
Y pwynt a wneuthum ar adolygu gweithrediadau’r Pwyllgorau Pwnc yw bod angen amser arnom i’r Pwyllgorau hynny gael cyfarfod. Mae’r Pwyllgor Busnes o’r farn nad yw un mis neu ddau yn ddigon o amser i’r Pwyllgorau ymsefydlu a dyna pam y cytunwyd y byddai’r adolygiad yn digwydd yn yr hydref.
I assure my constituents that, for me, recess does not mean sitting at home twiddling my thumbs. Along with most of my colleagues, I will be visiting schools, businesses, factories and constituents. I will be working hard during recess.
Yr wyf yn sicrhau fy etholwyr nad yw gwyliau, yn fy achos i, yn golygu eistedd gartref yn troi fy modiau. Fel y rhan fwyaf o’m cyd-aelodau, byddaf yn ymweld ag ysgolion, busnesau, ffatrïoedd ac etholwyr. Byddaf yn gweithio’n galed yn ystod y gwyliau.

Cig Eidion ar yr Asgwrn
Beef on the Bone

Christine Gwyther Yr Ysgrifennydd Amaethyddiaeth a Datblygu Gwledig siaradwyd yn Saesneg t. 27
I welcome the members of the farming industry who are in the public gallery. I extend the hand of friendship on behalf of the Cabinet and the rest of the Assembly, especially on behalf of the Agriculture and Rural Development Committee, which has been set up to represent your interests, and those of rural Wales. In the coming months, I will formulate policy and make decisions. The input of the farming community will be vital. Therefore, we welcome you today.
Yr wyf yn croesawu’r aelodau o’r diwydiant amaethu sydd yn yr oriel gyhoeddus. Estynnaf law cyfeillgarwch ar ran y Cabinet a gweddill y Cynulliad, yn enwedig ar ran y Pwyllgor Amaethyddiaeth a Datblygu Gwledig a sefydlwyd i gynrychioli’ch buddiannau chi, a rhai’r Gymru wledig. Yn y misoedd sydd i ddod, byddaf yn llunio polisi ac yn gwneud penderfyniadau. Bydd mewnbwn y gymuned amaethyddol yn holl bwysig. Felly, yr ydym yn eich croesawu heddiw.
I propose that the Assembly supports the earliest possible lifting of the current ban on beef on the bone and, in order to enable it to come to a considered decision, request that the Agriculture and Rural Development Committee conducts an urgent inquiry into the matter, consulting as appropriate with other Subject Committees, with a remit to report with recommendations to Assembly Members as soon as is reasonably practical.
Cynigiaf y bydd y Cynulliad yn cefnogi codi’r gwaharddiad cyfredol ar gig eidion ar yr asgwrn cyn gynted ag y bo modd ac, fel y gall gyrraedd penderfyniad ystyriol, gofynnaf i’r Pwyllgor Amaethyddiaeth a Datblygu Gwledig gynnal ymchwiliad brys i’r mater, gan ymgynghori fel y bo’n briodol â Phwyllgorau Pwnc eraill ac, fel rhan o’i gylch gorchwyl, i roi adroddiad gydag argymhellion i Aelodau’r Cynulliad cyn gynted ag y bo’n rhesymol ymarferol.

Christine Gwyther Yr Ysgrifennydd Amaethyddiaeth a Datblygu Gwledig (parhad) siaradwyd yn Saesneg t. 28
The ban on the sale of beef on the bone was imposed by the United Kingdom Government to protect public health. The protection of the health of people in Wales will remain our primary concern. It is also the prime concern of the Welsh farming industry, which will stand or fall on its record on product quality and safety. The ban has been called into question because it is considered an infringement of personal choice and freedom. I believe that every person in this Assembly would like to see the ban lifted as soon as possible. I know I would. The question is when that earliest possible time is.
Gorfodwyd y gwaharddiad ar werthu cig eidion ar yr asgwrn gan Lywodraeth y Deyrnas Unedig er mwyn gwarchod iechyd cyhoeddus. Gwarchod iechyd pobl yng Nghymru fydd ein prif ystyriaeth o hyd. Hon hefyd yw prif ystyriaeth diwydiant amaethyddol Cymru, sydd yn dibynnu’n llwyr ar ei record ar ansawdd a diogelwch ei gynnyrch. Codwyd amheuaeth ynghylch y gwaharddiad am ei fod yn cael ei ystyried yn rhywbeth sy’n torri ar draws dewis a rhyddid personol. Credaf y byddai pawb yn y Cynulliad hwn am weld codi’r gwaharddiad cyn gynted ag y bo modd. Fe fyddwn i, yn sicr. Y cwestiwn yw pa bryd yw’r adeg gynharaf posibl.
Will the Secretary for Agriculture and Rural Development give way?
A yw’r Ysgrifennydd Amaethyddiaeth a Datblygu Gwledig yn fodlon ildio?
No.
Nac ydwyf.
Medical and scientific advice tells us that the risk of BSE entering the food chain is now small, and has reduced from when the ban was imposed in late 1997. The most recent advice from the Chief Medical Officer for Wales, given in February this year and following further consideration by the Spongiform Encephalopathy Advisory Committee, was that the risk was still sufficient to retain the ban for at least another six months from that time—that is, up to August. This is consistent with advice from the English Chief Medical Officer.
Yn ôl y cyngor meddygol a gwyddonol, bychan erbyn hyn yw’r perygl i BSE ddod i’r gadwyn fwyd, ac mae’n llai nag yr oedd pan orfodwyd y gwaharddiad yn hwyr yn 1997. Y cyngor diweddaraf oddi wrth Brif Swyddog Meddygol Cymru, a roddwyd yn Chwefror eleni gan ddilyn ystyriaeth bellach gan y Pwyllgor Ymgynghorol ar Enseffalopathi Sbwngffurf, oedd bod y perygl yn ddigon o hyd i gadw’r gwaharddiad am o leiaf chwe mis arall oddi ar yr amser hwnnw—hynny yw, hyd at Awst. Mae hyn yn gyson â’r cyngor oddi wrth Brif Swyddog Meddygol Lloegr.
Welsh farming would benefit from the lifting of the ban, although we should be careful when we talk of economic benefits. It is worth mentioning that, since the ban was imposed, the share of the United Kingdom market supplied from home production has increased from 71 per cent to 82 per cent. Therefore, the economic effect of the ban is not perhaps as severe as some have suggested. It restricts the scope of Welsh beef farmers to market their produce, which is unfortunate, given the high quality of Welsh beef and the red-meat marketing strategy that we are developing. Lifting the ban would certainly give a psychological boost to an industry that is now beginning to recover after a very difficult period. There is, however, a wider context within which it may be detrimental to Welsh agricultural interests to lift the ban in advance of medical advice.
Byddai amaethyddiaeth yng Nghymru yn elwa o godi’r gwaharddiad, er y dylem fod yn ofalus wrth sôn am elw economaidd. Mae’n werth crybwyll bod y gyfran o farchnad y Deyrnas Unedig a gyflenwir gan gynnyrch cartref wedi codi o 71 y cant i 82 y cant ers gosod y gwaharddiad. Felly, nid yw effaith economaidd y gwaharddiad mor ddifrifol efallai ag y mae rhai wedi awgrymu. Mae’n cyfyngu ar gyfle ffermwyr cig eidion Cymru i farchnata eu cynnyrch, sydd yn anffodus, o wybod am ansawdd uchel cig eidion Cymru a’r strategaeth marchnata cig coch yr ydym yn ei datblygu. Mae’n sicr y byddai codi’r gwaharddiad yn rhoi hwb seicolegol i ddiwydiant sydd bellach yn dechrau ymadfer ar ôl cyfnod anodd iawn. Fodd bynnag, fe geir cyd-destun ehangach lle y gallai codi’r gwaharddiad cyn derbyn cyngor meddygol fod yn niweidiol i fuddiannau amaethyddol Cymru.
We need to look at the big picture. The United Kingdom Government is currently in delicate negotiations with the European Community about lifting the ban on beef exports from the United Kingdom. A report of the Community’s inspection of the United Kingdom arrangement is expected early next month and there is a very good chance that beef exports will resume later in the summer. The beef on the bone ban is not among the conditions applied to the beef export scheme. However, there is a danger that a unilateral lifting of the ban, contrary to medical advice, will be seen in Europe—and, more importantly, by our competitors—as an indication that at least one part of the United Kingdom, Wales, is possibly less than rigorous in its approach to BSE control measures. It would be a tragedy if this should result in a delay in lifting the export ban, which is the most important issue facing farmers. The possible damage to the Welsh beef industry will be far greater than that caused by the beef on the bone ban.
Rhaid inni edrych ar y darlun cyfan. Ar hyn o bryd, mae Llywodraeth y Deyrnas Unedig mewn trafodaethau manwl â’r Gymuned Ewropeaidd ynghylch codi’r gwaharddiad ar allforion cig eidion o’r Deyrnas Unedig. Disgwylir adroddiad o archwiliad y Gymuned o’r trefniant â’r Deyrnas Unedig yn fuan y mis nesaf ac mae gobaith da iawn y bydd allforion cig eidion yn ailddechrau’n ddiweddarach yn yr haf. Nid yw’r gwaharddiad ar gig eidion ar yr asgwrn yn un o’r amodau a gymhwysir at y cynllun allforio cig eidion. Mae perygl, fodd bynnag, y byddai codi’r gwaharddiad yn unochrog, yn groes i’r cyngor meddygol, yn cael ei weld yn Ewrop—ac, yn bwysicach, gan ein cystadleuwyr—fel arwydd bod o leiaf un rhan o’r Deyrnas Unedig, sef Cymru, heb fod yn drwyadl o bosibl yn ei hymagwedd at fesurau i reoli BSE. Byddai’n drychineb pe bai hyn yn arwain at oedi cyn codi’r gwaharddiad ar allforion, sef y mater pwysicaf sy’n wynebu ffermwyr. Byddai’r niwed posibl i ddiwydiant cig eidion Cymru yn fwy o lawer na’r hyn a achosid gan y gwaharddiad ar gig eidion ar yr asgwrn.
As I have said, further advice will come in August, when the Chief Medical Officers will consider further research and the number of BSE cases that have been reported during the six months’ period mentioned. I very much hope, as we all do, that the advice we receive then will allow us to lift the ban. It would be unwise to lift it before then, as agriculture in Wales has little to gain and could potentially suffer. None of us wants to see that happen. The right course of action is to refer the matter to the Agriculture and Rural Development Committee for its early consideration, using expert evidence. The Health and Social Services Committee, which has a direct interest in this matter, should also consider it. Expert evidence must also be made available to that Committee as soon as possible. When the Committees have reached consensus, or are in a position to make informed contributions to the debate, we will bring the matter back to the Assembly and debate it further.
Fel y dywedais, fe dderbynnir cyngor pellach yn Awst, pryd y bydd y Prif Swyddogion Meddygol yn ystyried ymchwil bellach a nifer yr achosion o BSE a hysbyswyd yn ystod y cyfnod o chwe mis y soniwyd amdano. Yr wyf yn mawr obeithio, fel yr ydym i gyd, y bydd y cyngor a dderbyniwn bryd hynny yn caniatáu inni godi’r gwaharddiad. Annoeth fyddai ei godi cyn hynny, gan mai ychydig sydd i’w ennill gan amaethyddiaeth yng Nghymru, ac mae posibiliad y gallai ddioddef. Nid oes neb ohonom am weld hynny’n digwydd. Y cwrs gweithredu cywir yw cyfeirio’r mater at y Pwyllgor Amaethyddiaeth a Datblygu Gwledig i dderbyn ystyriaeth fuan, gan ddefnyddio tystiolaeth arbenigol. Dylai’r Pwyllgor Iechyd a Gwasanaethau Cymdeithasol, sydd â budd uniongyrchol yn y mater hwn, roi ystyriaeth iddo hefyd. Rhaid i dystiolaeth arbenigol fod ar gael i’r Pwyllgor hwnnw hefyd cyn gynted ag y bo modd. Wedi i’r Pwyllgorau gyrraedd consensws, neu pan fyddant mewn sefyllfa i roi cyfraniadau cytbwys i’r ddadl, fe ddeuwn â’r mater yn ôl i’r Cynulliad a’i drafod ymhellach.

Heddiw cawn y cyfle cyntaf i drafod mewn modd ystyrlon ein hymateb, fel Aelodau’r Cynulliad, i’r gwaharddiad ar gig eidion ar yr asgwrn. Yr ydym i gyd yn dymuno gweld y gwaharddiad yn cael ei godi ar y cyfle cyntaf posibl.
in Welsh Today we have the first opportunity to discuss meaningfully our response, as Assembly Members, to the ban on beef on the bone. We all want to see this ban lifted at the first possible opportunity.
Yr wyf am ei gwneud yn berffaith glir fod Plaid Cymru yn cefnogi’r alwad i godi’r gwaharddiad. Nid oes neb yn dymuno gweld hynny’n digwydd yn fwy na grŵp Plaid Cymru. Fodd bynnag, yr wyf am ei gwneud yn glir hefyd ein bod ni am weithredu, hyd y bo modd, drwy gytundeb, cydweithrediad, ac—i ddefnyddio’r gair mawr—consensws.
in Welsh I want to make it perfectly clear that Plaid Cymru supports the call to lift the ban. No one wants to see that happen more than the Plaid Cymru group. However, I also make it clear that we want to proceed, as far as possible, through agreement, co-operation, and—to use the big word—consensus.
Nid yw hwn yn fater sy’n eiddo i un blaid neu garfan. Gan ei fod yn uno’r pleidiau, dylem weithredu yn synhwyrol, yn adeiladol ac mewn ffordd nad yw’n ceisio mantais wleidyddol i un blaid. Mae’r mater yn rhy bwysig i’w drin felly. Felly, gobeithiaf y bydd pob Aelod yn teimlo y gall gefnogi’r cynnig.
in Welsh This matter does not belong to any one party or faction. As it unites the parties, we should act sensibly, constructively and in a way that does not seek political advantage for any one party. The matter is far too important to be dealt with in such a way. Therefore, I hope that all Members will feel they can support the proposal.
Buom i gyd yn pregethu am wleidyddiaeth gonsensws yn ystod yr etholiad. Dyma gyfle i weithredu ar egwyddorion y bregeth honno. Gwae ni os byddwn yn ymrannu ar y cyfle cyntaf.
in Welsh We all preached about consensus politics during the election. We now have an opportunity to act on the principles of that sermon. Woe betide us if we divide at the first opportunity.
Cefndir y ddadl hon yw’r argyfwng difrifol sy’n wynebu’r diwydiant amaeth oherwydd BSE, a’r problemau a ddaeth yn sgîl penderfyniad yr Undeb Ewropeaidd i wahardd allforio cig eidion o wledydd Prydain. Er bod camau ar droed i godi’r gwaharddiad hwnnw, fe gymer amser i’r allforion godi i’r hyn oeddent cyn mis Mawrth 1996. Fe gymer amser i godi hyder yn y farchnad ac adennill y marchnadoedd a gollwyd. Nid oes amheuaeth y bu gwahardd cig eidion ar yr asgwrn yn gnoc arall i hyder y diwydiant ar adeg pan oedd angen ailadfer hyder.
in Welsh The background to this debate is the serious crisis that faces the agricultural industry as a result of BSE, and the problems that resulted from the European Union’s decision to ban the export of beef from the countries of Britain. Although steps are being taken to lift that ban, it will take time for the exports to reach the same level as before March 1996. It will take time to renew confidence in the market and win back the markets that were lost. There is no doubt that banning beef on the bone was another blow to the confidence of the industry at a time when confidence needed to be restored.
Ar un adeg, yr oedd popeth fel pe bai’n mynd yn groes i ddiddordebau ein diwydiant amaethyddol. Yr oeddwn i yn ymwybodol iawn o hynny, nid yn unig fel cynrychiolydd ardal amaethyddol yn y Senedd ac yn y Cynulliad, ond hefyd fel llefarydd Plaid Cymru ar faterion amaethyddol. Siaredais mewn llawer o gyfarfodydd protest a gynhaliwyd gan y ffermwyr yn ystod y tair blynedd ddiwethaf. Yr wyf wedi arwain sawl dirprwyaeth at Weinidogion mewn ymgais i ddatrys y broblem a sicrhau chwarae teg i’r diwydiant.
in Welsh At one time, everything seemed to battle against the interests of our agricultural industry. I was very much aware of that, not only as a representative of an agricultural area in Parliament and in the Assembly, but also as the Plaid Cymru spokesperson on agricultural matters. I spoke at many protest meetings held by farmers over the last three years. I have led many delegations to Ministers to try to resolve the problem and ensure fair play for the industry.
Mae gennyf fi, a nifer o Aelodau eraill, syniad go lew o’r pryder yng nghefn gwlad. Yr wyf wedi cynnal nifer o gyfarfodydd gyda ffermwyr ers imi gael fy ethol i’r Cynulliad. Maent am inni weithredu yn fuan. Maent am inni ddangos ein bod, fel Cynulliad, yn eu cefnogi yn eu hargyfwng. Hefyd, maent am inni weithredu yn gyfrifol. Ni fydd o fudd i’r diwydiant nac i’r cyhoedd os symudwn at bleidlais derfynol ar y mater cyn cael y cyfle i ystyried y dystiolaeth. Pa gorff cyfrifol a fyddai’n penderfynu heb edrych ar yr holl ystyriaethau?
in Welsh I, and many other Members, have a pretty good idea of the concerns of the countryside. I have had a number of meetings with farmers since being elected to the Assembly. They want us to act quickly. They want us to show that we, as an Assembly, support them in their crisis. They also want us to act responsibly. It will benefit neither the industry nor the public if we move to a final vote on the matter without having had the opportunity to consider the evidence. What responsible body would make a decision without looking at all the considerations?
Beth yw’r ffordd ymlaen? Nid yw pwerau’r Cynulliad yn dod i rym tan 1 Gorffennaf 1999. Mae yna gyfle, os derbyniwn y cynnig hwn, i’r Pwyllgor Amaethyddiaeth a Datblygu Gwledig ddechrau ei waith yr wythnos hon i sicrhau ein bod yn dechrau ar y broses o gymryd tystiolaeth.
in Welsh What is the way forward? The powers of the Assembly do not come into force until 1 July 1999. There is an opportunity, if we accept this motion, for the Agriculture and Rural Development Committee to start its work this week to ensure that we begin the process of taking evidence.
Hoffwn annog Aelodau’r Cynulliad i gefnogi’r cynnig hwn. Fel Cadeirydd y Pwyllgor hwnnw, yr wyf yn ymrwymo i ofyn i’m cyd-Aelodau gynnal cyfarfod cyn diwedd yr wythnos hon, i sicrhau ein bod yn dechrau’r ymchwiliad. Mae gan y Pwyllgor Iechyd a Gwasanaethau Cymdeithasol rôl bwysig. Gan fod adroddiadau a thystiolaeth feddygol i’w hystyried, mae’n fwriad gennym gynnal rhai sesiynau ar y cyd. Mae hynny’n golygu y bydd cydweithio, nid yn unig gyda Christine Gwyther, ond hefyd gyda Jane Hutt, Kirsty Williams ac aelodau’r ddau Bwyllgor. Mae’n bwysig mai’r Cynulliad sy’n gwneud y penderfyniad, wedi ystyried argymhellion y Pwyllgor. Unwaith y bydd y drefn wedi ei sefydlu, bydd pawb sydd â diddordeb yn y maes wedi cael cyfle i roi tystiolaeth.
in Welsh I encourage Members of the Assembly to support this motion. As Chairman of that Committee, I undertake to ask my fellow Members to hold a meeting before the end of this week, to ensure that we begin the inquiry. The Health and Social Services Committee has an important role. As there are reports and medical evidence to be considered, we intend to hold some sessions jointly. That means that there will be co-operation, not only with Christine Gwyther, but also with Jane Hutt, Kirsty Williams and the members of the two Committees. It is important that the Assembly makes the decision, after considering the Committee’s recommendations. Once the procedure is established, everyone who has an interest in this field will have had an opportunity to give evidence.
There is no doubt that most, if not all, Members wish to see the ban on beef on the bone lifted. Our agricultural industry has suffered a series of body blows in recent years. I am very conscious of the damage done to our rural economy by the BSE crisis and the subsequent ban on beef exports. Confidence needs to be restored in a sector that is important to farmers in Wales. After all, Wales is primarily a livestock producing country. We also produce the safest beef in the world and have rigorous controls on health and hygiene. Therefore, we must ensure that we promote our products to the full.
yn Saesneg Nid oes amheuaeth bod y rhan fwyaf, os nad y cwbl, o’r Aelodau yn dymuno gweld codi’r gwaharddiad ar gig eidion ar yr asgwrn. Mae ein diwydiant amaethyddol wedi dioddef un ergyd drom ar ôl y llall yn y blynyddoedd diwethaf hyn. Yr wyf yn ymwybodol iawn o’r difrod a wnaed i’n heconomi gwledig gan yr argyfwng BSE a’r gwaharddiad ar allforion cig eidion a’i dilynodd. Mae angen adfer hyder mewn sector sydd yn bwysig i ffermwyr yng Nghymru. Wedi’r cwbl, gwlad sy’n cynhyrchu da byw yw Cymru yn bennaf. Yr ydym hefyd yn cynhyrchu’r cig eidion mwyaf diogel yn y byd ac mae gennym reoliadau caeth ar iechyd a glanweithdra. Felly, rhaid inni sicrhau ein bod yn hybu ein cynhyrchion i’r eithaf.
We are also fortunate that the Assembly has the powers—if it chooses to exercise them—to lift the ban on beef on the bone. When the Prime Minister was challenged on that matter in the House of Commons, he said that that power was one of the inevitable consequences of devolution. The wonderful irony of the current situation is that those who opposed devolution now claim to be the biggest proponents of lifting the ban in Wales.
yn Saesneg Yr ydym hefyd yn ffodus bod gan y Cynulliad bwerau—os bydd yn dewis eu defnyddio—i godi’r gwaharddiad ar gig eidion ar yr asgwrn. Pan heriwyd y Prif Weinidog ar y mater hwnnw yn Nhŷ’r Cyffredin, dywedodd fod y pŵer hwnnw yn un o ganlyniadau anorfod datganoli. Eironi rhyfeddol y sefyllfa bresennol yw bod y rhai a oedd yn gwrthwynebu datganoli yn honni bellach mai hwy yw’r rhai sy’n dadlau gryfaf dros godi’r gwaharddiad yng Nghymru.
Now that we have the powers, let us use them responsibly. Let us show that we are not afraid of making decisions that are different from those taken in other countries of Britain. Let us also ensure that those decisions are taken after thorough examination of the facts. Let us make that decision as an Assembly that has the best interests of Wales at heart. The motion allows the Assembly as a whole to come to a decision based on recommendations made in Committee, which is an all-party one.
yn Saesneg Gan fod y pwerau gennym yn awr, gadewch inni eu defnyddio’n gyfrifol. Gadewch inni ddangos nad oes arnom ofn gwneud penderfyniadau sy’n wahanol i’r rhai a wneir yng ngwledydd eraill Prydain. Gadewch inni hefyd sicrhau y gwneir y penderfyniadau hynny ar ôl archwilio’r ffeithiau’n drwyadl. Gadewch inni wneud y penderfyniad hwnnw fel Cynulliad sydd yn gweithredu er budd Cymru. Mae’r cynnig yn caniatáu i’r Cynulliad cyfan ddod i benderfyniad ar sail argymhellion a wneir mewn Pwyllgor, sydd yn cynnwys yr holl bleidiau.
I call upon all Members to support the motion. It is the first substantive policy motion on which we are being asked to vote. Let us put aside our sectional interests and put the interests of all our constituents first.
yn Saesneg Galwaf ar yr holl Aelodau i gefnogi’r cynnig. Hwn yw’r cynnig polisi gwirioneddol cyntaf y gofynnir inni bleidleisio arno. Gadewch inni roi ein buddiannau adrannol o’r neilltu a rhoi buddiannau’n holl etholwyr yn gyntaf.
As a Liberal Democrat, it gives me great pleasure to state that a parliamentary question tabled on 21 April 1999 by my colleague Lembit Öpik established our right to make decisions on this matter in the Assembly. My colleague Mick Bates tabled the first motion in the National Assembly and, again, that drew attention to the issue that we are considering. Having won the ballot short debate, I had intended to give the Assembly the first opportunity to discuss beef on the bone. Last Thursday, the Business Secretary gave no clear indication about when this debate would be held. I would like to think that, by tabling my short debate, we have spurred him into action.
Pleser mawr i mi fel Democrat Rhyddfrydol yw datgan mai cwestiwn seneddol a gyflwynwyd ar 21 Ebrill 1999 gan fy nghyd-weithiwr Lembit Öpik a sefydlodd ein hawl i wneud penderfyniadau ar y mater hwn yn y Cynulliad. Fy nghyd-aelod Mick Bates a gyflwynodd y cynnig cyntaf yn y Cynulliad Cenedlaethol ac, unwaith eto, fe dynnodd hynny sylw at y mater sydd o dan ystyriaeth gennym. Wedi ennill y ddadl fer drwy dynnu tocyn, yr oeddwn wedi bwriadu rhoi’r cyfle cyntaf i’r Cynulliad drafod cig eidion ar yr asgwrn. Dydd Iau diwethaf, nid oedd y Trefnydd wedi nodi’n eglur pa bryd y cynhelid y ddadl hon. Carwn feddwl ein bod, drwy gyflwyno fy nadl fer, wedi ei symbylu i weithredu.
Advice from officials tells us that the week’s business is set in stone a week in advance. In this case, it was more a case of being set in sand. My motion served its purpose by giving us the opportunity to debate this issue at the earliest possible moment. I agree that the motion should be discussed by the Agriculture and Rural Development Committee. That is our preferred option. Discussion in that Committee will allow for sensible and considered decision making. The issue is too important to the people of Wales and the producers of Welsh beef to be used as a political football. The decision on it is too important to be made in a knee-jerk way. By referring the matter to Committee, I do not wish to see it being kicked into the long grass. Referring it to the Agriculture and Rural Development Committee does not mean that we will not make a decision, or defer making a decision until another place has done so. I welcome Ieuan’s assurance that he intends to begin this process immediately. My Conservative colleagues’ attempts this morning to try and stop the creation of the Agriculture and Rural Development Committee will delay that process.
Yn ôl cyngor gan swyddogion, mae busnes yr wythnos yn cael ei amserlenni’n bendant wythnos ymlaen llaw. Yn yr achos hwn, yr oedd yn debycach o fod wedi cael ei amserlenni’n amhendant. Mae fy nghynnig wedi cyflawni ei bwrpas drwy roi cyfle inni drafod y mater hwn ar y cyfle cyntaf posibl. Yr wyf yn cytuno y dylai’r cynnig gael ei drafod gan y Pwyllgor Amaethyddiaeth a Datblygu Gwledig. Dyna’r dewis fyddai orau gennym. Bydd trafod yn y Pwyllgor hwnnw yn caniatáu penderfynu mewn modd synhwyrol ac ystyriol. Mae’r mater yn rhy bwysig i bobl Cymru ac i gynhyrchwyr cig eidion Cymru i’w drin fel gêm wleidyddol. Mae’r penderfyniad arno yn rhy bwysig i’w wneud mewn modd difeddwl. Wrth gyfeirio’r mater i Bwyllgor, nid wyf am ei weld yn cael ei fwrw o’r neilltu. Nid yw cyfeirio’r mater i’r Pwyllgor Amaethyddiaeth a Datblygu Gwledig yn golygu na fyddwn yn gwneud penderfyniad, neu’n gohirio gwneud penderfyniad nes gwneir hynny mewn lle arall. Yr wyf yn falch o dderbyn sicrwydd gan Ieuan ei fod yn bwriadu dechrau’r broses hon ar unwaith. Bydd yr ymdrechion gan fy nghyd-aelodau Ceidwadol fore heddiw i geisio atal ffurfio’r Pwyllgor Amaethyddiaeth a Datblygu Gwledig yn gohirio’r broses honno.

I will not give way.
Nid wyf yn ildio.
We have talked a lot about evidence. The Committee will discuss evidence as it is presented. The evidence so far is clear. The measures put in place to control BSE have been, and continue to be, effective. They include the selective slaughter programme, the over-30-months scheme and the offspring cull.
Yr ydym wedi sôn llawer am dystiolaeth. Bydd y Pwyllgor yn trafod tystiolaeth fel y’i cyflwynir. Mae’r dystiolaeth hyd yn hyn yn eglur. Mae’r mesurau a sefydlwyd i reoli BSE wedi bod yn effeithiol, ac maent yn parhau felly. Maent yn cynnwys rhaglen lladd detholus, y cynllun dros 30 mis a’r didoliad ar ddisgynyddion.
People’s confidence in beef has been restored. We will eat 900,000 tonnes of beef in the UK this year. That returns us to 1995 consumption levels. There is a continued fall in the number of cattle that are affected by BSE. The risk posed to human health by dorsal root ganglia and bone marrow was first established by the SEAC report of 1997. Since then, there has been a subsequent SEAC report. We should remember that SEAC comprises independent scientific advisers. In December 1998, they concluded:
Adferwyd hyder pobl mewn cig eidion. Byddwn yn bwyta 900,000 o dunelli o gig eidion yn y DU eleni. Mae hynny’n mynd â ni yn ôl i’r lefelau bwyta yn 1995. Mae gostyngiad parhaus yn nifer y gwartheg a effeithir gan BSE. Roedd y perygl i iechyd dynol oddi wrth ganglia gwraidd y cefn a mêr esgyrn wedi ei sefydlu gyntaf gan adroddiad SEAC yn 1997. Cafwyd adroddiad dilynol gan SEAC ers hynny. Dylem gofio bod SEAC yn cynnwys ymgynghorwyr gwyddonol annibynnol. Yn Rhagfyr 1998, eu casgliad oedd:
‘the risk from dorsal root ganglia is… negligible in comparison to the possible risk earlier in the epidemic.’
‘mae’r perygl oddi wrth ganglia gwraidd y cefn…yn anwybyddadwy o’i gymharu â’r perygl posibl yn gynharach yn yr epidemig.’
That is the current evidence. The risk is negligible. Even Liam Donaldson, the Chief Medical Officer, admits that, as each month goes by, the risk decreases. Therefore, there is no need to wait for more reports for August. The evidence already exists. The risk is negligible. You are more likely to win the National Lottery jackpot three weeks in a row than to contract anything from eating infected beef. The possibility of infected beef entering the food chain is negligible.
Dyna’r dystiolaeth gyfredol. Mae’r perygl yn anwybyddadwy. Mae hyd yn oed Liam Donaldson, y Prif Swyddog Meddygol, yn cyfaddef bod y perygl yn lleihau fesul mis. Felly, nid oes angen disgwyl am ragor o adroddiadau ar gyfer Awst. Mae’r dystiolaeth yn bod eisoes. Mae’r perygl yn anwybyddadwy. Yr ydych yn fwy tebygol o ennill jacpot y Lotri Genedlaethol dair wythnos yn olynol nag o gael afiechyd drwy fwyta cig eidion a heintiwyd. Mae’r posibiliad y bydd cig eidion heintiedig yn dod i’r gadwyn fwyd yn anwybyddadwy.
SEAC has never instructed the Government to ban beef on the bone. It was one of a series of recommendations, and one of several actions that the Government could take. It also stated in 1997 and 1998 that the Government could give this information to the public and let the people decide.
Nid yw SEAC erioed wedi cyfarwyddo’r Llywodraeth i wahardd cig eidion ar yr asgwrn. Yr oedd yn un o gyfres o argymhellion, ac yn un o nifer o gamau y gallai’r Llywodraeth eu cymryd. Fe ddywedodd hefyd yn 1997 ac yn 1998 y gallai’r Llywodraeth roi’r wybodaeth hon i’r cyhoedd a gadael i’r bobl benderfynu.
Let the public choose whether they eat this material. We are constantly making choices that affect our health. We drive, we drink and we smoke. We use mobile phones and we eat genetically modified tomato paste. We are allowed to make those choices. I see no difference between that and giving Welsh consumers the choice of eating beef on the bone if they want to do so. We are faced with an example of the nanny state at its worst. I hope that this Assembly can lead the way in re-establishing people’s choice of what they eat. Today, the Liberal Democrats send a message to Welsh consumers that we trust them to make that choice.
Gadewch i’r cyhoedd ddewis a ydynt am fwyta’r deunydd hwn. Byddwn yn gwneud dewisiadau sy’n effeithio ar ein hiechyd drwy’r amser. Yr ydym yn gyrru, yr ydym yn yfed ac yr ydym yn ysmygu. Byddwn yn defnyddio ffôn symudol a byddwn yn bwyta past tomato a addaswyd yn enetig. Caniateir inni wneud y dewisiadau hynny. Ni welaf unrhyw wahaniaeth rhwng hynny a rhoi’r dewis i ddefnyddwyr Cymru fwyta cig eidion ar yr asgwrn os ydynt am wneud hynny. Yr ydym yn gweld un o’r enghreifftiau gwaethaf o wladwriaeth y nani. Gobeithiaf y bydd y Cynulliad hwn yn gallu arwain y ffordd wrth ailsefydlu dewis pobl ynghylch yr hyn y maent yn ei fwyta. Heddiw, mae’r Democratiaid Rhyddfrydol yn anfon neges at ddefnyddwyr Cymru sy’n dweud ein bod yn ymddiried ynddynt i wneud y dewis hwnnw.
We also send an important message to the Welsh farmers. We are committed to this vital sector of the rural community. Lifting the beef on the bone regulations is just one step in an important journey towards lifting all regulations on the export of beef, the acceptance of the date-based export scheme and winning back those vital overseas markets for our produce.
Yr ydym hefyd yn anfon neges bwysig at ffermwyr Cymru. Yr ydym wedi ymrwymo i’r sector hanfodol hwn yn y gymuned wledig. Bydd codi’r rheoliadau ar gig eidion ar yr asgwrn yn un cam ar daith bwysig tuag at godi’r holl reoliadau ar allforio cig eidion, derbyn y cynllun allforio ar sail dyddiad, ac ennill yn ôl y marchnadoedd tramor hanfodol hynny i’n cynnyrch.
I will withdraw my short debate motion later this afternoon. I hope the Agriculture and Rural Development Committee will not kick this opportunity into the long grass. We have an opportunity for sane, sensible, well-measured debate and early prompt action.
Byddaf yn tynnu’n ôl fy nghynnig am ddadl fer yn ddiweddarach y prynhawn hwn. Gobeithiaf na fydd y Pwyllgor Amaethyddiaeth a Datblygu Gwledig yn bwrw’r cyfle hwn o’r neilltu. Mae gennym gyfle i gael trafodaeth gall, synhwyrol a chytbwys, ac i weithredu’n fuan cyn hir.
In principle, we agree with the content of the motion, and I agree with many other comments that have been made. I particularly agree with the comments of the previous speaker about the importance of not kicking this issue into the long grass. It is important not to delay until Westminster decides it wants to lift the ban, and that delay is not used as a convenient way of taking the decision away from this Assembly.
Yr ydym yn cytuno, mewn egwyddor, â chynnwys y cynnig, a chytunaf â llawer o’r sylwadau eraill a wnaed. Cytunaf yn arbennig â sylwadau’r siaradwr blaenorol ynghylch pwysigrwydd peidio â bwrw’r mater hwn o’r neilltu. Mae’n bwysig peidio ag oedi hyd nes bydd San Steffan yn penderfynu ei fod am godi’r gwaharddiad, ac na ddefnyddir yr oedi hwnnw fel dull cyfleus i fynd â’r penderfyniad oddi wrth y Cynulliad hwn.
I campaigned on a promise during the Assembly election that I would do what I could in the Welsh Assembly to have the ban on beef on the bone lifted. Although I was aware of the scientific advice that there was an infinitesimal risk from eating beef on the bone, I also knew that when Jack Cunningham was Secretary of State for Agriculture, he had several options. One was to institute a ban. It was the bossiest, most nanny-state option, and we disagreed with his decision to take it.
Yn ystod yr etholiad i’r Cynulliad, yr oeddwn yn ymgyrchu ar sail addewid y byddwn yn gwneud y cwbl a allwn yng Nghynulliad Cymru i godi’r gwaharddiad ar gig eidion ar yr asgwrn. Er fy mod yn gwybod am y cyngor gwyddonol bod y mymryn lleiaf o berygl o fwyta cig eidion ar yr asgwrn, yr oeddwn hefyd yn gwybod bod gan Jack Cunningham nifer o ddewisiadau pan oedd yn Ysgrifennydd Gwladol dros Amaethyddiaeth. Un o’r rheini oedd cyflwyno gwaharddiad. Hwnnw oedd y dewis mwyaf awdurdodus a nodweddiadol o wladwriaeth y nani, ac yr oeddem yn anghytuno â’i benderfyniad i’w gymryd.
I made my judgements in the knowledge of all the factors that I mentioned. I am sure that the other parties that made the same promise as me to the livestock farmers and to the electorate during the election campaign also knew all the arguments. We decided that there was no case for the ban—there never was such a case.
Ffurfiais fy marn gan wybod yr holl ffactorau a grybwyllais. Yr wyf yn sicr bod y pleidiau eraill a rodwyd yr un addewid â mi i’r ffermwyr da byw i’r etholwyr yn ystod yr ymgyrch etholiadol hefyd yn gyfarwydd â’r holl ddadleuon. Yr oeddem wedi penderfynu nad oedd achos dros gadw’r gwaharddiad—ni fu’r fath achos erioed.
I have objected to the Business Statement twice in this Assembly. With the help of John Marek and others, including Kirsty Williams and the Liberal Democrats, we have forced beef on the bone onto the agenda. However, I am concerned that we are not dealing with the beef on the bone ban. This issue has become much more significant and now affects the credibility of this Assembly. We all know that the Assembly can lift the ban if it wishes. The people of Wales know that a majority of us said that we were in favour of lifting the ban, in the full knowledge of the infinitesimal risk that exists. They know we can do it, if we are prepared to make that decision. That would be very controversial in the United Kingdom, and brave here in Wales.
Yr wyf wedi gwrthwynebu’r Datganiad Busnes ddwywaith yn y Cynulliad hwn. Gyda help John Marek ac eraill, gan gynnwys Kirsty Williams a’r Democratiaid Rhyddfrydol, yr ydym wedi mynnu cael lle ar yr agenda i gig eidion ar yr asgwrn. Yr wyf yn bryderus, fodd bynnag, nad ydym yn ymdrin â’r gwaharddiad ar gig eidion ar yr asgwrn. Mae’r mater hwn wedi dod yn llawer pwysicach ac mae bellach yn effeithio ar hygrededd y Cynulliad hwn. Yr ydym oll yn gwybod bod y Cynulliad yn gallu codi’r gwaharddiad os yw’n dymuno. Mae pobl Cymru yn gwybod bod mwyafrif ohonom wedi dweud ein bod o blaid codi’r gwaharddiad, gan wybod yn iawn am y mymryn lleiaf o berygl sy’n bodoli. Fe wyddant y gallwn wneud hynny, os ydym yn barod i wneud y penderfyniad hwnnw. Byddai hynny’n ddadleuol iawn yn y Deyrnas Unedig, ac yn ddewr yma yng Nghymru.
If we decide to lift the ban, it will enable this Assembly to be seen as a body that can do things. It will greatly enhance its credibility. If we do not do it, and use delaying procedures and mechanisms until the United Kingdom Government makes a decision that affects the whole country, this Assembly will look like a Westminster poodle.
Os penderfynwn godi’r gwaharddiad, bydd modd i’r Cynulliad hwn gael ei weld fel corff sy’n gallu cyflawni pethau. Bydd yn hwb mawr i’w hygrededd. Os na wnawn hynny, ac os defnyddiwn weithdrefnau a mecanweithiau i oedi hyd nes bydd Llywodraeth y Deyrnas Unedig yn gwneud penderfyniad sy’n effeithio ar yr holl wlad, bydd y Cynulliad hwn yn ymddangos fel ci bach i San Steffan.
It is vital that we deal with this issue as quickly as possible. Therefore, I support the motion. However, will the Secretary fo Agriculture and Rural Development tell us what the timetable is. It worries me that the matter will go to a Committee, then to another Committee and so on, and that that will be used as a mechanism to delay making a decision that might embarrass the Westminster Government. We do not want that. There never was a case for this ban. The sooner we lift it, the better.
Mae’n holl bwysig inni ymdrin â’r mater hwn mor gyflym ag y bo modd. Felly, yr wyf yn cefnogi’r cynnig. Fodd bynnag, a yw’r Ysgrifennydd Amaethyddiaeth a Datblygu Gwledig yn fodlon dweud wrthym beth yw’r amserlen? Yr wyf yn poeni y bydd y mater yn mynd i Bwyllgor, wedyn i Bwyllgor arall ac yn y blaen, ac y defnyddir hynny fel mecanwaith i ohirio penderfyniad a allai beri annifyrrwch i’r Llywodraeth yn San Steffan. Nid ydym am i hynny ddigwydd. Ni fu dadl erioed dros y gwaharddiad hwn. Gorau po gyntaf y byddwn yn ei godi.
Before addressing the debate, I would like to give my best wishes to Christine Gwyther, and offer her my sincere congratulations on her appointment. We all understand how difficult her brief is. We all understand the importance of agriculture to our small country, and we all have a responsibility to work with Christine to ensure we address the problems of the industry and the countryside. She has my personal support in all her endeavours.
Cyn dod at y ddadl, hoffwn roi fy nymuniadau gorau i Christine Gwyther, a chynnig fy llongyfarchiadau cywiraf iddi ar ei phenodiad. Yr ydym oll yn deall pa mor anodd yw ei briff. Yr ydym oll yn deall pwysigrwydd amaethyddiaeth i’n gwlad fach ni, ac mae cyfrifoldeb arnom i gyd i weithio gyda Christine i sicrhau ein bod yn wynebu problemau’r diwydiant a chefn gwlad. Bydd yn cael fy nghefnogaeth bersonol i yn ei holl ymdrechion.
I think everyone agrees that we will have to face some tough decisions on two matters. However, first, I stress that there is consensus—everybody understands the importance of agriculture to the Welsh economy, and its importance in Britain. It is worth noting that agriculture is twice as important in Wales—in terms of employment and gross domestic product—as it is in the United Kingdom.
Credaf fod pawb yn cytuno y bydd rhaid inni wynebu rhai penderfyniadau anodd ar ddau fater. Yn gyntaf, fodd bynnag, yr wyf yn pwysleisio bod consensws—mae pawb yn deall pwysigrwydd amaethyddiaeth i economi Cymru, a’i phwysigrwydd ym Mhrydain. Mae’n werth nodi bod amaethyddiaeth ddwywaith yn bwysicach yng Nghymru—o ran cyflogaeth a chynnyrch mewnwladol crynswth—nag ydyw yn y Deyrnas Unedig.
The beef industry is worth about 25 per cent of that GDP. We all accept that it is an important part of economic life in Wales. We also accept that we need to lift the ban on beef on the bone as quickly as possible. So far so good; we have consensus. However, there are two matters about which we have to think long and hard, and I disagree with the last speaker and with Kirsty, although I am pleased to say that, probably for the first time in my life, I agree with a member of Plaid Cymru.
Mae’r diwydiant cig eidion yn werth tua 25 y cant o’r cynnyrch mewnwladol crynswth hwnnw. Yr ydym oll yn derbyn ei fod yn rhan bwysig o fywyd economaidd Cymru. Yr ydym hefyd yn derbyn y bydd rhaid inni godi’r gwaharddiad ar gig eidion ar yr asgwrn mor gyflym ag y bo modd. Hyd yn hyn, popeth yn iawn; mae gennym gonsensws. Fodd bynnag, mae dau fater y bydd rhaid inni feddwl yn hir ac yn galed yn eu cylch, ac yr wyf yn anghytuno â’r siaradwr diwethaf ac â Kirsty, er ei bod yn dda gennyf ddweud fy mod, efallai am y tro cyntaf yn fy mywyd, yn cytuno ag aelod o Blaid Cymru.
We must ask ourselves two questions. First, can we seriously consider taking a unilateral decision in Wales to lift the ban? Secondly, can we seriously consider making that decision in the light of conflicting medical evidence? Those are the questions we must ask.
Rhaid inni ofyn dau gwestiwn i ni’n hunain. Yn gyntaf, a allwn o ddifrif ystyried gwneud penderfyniad unochrog yng Nghymru i godi’r gwaharddiad? Yn ail, a allwn o ddifrif ystyried gwneud y penderfyniad hwnnw yng ngoleuni’r dystiolaeth feddygol anghyson? Dyna’r cwestiynau y bydd rhaid inni eu gofyn.
Glyn was right to say that we have the power to decide to lift the ban. However, it is not right to exercise the power to make a decision simply because we are empowered to do so. I argued for devolution for a very long time, because I wanted the opportunity for us in Wales to create Welsh solutions to Welsh problems. However, BSE is not a Welsh problem; it is a United Kingdom problem and a European problem. If the latest evidence from America is true, BSE is now an international problem. We should not make decisions in Wales and disregard their impact on our neighbours and our trading partners in Europe. That would be a false move.
Yr oedd Glyn yn iawn wrth ddweud bod y pŵer gennym i benderfynu codi’r gwaharddiad. Fodd bynnag, nid yw’n iawn arfer y pŵer i benderfynu ond am fod gennym yr awdurdod i wneud hynny. Dadleuais o blaid datganoli am gyfnod hir iawn, am fy mod am gael y cyfle i ni yng Nghymru greu atebion Cymreig i broblemau Cymreig. Fodd bynnag, nid problem Gymreig mo BSE; mae’n broblem i’r Deyrnas Unedig ac i Ewrop. Os yw’r dystiolaeth ddiweddaraf o America yn wir, mae BSE bellach yn broblem ryngwladol. Ni ddylem wneud penderfyniadau yng Nghymru ac anwybyddu eu heffaith ar ein cymdogion ac ar ein partneriaid masnachol yn Ewrop. Byddai hynny’n gam gwag.
The ban on beef on the bone is only one of several food safety measures made by successive British Governments. There are now more than 60 similar orders. The Assembly is empowered to lift about one third of the measures that Governments have introduced over the past 10 years to clean up the food chain and to make sure that the slaughtering process and the movement of stock is properly supervised. Are we seriously proposing to remove one of those orders, knowing that it creates a precedent? Are we seriously suggesting, given our common border with England and our trading arrangements with the European Union, that we set up a whole separate system of animal health and food production in Wales? I do not think we are. However, we must ask ourselves these questions.
Nid yw’r gwaharddiad ar gig eidion ar yr asgwrn yn ddim ond un o nifer o fesurau diogelwch bwyd a wnaed gan nifer o Lywodraethau Prydeinig ar ôl ei gilydd. Erbyn hyn, mae mwy na 60 o orchmynion tebyg. Mae awdurdod gan y Cynulliad i godi tua un rhan o dair o’r mesurau a gyflwynwyd gan Lywodraethau dros y 10 mlynedd diwethaf i lanhau’r gadwyn fwyd a sicrhau bod y prosesau lladd a symudiadau da byw yn cael eu goruchwylio’n iawn. A ydym o ddifrif yn bwriadu dileu un o’r gorchmynion hynny, gan wybod bod hynny’n creu cynsail? A ydym o ddifrif yn awgrymu, yng ngolwg y ffin yr ydym yn ei rhannu â Lloegr a’n trefniadau masnachu â’r Undeb Ewropeaidd, ein bod am sefydlu system hollol wahanol ar gyfer iechyd anifeiliaid a chynhyrchu bwyd yng Nghymru? Nid wyf yn credu ein bod. Fodd bynnag, rhaid inni ofyn y cwestiynau hyn i ni’n hunain.
I do not see the logic in saying that the first decision of the Assembly should not be to develop an imaginative, distinctive policy to tackle the problems of the Welsh countryside, but to use our powers as a battering ram against a policy decision that was made at the United Kingdom level and with which we do not happen to agree. I hope that the suggestion that we make this decision unilaterally will be put on the backburner. I support the proposal that this matter be referred to the Agriculture and Rural Development Committee. I am sure that its members will want to reflect not only on the medical and scientific advice, but on the wider implications of making a decision in Wales that will impact dramatically on the confidence that people throughout Europe have in Welsh agriculture.
Ni welaf y rhesymeg o ddweud na ddylai’r Cynulliad, fel ei benderfyniad cyntaf, ddatblygu polisi arbennig, creadigol i fynd i’r afael â phroblemau cefn gwlad Cymru, ond y dylem ddefnyddio ein pwerau yn lle hynny fel pastwn yn erbyn penderfyniad polisi a wnaed ar lefel y Deyrnas Unedig nad ydym yn digwydd cytuno ag ef. Gobeithiaf y rhoir o’r neilltu yr awgrym y dylem wneud y penderfyniad hwn yn unochrog. Yr wyf yn cefnogi’r cynnig y dylai’r mater hwn gael ei gyfeirio i’r Pwyllgor Amaethyddiaeth a Datblygu Gwledig. Yr wyf yn sicr y bydd ei aelodau am fyfyrio nid yn unig ar y cyngor meddygol a gwyddonol, ond hefyd ar y goblygiadau ehangach o wneud penderfyniad yng Nghymru a fydd yn effeithio’n drawiadol ar yr hyder sydd gan bobl drwy Ewrop yn amaethyddiaeth Cymru.
My second point is about medical advice. I was surprised and disappointed to hear Kirsty, who is Chair of the Health and Social Services Committee, suggest that we should set aside the medical evidence. We saw the appearance of BSE in this country in the mid-1980s. It was not until 1996 that the Government put in place measures that have successfully and comprehensively dealt with the problem. At every stage, Governments have made mistakes. They disregarded medical advice and the warnings given by the scientific and medical community. They preferred to take the view that the risk was minimal and to hope that things would work out. Of course, they did not. The BSE epidemic has cost taxpayers £4 billion, caused untold cost and distress to the farming community, led to 3 million cattle being slaughtered, disrupted our trading arrangements with the European Union and led to an international ban on exports from this country. It also caused the deaths of 40 people from new variant CJD. We do not know the potential extent of new variant CJD, yet we are told that we should disregard medical and scientific advice.
Mae’r ail bwynt sydd gennyf yn ymwneud â chyngor meddygol. Yr oeddwn wedi fy synnu a’m siomi o glywed Kirsty, sydd yn Gadeirydd y Pwyllgor Iechyd a Gwasanaethau Cymdeithasol, yn awgrymu y dylem roi’r dystiolaeth feddygol o’r neilltu. Gwelsom BSE yn ymddangos yn y wlad hon ar ganol y 1980au. Bu’n rhaid aros tan 1996 i’r Llywodraeth sefydlu mesurau sydd wedi ymdrin yn llwyddiannus ac yn gynhwysfawr â’r broblem. Mae Llywodraethau wedi gwneud camgymeriadau bob cam o’r ffordd. Yr oeddent wedi anwybyddu cyngor meddygol a’r rhybuddion gan y gymuned wyddonol a meddygol. Yr oedd yn well ganddynt gredu bod y perygl yn fach iawn a gobeithio y byddai pethau’n dod i drefn. Wrth gwrs, nid hynny a fu. Mae’r epidemig BSE wedi costio £4 biliwn i’r trethdalwyr, wedi achosi costau a gofid di-ben-draw i’r gymuned amaethyddol, wedi arwain at ladd 3 miliwn o wartheg, wedi amharu ar ein trefniadau masnachu â’r Undeb Ewropeaidd ac wedi arwain at waharddiad rhyngwladol ar allforion o’r wlad hon. Mae hefyd wedi achosi marwolaeth 40 o bobl o amrywiolyn newydd CJD. Ni wyddom beth yw ymlediad posibl amrywiolyn newydd CJD, ond fe ddywedir wrthym y dylem anwybyddu’r cyngor meddygol a gwyddonol.
Kirsty, you said much about the exercise of personal choice, and that the Chief Medical Officer did not instruct the Government to introduce a ban. The Chief Medical Officer cannot instruct anybody, but he can offer advice. In his report in January this year, he gave this advice about personal choice:
Kirsty, yr ydych wedi wedi dweud llawer am arfer dewis personol, a bod y Prif Swyddog Meddygol heb gyfarwyddo’r Llywodraeth i gyflwyno gwaharddiad. Ni all y Prif Swyddog Meddygol gyfarwyddo neb, ond fe all gynnig cyngor. Yn ei adroddiad yn Ionawr eleni, rhoddodd y cyngor hwn ar ddewis personol:
‘When considering a disease with no known cure, fatal consequences, an epidemic whose size is not yet known, and the exceptional circumstances in which the risk was created, it is difficult to seek equivalence with other levels of risk which people face in everyday life.’
‘Wrth ystyried afiechyd sydd heb unrhyw feddyginiaeth hysbys, canlyniadau marwol, epidemig na wyddys ei faint eto, a’r amgylchiadau eithriadol lle y creir y perygl, anodd yw ceisio cymharu hynny â lefelau perygl eraill a wynebir gan bobl yn eu bywyd bob dydd.’
In the light of that, the Chief Medical Officer made a very firm recommendation to the Government that the ban should be introduced and should remain in place.
Yng ngoleuni hynny, rhoddwyd argymhelliad cryf iawn i’r Llywodraeth gan y Prif Swyddog Meddygol y dylid cyflwyno’r gwaharddiad ac y dylai aros yn ei le.
You misunderstood my comments about the Chief Medical Officer’s advice and the advice from SEAC, the independent scientific body that was set up to advise the Government and the Chief Medical Officer. In 1997 and 1998, SEAC offered the Government a series of options. One option was introducing the ban, others included giving the public information and letting them decide for themselves. I did not state that the Chief Medical Officer made such a decision; SEAC, gave the options that I mentioned.
Yr ydych wedi camddeall fy sylwadau am gyngor y Prif Swyddog Meddygol a’r cyngor gan SEAC, y corff gwyddonol annibynnol a sefydlwyd i gynghori’r Llywodraeth a’r Prif Swyddog Meddygol. Yn 1997 ac 1998, cynigiodd SEAC gyfres o ddewisiadau i’r Llywodraeth. Un dewis oedd cyflwyno’r gwaharddiad, ymhlith y lleill yr oedd rhoi gwybodaeth i’r cyhoedd a gadael iddynt benderfynu drostynt eu hunain. Ni ddywedais fod y Prif Swyddog Meddygol wedi gwneud penderfyniad o’r fath; SEAC, a gynigiodd y dewisiadau a nodais.
I am very familiar with the work of SEAC. The Government established SEAC at my urging. I have read SEAC’s report and that of the Chief Medical Officer. It is the responsibility of the Department of Health, not SEAC, to advise the Government on how to respond to the medical recommendations. Fortunately, the controls that were introduced belatedly in 1996 are now taking effect. As a result of the 30-month ban introduced in August 1996, I hope that BSE will be eradicated in August this year. That is a strong reason for being prudent now. The Chief Medical Officer has recommended that the prospects are—
Yr wyf yn gyfarwydd iawn â gwaith SEAC. Sefydlwyd SEAC gan y Llywodraeth ar fy anogaeth i. Darllenais adroddiad SEAC ac un y Prif Swyddog Meddygol. Cyfrifoldeb yr Adran Iechyd, nid SEAC, yw cynghori’r Llywodraeth ynghylch sut i ymateb i’r argymhellion meddygol. Yn ffodus, mae’r rheoliadau a gyflwynwyd yn rhy hwyr yn 1996 bellach yn cael effaith. O ganlyniad i’r gwaharddiad 30-mis a gyflwynwyd yn Awst 1996, fy ngobaith yw y caiff BSE ei ddileu yn Awst eleni. Mae hynny’n ddadl gref dros fod yn bwyllog yn awr. Mae’r Prif Swyddog Meddygol wedi argymell bod y rhagolygon yn—
David Davies a gododd—
David Davies rose—
If the honourable Gentleman will allow me to finish my sentence, I will give way to him.
Os yw’r Bonheddwr anrhydeddus yn fodlon caniatáu imi fy mrawddeg, byddaf yn ildio iddo.
Dafydd Elis-Thomas The Presiding Officer spoken in English p. 40
Dafydd Elis-Thomas Y Llywydd siaradwyd yn Saesneg t. 40
David Davies is not an honourable Gentleman.
Nid Bonheddwr anrhydeddus mo David Davies.
We are all entitled to our own opinions. Are you instructing me that he is not an honourable Gentleman?
Pawb â’i farn. A ydych yn fy nghyfarwyddo nad ydyw’n Fonheddwr anrhydeddus?
Dafydd Elis-Thomas The Presiding Officer spoken in English p. 40
Dafydd Elis-Thomas Y Llywydd siaradwyd yn Saesneg t. 40
I am not instructing you on the morality of David Davies. However, in this Chamber we are not ‘honourable Gentlemen’.
Nid wyf yn eich cyfarwyddo ynghylch moesoldeb David Davies. Fodd bynnag, yn y Siambr hon, nid ‘Boneddigion anrhydeddus’ mohonom.
I will probably have to reassess my lifestyle then. It is probably just as well that we do not explore that at the moment. I will give way to David Davies shortly.
Mae’n debyg y bydd rhaid imi ailasesu fy ffordd o fyw felly. Mae’n debyg mai’r peth gorau fyddai inni beidio ag edrych ar hynny ar y funud. Byddaf yn ildio i Davies Davies ymhen ychydig.
We are now, in 1999, perhaps months away from the solution to BSE. The firm medical evidence is in favour of waiting. The review is underway and I hope that, in August, the Government will say that the ban can be removed. The ban would thus be removed in the context of a comprehensive solution to the problem of BSE. We must bear in mind that we have 60 other orders to tackle.
Mae’n bosibl ein bod bellach, yn 1999, ychydig fisoedd oddi wrth ddatrys BSE. Mae’r dystiolaeth feddygol bendant yn ffafrio disgwyl. Mae’r adolygiad yn mynd rhagddo a gobeithio, yn Awst, y bydd y Llywodraeth yn dweud y gellir codi’r gwaharddiad. Byddai’r gwaharddiad drwy hynny yn cael ei godi yng nghyd-destun ateb cynhwysfawr i broblem BSE. Rhaid inni gofio bod gennym 60 o orchmynion eraill i’w trafod.
Our objectives are clear. We want to protect human health—that is the most important consideration. We also want to eradicate BSE, to restore the confidence of producers and consumers, and to rebuild confidence in agriculture so that people who work in agriculture can look forward confidently to the future.
Mae ein hamcanion yn eglur. Yr ydym am warchod iechyd dynol—dyna’r ystyriaeth bwysicaf. Yr ydym hefyd am ddileu BSE, am adfer hyder cynhyrchwyr a defnyddwyr, ac am ailennyn hyder mewn amaethyddiaeth fel y gall y rhai sy’n gweithio mewn amaethyddiaeth edrych ymlaen yn hyderus i’r dyfodol.
If we make a precipitate decision now, exercising our powers in a way that is not particularly well thought through and flying in the face of the advice from the medical community, we will sow the seeds of future uncertainty, and create doubt in the minds of people who should have confidence in the British farming industry.
Os penderfynwn yn frysiog yn awr, a defnyddio’n pwerau heb ystyried yn fanwl, ac yn groes i gyngor y gymuned feddygol, byddwn yn hau hadau ansicrwydd at y dyfodol, ac yn creu amheuaeth ym meddyliau pobl a ddylai fod yn hyderus yn niwydiant amaethyddol Prydain.
Therefore, I support the recommendation that the Agriculture and Rural Development Committee consider this matter. However, I hope that they will be careful in presenting any recommendation to the Assembly. We should not act unilaterally, or in defiance of medical advice.
Felly, yr wyf yn cefnogi’r argymhelliad y dylai’r Pwyllgor Amaethyddiaeth a Datblygu Gwledig roi ystyriaeth i’r mater hwn. Gobeithiaf, fodd bynnag, y cymerant ofal wrth gyflwyno unrhyw argymhelliad i’r Cynulliad. Ni ddylem weithredu’n unochrog, nac yn groes i gyngor meddygol.
Mr Davies has urged us to wait and exercise caution in using our powers. It is well known that Mr Davies led the campaign for devolution, and it is fairly well known in this Chamber that I helped to lead the campaign against devolution.
Mae Mr Davies wedi’n hannog i aros ac arfer pwyll wrth ddefnyddio’n pwerau. Fe ŵyr bron pawb mai Mr Davies a arweiniodd yr ymgyrch dros ddatganoli, ac fe ŵyr nifer dda yn y Siambr hon fy mod wedi helpu i arwain yr ymgyrch yn erbyn datganoli.
How am I now to persuade a sceptical public—particularly in a rural area such as Monmouthshire—that the Assembly can be a positive thing if we are not going to exercise the powers that we have gained at some cost to the taxpayer. There is consensus that the ban should be lifted as soon as possible, and we have the powers to do so. That possibility will be realised on 1 July, and I urge everyone to make the most of devolution and get the ban lifted.
Sut y gallaf berswadio’r cyhoedd amheus—yn enwedig mewn ardal wledig fel Sir Fynwy—fod modd i’r Cynulliad fod yn beth cadarnhaol os nad ydym i ddefnyddio’r pwerau yr ydym wedi eu hennill ar gryn gost i’r trethdalwr. Ceir consensws y dylid codi’r gwaharddiad cyn gynted ag y bo modd, ac mae’r pwerau gennym i wneud hynny. Fe wireddir y posibiliad hwnnw ar 1 Gorffennaf, ac yr wyf yn annog pawb i fanteisio i’r eithaf ar ddatganoli a chodi’r gwaharddiad.
As a farmer, I have a straightforward message. The message in Welshpool market yesterday was—for goodness sake, get on with it. Therefore, I was pleased to hear Ieuan’s statement that the Agriculture and Rural Development Committee will meet this week. That is an excellent sign, because we have to deal with many other issues, such as the fall in income, the establishment of food processing, and adding value. We have so much to tackle in this fundamental industry for the rural economy.
Fel ffermwr, mae gennyf neges syml. Y neges ym marchnad y Trallwng ddoe oedd—er mwyn popeth, bwrwch iddi. Felly, yr oedd yn dda gennyf glywed datganiad Ieuan y bydd y Pwyllgor Amaethyddiaeth a Datblygu Gwledig yn cyfarfod yr wythnos hon. Mae hynny’n arwydd ardderchog, oherwydd bydd rhaid inni ymdrin â llawer o faterion eraill, fel y gostyngiad mewn incwm, sefydlu prosesu bwyd ac ychwanegu gwerth. Mae gennym gymaint i ymdrin ag ef yn y diwydiant sylfaenol hwn i’r economi gwledig.
I want to clarify some points that arose from the opening remarks. The Florence agreement on controlling BSE has been rigorously implemented, and, as Ron Davies pointed out, has been successfully and comprehensively eradicating this terrible disease from our industry. That is why I, along with Glyn and Kirsty, urge the speedy lifting of the ban.
Yr wyf am roi gwedd gliriach ar rai o’r pwyntiau a gododd o’r sylwadau agoriadol. Mae cytundeb Fflorens ar reoli BSE wedi ei weithredu’n drwyadl, ac, fel y nododd Ron Davies, mae wedi bod yn dileu’r afiechyd ofnadwy hwn o’n diwydiant mewn modd llwyddiannus a chynhwysfawr. Dyna pam yr wyf fi, ynghŷd â Glyn a Kirsty, yn annog codi’r gwharddiad yn fuan.
Consumers are given a choice about other aspects of health. We are very concerned about public safety, but there is a choice. This ridiculous and stupid regulation has done our industry much harm. The SEAC regulations did not demand the imposition of such a regulation. Protective regulations, more than any others, have done the industry a lot of good in the eyes of the consumer. I urge you all to pressurise the Agriculture and Rural Development Committee to do its work effectively and quickly.
Rhoddir dewis i ddefnyddwyr ynghylch agweddau eraill ar iechyd. Yr ydym yn bryderus iawn ynghylch diogelwch y cyhoedd, ond y mae dewis ar gael. Mae’r rheoliad dwl a chwerthinllyd hwn wedi gwneud llawer o niwed i’n diwydiant. Nid oedd rheoliadau SEAC yn mynnu gosod rheoliad o’r fath. Mae rheoliadau amddiffynnol, yn fwy nag unrhyw rai eraill, wedi gwneud llawer o les i’r diwydiant yng ngolwg y defnyddiwr. Yr wyf yn annog pawb ohonoch i bwyso ar y Pwyllgor Amaethyddiaeth a Datblygu Gwledig i wneud ei waith yn effeithiol ac yn gyflym.
The selective cull, the over-30-months scheme, has meant that our industry is safe. I am a farmer, and I can tell you of the misery being caused to our industry. This Assembly should take its powers seriously, and give a great boost to the industry. Farmers need to be told that we care. They need to see the support of this Assembly for their industry. Therefore, I support the motion, but let us have a sense of urgency. Let us make sure that we move forward, and that our powers can give confidence to our industry.
Mae’r didoliad detholiadol, y cynllun dros-30-mis, yn golygu bod ein diwydiant yn ddiogel. Ffermwr ydwyf fi, ac yr wyf yn gwybod am y gofid a achosir i’n diwydiant. Dylai’r Cynulliad hwn gymryd ei bwerau o ddifrif, a rhoi hwb mawr i’r diwydiant. Rhaid dweud wrth y ffermwyr bod hyn o bwys i ni. Rhaid iddynt weld cefnogaeth y Cynulliad hwn i’w diwydiant. Felly, yr wyf yn cefnogi’r cynnig, ond gadewch inni fod yn ymwybodol o’r angen am frys. Gadewch inni sicrhau ein bod yn symud ymlaen, a bod ein pwerau yn gallu rhoi hyder i’n diwydiant.
The lifting of the export ban, and Wales’ return to the export market depends on our lifting the ban of meat on the bone. I was at the Blackpool conference last year, lobbying the Labour Party on that issue. I was asked to attend by exporters, who said that the ban of meat on the bone had to be lifted as a priority. It must be made absolutely clear that we will not progress until we lift this ban.
Mae codi’r gwaharddiad ar allforion, a gallu Cymru i ailafael yn y farchnad allforion yn dibynnu ar ein penderfyniad i godi’r gwaharddiad ar gig ar yr asgwrn. Yr oeddwn yng nghynhadledd Blackpool y llynedd, yn pwyso ar y Blaid Lafur ar y mater hwnnw. Yr allforwyr oedd wedi gofyn imi fynd yno, a’u barn hwy oedd bod rhaid rhoi blaenoriaeth i godi’r gwaharddiad ar gig ar yr asgwrn. Rhaid dweud yn gwbl eglur na fyddwn yn gallu symud ymlaen nes codwn y gwaharddiad hwn.
Has Peter Rogers noticed the sad reimposition of the beef export ban on Northern Ireland, which was the only part of the United Kingdom where the beef export ban had been lifted? However, it has now been reimposed overnight. There are European Commission meat inspectors in Belfast at the moment, discussing the problems caused by the breakdown of their computerised cattle-tracing scheme. As a result, the beef export ban has now been reimposed in Northern Ireland.
A yw Peter Rogers wedi sylwi bod y gwaharddiad ar allforio cig eidion o Ogledd Iwerddon wedi ei ailgyflwyno, gwaetha’r modd, ac mai honno oedd yr unig ran o’r Deyrnas Unedig lle’r oedd y gwaharddiad ar allforio cig eidion wedi ei godi? Fodd bynnag, mae wedi ei ailgyflwyno dros nos. Mae arolygwyr cig y Comisiwn Ewropeaidd yn Belfast ar hyn o bryd, yn trafod y problemau a achoswyd gan fethiant eu cynllun olrhain gwartheg cyfrifiadurol. O ganlyniad i hynny, mae’r gwaharddiad ar allforio cig eidion bellach wedi ei ailgyflwyno yng Ngogledd Iwerddon.
I was not aware that it had been reimposed, but I was aware that there had been a breakdown, and that there were some missing cattle. It is important that we get the ban on meat on the bone lifted so that we can get back into the export markets.
Ni wyddwn ei fod wedi ei ailgyflwyno, ond yr oeddwn yn gwybod am y methiant, a bod rhai gwartheg ar goll. Mae’n bwysig inni gael codi’r gwaharddiad ar gig ar yr asgwrn fel y gallwn ddod yn rhan o’r marchnadoedd allforion eto.
Another problem for Welsh agriculture is the great groan against the supermarkets. Until we can get a third player into the market place, to compete for exports and get into Europe and the world, we are going to have to put up with that. There are not enough buyers in the market place. That is a critical problem that we must tackle.
Problem arall i amaethyddiaeth Cymru yw’r gŵyn fawr yn erbyn yr archfarchnadoedd. Hyd nes y cawn drydydd chwaraewr yn y farchnad, i gystadlu am allforion a chael mynediad i Ewrop a’r byd, bydd rhaid inni ddioddef hynny. Nid oes digon o brynwyr yn y farchnad. Mae hynny’n broblem allwedol y bydd rhaid inni fynd i’r afael â hi.
It is also very encouraging that, despite the ban, and despite the rumours, meat-eating in this country has returned to pre-BSE levels. The British consumer has regained confidence in our product. That is very important. We know that this law has been flouted all over the country. We all know people who eat meat on the bone. Therefore, the ban is one of the silliest laws in place. With our powers, we should do something about it.
Mae hefyd yn galonogol, er gwaethaf y gwaharddiad, ac er gwaethaf y sïon, fod bwyta cig yn y wlad hon wedi dychwelyd at y lefelau cyn BSE. Mae’r defnyddiwr Prydeinig wedi adennill ei hyder yn ein cynnyrch. Mae hynny’n bwysig iawn. Gwyddom fod y ddeddf hon wedi ei herio ym mhob rhan o’r wlad. Yr ydym oll yn adnabod pobl sy’n bwyta cig ar yr asgwrn. Felly, y gwaharddiad hwn yw un o’r deddfau gwirionaf mewn grym. Gyda’r pwerau sydd gennym, dylem wneud rhywbeth ynghylch hynny.
One of the three principal recommendations from the SEAC report was that people should be made aware of the minute risk. We have already heard the comparison with winning the lottery three times. There is a one-in-a-billion chance of being at risk through eating meat on the bone. There is a one in 200 chance of contracting cancer and possibly dying if you smoke 20 cigarettes a day.
Un o’r tri phrif argymhelliad yn adroddiad SEAC oedd y dylid rhoi gwybod i bobl am y perygl bychan iawn. Yr ydym eisoes wedi clywed cymhariaeth ag ennill y lotri dair gwaith. Mae tebygolrwydd o un mewn biliwn o fod mewn perygl drwy fwyta cig ar yr asgwrn. Mae tebygolrwydd o un mewn 200 o gael canser a marw efallai os ysmygwch 20 o sigarennau’r dydd.
We are lucky that beef production in Wales is geared very much towards grass-fed cattle. There has not been enough understanding of, or research on, Welsh beef production to justify these bans. We should inform people of the minute risk, and let them decide. People will then see that we have the best and the safest beef in the world.
Yr ydym yn ffodus bod cynhyrchu cig eidion yng Nghymru yn gysylltiedig yn bennaf â gwartheg a borthir â glaswellt. Ni chafwyd digon o ddealltwriaeth am gynhyrchu cig eidion yng Nghymru, nac o ymchwil, i gyfiawnhau’r gwaharddiadau hyn. Dylem roi gwybod i bobl am y perygl bychan iawn, a gadael iddynt benderfynu. Wedyn bydd pobl yn gweld mai gennym ni y mae’r cig eidion gorau a mwyaf diogel yn y byd.
Devolution has given Wales its best chance to show that we have got teeth, not only for eating meat, but to lift this ban. We must listen to the debate on lifting the ban, and give the Welsh rural communities a real chance of survival.
Mae datganoli wedi rhoi’r cyfle gorau i Gymru ddangos bod ganddi ddannedd, nid yn unig i fwyta cig, ond i godi’r gwaharddiad hwn. Rhaid inni wrando ar y ddadl ar godi’r gwaharddiad, a rhoi cyfle gwirioneddol i gymunedau gwledig Cymru gael goroesi.
Kirsty Williams said that the evidence that would allow us to make a decision was clear. The advice—SEAC’s report and the Chief Medical Officer’s statements—is based on a number of suppositions, postulates and hypotheses, which have yet to be proven to be true.
Dywedodd Kirsty Williams fod y dystiolaeth a fyddai’n caniatáu inni benderfynu yn eglur. Mae’r cyngor—adroddiad SEAC a datganiadau’r Prif Swyddog Meddygol—yn seiliedig ar nifer o dybiaethau, cynosodiadau a damcaniaethau, sydd eto i’w profi.
As with all other biological science issues, there is an element of uncertainty until we have the evidence. An example of such uncertainty is maternal transmission of BSE. Empirical evidence of how well the guidelines are being adhered to in meat processing is vital, as is establishing the rigorousness of the evidence on the infectiveness of dorsal root ganglia.
Yn yr un modd â phob mater arall sy’n ymwneud â’r gwyddorau biolegol, geir elfen o ansicrwydd hyd nes bydd y dystiolaeth gennym. Un enghraifft o ansicrwydd o’r fath yw trosglwyddo BSE drwy’r fam. Mae’n holl bwysig cael tystiolaeth empiraidd am y graddau y cedwir at y canllawiau wrth brosesu cig, a hefyd sefydlu pa mor gadarn yw’r dystiolaeth am natur heintus ganglia gwraidd y cefn.
A number of factors should be taken into account and we are still in the process of looking at the evidence to see if the advice on which we are operating is borne out in practice. People who ask for more time before making up their minds on the matter do so in order to examine the evidence coming in, and thereby to ascertain whether we are being given the proper advice. The advice and evidence that we receive suggests that the risk is approximately one in a million or one in ten million.
Dylid rhoi ystyriaeth i nifer o ffactorau ac yr ydym yn dal i edrych ar y dystiolaeth i weld a yw’r cyngor yr ydym yn ei ddilyn yn cael ei gadarnhau mewn ymarfer. Mae pobl sy’n gofyn am fwy o amser cyn penderfynu yn gwneud hynny er mwyn cael archwilio’r dystiolaeth sy’n dod i mewn, a thrwy hynny canfod a ydym yn derbyn y cyngor priodol. Mae’r cyngor a’r dystiolaeth yr ydym yn eu derbyn yn awgrymu bod y perygl tua un mewn miliwn neu un mewn deng miliwn.
We allow people to decide whether or not to continue to use products such as tobacco. Why should a particular test be applied to beef on the bone, when it is not applied to nearly every other product in the pharmaceutical world? Presumably, if that test was applied, many common drugs would not be prescribed.
Yr ydym yn caniatáu i bobl benderfynu a ydynt am barhau i ddefnyddio cynhyrchion fel tybaco. Pam y dylid cymhwyso prawf penodol at gig eidion ar yr asgwrn, pan na chymhwysir hynny at bron bob cynnyrch arall ym maes fferylliaeth? Mae’n debyg, pe bai’r prawf yn cael ei gymhwyso atynt, y byddai llawer o gyffuriau cyffredin yn peidio â chael eu rhagnodi.
That is a good point with which I do not disagree. However, I believe that Ron Davies answered David Melding’s question earlier in the discussion. There are so many questions about BSE and the new variant CJD, that we simply do not know all the answers. Potentially, we are sitting on a time bomb—we have no information about matters such as the incubation period. The jury is out on this issue. However, today we are considering a specific issue—lifting the ban on beef on the bone. If the evidence that the risk is one in a million, one in 6 million or one in 10 million is true, I believe that it is reasonable to allow consumers to decide, and I would support lifting the ban. However, we must obtain the evidence to confirm that the risk is very small before we decide. On that basis, I support the resolution.
Mae hynny’n bwynt da ac nid wyf yn anghytuno ag ef. Fodd bynnag, credaf fod Ron Davies wedi ateb cwestiwn David Melding yn gynharach yn y drafodaeth. Mae cymaint o gwestiynau ynghylch BSE a’r amrywiolyn newydd CJD, fel na wyddom yr holl atebion. Mae’n bosibl bod trychineb yn ein disgwyl—nid oes gennym unrhyw wybodaeth am faterion fel y cyfnod heintus. Yr ydym yn dal i ddisgwyl y dyfarniad ar y mater hwn. Heddiw, fodd bynnag, yr ydym yn ystyried mater penodol—codi’r gwaharddiad ar gig eidion ar yr asgwrn. Os mai gwir yw’r dystiolaeth bod y perygl yn un mewn miliwn, yn un mewn 6 miliwn neu’n un mewn 10 miliwn, credaf ei bod yn rhesymol i adael i’r defnyddwyr benderfynu, a byddwn yn cefnogi codi’r gwaharddiad. Fodd bynnag, rhaid inni gael y dystiolaeth i gadarnhau bod y perygl yn fychan iawn cyn penderfynu. Ar y sail honno, yr wyf yn cefnogi’r cynnig.
I wish to support this motion and make a few points. I have listened to several Members in the Chamber stating that lifting the ban on beef on the bone would free consumers to make individual choices in the same way that they choose to buy a packet of cigarettes or drive a fast sports car. That is daft and dangerous reasoning. I shall give two reasons to show why it is such a silly point.
Carwn gefnogi’r cynnig hwn a gwneud ychydig o bwyntiau. Yr wyf wedi clywed sawl Aelod yn y Siambr hon yn dweud y byddai codi’r gwaharddiad ar gig eidion ar yr asgwrn yn caniatáu i ddefnyddwyr wneud dewisiadau unigol yn yr un modd ag y maent yn dewis prynu pecyn o sigarennau neu yrru gar cyflym. Rhesymu gwirion a pheryglus yw hynny. Rhof ddau reswm i ddangos pam y mae’n bwynt mor wirion.
First, we live in a society that consumes a great deal of processed food and people may not be sure about the exact origin of a piece of meat that might be included in the ingredients. Processed food is primarily consumed by the poorest and most vulnerable people in our society. Children constitute a second group that does not have a choice about whether to drive a sports car. They rely on their parents, guardians or school canteen to provide them with food that is safe. They cannot make individual choices about the ingredients in the food that they eat. Some Members have made a silly sixth-form debating point, which has no place in this Chamber, or in the real world, where people have died of CJD in the most horrible way. It is not just the rights of producers that are important in this debate, but also the rights of consumers—every man, woman and child in Wales, Europe and the world.
Yn gyntaf, yr ydym yn byw mewn cymdeithas sy’n defnyddio llawer iawn o fwyd proses ac mae’n bosibl na fydd pobl yn sicr ynghylch union darddiad darn o gig a allai fod ymhlith y cynhwysion. Mae bwyd proses yn cael ei fwyta’n bennaf gan y bobl dlotaf a mwyaf agored i niwed yn ein cymdeithas. Mae plant yn ail grŵp nad oes ganddynt ddewis ynghylch a ydynt am yrru gar cyflym. Maent yn dibynnu ar eu rhieni, eu gwarcheidwaid neu ffreutur yr ysgol i ddarparu bwyd diogel ar eu cyfer. Ni allant wneud dewisiadau unigol ynghylch y cynhwysion yn y bwyd y maent yn ei fwyta. Mae rhai Aelodau wedi gwneud pwynt gwirion, yn nodweddiadol o ddadl chweched dosbarth, nad oes le iddo yn y Siambr hon, nac yn y byd go-iawn, lle y mae pobl wedi marw o CJD yn y modd mwyaf ofnadwy. Nid hawliau’r cynhyrchwyr yw’r unig beth sydd o bwys yn y ddadl hon, ond hefyd hawliau defnyddwyr—pob dyn, benyw a phlentyn yng Nghymru, Ewrop a’r byd.
To reinstate confidence in beef exports from Wales, consumers must be confident about Welsh beef. Unless consumers are confident, the producers have no market. This is not the place to play games with people’s health before receiving proper medical evidence on a subject about which we do not have the full facts. We should not play games with the credibility of this Assembly in order to grab a few headlines.
Er mwyn ailennyn hyder mewn allforion cig eidion o Gymru, rhaid i ddefnyddwyr fod yn hyderus ynghylch cig eidion Cymru. Oni bai fod y defnyddwyr yn hyderus, ni fydd marchnad i’r cynhyrchwyr. Nid dyma’r lle i chwarae â iechyd pobl cyn derbyn tystiolaeth feddygol briodol ar bwnc na wyddom yr holl ffeithiau amdano. Ni ddylem chwarae â hygrededd y Cynulliad hwn er mwyn cael ychydig o benawdau yn y wasg.
I never thought I would see Welsh politics turned on its head in the way that has happened in this Chamber today. My Conservative colleagues have suddenly become great proponents of devolution. That demonstrates the new politics of Wales. As somebody who campaigned in the ‘yes’ campaign, I did not support the establishment of an Assembly that would make hasty decisions nakedly to court publicity. It is important that we make considered decisions here. Nothing would affect the credibility of this Assembly more than making decisions without considering them properly. This crisis occurred because of the inaction of the Westminster Government in the late 1980s. We must not fall into that trap. Inaction by successive Agriculture Ministers produced an à la carte pig’s breakfast. Those Agriculture Ministers were all meat eaters. The Assembly must weigh up the evidence. We will do that in the Agriculture and Rural Development Committee. Those who want to make a quick decision are the sort of people who, if they were in charge of the criminal justice system, would be lynching people instead of holding trials. We must consider all the evidence and make a proper decision.
Ni feddyliais erioed y byddwn yn gweld gwleidyddiaeth Cymru wedi ei throi ar ei phen fel y gwnaed yn y Siambr hon heddiw. Yn sydyn iawn, mae fy nghyd-aelodau Ceidwadol wedi dod yn bleidwyr mawr dros ddatganoli. Mae hynny’n dangos y wleidyddiaeth newydd sydd yng Nghymru. Fel rhywun a ymgyrchodd yn yr ymgyrch ‘ie’, nid oeddwn am gefnogi sefydlu Cynulliad a fyddai’n brysio i wneud penderfyniadau er mwyn ceisio ennill cyhoeddusrwydd. Mae’n bwysig inni wneud penderfyniadau ystyriol yma. Ni fyddai dim yn effeithio mwy ar hygrededd y Cynulliad hwn na phenderfyniadau sydd heb eu hystyried yn briodol. Digwyddodd yr argyfwng hwn oherwydd diffyg gweithredu Llywodraeth San Steffan yn hwyr yn y 1980au. Rhaid inni beidio â syrthio i’r fagl honno. Yr oedd diffyg gweithredu gan sawl Gweinidog Amaeth ar ôl ei gilydd wedi creu llanast gwirioneddol. Yr oedd pob un o’r Gweinidogion Amaeth hynny yn bwyta cig. Rhaid i’r Cynulliad bwyso a mesur y dystiolaeth. Fe wnawn hynny yn y Pwyllgor Amaethyddiaeth a Datblygu Gwledig. Y rhai sydd am benderfynu’n sydyn yw’r math o bobl a fyddai, pe baent yn gyfrifol am y system cyfiawnder troseddol, yn crogi pobl yn lle cynnal achosion llys. Rhaid inni ystyried yr holl dystiolaeth a dod i benderfyniad priodol.
I agree with some of the points that my colleagues on the right have made. It is important that confidence in our Welsh produce is increased. However, the last thing we want is for the ban to be lifted and for there to be another public health scare about beef on the bone. That is the worst possible way of promoting our beef abroad and in the rest of the UK. Farmers deserve a break. We should consider the situation properly and examine all the evidence before deciding to lift this ban. The best message we can give is that, having considered all the evidence, we might be in a position to lift the beef on the bone ban. That is the way to restore consumers’ confidence. We must ensure that we have considered the matter properly, rather than making a hasty decision that might have serious consequences for the farming industry in the future.
Cytunaf â rhai o’r pwyntiau a wnaed gan fy nghyd-aelodau ar y dde i mi. Mae’n bwysig cynyddu hyder yng nghynnyrch Cymru. Fodd bynnag, y peth olaf yr ydym am ei weld yw codi’r gwaharddiad ac wedyn cael bygythiad newydd i iechyd cyhoeddus oherwydd cig eidion ar yr asgwrn. Dyna’r ffordd waethaf posibl i hybu ein cig eidion dramor ac yng ngweddill y DU. Mae ffermwyr yn haeddu tro lwcus. Dylem ystyried y sefyllfa yn iawn ac archwilio’r holl dystiolaeth cyn penderfynu codi’r gwaharddiad hwn. Y neges orau y gallwn ei rhoi, ar ôl ystyried yr holl dystiolaeth, yw y gallem fod mewn sefyllfa i godi’r gwaharddiad ar gig eidion ar yr asgwrn. Dyna’r ffordd i adfer hyder y defnyddwyr. Rhaid inni sicrhau ein bod wedi ystyried y mater yn iawn, yn hytrach na dod i benderfyniad sydyn a allai gael effeithiau difrifol ar y diwydiant amaethyddol yn y dyfodol.
Carwn ddiolch i bawb sydd wedi cyfrannu at y drafodaeth bwysig hon. Rhaid ystyried y mater cyn gynted ag y bo modd. Mae dwy elfen yn haeddu ystyriaeth. Yn gyntaf, rhaid inni gael penderfyniad buan. Yn seicolegol, mae angen penderfyniad buan ar y diwydiant amaethyddol yng Nghymru. Byddai hynny yn dangos ein hyder yn y diwydiant hwnnw a’r ffaith ein bod yn hyderus ei fod yn cynhyrchu’r deunydd gorau posibl i’r safon uchaf posibl a’i fod yn ddiogel i’w fwyta.
I wish to thank everybody who has contributed to this important discussion. The matter must be considered as soon as possible. Two elements deserve consideration. First, we must come to an early decision. Psychologically, the agricultural industry in Wales needs an early decision. That would show our confidence in that industry and the fact that we are confident that it is producing the best possible produce to the highest possible standard and that it is safe to eat.
Yr ail elfen yw’r angen i drafod y mater hwn mewn ffordd gyfrifol a chynhwysfawr, gan ystyried yr holl dystiolaeth sydd ar gael. Pe na fyddem yn gwneud hynny, byddem yn gwneud cam mawr â’r pwnc. Nid wyf yn ceisio osgoi dod i benderfyniad. Fel y mae Ieuan wedi dweud, mae’n bosibl y bydd y Pwyllgor Amaethyddiaeth a Datblygu Gwledig yn cyfarfod yr wythnos hon i ddechrau ar y trafodaethau hynny. Y peth pwysig yw bod y Cynulliad wedi cymryd y camau cyntaf i drafod y mater hwn. Gobeithiaf yn fawr mai’r Cynulliad a fydd yn gwneud y penderfyniad cyntaf, ond nid yw hynny yn fy mhoeni yn ormodol. Os bydd y trafodaethau yn y lle hwn yn gorfodi pobl mewn lle arall i ddod i benderfyniad, byddaf fi a’r diwydiant amaethyddol yng Nghymru yn ddiolchgar am hynny. Mae’n bwysig ein bod yn rhoi cyfle i bobl sydd wedi codi cwestiynau pwysig y prynhawn yma i ystyried yr holl dystiolaeth. Ar ddiwedd y broses honno a chyn gynted â phosibl, yr wyf yn hyderus y bydd y Pwyllgor Amaethyddiaeth a Datblygu Gwledig a’r Pwyllgor Iechyd a Gwasanaethau Cymdeithasol yn argymell bod y Cynulliad yn codi’r gwaharddiad. Mae’n bwysig ein bod yn symud mor gyflym ag y gallwn i ddechrau’r broses honno, a’n bod yn symud gyda’n gilydd i sicrhau penderfyniad ag iddo hygrededd.
The second element is the need for responsible and comprehensive discussion on this matter, considering all the evidence available. If we did not do that, we would be doing the subject a great injustice. I am not trying to avoid a decision. As Ieuan said, it is possible that the Agriculture and Rural Development Committee will meet this week to begin those discussions. The important thing is that the Assembly has taken the first steps towards discussing this matter. I very much hope that the Assembly will take the first decision, but that does not worry me greatly. If our discussions force people in another place to make a decision, I and the Welsh agricultural industry will be grateful. It is important that we give people who have raised important questions this afternoon the opportunity to consider all the evidence. At the end of that process and as soon as possible, I am confident that the Agriculture and Rural Development Committee and the Health and Social Services Committee will make a recommendation to the Assembly to lift the ban. It is important that we act as swiftly as possible to start that process, and we should move in unison to ensure a credible decision.

It is an important moment in the birth of the new National Assembly to have this debate, which has attracted such widespread interest. I am honoured to play my part in responding to this debate.
Mae’n adeg bwysig yng ngenedigaeth y Cynulliad Cenedlaethol newydd i gael y ddadl hon, sydd wedi denu cymaint o sylw. Braint i mi yw cael chwarae fy rhan wrth ymateb i’r ddadl hon.
I thank the Secretary for Agriculture and Rural Development, Christine Gwyther, and Ieuan Wyn Jones for moving the motion so that the Agriculture and Rural Development Committee and other Committees can consider this in great detail and conduct an urgent inquiry into the earliest possible removal of the ban on beef on the bone. I also thank those people who have recognised the sensitivity and importance of this issue in their speeches. You have highlighted the widespread support in this Chamber for lifting the ban and the importance of the Assembly acting as quickly as possible. We take that point on board in the interests of the agricultural industry in Wales. It does not hold water for David Davies to talk about making the most of devolution. He campaigned against it, so how can he expect us to respect him in trying to push through irresponsible quick-fix discussions and decisions that undermine the dignity of this Assembly? I represent the Vale of Glamorgan, which has a strong farming community. I spent time during the election campaign with Vale farming families, many of whom are going through a very difficult period and I understand their needs and concerns.
Yr wyf yn diolch i’r Ysgrifennydd Amaethyddiaeth a Datblygu Gwledig, Christine Gwyther, ac i Ieuan Wyn Jones am roi’r cynnig gerbron fel y gall y Pwyllgor Amaethyddiaeth a Datblygu Gwledig a Phwyllgorau eraill roi ystyriaeth fanwl iawn i hyn a chynnal ymchwiliad brys i godi’r gwaharddiad ar gig eidion ar yr asgwrn ar y cyfle cyntaf posibl. Yr wyf yn diolch hefyd i’r bobl hynny a gydnabu sensitifrwydd a phwysigrwydd y mater hwn yn eu hareithiau. Yr ydych wedi tynnu sylw at y gefnogaeth eang sydd yn y Siambr hon i godi’r gwaharddiad a pha mor bwysig ydyw i’r Cynulliad weithredu mor gyflym ag y bo modd. Yr ydym yn derbyn y pwynt hwnnw er mwyn buddiannau’r diwydiant amaethyddol yng Nghymru. Nid yw’r hyn a ddywedodd David Davies am fanteisio i’r eithaf ar ddatganoli yn dal dŵr. Fe ymgyrchodd yn ei erbyn, felly sut y gall ddisgwyl inni ei barchu wrth iddo geisio gyrru drwodd drafodaethau a phenderfyniadau anghyfrifol ac anystyriol sy’n tanseilio urddas y Cynulliad hwn? Yr wyf yn cynrychioli Bro Morgannwg, sydd â chymuned amaethyddol gref. Treuliais amser yn ystod yr ymgyrch etholiadol gyda theuluoedd amaethyddol yn y Fro, lawer ohonynt yn mynd drwy gyfnod anodd iawn ac yr wyf yn deall eu hanghenion a’u pryderon.
This debate is important for the future of farming in Wales. It is vital to maintain public confidence in the industry and in food safety measures. We must remember that the source of this ban is a public health concern. As Secretary for Health and Social Services, it is my duty and responsibility to summarise and review the background to that ban, although that has been ably done by previous speakers.
Mae’r ddadl hon yn bwysig i ddyfodol ffermio yng Nghymru. Mae’n holl bwysig cynnal hyder y cyhoedd yn y diwydiant ac yn y mesurau diogelwch bwyd. Rhaid inni gofio mai pryder ynghylch iechyd cyhoeddus yw man cychwyn y gwaharddiad hwn. Fel yr Ysgrifennydd Iechyd a Gwasanaethau Cymdeithasol, fy nyletswydd a’m cyfrifoldeb yw crynhoi ac adolygu cefndir y gwaharddiad hwnnw, er bod siaradwyr blaenorol wedi gwneud hynny’n fedrus.
In late 1997, SEAC reported that BSE infectivity in the backbones of cattle and in beef bone marrow could contaminate meat cooked on the bone and soup and gravy made using bones. However, if meat was cooked off the bone that risk was removed. Ever since the introduction of the ban on specified bovine offal in 1989, successive Governments have excluded from the human food chain any tissue in which BSE infectivity has been identified. That is critical and the point has not been made enough today. A number of speakers referred to the SEAC report. Last November, the report concluded that, although the risk to public health could not be predicted with precision, these risks were less than those of the previous 12 months. However, the risks have not been eliminated.
Yn hwyr yn 1997, adroddodd SEAC y byddai heintusrwydd BSE yn esgyrn cefn ac ym mêr esgyrn gwartheg yn gallu heintio cig a gaiff ei goginio ar yr asgwrn a chawl a grefi a wneir drwy ddefnyddio esgyrn. Fodd bynnag, pe bai’r cig yn cael ei goginio oddi ar yr asgwrn byddai’r perygl wedi ei ddileu. Byth ers cyflwyno’r gwaharddiad ar offal gwartheg penodol yn 1989, mae Llywodraethau ar ôl ei gilydd wedi cau allan o’r gadwyn fwyd ddynol unrhyw feinwe y canfuwyd heintusrwydd BSE ynddi. Mae hyn yn holl bwysig ac ni soniwyd ddigon am y pwynt hwn heddiw. Mae sawl siaradwr wedi cyfeirio at adroddiad SEAC. Tachwedd diwethaf, casgliad yr adroddiad oedd bod y peryglon hyn, er na ellid rhagfynegi’n fanwl y perygl i iechyd cyhoeddus, yn llai na’r rhai yn y 12 mis blaenorol. Fodd bynnag, nid yw’r peryglon wedi eu dileu.
In January, the UK Government accepted the recommendation made by the Chief Medical Officer—which was endorsed by the Medical Officer for Wales this week—that existing controls regarding the Government’s risk reduction on BSE should continue. Despite the decline in the risk of infectivity, it was concluded that lifting the ban at that stage would introduce a renewed, but very small risk. Given the anticipated further decline in the number of BSE infected cattle this year, the Chief Medical Officer recommended that the control be reviewed six months on from 1 February 1999.
Yn Ionawr, derbyniodd Llywodraeth y DU yr argymhelliad a wnaed gan y Prif Swyddog Meddygol—a gadarnhawyd gan y Swyddog Meddygol dros Gymru yr wythnos hon—y dylid cadw rheoliadau presennol y Llywodraeth ynghylch lleihau peryglon BSE. Er bod perygl heintusrwydd yn llai, y casgliad oedd y byddai codi’r gwaharddiad ar hyn o bryd yn cyflwyno perygl newydd, ond bychan iawn. Yng ngolwg y gostyngiad pellach a ddisgwylir yn nifer y gwartheg a heintiwyd gan BSE eleni, argymhelliad y Prif Swyddog Meddygol oedd y dylid arolygu’r mesur rheoli ymhen chwe mis ar ôl 1 Chwefror 1999.
We must remember that the controls exist to protect public health from the risk of new variant CJD. As Brian Gibbons said, we are still looking at that evidence. Research is going on and we are currently looking at those important controls. Rhodri Morgan mentioned that the controls did not work in Northern Ireland, which led to the replacement of the ban on exports. New variant CJD is a very distressing disease for which there is no known cure. In light of the views of the Chief Medical Officer, last year it was concluded that it would be wrong to expose anyone, in particular our children—thank you Huw Lewis for making that point—to even a small risk of it unnecessarily. Unlike other food borne diseases such as food poisoning, you cannot control and combat BSE in captivity by good hygiene practices or by cooking. This means that effective action must be taken to prevent BSE infectivity from entering the food chain. We all share that great responsibility. Is recognising that responsibility being bossy, Glyn?
Rhaid inni gofio bod y rheoliadau’n bod er mwyn gwarchod iechyd cyhoeddus rhag perygl amrywiolyn newydd CJD. Fel y dywedodd Brian Gibbons, yr ydym yn dal i ystyried y dystiolaeth honno. Mae’r ymchwil yn mynd rhagddi ac yr ydym yn edrych ar y rheoliadau pwysig hynny ar hyn o bryd. Soniodd Rhodri Morgan nad oedd y rheoliadau’n gweithio yng Ngogledd Iwerddon, a bod hynny wedi arwain at ailgyflwyno’r gwaharddiad ar allforion. Mae amrywiolyn newydd CJD yn afiechyd poenus iawn ac nid oes meddyginiaeth ar ei gyfer hyd y gwyddom. Yn wyneb barn y Prif Swyddog Meddygol, daethpwyd i’r casgliad y llynedd na fyddai’n iawn rhoi neb, ac yn enwedig ein plant, mewn perygl—diolch i chi Huw Lewis am wneud y pwynt hwnnw—hyd yn oed perygl bach iawn, heb fod angen. Yn wahanol i afiechydon eraill a gludir mewn bwyd fel gwenwyn bwyd, ni ellir rheoli a gwrthweithio BSE caeth drwy arferion glanweithdra da neu drwy goginio. Mae hynny’n golygu bod rhaid cymryd camau effeithiol i atal heintusrwydd BSE rhag cyrraedd y gadwyn fwyd. Yr ydym oll yn rhannu’r cyfrifoldeb mawr hwnnw. Ai bod yn awdurdodus yw cydnabod y cyfrifoldeb hwnnw, Glyn?
We do not know the incubation period of new variant CJD; we do not know how it is transmitted or how many people may potentially be infected. To date we know 40 people have died, one of whom resided in Wales. An unknown number may be incubating the disease. In the light of this, the precautionary principle—namely to avoid suspected risky behaviour—is the most sensible line to take to promote public health.
Ni wyddom beth yw cyfnod heintus amrywiolyn newydd CJD; ni wyddom sut y caiff ei drosglwyddo na faint o bobl a allai fod wedi eu heintio. Hyd yn hyn fe wyddom fod 40 o bobl wedi marw, ac yr oedd un ohonynt yn byw yng Nghymru. Ni wyddom faint o bobl a allai fod yn magu’r afiechyd. Yng ngoleuni hynny, egwyddor rhagofal—sef osgoi ymddygiad yr amheuir ei fod yn beryglus—yw’r llwybr mwyaf synhwyrol i’w ddilyn er mwyn hybu iechyd cyhoeddus.
Finally, it must be said that moving too quickly to lift the ban is not in the industry’s interests. We must be careful not to weaken the public’s confidence in the safety of Welsh beef if we are going to move the EU ban, as Christine Gwyther and others have said. Confidence has grown, therefore let us not dent it. Peter, it is important that we move carefully on this. It is important to emphasise that Labour colleagues and myself are happy to support the lifting of the ban—it is Welsh Labour Party policy. However, we must be convinced that there is no longer a risk to public health.
Yn olaf, rhaid dweud na fyddai er budd y diwydiant i symud yn rhy gyflym at godi’r gwaharddiad. Rhaid inni fod yn ofalus i beidio â gwanhau hyder y cyhoedd yn niogelwch cig eidion Cymru os ydym i ddileu gwaharddiad yr UE, fel y dywedodd Christine Gwyther ac eraill. Mae’r hyder wedi cynyddu, felly gadewch inni beidio â’i bylu. Peter, mae’n bwysig inni symud yn ofalus ar y mater hwn. Mae’n bwysig pwysleisio ei bod yn dda gan fy nghyd-aelodau Llafur a minnau gefnogi codi’r gwaharddiad—dyna bolisi Plaid Lafur Cymru. Fodd bynnag, rhaid inni fod yn sicr nad oes perygl mwyach i iechyd cyhoeddus.
In conclusion, I am grateful that Members have conducted this debate with due attention to the gravity of this issue for farmers and for the public at large. It is right and proper that the Agriculture and Rural Development Committee and the Health and Social Services Committee look at the evidence in depth, as a matter of urgent priority. This must not be put out to the long grass. I will be listening carefully to these deliberations. We will make sound responsible decisions when it comes back to the Assembly, based—as Ieuan expressed so well—on agreement, partnership and consensus. This matter, like many others, will come before us in this new National Assembly for Wales where we must prove our worth, credibility and authority to people in Wales. If we take the decisions in that light, we will really be making devolution work for Wales.
I derfynu, yr wyf yn ddiolchgar bod yr Aelodau wedi cynnal y ddadl hon gan roi sylw dyledus i ddifrifwch y mater hwn i ffermwyr ac i’r cyhoedd yn gyffredinol. Mae’n iawn ac yn briodol i’r Pwyllgor Amaethyddiaeth a Datblygu Gwledig a’r Pwyllgor Iechyd a Gwasanaethau Cymdeithasol ystyried y dystiolaeth yn fanwl, fel blaenoriaeth frys. Rhaid peidio â bwrw’r mater o’r neilltu. Byddaf yn gwrando’n ofalus ar y trafodaethau hyn. Byddwn yn gwneud penderfyniadau cyfrifol a chadarn pan ddaw’r mater yn ôl i’r Cynulliad, yn seiliedig—fel y dywedodd Ieuan mor groyw—ar gytundeb, partneriaeth a chonsensws. Daw’r mater hwn, a llawer un arall, ger ein bron yng Nghynulliad Cenedlaethol newydd Cymru lle y bydd rhaid inni brofi ein gwerth, ein hygrededd a’n hawdurdod i bobl Cymru. Os deuwn i benderfyniadau yng ngoleuni hynny, byddwn yn sicrhau bod datganoli yn gweithio i Gymru.
Point of order. The Secretary for Agriculture and Rural Development and the Secretary for Health and Social Services would not take interventions, but I understand that they do not have to. However, many politicians—certainly in that party—have expressed a need for this Assembly to be accountable, open and transparent. Speakers raised issues that other Members may wish to question. Would it be in order to indicate to the executive—in the interest of the spirit of the Standing Orders—that Secretaries should give way when asked to do so?
Mater o drefn. Nid oedd yr Ysgrifennydd Amaethyddiaeth a Datblygu Gwledig a’r Ysgrifennydd Iechyd a Gwasanaethau Cymdeithasol yn fodlon derbyn ymyriadau, ond deallaf nad oes rhaid iddynt. Fodd bynnag, mae llawer o wleidyddion—yn sicr yn y blaid honno—wedi mynegi’r angen i’r Cynulliad hwn fod yn atebol, yn agored ac yn eglur. Yr oedd y siaradwyr wedi codi materion y gallai Aelodau eraill ddymuno holi yn eu cylch. A fyddai’n dderbyniol i gyfarwyddo’r adran weithredol—er mwyn cynnal ysbryd y Rheolau Sefydlog—y dylai Ysgrifenyddion ildio pan ofynnir iddynt wneud hynny?

Cod Ymarfer ar Benodiadau Cyhoeddus
Code of Practice on Public Appointments
In supporting this motion, I would like to point out that the White Paper ‘A Voice for Wales’ made a commitment on behalf of the Assembly to observe high standards in making public appointments in Wales. This Code is required under our own Standing Orders, which state that ‘the Assembly shall adopt and keep under review a Code of Practice governing the procedures for making the public appointments for which it is responsible.’ I stress the word ‘review’.
Wrth gefnogi’r cynnig hwn, hoffwn nodi bod ymrwymiad yn y Papur Gwyn ‘Llais dros Gymru’ i gadw at safonau uchel wrth benodi rhai i swyddi cyhoeddus, ar ran y Cynulliad. Mae’r Cod hwn yn ofynnol o dan ein Rheolau Sefydlog ein hunain sy’n datgan y bydd ‘y Cynulliad yn mabwysiadu ac yn parhau i adolygu Cod Ymarfer i reoli’r gweithdrefnau ar gyfer yr holl benodiadau cyhoeddus y mae’n gyfrifol amdanynt. Yr wyf yn pwysleisio’r gair ‘adolygu’.
The Codes that we adopted during last week’s plenary sessions are the property of this Assembly and can be reviewed and amended as appropriate. Members have raised issues with me and I have assured them that this is a live document that can be reviewed in the future. The proposed Code is in line with the seven principles of the procedures for appointments adopted by the Commissioner for Public Appointments. The principles are: Ministerial and/or Assembly Secretary responsibility for appointment, selection on merit, independent scrutiny of the procedures, compliance with equal opportunities procedures and practice, probity, openness and transparency and, finally, compliance with the guidelines of proportionality.
Mae’r Codau a fabwysiadwyd gennym yn ystod sesiynau llawn yr wythnos diwethaf yn eiddo i’r Cynulliad hwn a gellir eu hadolygu a’u newid fel y bo’n briodol. Mae Aelodau wedi codi materion gyda mi ac yr wyf wedi eu sicrhau bod hon yn ddogfen fyw y gellir ei hadolygu yn y dyfodol. Mae’r Cod arfaethedig yn gyson â saith egwyddor y gweithdrefnau ar gyfer penodi a fabwysiadwyd gan y Comisiynydd dros Benodiadau Cyhoeddus. Yr egwyddorion yw: cyfrifoldeb y Gweinidog ac/neu Ysgrifennydd y Cynulliad dros benodi, dethol yn ôl teilyngdod, archwiliad annibynnol o’r gweithdrefnau, cydymffurfio â gweithdrefnau ac ymarfer cyfleoedd cyfartal, gonestrwydd, bod yn agored ac yn eglur ac, yn olaf, cydymffurfio â’r canllawiau ar gyfranoldeb.
The Assembly is responsible for a wide range and variety of public appointments in Wales—approximately 600. There is a need to attract high quality candidates to lead our public bodies, provide expert advice and represent the interests of the public. Selection on merit is the basis of the process. Candidates must meet the published criteria for any appointment in order to be considered. Openness and transparency at all stages are key objectives of the Code. However, personal details on individual candidates will remain private and will only be seen by people directly involved in the appointment decision.
Mae’r Cynulliad yn gyfrifol am amrediad ac amrywiaeth eang o benodiadau cyhoeddus yng Nghymru—tua 600. Mae angen denu ymgeiswyr o ansawdd uchel i arwain ein cyrff cyhoeddus, darparu cyngor arbenigol a chynrychioli buddiannau’r cyhoedd. Dethol ar sail teilyngdod yw sylfaen y broses. Rhaid i ymgeiswyr ateb yr holl feini prawf a gyhoeddwyd ar gyfer unrhyw benodiad er mwyn cael eu hystyried. Mae bod yn agored ac yn eglur ym mhob cam yn amcanion allweddol yn y Cod. Fodd bynnag, bydd manylion personol am ymgeiswyr unigol yn aros yn breifat ac ond y rhai sy’n ymwneud yn uniongyrchol â’r penderfyniad i benodi fydd yn eu gweld.
There is a need to be much more pro-active in promoting public appointments and work is being commissioned on a strategy to address this. Under the Code, no public appointment will be made without the involvement of an independent element. This is essential to ensure that the Code is honoured through an independent panel member system. These panel members will be the eyes and ears of the Commissioner for Public Appointments. The Code proposes that the Assembly adopts a plan for increasing equal opportunities in public appointments. The Welsh Office has committed itself to increasing the number of public appointments held by women and people from ethnic minorities, and to ensuring that applicants with a disability are given equality of opportunity. Much progress has been made, but it is vital that we improve on the existing situation where 31 per cent of public appointments are held by women and only one per cent are held by ethnic minorities.
Mae angen bod yn llawer mwy rhagweithiol wrth hyrwyddo penodiadau cyhoeddus ac mae gwaith yn cael ei gomisiynu ar lunio strategaeth i ymdrin â hyn. O dan y Cod, ni wneir unrhyw benodiad cyhoeddus heb gyfraniad gan elfen annibynnol. Mae hyn yn hanfodol er mwyn sicrhau y caiff y Cod ei gyflawni drwy system o aelodau panel annibynnol. Yr aelodau panel hyn fydd llygaid a chlustiau’r Comisiynydd dros Benodiadau Cyhoeddus. Mae’r Cod yn bwriadu i’r Cynulliad fabwysiadu cynllun i gynyddu cyfleoedd cyfartal mewn penodiadau cyhoeddus. Mae’r Swyddfa Gymreig wedi ymrwymo i gynyddu nifer y swyddi cyhoeddus a lenwir gan fenywod a phobl o leiafrifoedd ethnig, ac i sirchau cyfle cyfartal i ymgeiswyr ag anabledd. Gwnaed llawer o gynnydd, ond mae’n hanfodol inni wella’r sefyllfa bresennol lle y llenwir 31 y cant o swyddi cyhoeddus gan fenywod a dim ond un y cant gan leiafrifoedd ethnig.
The Code has been prepared to reflect Assembly principles of inclusiveness and the Subject Committees will oversee this process. Two nominated Committee members will approve an appointment plan for each case, in conjunction with the relevant Assembly Secretary and the Independent Assessor. At least one Committee nominee will be from a different party to the Assembly Secretary. The Code also sets out the principle that each appointment plan should be proportionate to the body concerned. Certain elements will also be present. However, it is sensible to have flexible procedures, given the wide variety of public bodies in Wales. We should always bear in mind the need to be timely in making appointments. The draft Code proposes adherence to the highest standards in making appointments and I envisage that this will lead to the highest calibre of appointments being made at the end of the process.
Paratowyd y Cod fel ei fod yn adlewyrchu egwyddorion cynwysoldeb y Cynulliad a bydd y Pwyllgorau Pwnc yn goruchwylio’r broses hon. Enwebir dau aelod o’r Pwyllgorau a fydd yn cymeradwyo cynllun penodi ar gyfer pob achos, ar y cyd â’r Ysgrifennydd perthnasol o’r Cynulliad a’r Asesydd Annibynnol. Bydd o leiaf un o’r rhai a enwebir gan y Pwyllgorau o blaid wahanol i’r Ysgrifennydd o’r Cynulliad. Mae’r Cod hefyd yn nodi’r egwyddor y dylai pob cynllun penodi fod yn gyfrannol â’r corff dan sylw. Bydd rhai elfennau yn bresennol hefyd. Peth doeth, fodd bynnag, yw cael gweithdrefnau hyblyg, o wybod am yr amrywiaeth eang o gyrff cyhoeddus sydd yng Nghymru. Dylem bob amser gofio’r angen i fod yn brydlon wrth benodi. Mae’r drafft o’r Cod yn cynnig y dylid cadw at y safonau uchaf wrth benodi a rhagwelaf y bydd hyn yn arwain at benodiadau o’r safon uchaf ar ddiwedd y broses.
I am grateful for the opportunity to speak on this matter. There has been a lot of discussion this morning about the standards for the Assembly and the way in which we will be judged in the future. There is probably nothing on which we will be judged that could compare with the way in which people in Wales have perceived the dishing out of public appointments and the way in which quangos have worked in the past. We have given the Tories a lot of flack today. However, we should remember that one of the big factors that swung people for devolution was the recognition that, at the end of those years of Tory Government, we had more unelected people running public bodies in Wales than elected councillors. The majority of those had been appointed because they had played golf with a Minister, because their husbands had had a drink or gone to a cocktail party with another Minister or because they had watched the rugby together in the Cardiff and County Club.
Yr wyf yn ddiolchgar am y cyfle i siarad ar y mater hwn. Cafwyd llawer o drafod fore heddiw am y safonau i’r Cynulliad a’r modd y cawn ein barnu yn y dyfodol. Mae’n debyg nad oes dim a ddefnyddir i’n barnu a allai gymharu â’r modd y mae pobl Cymru wedi canfod y modd y rhannwyd penodiadau cyhoeddus a gweithrediadau’r cwangos yn y gorffennol. Mae’r Torïaid wedi bod dan y lach gennym heddiw. Penodwyd y rhan fwyaf o’r rheini am eu bod wedi chwarae golff â rhyw Weinidog, am fod eu gwŷr wedi mynd am ddiod neu i barti coctel gyda Gweinidog arall neu am eu bod wedi gwylio gêm rygbi gyda’i gilydd yn nghlwb y Cardiff and County.
I am proud to say that the Labour Party in Government has begun to change the situation, although it has not changed the Cardiff and County Club yet. As a result of that change, we are beginning to get away from the system of power broking and patronage that has characterised our public life until now. Sometimes it is true and sometimes it is not, but that is people’s perception of the way in which public appointments have been made.
Yr wyf yn falch o ddweud bod y Blaid Lafur mewn Llywodraeth wedi dechrau newid y sefyllfa, er nad yw eto wedi newid clwb y Cardiff and County. O ganlyniad i’r newid hwnnw, yr ydym yn dechrau symud oddi wrth y system broceru pŵer a nawdd a fu’n nodweddiadol o’n bywyd cyhoeddus hyd yn hyn. Dyna sut y mae weithiau, weithiau ddim, ond dyna sut y mae pobl yn gweld y ffordd y gwnaed penodiadau i swyddi cyhoeddus.
It is no coincidence that, since the introduction of advertisements and proper equal opportunities based procedures, we have two women leading public bodies in Wales for the first time. There are many more women, many more people from black and ethnic minority backgrounds and many young people who have an important role to play in our public life. I welcome this Code of Practice. It sets a good framework and begins the process of tackling this matter. However, our work as Assembly Members will ensure that positions are well advertised and that we start to shift the culture. That will ensure that people no longer believe that there are only certain types of people who are used to sitting on committees and who are eligible to be considered. We will start to make people in Wales believe that we genuinely want people with practical day-to-day living skills involved in our public bodies and in the delivery of our public services. I urge the Assembly to take this issue seriously. This is something that we must deliver and monitor at every stage.
Nid yw’n gyd-ddigwyddiad o gwbl, ers cyflwyno hysbysebion a gweithdrefnau priodol ar sail cyfleoedd cyfartal, fod gennym ddwy fenyw yn arwain cyrff cyhoeddus yng Nghymru am y tro cyntaf. Mae llawer mwy o fenywod, llawer mwy o bobl o gefndiroedd du a lleiafrifoedd ethnig a llawer o bobl ifanc sydd â rôl bwysig i’w chwarae yn ein bywyd cyhoeddus. Yr wyf yn croesawu’r Cod Ymarfer hwn. Mae’n gosod fframwaith da ac yn dechrau’r broses o fynd i’r afael â’r mater hwn. Fodd bynnag, bydd ein gwaith fel Aelodau o’r Cynulliad yn sicrhau y caiff swyddi eu hysbysebu’n dda a’n bod yn dechrau trawsnewid y diwylliant. Bydd hynny’n sicrhau na fydd pobl yn meddwl mwyach mai ond rhai mathau o bobl sydd wedi arfer eistedd ar bwyllgorau ac sy’n gymwys i’w hystyried. Byddwn yn dechrau darbwyllo pobl Cymru bod arnom wir eisiau pobl â medrau byw ymarferol bob-dydd i gymryd rhan yn ein cyrff cyhoeddus ac wrth gyflenwi ein gwasanaethau cyhoeddus. Yr wyf yn annog y Cynulliad i gymryd y mater hwn o ddifrif. Mae hyn yn rhywbeth y mae’n rhaid inni ei gyflenwi a’i fonitro ym mhob cam.
In concluding, I would like assurance from Andrew, as Business Secretary, or the First Secretary that the development of the equal opportunities action plan will be given priority and that we will establish a mechanism to monitor this matter through the Assembly. The current procedure does not state how this matter will come back to the Assembly or how we keep tabs to ensure that we are achieving our objectives. We must move the whole process and learn how to reach out in order to bring new people in. We must review this matter within the next 12 months because it is important. It is a matter that will set the standard and begin to build people’s confidence that we intend to have a different kind of democracy in which people from all over Wales can participate in our public life.
I derfynu, hoffwn dderbyn sicrwydd oddi wrth Andrew, fel y Trefnydd, neu’r Prif Ysgrifennydd y rhoddir blaenoriaeth i ddatblygu’r cynllun gweithredu cyfleoedd cyfartal ac y byddwn yn sefydlu mecanwaith i fonitro’r mater hwn drwy’r Cynulliad. Nid yw’r weithdrefn gyfredol yn nodi sut y daw’r mater hwn yn ôl i’r Cynulliad neu sut y byddwn yn cadw golwg arno er mwyn sicrhau ein bod yn cyrraedd ein hamcanion. Rhaid inni symud yr holl broses ymlaen a dysgu sut i estyn allan er mwyn cynnwys pobl newydd. Rhaid inni adolygu’r mater o fewn y 12 mis nesaf am ei fod yn bwysig. Mae’n fater a fydd yn pennu’r safon ac yn dechrau ennyn hyder pobl yn ein bwriad i gael math gwahanol o ddemocratiaeth lle y caiff pobl o bob rhan o Gymru gymryd rhan yn ein bywyd cyhoeddus.
I have great sympathy with the words of the Business Secretary and Val Feld. They have committed themselves to selection on merit for all sorts of non-governmental organisations. I wonder which golf club Val Feld’s husband frequented in order to obtain a place for her on the Equal Opportunities Commission. I am afraid I must oppose this motion, not because I disagree with the sentiments but because I would like to see the Code strengthened. I draw Members’ attention to paragraph 11, which makes it clear that people must not be discriminated against on the basis of age, disability, gender, marital status, sexual orientation, race, colour, nationality, ethnic or national origin, religion or community background. However, there is one omission. In Monmouth, my constituency, and in many other constituencies throughout eastern Wales, many people are worried that they are being discriminated against because of an inability to speak Welsh. Therefore, I ask Members to send out an appropriate gesture to non-Welsh speakers, such as myself, who outnumber Welsh speakers in Wales, by inserting a line about the importance of not discriminating against people on the basis of the language that they speak.
Yr wyf yn cydymdeimlo’n fawr â geiriau’r Trefnydd a Val Feld. Maent wedi ymrwymo i ddethol ar sail teilyngdod ar gyfer pob math o gyrff anlywodraethol. Ys gwn i pa glwb golff yr oedd gŵr Val Feld yn arfer mynd iddo er mwyn cael lle iddi ar y Comisiwn Cyfleoedd Cyfartal. Mae arnaf ofn y bydd rhaid imi wrthwynebu’r cynnig hwn, nid am fy mod yn anghytuno â’r teimladau ond am yr hoffwn weld cryfhau’r Cod. Tynnaf sylw’r Aelodau at baragraff 11, sydd yn datgan na ellir gwahaniaethu yn erbyn pobl ar sail oed, anabledd, rhyw, statws priodasol, tueddiad rhywiol, hil, lliw, cenedligrwydd, tarddiad ethnig neu genedlaethol, crefydd neu gefndir cymunedol. Mae un peth wedi ei hepgor, fodd bynnag. Ym Mynwy, f’etholaeth i, ac mewn llawer o etholaethau eraill drwy ddwyrain Cymru, mae llawer o bobl yn poeni bod gwahaniaethu’n digwydd yn eu herbyn oherwydd anallu i siarad Cymraeg. Felly, yr wyf yn gofyn i’r Aelodau anfon neges briodol i rai di-Gymraeg, fel myfi, sydd yn fwy o ran nifer na’r siaradwyr Cymraeg yng Nghymru, drwy gynnwys llinell ynghylch pwysigrwydd peidio â gwahaniaethu yn erbyn pobl ar sail yr iaith y maent yn ei siarad.
Point of order. I am not sure how to request an apology for the assumption that the Tory standards as to who achieves positions are widespread. I assure David Davies that I did not have a husband when I became the director of the Equal Opportunities Commission, which makes appointments solely on merit. When merit systems work, women can achieve senior positions.
Mater o drefn. Nid wyf yn sicr sut i ofyn am ymddiheuriad am y rhagdybiaeth bod y safonau Torïaidd ynghylch pwy sy’n cael swyddi yn rhai cyffredin. Yr wyf yn sicrhau David Davies nad oedd gennyf ŵr pan benodwyd fi’n gyfarwyddwr y Comisiwn Cyfleoedd Cyfartal, sy’n penodi ar sail teilyngdod yn unig. Pan fydd systemau sy’n seiliedig ar deilyngdod yn gweithio, fe all benywod gyrraedd swyddi uwch.

That is a point of order. I have noticed the use of gender-specific language a number of times this morning. Also, I have noticed statements that might be regarded as not in order, as they are not in keeping with the equality of opportunity language to be used in this Assembly. I intend to review this and will make a statement on this matter soon.
Mater o drefn yw hynny. Yr wyf wedi sylwi ar y defnydd o iaith ryw-benodol sawl gwaith fore heddiw. Yr wyf hefyd wedi sylwi ar ddatganiadau y gellid eu hystyried yn rhai annerbyniol, am nad ydynt yn gyson â’r iaith gyfle cyfartal sydd i’w defnyddio yn y Cynulliad hwn. Yr wyf yn bwriadu gwneud arolwg o hyn a rhof ddatganiad ar y mater cyn hir.
Can I have your guidance? We are supposed to finish in two minutes. Can we have an extra few minutes to wrap up this debate or not?
A allwch roi arweiniad i mi? Yr ydym i fod i orffen ymhen dau funud. A oes modd cael ychydig o funudau’n ychwanegol i ddod â’r ddadl hon i ben ai peidio?

I would carry on if I were you.
Byddwn yn dal ati pe bawn yn eich lle chi.
I have the floor, so I will take advantage of it. I have a small complaint. This paper was laid on Thursday. As a north Wales Member, I was unable to get it. The officials here are very good, but they were only able to e-mail the paper to me yesterday. Also, the Agenda was not on the internet and I did not have access to the intranet. We need to be more careful. Will the Business Secretary not table important papers such as this within a few days of them being debated?
Yr wyf yn cael annerch, felly yr wyf am fanteisio ar hynny. Mae gennyf gŵyn fechan. Cyflwynwyd y papur hwn ddydd Iau. Fel Aelod yng ngogledd Cymru, nid oeddwn yn gallu ei dderbyn. Mae’r swyddogion yma yn dda iawn, ond nid oeddent yn gallu anfon y papur drwy e-bost ataf tan ddoe. Hefyd, nid oedd yr Agenda ar y rhyngrwyd ac nid oeddwn yn gallu cyrraedd y fewnrwyd. Bydd yn rhaid inni fod yn fwy gofalus. A yw’r Trefnydd yn fodlon peidio â chyflwyno papurau pwysig fel hwn dim ond ychydig ddyddiau cyn eu trafod?
I have two reservations about this paper. First, it delegates the powers to the First Secretary. The Assembly will not have much control over the powers once they are delegated. In general, the Code of Practice is very good. However, I take issue with particular points.
Mae gennyf ddwy amheuaeth ynghylch y papur hwn. Yn gyntaf, mae’n dirprwyo’r pwerau i’r Prif Ysgrifennydd. Ni fydd gan y Cynulliad lawer o reolaeth dros y pwerau ar ôl eu dirprwyo. At ei gilydd, mae’r Cod Ymarfer yn dda iawn. Fodd bynnag, yr wyf yn anghytuno â rhai pwyntiau.
My second reservation is about the right of the Assembly to know what is going on. For example, paragraph 4 states that:
Mae’r ail amheuaeth sydd gennyf yn ymwneud â hawl y Cynulliad i wybod beth sy’n mynd ymlaen. Er enghraifft, dywedir ym mharagraff 4:
‘The First Secretary may delegate responsibility for specific public appointments to Assembly Secretaries who, while they retain final responsibility, are required to consult appointed representatives from the relevant Subject Committee.’
‘Gall y Prif Ysgrifennydd ddirprwyo cyfrifoldeb dros benodiadau cyhoeddus penodol i Ysgrifenyddion y Cynulliad a fydd, tra eu bod yn cadw’r cyfrifoldeb terfynol, yn gorfod ymgynghori â chynrychiolwyr a benodwyd o’r Pwyllgor Pwnc perthnasol.’
Consultation is not sufficient for the Assembly. The Secretaries would need to take representations made by the appointed Committee members more seriously than just to invite them into their offices to consult them, and then say we have done our job, we have consulted those members, and we will now get on and do what we want.
Nid yw ymgynghori yn ddigonol i’r Cynulliad. Byddai’n rhaid i’r Ysgrifenyddion roi mwy o bwys ar sylwadau a wneir gan yr aelodau Pwyllgor a benodwyd drwy wneud mwy na dim ond eu gwahodd i’w swyddfeydd i ymgynghori â hwy, ac wedyn dweud ein bod wedi gwneud ein gwaith, yr ydym wedi ymgynghori â’r aelodau hynny, a byddwn yn awr yn mynd ymlaen ac yn gwneud yr hyn a fynnwn.
On paragraph 19, in addition to communicating the outcome to all applicants and announcing it publicly, what is wrong with putting it on the intranet? Paragraph 24 states that the Welsh Office will give:
Ynglŷn â pharagraff 19, yn ogystal â rhoi gwybod i’r holl ymgeiswyr am y canlyniad a’i gyhoeddi, beth sydd o’i le ar ei roi ar y fewnrwyd? Mae paragraff 24 yn dweud y bydd y Swyddfa Gymreig yn rhoi:
‘to the relevant Assembly Secretary for approval, at least six months in advance of a routine vacancy arising, an appointment plan.’
‘cynllun penodi i’r Ysgrifennydd perthnasol o’r Cynulliad i’w gymeradwyo, o leiaf chwe mis cyn y daw swydd yn wag fel mater o drefn.’
Why cannot the National Assembly have that at the same time? Paragraph 24 states:
Pam nad oes modd i’r Cynulliad gael hynny ar yr un amser? Mae paragraff 24 yn dweud:
‘The Assembly Secretary will discuss the submission with the two nominated relevant Subject Committee members.’
‘Bydd yr Ysgrifennydd o’r Cynulliad yn trafod yr hyn a gyflwynir gyda’r ddau aelod a enwebwyd gan y Pwyllgor Pwnc perthnasol.’
Why does it not state that the Assembly Secretary, as soon as practicable, will discuss the submission with the two nominated members from the Committee? Importantly, paragraph 24 continues:
Pam nad yw’n dweud y bydd yr Ysgrifennydd o’r Cynulliad, cyn gynted ag y bo modd, yn trafod yr hyn a gyflwynir gyda’r ddau aelod a enwebwyd gan y Pwyllgor Pwnc perthnasol? Wedyn, ac mae hyn yn bwysig, mae paragraff 24 yn dweud:
‘the relevant Assembly Secretary can decide that the selection panel may consist of fewer people—for example, a senior Assembly Official, the Chair of the body concerned and an Independent Assessor (this last being an essential requirement) who will report their conclusions and recommendations to the Assembly Secretary and Subject Committee for approval.’
‘gall yr Ysgrifennydd perthnasol o’r Cynulliad benderfynu y gall y panel dethol gynnwys llai o bobl—er enghraifft, uwch Swyddog o’r Cynulliad, Cadeirydd y corff dan sylw ac Asesydd Annibynnol (a’r olaf yn ofyniad hanfodol) a fydd yn rhoi adroddiad am eu casgliadau a’u hargymhellion i’r Ysgrifennydd o’r Cynulliad a’r Pwyllgor Pwnc i’w cymeradwyo.’
It seems from this that we can do without the two nominated members from any particular Subject Committee. The Assembly Secretary can dispense with them. Yet, paragraph 7 states:
Yn ôl hynny, mae’n ymddangos y gallwn hepgor y ddau aelod a enwebwyd o unrhyw Bwyllgor Pwnc penodol. Fe all yr Ysgrifennydd o’r Cynulliad wneud hebddynt. Eto, mae paragraff 7 yn dweud:
‘No public appointment shall be made…without discussion with the relevant Subject Committee.’
‘Ni wneir unrhyw benodiad cyhoeddus… heb drafodaeth â’r Pwyllgor Pwnc perthnasol.’
Therefore, unless I am mistaken, this paper is inconsistent. For example, it refers to Ministers, where we have Secretaries. I know that we can use the term ‘Minister’ but such things ought to be tidied up.
Felly, onid wyf yn camgymryd, mae’r papur hwn yn anghyson, Er enghraifft, mae’n cyfeirio at Weinidogion, ond Ysgrifenyddion sydd gennym ni. Yr wyf yn gwybod y gallwn arfer y term ‘Gweinidog’ ond fe ddylid tacluso pethau o’r fath.
Finally, there are the minimum requirements for tier 1 and tier 2 appointments. There is no National Assembly access to the information. The appointments must be publicised. Why cannot the information be put on the intranet so that we know about the appointments? Why cannot we, as Members of the National Assembly for Wales, have a list of what is coming up in six months’ time? The same thing applies to tier 1 and tier 2 appointments. There is no Assembly involvement.
Yn olaf, dyna’r lleiafswm gofynion ar gyfer penodiadau haen 1 a haen 2. Nid oes modd i’r Cynulliad Cenedlaethol weld wybodaeth. Rhaid rhoi cyhoeddusrwydd i’r penodiadau. Pam na ellir rhoi’r wybodaeth ar y fewnrwyd fel y byddwn yn gwybod am y penodiadau? Pam na allwn, fel Aelodau o Gynulliad Cenedlaethol Cymru, gael rhestr o’r hyn fydd yn codi ymhen chwe mis? Mae’r un peth yn wir am benodiadau haen 1 a haen 2. Nid oes modd i’r Cynulliad gymryd rhan.
There is an issue of National Assembly access to information here. There is no Assembly involvement and there also seem to be inconsistencies in the paper. I would like Subject Committees to be able to attend confirmation hearings, at least for the top jobs, such as the chairman of the Welsh Development Agency, or other important jobs that matter to the whole of the Assembly and the whole of Wales. I would like this paper to be further considered.
Mae’r mater hwn yn ymwneud â hawl y Cynulliad Cenedlaethol i weld gwybodaeth. Nid oes modd i’r Cynulliad gymryd rhan ac ymddengys hefyd fod anghysonderau yn y papur. Byddwn yn hoffi gweld y Pwyllgorau Pwnc yn cael hawl i fod yn bresennol mewn gwrandawiadau cadarnhau, o leiaf ar gyfer y swyddi uchaf, fel cadeirydd Awdurdod Datblygu Cymru, neu swyddi pwysig eraill sydd o bwys i’r Cynulliad cyfan ac i Gymru gyfan. Byddwn yn hoffi cael ystyriaeth bellach i’r papur hwn.

We are seriously out of time. I call the First Secretary to respond briefly, and then we will hold a vote on this motion.
Mae’n hamser ni ar ben ers meitin. Galwaf ar y Prif Ysgrifennydd i ateb yn fyr, ac wedyn fe gynhaliwn bleidlais ar y cynnig hwn.

Alun Michael Y Prif Ysgrifennydd siaradwyd yn Saesneg t. 59
John has proved that he has read the document quickly, but he has misunderstood some of its elements. For instance, he referred to Ministers. The reference to Ministers is made in the context of the current Code for making ministerial appointments. The document goes on to spell out how that process of appointment is strengthened by the involvement of members of other parties, ensuring the accountability and inclusiveness that are founding principles of the Assembly.
Mae John wedi profi ei fod wedi darllen y ddogfen yn gyflym, ond camddeallodd rai o’r elfennau ynddi. Er enghraifft, fe gyfeiriodd at Weinidogion. Mae’r cyfeiriad at Weinidogion yng nghyd-destun y Cod cyfredol ar benodiadau gweinidogion. Mae’r ddogfen yn mynd ymlaen i fanylu ynghylch y modd y caiff y broses benodi honno ei chryfhau drwy gynnwys aelodau pleidiau eraill, gan sicrhau’r atebolrwydd a chynwysoldeb sydd yn egwyddorion sylfaenol i’r Cynulliad.
To answer the point made by David Davies, there will be opportunities to strengthen this Code, which is a starting point for the Assembly. It takes the Code of Conduct for Ministers prior to devolution and extends and strengthens it considerably. That does not prevent the Assembly from adding further principles to the Code as it wishes. I assure him that this is the starting point, not the finishing point of the process.
I ateb y pwynt a wnaed gan David Davies, fe fydd cyfleoedd i gryfhau’r Cod hwn, sydd yn fan cychwyn i’r Cynulliad. Mae’n cymryd y Cod Ymddygiad i Weinidogion cyn datganoli ac yn ei ymestyn a’i gryfhau’n sylweddol. Nid yw hynny’n rhwystro’r Cynulliad rhag ychwanegu egwyddorion pellach at y Cod yn ôl ei ddymuniad. Yr wyf yn ei sicrhau mai man cychwyn sydd yma, nid pen draw’r broses.
This is a matter of public concern. There is a review process, which the Business Secretary has said is going to be a live document. Would the First Secretary therefore give a specific time when a review of the document will take place, say four or five months’ time? Also, could the document go out for public consultation as it raises important public issues? If we could have public consultation on the document and come back with a specific time for review, we can reassure people that all these points will be picked up again.
Mae hyn yn destun pryder i’r cyhoedd. Mae proses adolygu ar gael, ac mae’r Trefnydd wedi dweud mai dogfen fyw fydd hon. Felly, a yw’r Prif Ysgrifennydd yn fodlon rhoi amser penodol pryd y caiff y ddogfen ei hadolygu, ymhen pedwar neu bum mis dyweder? Hefyd, a oes modd cylchredeg y ddogfen er mwyn ymgynghori â’r cyhoedd gan ei bod yn codi materion sydd o bwys i’r cyhoedd? Os gallwn gael ymgynghoriad cyhoeddus ar y ddogfen ac os gallwch ddod yn ôl ag amser penodol i’r adolygiad, gallwn roi sicrwydd i bobl y bydd yr holl bwyntiau hyn yn cael eu dilyn eto.

I accept the principle implicit in what Mike has said, and suggest that the Business Committee looks at a timetable. The Standards Committee, as soon as it is established, would also have a role in that. I agree to the principle and ask that we look at a timetable so that we can make sure that it is appropriate and allows the sort of public consultation that Mike suggests.
Yr wyf yn derbyn yr egwyddor sydd ymhlyg yn yr hyn a ddywedodd Mike, ac yr wyf yn awgrymu y dylai’r Pwyllgor Busnes ystyried amserlen. Byddai rhan hefyd i’r Pwyllgor Safonau yn hyn o beth, cyn gynted ag y caiff ei sefydlu. Yr wyf yn cytuno â’r egwyddor ac yn awgrymu y dylem ystyried amserlen fel y gallwn ofalu ei bod yn briodo ac yn rhoi cyfle i’r math o ymgynghori â’r cyhoedd a awgrymwyd gan Mike.
There are many things that could be said about this document. However, I assure the Assembly that it goes further, is stronger and protects the public interest in a way that goes beyond what was previously required by the United Kingdom Government. It is a step forward and should be welcomed. I also welcome the spirit in which Members are saying yes. The Assembly is starting off on the right basis.
Gellid dweud llawer o bethau am y ddogfen hon. Fodd bynnag, yr wyf yn sicrhau’r Cynulliad ei bod yn mynd ymhellach, ei bod yn gryfach ac yn diogelu buddiannau’r cyhoedd mewn modd sy’n mynd y tu hwnt i’r hyn oedd yn ofynnol cyn hynny gan Lywodraeth y Deyrnas Unedig. Mae’n gam ymlaen a dylid ei groesawu. Yr wyf hefyd yn croesawu ysbryd cadarnhaol yr Aelodau. Mae’r Cynulliad yn cychwyn ar y sylfaen gywir.
I conclude by referring to some of the points that Val Feld made. We have in recent times, through the Nolan and Neill Committees, dealt with past problems and scandals with propriety. There is a positive side to that agenda, and that is the positive side. We must ensure that we get quality appointments that can do the best possible job for Wales. The Standards Committee should not only look at how we take forward the protections, but how to increase the standard of public appointments in Wales.
Yr wyf yn gorffen drwy gyfeirio at rai o’r pwyntiau a wnaeth Val Feld. Yn y cyfnod diweddar, drwy Bwyllgorau Nolan a Neill, yr ydym wedi ymdrin mewn modd priodol â phroblemau a sgandalau’r gorffennol. Mae ochr gadarnhaol i’r agenda honno, a hon yw’r ochr gadarnhaol. Rhaid inni sicrhau ein bod yn cael penodiadau o safon dda sy’n gallu gwneud y gwaith gorau posibl dros Gymru. Dylai’r Pwyllgor Safonau edrych ar y modd i ddatblygu’r amddiffyniadau, a hefyd sut i wella safon penodiadau cyhoeddus yng Nghymru.
I have been struck by the extent to which there is a closed shop and that there is not the equality of opportunity that Val referred to. It is not only the Conservative group that is exclusive in that way. Equality of opportunity and inclusiveness are principles on which the Assembly has been established. We need to ensure that quality of appointment, inclusiveness and equality of opportunity exist within our process for appointing people to public bodies. I hope that all Members accept that those aspects should be part of the programme. This is the starting point and not the end of the road.
Fe’m trawyd gan y graddau y ceir cylch caeëdig ac na cheir y cyfle cyfartal y cyfeiriodd Val ato. Nid y grŵp Ceidwadol yw’r unig rai sy’n gaeëdig yn y modd hwnnw. Mae cyfle cyfartal a chynwysoldeb yn egwyddorion y sefydlwyd y Cynulliad arnynt. Rhaid inni sicrhau bod ansawdd penodiadau, cynwysoldeb a chyfle cyfartal yn bodoli o fewn ein proses ar gyfer penodi pobl i gyrff cyhoeddus. Gobeithiaf fod yr holl Aelodau’n derbyn y dylai’r agweddau hynny fod yn rhan o’r rhaglen. Y man cychwyn yw hyn ac nid diwedd y daith.

Mae gennyf un nodyn byr i’w ychwanegu. Yr wyf yn ddiolchgar i Kirsty Williams am egluro, yn ystod y ddadl flaenorol ar gig eidion, ei bod yn tynnu ei chynnig yn ôl.
I have one brief message to add. I am grateful to Kirsty Williams for making it clear, during the previous debate on beef, that she was withdrawing her motion.
Point of order. I am withdrawing my motion for a short debate as I believe it has served its purpose. It is also a great concern to me that, due to Standing Orders Nos. 6.12 and 6.36, it is possible for the governing group to circumnavigate motions tabled by individual Assembly Members. In future, the ability of the governing party to steal or pre-empt a Member’s motion would not be in the spirit of the Assembly.
Mater o drefn. Yr wyf yn tynnu’n ôl fy nghynnig am ddadl fer gan fy mod yn credu ei fod wedi cyflawni ei bwrpas. Mae hefyd yn destun pryder mawr i mi ei bod yn bosibl, oherwydd Rheolau Sefydlog Rhifau 6.12 a 6.36, i’r grŵp llywodraethol osgoi cynigion a gyflwynwyd gan Aelodau unigol o’r Cynulliad. Yn y dyfodol, ni fyddai gallu’r blaid lywodraethol i ddwyn neu achub y blaen ar gynnig gan Aelod yn gydnaws ag ysbryd y Cynulliad.

I referred to this earlier. We are on a learning curve in this Assembly and I was grateful to you for your willingness to withdraw your motion.
Cyfeiriais at hyn yn gynharach. Yr ydym yn dysgu fesul tipyn yn y Cynulliad ac yr oeddwn yn ddiolchgar i chi am eich parodrwydd i dynnu’ch cynnig yn ôl.

If there is no opposition, I ask the Business Secretary formally to move the motion.
Os nad oes gwrthwynebiad, yr wyf yn gofyn i’r Trefnydd roi’r cynnig gerbron yn ffurfiol.

I have a message for all Members.
yn Saesneg Mae gennyf neges i’r holl Aelodau.
Mae yna faterion sydd wedi tynnu fy sylw. Yn gyntaf, nid yw Aelodau bob amser yn siarad i mewn i’r meicroffon. Os nad ydych yn gwneud hynny, nid ydych yn siarad o gwbl, fel petai. Mae’r Cofnod, y cyfieithu ar y pryd a’r system sain yn dibynnu ar y meicroffon. Mae’n allweddol ein bod i gyd yn siarad i mewn iddo.
in Welsh There are some issues that have drawn my attention. Firstly, Members do not always speak into their microphones. If you do not, you do not speak at all, as it were. The Record, the simultaneous translation and the sound system depend on the microphone. It is crucial that we all speak into it.
Yn ail, os oes gennych unrhyw nodiadau perthnasol, yn enwedig dyfyniadau, byddai’r Cofnod yn ddiolchgar iawn o’u cael. Nid wyf yn awyddus i hybu hyn oherwydd nid wyf eisiau gweld Aelodau yn defnyddio gormod o bapur, nag ychwaith yn siarad o nodiadau yn hytrach nag yn siarad fel rhan o ddadl.
in Welsh Secondly, if you have any relevant notes, particularly quotations, the Record would be very pleased to have them. I am not eager to promote this because I do not wish to see Members using too much paper, nor speaking from notes rather than speaking as part of a debate.
Yn drydydd, mae gennyf neges oddi wrth fy nghyfaill John Lloyd, y Clerc. Yr ydych yn gwybod bod yfory yn ddiwrnod pwysig a diddorol yn hanes y Cynulliad. Dylech fod wedi derbyn copïau o lythyrau a anfonwyd ganddo ddydd Gwener diwethaf, a chopi o raglen y dydd. Os nad oes gennych gopi, mae gan John Lloyd gopïau ychwanegol. Bydd Margaret Evans hefyd ar gael yn y neuadd y tu allan i’r Siambr, rhag ofn y bydd gennych unrhyw gwestiynau. Dymunaf yn dda inni gyd at yfory. Mae’n ddydd a fydd o bwys i Gymru ac i’r Deyrnas Unedig i gyd. Diolch yn fawr.
in Welsh Thirdly, I have an announcement from my friend John Lloyd, the Clerk. You will know that tomorrow is an important and interesting day in the history of the Assembly. You should all have received copies of letters that he sent last Friday, and a copy of the programme for the day. If you do not have a copy, John Lloyd has additional copies. Margaret Evans will also be available in the milling area outside the Chamber, in case you have any questions. I wish us all well for tomorrow. It will be an important day for Wales and the whole of the United Kingdom. Thank you very much.
